SYRACUSE, N.Y. (AP) -- Two pretrial rulings will limit the defense for a prominent Muslim doctor accused of setting up an illegal charity and violating U.S. sanctions by sending money to Iraq. U.S. District Judge Norman Mordue ruled that attorneys for Dr. Rafil Dhafir cannot argue that he was selectively prosecuted because of his religion.Government prosecutors also won a ruling that prevents Dhafir's attorneys from delving into the government's motive for originally investigating Dhafir.
Deveraux Cannick, Dhafir's lead attorney, acknowledged the rulings were a setback but said he remained confident Dhafir would be vindicated....
Cannick has argued the government singled out Dhafir for a three-year investigation because he was an Iraq-born Muslim and when it failed to link him to any terrorists or terrorist groups, it charged him with fraud to save face. Furthermore, Cannick said other individuals and corporations that sent money to Iraq have faced only civil penalties, not criminal charges.
Dhafir's trial is scheduled to start Monday. Five other defendants, including his wife, have pleaded guilty.
Dhafir, 56, of Manlius, is accused of conspiring to violate the U.S. embargo against Iraq. He also is charged with defrauding Medicare out of $274,000 through his former Rome oncology practice and evading $400,000 in federal income tax payments by writing off the illegal charity donations.
Based on the AP Article, it doesn`t look good for the doctor. Prosecutors and the participating judge must hae quite damaging evidence since Dhafir has been in jail for over 2 1/2 years and his bail has been revoked 4 times. The most visible charge here is the defrauding of medicare.
Right back to the reliable defense when they are caught - “innocent peaceful Muslims” taught in the mosques and various Muslim organizations. Using all the rights and freedoms of the US for their criminal defense.
Why will he need a defence? Isn't he a Muslim? aren't they superior to the infidel legal system which they claim is corrupt? Please use Sharia to try this criminal and see if any limbs will remain.
I guess the Dr. needs to be able to defend himself, since he's muslim and this is Ramadan period.
This is what Christians in Saudi Arabia and Iraq taste without doing any evil, however this man is being charged so let him see how good it is....
What is good for the goose (christian)that did not commit a crime in Saudi, sudan, indonesia, Nigeria or Iraq etc is also good for the gander(muslim) that commits a crime in United States .........

Don't tell me,he thought the money was going to a charity supporting an Orphanage for victims of war.
This is the standard ploy by funders of terrorism,the orphan's had suicide bombers as parents and are being cared for to be raised as future suicide bombers as well.
Time for the Government to overhaul the Tax laws to prevent off-shore charity scams to finance terrorism,after all,Muslims claimed to be shocked at being fooled by the false charity and not outraged it's supporting terrorism.
Just once I'd like to hear a Muslim condemn terrorism by other Muslims without resorting to the "BUT" that explains away the actions as a defensive response to protect Islam.
