Why should he be repentant? What has been done to disabuse him of the jihad ideology? Undoubtedly nothing. From Australia's Sunday Telegraph:
UNREPENTANT Bali bomber Imam Samudra has warned he will continue to wage jihad if a recent constitutional court decision means he is set free.Vowing to carry out more bombings against "unbelievers", Samudra said: "I want to continue my Jihad Fie Sabililah (violent holy struggle).
Actually this is "jihad for the sake of Allah," which is indeed a technical term in Islamic law referring to jihad warfare.

I want to go to Israel to kill Sharon."Speaking from his death-row cell in Bali's Kerobokan prison, Samudra vowed to kill again. "If I get the death penalty, I will die a martyr's death. If I'm free, I'll bomb again. You got it?"
The 33-year-old field commander of the Bali bombings that killed 202, including 88 Australians, said he would "slaughter Bush" if a recent change in Indonesian legislation meant he was released from custody.
Notwithstanding this mad, bloody terrorist's quest for extra Jihadi adventures, el-Qaeda (to which his grouping, Jemaa Islamia, is closely linked) - and Islamo-fascist butchery in general - are NO joke.
More loosely decentralized than ever over the past two years, el-Qaeda’s mutated into five major strands today. The first is Osama bin-Laden’s original organization, which perpetrated the NYC and DC terror-attacks, reported to be in concealment chiefly in Pakistan &/or Afghanistan (or Yemen); second are the different local - albeit essentially transnational - subsidiary-operations, predominantly staffed by veterans of the conflicts in Afghanistan. These cells, nowadays, are spread all over the planet, though centred mainly in the Middle East and North Africa, with a growing weight in South East Asia.
Then there’s a sinister network of affiliated, previously-extant “militant movements”, under the rubric of bin-Laden’s “World Islamic Front For Jihad Against Crusaders & Jews” (founded 1998), the global, pan-Islamist “peak-body”, an “umbrella-group” to maximally INTEGRATE the strategic combination of various factions - all with closely-overlapping common-interests. It includes such Members as the Taleban, Jemaa Islamia, Lasqar el-Tayba, the Chechen Jihadis, the MILF and Hamas, inter alia, while Hezbollah (as a pack of Shi’ites) is seated as an Associate.
Next come the “franchised” units in Iraq, radical Moslem volunteers, Iraqi and foreign, led by Abu-Musa el-Zarqawi and the other Mujahedin who’d got away from the US hits on their el-Qaeda-chartered camp, tucked into a mountainous enclave in northeastern Iraqi Kurdistan (a patch then controlled neither by Saddam Hussein nor the Pesh Mergas), hard by the Iranian border and “privately” supplied from that side - thus not (directly) by the Government of Iran....
Last, there are the ubiquitous Jihadi copy-cats, ideologically aligned with and “inspired” by el-Qaeda, but functioning with marginal, minor contact with bin-Laden, effectively autonomous, virtually independent, but striking in correspondence with his “Grand Strategy”. Reputedly, the Madrid bombings were the deeds of a ring from this devolved stream of el-Qaeda’s structure.
This points to Defence having to be mounted on all these parallel levels (and more) AT ONCE, domestically and abroad. However, as much as he seeks to destroy America, bin-Laden’s fully aware that he won’t be able to do this without executing some key, intermediate steps first.
Accordingly, he retains two PRIORITY targets: Saudi Arabia and Pakistan - where he’s in with a fair chance. Bin-Laden craves power in the former for a host of reasons, old and new, among them its obscene wealth, to be put at the disposal of the Jihad; he covets the latter primarily for its nuclear-tipped rockets and its atomic weapons and missile industries, for the selfsame purpose - chilling, if he can gain even ONE of these lands, with which to further his dark designs.
It therefore behoves America to DENY el-Qaeda ANY ascendancy in this pair in particular. This is highly problematic, with regard to the repressive characters of their respective Governments, plus their long and insidious, individual records of underhandedness towards the USA....

slippery technicality to go out and murder Innocents.
