DETROIT (AP) - A federal judge dismissed terrorism charges against two men convicted last year, saying the prosecution's zeal to obtain a conviction in the wake of Sept. 11 overcame its professional judgment.But U.S. District Judge Gerald Rosen said the two, as well as a third man, must stand trial again on charges of document fraud.
The judge's decision came after the Justice Department admitted widespread prosecutorial misconduct in the case and asked the judge to dismiss the terrorism charges against two men accused of being part of a Detroit terror cell.
Rosen said the prosecution's "understandable sense of mission and zeal to obtain a conviction" in the wake of the Sept. 11 "overcame not only its professional judgment, but its broader obligations to the justice system and the rule of law."
The case had been hailed by the Bush Administration as a victory in the war on terror.
The government's change of heart came after a monthslong court-ordered review of documents connected to the case. The Justice Department uncovered much more potentially exculpatory evidence that should have been given to the defense before trial.
Karim Koubriti, 26, and Abdel-Ilah Elmardoudi, 38, were convicted in June 2003 of conspiracy to provide material support for terrorism and to engage in fraud and misuse of visas and other documents. Ahmed Hannan, 36, was convicted of only the fraud charge, and Farouk Ali-Haimoud, 24, was acquitted.
So the lives of two more innocent Muslims (and their families) are ruined because of American religious and racial bigotry. Once again the American secret police, inquisitors, and "prosecutors" conspire to persecute innocent people for the crime of being Muslim.
How much longer do you expect that peaceful Muslims will tolerate this oppression and abuse? How much longer do you thing they will allow the Americans to war against Almighty Allah (swt) in direct contravention of the Quranic injunctions?

You may be a good muslim but you are bad at math. The terrorism, genocide and oppression in Russia, Isreal, Sudan, Rawanda, Iraq, Spain, Phillipines, Bali, and the US have been committed by followers of a false moon god - al-lah. That adds up to the fact that islam is a belief system based on hate and fear and it uses terror as a tool to promote its agenda.
I pray that the "peaceful" muslims will someday see the words of the koran and mohammed as lies and worship the the true God. The God of Abraham, Issac and Jacob.
BTW Trying to expose and eliminate islam is not racial bigotry. islam is a belief system and a belief system is not a race.
Hate to agree with Reza on anything, but according to the European view of the world the Semites are a race, the Nordics are a race, etc. So any assertion that we are better than they are is by definition 'racism'. But that doesn't make it wrong! :-)

As I have commented many times before, When it comes to terrorism; I would rather see the prosecuting team go after the slimest of evidence whether they get a conviction in court or not.
Would you rather have them just ignore the evidence and throw their hands up saying; we can`t win this one! I for one think that would be extemely foolish given the climate we are living in today.
I applaud the Zeal and effort of these prosecutors; win or lose.

It would be curious to know what kind of exculpitory evidence that was not made available to the defence during the trial, over rides the evidence that got these guys prosecuted and convicted in the first place.
