NYC Cops rip judge: 'It's giving an open door to terrorists'

Another activist judge makes us all a little more vulnerable. From the New York Daily News:

NYPD cops blasted a federal judge's ruling aimed at stopping them from searching demonstrators' bags outside the Republican National Convention, saying the decision gives "an open door to terrorists."

Manhattan Federal Judge Robert Sweet's decision - made public yesterday - prohibits blanket searches of bulky bags and backpacks in the absence of a "specific threat."

"In this day and age of terrorism, it's an extremely dangerous step in a very dangerous time in New York City," said an outraged Michael Palladino, president of the Detectives Endowment Association.

"It's giving an open door to terrorists, and further handcuffing police at a time that they should be given a little bit more latitude," Palladino said. He said he plans to urge Mayor Bloomberg to appeal the ruling.

Sweet's decision also limits how many streets the NYPD can close around Madison Square Garden, and prohibits cops from penning protesters behind metal barricades.

The ruling does not prevent the use of hand-held metal-detecting wands around the perimeter of the convention.

Sweet wrote that his ruling is an attempt to "define a resolution which can serve to encourage free expression in a secure society."

He described the preventive measure by police as an "invasion of personal privacy."

Christopher Dunn, an attorney for the New York Civil Liberties Union, called it a "historic victory."

The police should do it anyway. Or, arrest any Muslim looking beady eyed picketer in sight. How ridiculous. This is the type of Judge that lobbies from the bench and should be tossed off.

The police ought to think about developing the dreaded "blue flu" until this Judge pulls his head from his ass.

This is public endangerment. Perhaps the Judge should be put on duty with the police during the convention.

Meanwhile up in Boston, the ACLU is inviting any T riders who've been "demeaned" by having been asked to have their bags searched (up to & during the DNC) to give a full report (on their website) to take the Boston police to court! Absolute madness. The emperor has no clothes, the emperor has no clothes!!!

Another example of political correctness being placed above public safety. This judge would rather gamble innocent lives than risk 'offending' someone by letting the police search their articles in such an abhorrent 'invasion of privacy'. Even more so if it were seen that the police were profiling a ‘religious’ group that so openly states its hostile intentions.

The Republicans should make this a campaign issue. And, republican delegates should make a unanimous proclamation that they will submit to voluntary searches.

And Bush should say:

Although not an American, nor a Jew, I strongly think that the Judge should be dealt with for making such judgement. If his/her children has or had been killed by Jihadists, he/she wouldn't have said such (although I do not pray for such for him/her).

So who brought the opposing arguments to judge Sweet in tne interest of security?

What is the position of Homeland Security?

If this is a safety security issue, then Homeland security should be flexing its muscles and not allow some judge or the ACLU to undermine that which should be their domain of authority.

I do not recall that judges where given extensive training in how to protect Americans from terrorism.

If Homeland Security is going to allow people in black robes to decide how to conduct security checks, then we end up demoralizing the people who are on the front lines and trained to perform these tasks.

This judge has got to stay away from putting any kind of restrictions, and envoking searches and seizures rules on law enforcement whether they are random or without evidence of something suspicious when they are dealing with such high profile events such as the Republican and Democratic conventions. Search and seizure rules have always been the playground for legal arguments among attorneys and never ending arguments in appeals courts.

However Then we have Homeland security saying that the airlines can only look at no more then 2 middle eastern men that board a flight. Apparently the politically correct crowd is gotten their hands into everything. Let`s stop this knee jerk lunacy, this is not the time for setting guide lines like this.

The ACLU of course is arguing that this 80 page argument doesn`t tie law enforcements hands. then why was there any arguments brought forth in the first place?

Please pardon me for repeating a part of a posting I made last week, however I feel it has bearing on my comments.

I am a resident of Manhattan and an eyewitness to the attacks of 9/11. I watched out my office window as the 2nd plane hit. My co-worker had been walking to work down Madison Avenue as the first plane flew overhead, and he had alerted me to what was unfolding. At that time it was not yet known it was an attack, we thought it was just a terrible catastrophe. Being less than a mile from the WTC that day, and working for a life insurance company, I felt very close to the horror that followed. I will never forget the terrible smell of death that pervaded the Manhattan atmosphere for months.

The 9/11 attacks wrought unimaginable horror on all New Yorkers. Many of us will never fully "recover" from the event. I am grateful for forums such as these that help to foster understanding of the enemy we are dealing with, their methods and their ideology.

The "political correctness" demonstrated by this judge leaves me so afraid. After what we have been through here in New York, it is unbelievable that "New York's Finest" find their hands tied in efforts to root out the enemy in our midst. This city is already a veritable land mine under the best circumstances. Homeless people leave large bags and luggage lying on sidewalks abandoned throughout our city. We are packed as closely as sardines on our subway platforms, and at any given stop, many people look as if they could pose as a poster person for al-Qaeda. Basically, we need all the help we can get in preventing another catastrophe.

Since everyone I know knows at least one person who lost a close friend or loved one in the attacks of 9/11, I can only assume that this idiotic judge was somehow left unaffected by the tragedy, otherwise he would surely be doing everything in his power to prevent a reoccurance. I can speak for many civilized New Yorkers who would gladly sacrifice some civil liberties in exchange for a sense of safety and security. The irony of the matter is, I can't even attend a performance at the Metropolitan Opera House or Carnegie Hall without expecting to have my bag searched.

If all the warnings issued recently by our own government officials don't count as a "specific threat," I can only say I'm glad I'll be out of town for what is surely going to be a senseless melee during the convention.

This is a silly judgement.
Invasions of personal privacy are exactly what take place in times of war, and we are in a semi declared war.
We all will acquiese, never without some unease, but as the situation requires, wondering if, at the end of what could be a long war, we will remember and recover what we gave up.
Or will it be a different age different society, and we will in fact have been changed remarkably by this war as by many other.

This was a no brainer, there shouldn't even have been a ruling. We are being told the Conventions may be targets. For Christ's sake you get a full search going to a ballgame. SCOTTY BEAM ME UP!

This Judge Sweet geezer should be reminded of an age old rhymn, with perhaps more of a progressive slant, and memorize it before he starts putting public safety stacks lower than fear of offending invaders :

Last weekend we took the kids to six flags, in addition to passing through a metal detector (similar to airports) we had our bag and cooler searched, as did every other person that passed through the gates. Why such protection for an amusement park but allowing protesters (who for the most part are known to be anything but peaceful) and knowing that the conventions would be a prime target would this idiot judge make such a ruling?? Hopefully there is time for a different judge to overrule this senile old coot whom has taken leave of any sense he had left before a disaster strikes....and if one does because of his ruling I hope a lynch mob shows up at his home to avenge the deaths of innocent people that he not only caused, but could have prevented...God help us all if "marriage is my profession" kerry gets in.

The judge should be removed from the bench and committed.

This is insane. They police should get "blue flu" this puts their lives in direct danger, as well as the publics.

I would like to write some “Letters to the Editor” to try to educate and inform the people to not get rid of all their hate, cause there’s coming a time when we are gonna need it to push back the tidal wave of Islam that we are about to be engulfed in.

We have just had a couple of cross burning –one here in Anderson, (Ca.) and another in Chico, (Ca.). So I know if I wrote a letter to the Editor saying “Lets reserve a little hatred for the Sleazy Reza’s whose moon-god says kill us all”. At this time – the atmosphere being already charged – the community would rise up and hang me.

I have mellowed a little over the years and believe a person should be able to work (legally) and live kinda where he has the money to live. So I’ve put my uniform up and haven’t burned any crosses lately.

But I see a real danger in being so tolerant toward this new wave of immigrants that is swelling our population. These people either wants to convert us, subjugate us or kill us.

She's the Predident of the Foundation, I hear anyway. Another important question about Mrs. Kerry is: When is the skag going to clean up and do something about that rat's nest she calls hair?

Well DC..if her lap dog..err..husband gets in she will be wearing a black tent with face flap (not that thats a bad thing where shes concerned) while "thank allah I found a rich widow...by the way did you know I was in nam" Kerry chooses which one of his 4 wives will service him tonight.

As a New Yorker I am appalled by this "judge's" decision. This man most likely lives on the North Shore of LI and has his driver drive him to work daily as he reads the Times and pats himself on the back for standing up to those nasty NYPD'ers. I'll show THEM whose da man!
I also lost friends on 911 and I also think about it every day. Decisions like this open the door for the next stage of this war. Bus bombings and street bombings are next. All in the name of "God's will". Just remember that the imams wear black robes and also think they are superior!

Besides the overt racism and general oversimplification of the war on terror and its implications and causes, I'd just like to comment a few things that struck me as I read through the comments on this website:

1. None of you are looking to address why the terrorists are bombing us. Unless we can stop them from wanting to kill us, the killing will continue. This country is WAY TOO BIG to be fully secured through inspection, metal detectors, aerial photos or whatever. I'm sure one of you geniuses will suggest nuking the middle east, but that might be somewhat unrealistic, I think we need to start attacking this problem at its source.

2. Have none of you read the constitution? Take a look at Amendment IV, it's interesting. It seems long ago the Founding Fathers thought it was worth putting in some protection for the citizens against the government invading their privacy in PUBLIC SPACES (which 6-flags and the opera are not).

But you all are probably right though. I'm should go live with the towel heads, islamic fuckheads or [insert slur here] and we should all let the government rifle through our possesions. I'm sure that will catch many terrorist, and if you have nothing to hide, why should you mind your phone being tapped.

Oh, and by the way, I know someone who died in the 9/11 attacks too, but I don't think the best way to honor her memory is to stomp on the rights so many have fought so hard over our countries 228 year history to protect and defend.
