This petition, "U.S. Marine kills wounded insurgent" (thanks to Dennis), is in support of the Marine depicted in Kevin Sites' video, killing an Iraqi. It emphasizes that the Iraqi insurgents do not follow the rules of warfare, and so cannot be accorded the same treatment that is given to those who do. This story, "Insurgents Wave White Flag, Fire On U.S. Troops In Fallujah" emphasizes the truth of that.

No, I won't sign. I think that we should have higher standards than Iraqi insurgents.

Killing unarmed soldiers is against the Geneva convention.

I signed. I did so to thumb my nose at a Leftism which claims to be pacifistic, yet cheers for class wars and "people's wars"; that scorns "bourgeois morality" as hypocrisy on every campus in the land, but then suddenly becomes oh so solicitous for legal niceties when their side is injured.

The Geneva conventions and other laws of war are a monument to an era of intra-Western warfare in which uniformed armies were the rule. If you are going to fight a "people's war" in which there are no rules, expect to be shot when you're down--especially if you are booby-trapped.

Voltaire, I normally agree with your posts 100% but on this I have to disagree. Firstly, the enemy combatant was in civilian clothing NOT in uniform , thus NOT a soldier. These people are TERRORISTS remember and not covered by the Geneva Convention.. Second, the marine in question was aware that these thugs had already blown up two Marines by pretending to play dead and then detonating a booby-trap bomb as the Marines were checking them out. Thirdly , should this Marine have left a wounded terrorist behind who could have either shot another Marine or, again, detonated a hidden bomb as more Marines entered the mosque ? The Marine in question did what all soldiers would do in extreme combat situations - it is a case of kill or be killed. Lastly, even if the Marines shot every prisoner they took they would still have higher standards then the islamic terrorists they are fighting against.

Killing unarmed soldiers is against the Geneva convention.

Killing noncombatants or lawful combatants who have surrendered or been rendered "hors de combat" -- typically meaning wounded beyond the ability to resist -- is against the Geneva Conventions.

In this case:

a) Someone who fired from a mosque while dressed in civilian clothes is not a lawful combatant, and is not protected by the Geneva Convention. He could have been captured, interrogated, and then shot without violating either the spirit or the letter of the Conventions.

b) False surrenders and faking being wounded -- when done to gain tactical advantage -- are also violations of the Geneva Conventions. Again, by his behavior he voided any protection under the Conventions.

Don't believe what the loons say about the Geneva Conventions. Read them yourself; all of this is clearly stated.

The first time I read about that shooting, I thought, "how awful" (against the marine) because of how the media presented it. Then I saw the video on TV.

Had that marine not killed that terrorist pretending to be dead, then Kevin Sites might not have lived beyond that day.

War is hell, but it is even tougher when the enemy embraces, and celebrates death over life.

In this kind of war, several of the so called Geneva war ethics cannot apply, and should not apply. The enemy is not so easy to Identify, he does not wear the uniform of a soldier in a military unit as the Americans do. He will try to kill you anyway he can without any compunction while taking his own life in the process. Already to many Americans have been killed, or seriously injured by trying to comport with the politically correct entrapments of many of the Geneva conference rules. This enemy lives by its own rules (none)---Our soldiers are forced too, and must adapt to many of their rules so that we can reduce our own body bag count.

BEIJING -- The CIA is offering a rare glimpse into its successes and failures at trying to understand China during its first communist decades in a huge cache of newly declassified documents released this week in Washington.

The group of 71 intelligence reports covers three decades until 1976, the year communist founder Mao Zedong died. They reflect the U.S. intelligence agency's struggle to track China's political and economic evolution, its rise as a military power and its break with its former Soviet patrons. "The documents in this volume played an essential role in helping U.S. government leaders and officials formulate policy toward" China after the 1949 revolution, Robert L. Suettinger, a former intelligence analyst, wrote in an introduction to the collection.
"They are, in a sense, some of the foundation stones for a work that is still in progress."
The CIA says the reports, which include high-level National Intelligence Estimates, are the biggest single batch of declassified agency documents ever released.
They indicate that despite occasional missteps, assessments often were generally accurate. They included the conclusion that the Communist Party faced no serious challenges to its control, despite American support for Taiwan's rival Nationalists, which fled the mainland in 1949 after losing a civil war and hoped to return to power.
And despite conflicting signals during the chaos of the ultra-radical 1966-76 Cultural Revolution, they also foresaw that moderate political and military leaders would emerge to take power.
However, occasional mistakes are also revealed as the analysts tried to follow the secretive Beijing government, relying on Hong Kong press reports, interviews with ethnic Chinese who had visited relatives on the mainland, and other secondhand sources.
As China prepared to explode its first nuclear bomb, the CIA was aware of the preparations, but thought the country hadn't produced enough fissionable material for a test before the end of 1964. China set off its first explosion on Oct. 16, 1964.

Few Americans know that every year for the past five years the Pentagon has released an “Annual Report on the Military Power of the People’s Republic of China.” I had to call the Pentagon to get the Report of 2004. It was unavailable even in “Yahoo!”

No wonder! Those Americans who are publicly visible and/or audible have been preoccupied with Iraq (population 25 million) to such an extent that China (population 1.2 billion) seems to have disappeared soon after the Tiananmen Square massacre except as a tourist haven, occasionally glimpsed by the U.S. mainstream media. The Pentagon houses 26,000 military and civilian employees (and 3,000 “support personnel”) “dedicated to protecting our national interests,” as the Pentagon puts it.
The Pentagon has its own intelligence-espionage service, the Defense Intelligence Agency (DIA). But, predictably for me, the Pentagon’s annual report on “the military power” of China contains no information that could not be found in the U.S. mainstream media.
About a year ago, one of the e-mails I received was from a Pentagon officer who said that he agreed with my Internet columns and that the Pentagon understands nothing about the geostrategy of China.
In every institution there are such outstanding individuals. When Commentary published in 1978 my article contending that the CIA and Western espionage-intelligence vis-a-vis dictatorships like Russia or China did not virtually exist, this was a shock (it was 1978, not 2004, when the ineptness of the CIA had become generally recognized!). But a senior CIA analyst (retired) told me that the situation in the CIA was even worse than I had described it, but if he said this publicly the CIA would have deprived him of his pension.
Yes, in big bureaucracies of the democratic West there are individuals who see the truth, but they cannot tell the truth publicly because this is the prerogative of the top of the bureaucratic hierarchy.

The Pentagon seems never to have read in the Chinese press about Project 863, founded in 1986, and Super-Project 863, founded in 1996, to develop post-nuclear superweapons in which China cannot be behind the Pentagon because the United States discontinued the development of some of such weapons in 1969 as contradicting the relevant international agreements, though there are Americans who believe that President Nixon’s announcement to this effect was a cunning U.S. ploy to mislead the world.
According to these Americans, it is the United States that is a secretive totalitarian country after world domination, which some of these Americans hail while others curse, and both are captivated by their fantasies about the military omnipotence of the infinitely glorious/infinitely evil United States.
The development of other superweapons, such as molecular nanoweapons, is lavished with money in China and starved in the United States. It can be recalled in this connection how unwilling Roosevelt’s government was to launch the Manhattan Project. But the United States was at war with Germany, also developing nuclear superweapons, and the Jewish emigre scientists, headed by the great Albert Einstein, importuned Roosevelt .
The Report of 2004 begins with “lessons learned [by China] from Operation IRAQI FREEDOM” (that is, the war in Iraq). There are five lessons. That is, China has been greatly impressed by the Pentagon’s war in Iraq and has drawn five instructions concerning the modernization of its backward weapons to advance them closer to the shining example of the Pentagon’s war in Iraq.
WHERE IS THE CIA??

Kerry knows all this but purposefully ignores the fact that Iran test-fired a medium-range ballistic missile (that can reportedly carry nuclear warheads) capable of reaching Israel on September 18 and also in August, and that Iranian leader Ayatollah Ali Khamenei has stated, “We must have two bombs ready to go in January” and that his goal is to “destroy the Zionist regime.”
In addition, Kerry, according to WND’s Andy Wilcoxson’s explosive article last week, has accepted money from the terrorist organization Kosovo Liberation Army (KLA), an organization with ties to Osama bin Laden, Islamic terror organizations and the Iranian government. Its leader, Hashim Thaci, a Brooklyn resident, attended the Democratic Party’s convention in Boston this summer as well as a Kerry fund-raiser in New York at which a video was made (http://www.vpro.nl/programma/tegenlicht/afleveringen/18793157) showing KLA members writing checks to the Kerry campaign. According to Wilcoxson, “The KLA is directly threatening the safety of American personnel stationed in Kosovo. … John Kerry, who was on the Senate Intelligence Committee from 1993 until 2000, must know who the KLA is, but he clearly doesn’t care.”
The Bush Factor
In less than four years, President Bush has revolutionized American foreign policy and instead of engaging in the terrorist-appeasing policies of his predecessor – which resulted in September 11, 2001, and the unmasking of the vast Islamo-facist network and its supporters, who wish only death to America – “brought the fight to our enemy.” In so doing, he put the world on notice that he fully understood and would aggressively fight the terrorist threat to our nation – as well as to Israel.
“The clarity of the president’s understanding of the nature of militant Islam is illustrated by his strong support for Israel’s right to defend itself against Arab terror and xenophobia,” said Kenneth J. As Yogi Berra said, ‘When you come to a fork in the road, take it.’ I choose the Bush fork.”

NBC News reported Monday night that 380 tons of missing explosives were already gone when U.S. troops arrived at the Al-Qaqaa weapons installation in April 2003 – one day after Saddam's government was toppled.

NBC should know. It had a reporter embedded with the U.S. troops when they arrived at Al-Qaqaa in April 2003. While the Kerry campaign blasted the Bush administration for "stunning incompetence" on Monday, many Bush supporters questioned the timing of the New York Times' report Monday about the missing explosives, just eight days before the presidential election.
NBC News correspondent Jim Miklaszewski suggested a political motive as well: In his report on the missing explosives Monday night, he quoted one official as saying, "Recent disagreements between the administration and the head of the International Atomic Energy Agency makes this announcement appear highly political."

Powell: Iran Is Trying to Fit Missiles for Nukes

SANTIAGO, Chile – The United States has intelligence indicating Iran is trying to fit missiles to carry nuclear weapons, U.S. Secretary of State Colin Powell said.

Powell partially confirmed claims by an Iranian opposition group that Tehran is deceiving the United Nations and is attempting to secretly continue activities meant to give it atomic arms by next year. "I have seen intelligence which would corroborate what this dissident group is saying," Powell told reporters Wednesday as he traveled to the Asia-Pacific Economic Cooperation summit in Santiago. "And it should be of concern to all parties."
Pressed by reporters on the intelligence reports, Powell said the intelligence indicated that Iran "had been actively working on delivery systems" capable of carrying a nuclear weapon.

Iran Bought Blueprints of Nuclear Bomb, Opposition Group Says

VIENNA, Austria – Iran bought blueprints of a nuclear bomb from the same black-market network that gave Libya such diagrams and continues to enrich uranium despite a commitment to suspend the technology that can be used for atomic weapons, an Iranian opposition group said Wednesday.
Farid Soleimani, a senior official of National Council for Resistance in Iran, said the diagram was provided by Abdul Qadeer Khan, the Pakistani head of the nuclear network linked to clandestine programs in Iran and Libya.

Former U.N. nuclear inspector David Albright earlier this year described the Chinese design that Libya owned up to having as something "that would not take a lot of modifying" to fit it on Iran's successfully tested Shahab-3 ballistic missile.
The opposition group made its claim days after Iran announced it would suspend all activities related to nuclear enrichment as part of an agreement with three European nations aimed at heading off a confrontation over its nuclear program.
Soleimani said centrifuges and other equipment needed to produce enriched uranium had been covertly moved from a facility at Lavizan-Shian to a nearby site within Tehran's city limits.
The opposition group says Lavizan-Shian was home to the Center for Readiness and New Defense Technology and was part of the covert attempt to develop nuclear weapons.
The diplomat said the IAEA was looking into the possibility equipment was moved from Lavizan-Shian to an unknown location.
A report detailing IAEA investigations into Iran's nuclear programs prepared for the agency's Nov. 25 board meeting notes that Iran has failed to produce a trailer that apparently contained nuclear equipment at Lavizan-Shian for IAEA inspection.
The IAEA report also said Iran has "declined to provide a list of equipment used" at Lavizan-Shian, which the government says was home to research on how to reduce casualties in case of nuclear attack.
"The agency investigation of Lavizan ... is still open," said the diplomat. "They are still pursuing what happened to the equipment at Lavizan."

History of Cooperation
For all intents, the match is a natural. But things weren't always rosy between the two powers.
Before the revolution, the last Chinese official to meet with the late Shah Mohammed Reza Pahlavi was Chinese Communist Party chief Hua Kuo-feng.
The meeting "left a very strong negative feeling about China among Iranians," Abbas Maleki, director of the Caspian Institute, a Tehran research organization, told the Post.
Ties have improved greatly since then, however. In August 2001, Iranian Ambassador to China Mohammad Hossein Malaek held a reception in Beijing to mark "the 30th anniversary of the establishment of diplomatic relations between Iran and China," China's People's Daily reported.
"In terms of economic relations, China has become one of the most important trade partners of Iran," said the paper. "At present, the Sino-Iranian political relations remain steady, and trade and economic ties are also developing fast…"
In March 2002, Wu Yi, a member of China's State Council, made a visit to Iran to meet with President Mohammad Khatami. Again, the focus of the visit was to improve trade and economic ties.
"The bilateral trade between China and Iran has increased fast in recent years, with trade volume reaching some 3.3 billion U.S. dollars last year, several times higher than that some 10 years ago," People's Daily reported.
Economics
Economically, the cooperation between both nations now amounts to hundreds of billions of dollars over many years.
For instance, said the Post, in October "the two countries signed a preliminary accord worth $70 billion to $100 billion by which China will purchase Iranian oil and gas and help develop Iran's Yadavaran oil field, near the Iraqi border."

Military Cooperation
Perhaps the most troubling aspect of the growing Iran-China alliance is the Islamic republic's access to the improving technology being developed, deployed and utilized by the People's Liberation Army.
Nowhere are U.S. concerns greater than in the area of ballistic missile technology. American officials have sanctioned Chinese companies for improperly transferring such technology in January 2002 and as recently as early this year, but that hasn't stopped the transfers, experts and analysts believe.
And now, as Iran continues to develop its nuclear program, U.S., European and Israeli officials worry Iran is using the missile technology to build better weapons – weapons that eventually could carry nuclear warheads.
In terms of its nuclear weapons ambitions, the U.N.'s nuclear watchdog, the International Atomic Energy Agency, has determined that China, along with Pakistan and Russia, have probably provided nuclear technology to Tehran.

Russia Develops New Type of Nuclear Missile

The Bush administration has announced a new series of sanctions against China. The sanctions lodged against Chinese Army owned companies were imposed because of illegal arms technology transfers to Iran.

The list of Chinese Army companies now under sanction includes several familiar names from the Clinton years such as China Great Wall Industry, China North Industries (Norinco) and the China New Era Group. Both China Great Wall and China North Industries received advanced U.S. space technology through presidential waivers signed by President Clinton.

According to GM China, the similarities between its Spark minicar and Chinese Chery Automobile Corp.'s QQ model are more than just mere coincidence. In fact, if you examine the automobiles, they are virtually identical.

Thus, General Motors recently filed a complaint with the Chinese government that the QQ was an illegal copy of its Spark.
Despite the GM charges, Chinese officials quickly denied that State-owned Chery had illegally copied U.S. auto technology. A top Chinese Commerce Minister stated that General Motors Corp. did not provide enough evidence to prove that Chery had copied the GM Spark.
"Unless GM provides further evidence to prove that Chery acquired such technology and designs through certain means, just simple similarity in terms of exterior design isn't sufficient enough to prove that the Chinese company is guilty," said Deputy Commerce Minister Zhang Zhigang. This is not the first time that China has been accused of stealing auto designs and copying them for fun and profit. For example, a failed Chrysler "joint venture" was cited by the U.S. Commerce Department report as a demonstration of Chinese honesty in business.

Iran Defies Demand of Nuclear Watchdog Agency

VIENNA, Austria – Defying a demand set by 35 nations, Iran announced Tuesday that it had started converting raw uranium into the gas needed for enrichment, a process that can be used to make nuclear weapons.

"Tests are going on successfully" to make uranium hexafluoride gas, the feed stock for enrichment, said Iranian Vice President Reza Aghazadeh. Of the more than 40 tons of raw uranium being mined for conversion, "Some ... has been used," he told reporters.
His comments, outside the general conference of the 137-nation International Atomic Energy Agency, were the latest sign that Iran was ignoring demands made on the weekend by the agency's board of governors to suspend all enrichment and related activities and banish international fears the technology could be used to make weapons.

VIENNA, Austria – More than 40 countries with peaceful nuclear programs could retool them to make weapons, the head of the U.N. atomic watchdog agency said Monday amid new U.S and European demands that Iran give up technology capable of producing such arms.

Mohamed ElBaradei, director general of the International Atomic Energy Agency, suggested in a keynote address to the IAEA's general conference that it was time to tighten world policing of nuclear activities and to stop relying on information volunteered by countries. Beyond the declared nuclear arms-holding countries, "some estimates indicate that 40 countries or more now have the know-how to produce nuclear weapons," ElBaradei said. "We are relying primarily on the continued good intentions of these countries, intentions, which ... could ... be subject to rapid change."

TEHRAN, Iran -- Iran on Sunday denounced as ``illegal'' demands from the U.N. atomic watchdog agency that it freeze all work on uranium enrichment - a technology that can be used for nuclear weapons - and threatened to limit cooperation with the agency if it moves toward sanctions.

But Hasan Rowhani, Iran's top nuclear negotiator, stopped short of outright rejection of the International Atomic Energy Agency's demands and held out the possibility of negotiations on the issue. ``We are committed to the suspension of actual enrichment, but we have no decision to expand the suspension,'' Rowhani said at a news conference a day after the IAEA governing board issued its demand to freeze all enrichment-related work and said it would judge Tehran's compliance in two months.
``This demand is illegal,'' he said. ``The IAEA board of governors has no right to make such a suspension obligatory for any country.''
``Actual enrichment'' refers to the injection of uranium gas into centrifuges. Rowhani indicated Iran's other activities, such as production, assembly and testing of centrifuges, were likely to continue.

The resignation of Jiang, 78, announced at the close of a four-day meeting of the party's Central Committee, for the first time put Hu, 61, formally in command of all the vast party, government and military bureaucracies that rule China and its 1.3 billion people.
The shift, although important for the smooth working of the Chinese government, was unlikely to produce swift or radical changes in the way Beijing approaches its relations with the United States, its resolve to return Taiwan to the mainland or its effort to continue moving into a market economy while maintaining growth and social stability.

Iran to pursue nuke program

Gorelick Rejected Attempt to Revise 'Wall' Memo

One of America's most prominent federal prosecutors sought changes to the 1995 "wall" memo authored by then-Deputy Attorney General Jamie Gorelick, but most of the concerns expressed by U.S. Attorney Mary Jo White over the barriers erected between criminal and counter-intelligence investigations were rejected.
Gorelick's "wall" memo was the subject of an April 26 CNSNews.com report, which quoted four sources as saying the memo erected barriers to intelligence-sharing between the FBI and intelligence agencies, and impeded the investigation of alleged Chinese espionage and illegal campaign donations to then-President Bill Clinton's 1996 re-election campaign.
According to documents obtained by CNSNews.com, White, who was the U.S. attorney for the Southern District of New York, spelled out her concerns shortly after Gorelick wrote the memo establishing the new guidelines for federal investigations.
The reply that followed came from Michael Vatis, deputy director of the Executive Office of National Security, with Gorelick signing off on Vatis' language.
White was concerned that Gorelick's new guidelines for investigations had made it too complicated for the FBI to contact the U.S. attorney's office and launch a probe of suspicious activity. White suggested that only the Office of Intelligence Policy and Review at the Department of Justice needed to approve such an investigation, and not the department's criminal division.
However, the Vatis/Gorelick memo offered a blunt reply.
"I recommend rejecting this change," the June 19, 1995 document stated. "[A] USAO [U.S. attorney's office] should not be notified of a national security investigation -- particularly one that has not yet developed into a criminal case -- without the approval of the AAG [assistant attorney general], Criminal Division."
The Vatis/Gorelick memo also addressed White's reservations over how the new investigative guidelines would impact a probe under the Foreign Intelligence Surveillance Act (FISA). White contended that once the Justice Department's Criminal Division had decided that criminal law enforcement concerns existed in a FISA investigation, the appropriate U.S. attorney should be contacted.
Vatis rejected this notion as well.
"Notifying the USAO as soon as law enforcement concerns exist -- but before Crim. thinks that the investigation should 'go criminal' -- is simply too early," the document stated.
The current U.S. attorney general, John Ashcroft, recently de-classified the original Gorelick memo that established the new investigative guidelines. He did so shortly before testifying in front of the commission investigating the Sept. 11, 2001 terrorist attacks, calling the Gorelick memo "the single greatest structural cause for September 11."
The June 19, 1995 memo from Vatis/Gorelick was included in a batch of documents released Wednesday by the Justice Department in response to a request by U.S. Sens. John Cornyn, R-Texas, and Lindsay Graham, R-S.C.
The senators, in a joint statement, asked the department to "provide key Gorelick documents" in response to the Sept. 11 commission's "failure to hear testimony from a key Clinton administration Justice Department official [Gorelick], preventing the Congress from receiving a full accounting of intelligence and enforcement procedures that led to the tragic attacks."
A separate statement, released by Cornyn's office late Wednesday, charged that the newly released documents "substantially discredit former Deputy Attorney General -- and current 9/11 Commission member -- Jamie Gorelick's claims of limited involvement in the promulgation of 'the wall' separating counterintelligence and law enforcement agencies.
"Specifically, the documents show that she was substantially involved in the development of the information-sharing policy and contradicts statements that the department's policies under the Clinton-Reno administration enhanced, rather than restricted, such vital information sharing," Cornyn stated.
'Special Knowledge'
"These documents show what I've said all along: Commissioner Gorelick has special knowledge of the facts and circumstances leading up to the erection and buttressing of 'that wall' that, before the enactment of the Patriot Act, was the primary obstacle to the sharing of communications between law enforcement and intelligence agencies," Cornyn's statement continued.
Gorelick's membership on the 9/11 commission has become controversial considering that she also worked in the Clinton administration's Justice Department. Many Republicans in Congress have called for her to testify before the commission, a request the commission's chairman has rejected.
"This is a person with knowledge of relevant facts. Either the Commission wants the whole truth, or it does not," Cornyn stated.
"If it does, she should appear in public testimony so that the families of the victims, the American people and the Congress can have a full and complete picture of what led to the failures of 9/11," Cornyn added.

A Shooting in Fallujah
This was an unfortunate act of war, but not a war crime.

As readers of NRO and National Review know, I have written a number of articles on war crimes and atrocities in response to the 1971 Senate testimony of John Kerry, who claimed that such acts were routinely committed by Americans in Vietnam with the knowledge of officers at all levels of command. I argued that while there were instances of Americans committing atrocities in Vietnam, they were no more widespread there than in earlier wars.

Despite my best efforts to avoid doing so, it seems I am destined to write once again on the issue of atrocities and war crimes. As the world knows by now, a Marine in Fallujah was captured on tape apparently shooting a wounded insurgent. Naturally, the tape has unleashed a furor and the incident is being investigated. The question is: Was this an unfortunate act of war, or was it a war crime? In my opinion, it was the former.

What are we talking about here? Let us be clear. Atrocities and war crimes are acts of violence in wartime whose brutality and cruelty exceed military necessity. They include, but are not limited to, looting, torture, rape, massacre, mutilation of the enemy dead, and the killing of captured soldiers or non-combatants. As I wrote in National Review earlier this year, the West has placed three constraints on its conduct of warfare: proportion, discrimination, and the positive law of war. Proportion means that particular actions must be proportionate to legitimate military necessity and not involve needless suffering or destruction. Discrimination means that direct, intentional attacks on noncombatants and non-military targets are prohibited.

The positive law of war derives from conventions, customs, the general principles of law, decisions in international law, and the writings of authorities. Standards regulating the conduct of war have followed two general paths: "Geneva law," protecting victims and innocents, and "Hague law," regulating land combat.

The most important conventions that underlie the positive law of war (and therefore provide guidelines for the conduct of war) include the Hague Convention IV of 1907, the Geneva Convention of 1949, the 1977 Protocols to those conventions, and the Nuremberg trials following World War II. Customs that constrain the conduct of war include military necessity, humanity, and chivalry.

The key to applying the law of war to particular situations is the principle of military necessity. This principle holds that, subject to the principles of humanity and chivalry, a belligerent is justified in applying the amount of force necessary to achieve the complete submission of the enemy as soon as possible, with the least expenditure of time, life, and resources. Military necessity recognizes that a commander's overriding concern is the accomplishment of his mission and the safety of his troops. One would not attack a populated area, increasing the risks of civilian deaths, unless such an attack were essential to the campaign.

Humanity is the self-evident recognition of the fact that one's enemy is also a human being. Prohibitions against killing or torturing prisoners, and the generally recognized obligation to provide medical treatment to wounded prisoners, flow from this principle.

Chivalry is the customary recognition of the idea that the strong protect the weak. Soldiers do not declare war on women or children because it is dishonorable to do so. If women or children engage in war, however, the principle of military necessity usually takes precedence over chivalry.

The dilemma, of course, is how to judge an action, given the likely clash among the main conditions. Do all conditions have to be met? Must all be met equally, or do some conditions take priority over others? The general conclusion is that all conditions must be met. But there is also the necessity of prudence in evaluating actions in war. Different times and circumstances may make one condition more important than another. Moreover, a reasonable judgment that a condition was met in a particular situation can be changed as a result of additional experience, information, or insight.

These principles lead us to the conclusion that we need to make a distinction in the case of the Marine in Fallujah. Clearly, a soldier who executes a prisoner, either on his own or under orders, has acted in cold blood and consequently has committed a war crime. Proportionality, humanity, and chivalry guide this judgment. But it seems to me that in the case of the Marine in question, military necessity trumped the other two conditions. He did not kill in cold blood, but responded to threatened danger in an uncertain environment. To fully convey this environment, let me reprint an e-mail from another Marine in Fallujah that I recently posted on The Corner:
This is one story of many that people normally don't hear, and one that everyone does.
This is just one most don't hear:
A young Marine and his cover man cautiously enter a room just recently filled with insurgents armed with AK-47s and RPGs. There are three dead, another wailing in pain. The insurgent can be heard saying, "Mister, mister! Diktoor, diktoor (doctor)!" He is badly wounded, lying in a pool of his own blood. The Marine and his cover man slowly walk toward the injured man, scanning to make sure no enemies come from behind. In a split second, the pressure in the room greatly exceeds that of the outside, and the concussion seems to be felt before the blast is heard. Marines outside rush to the room, and look in horror as the dust gradually settles. The result is a room filled with the barely recognizable remains of the deceased, caused by an insurgent setting off several pounds of explosives.
The Marines' remains are gathered by teary-eyed comrades, brothers in arms, and shipped home in a box. The families can only mourn over a casket and a picture of their loved one, a life cut short by someone who hid behind a white flag. But no one hears these stories, except those who have lived to carry remains of a friend, and the families who loved the dead. No one hears this, so no one cares.
This is the story everyone hears:
A young Marine and his fire team cautiously enter a room just recently filled with insurgents armed with AK-47s and RPGs. There are three dead, another wailing in pain. The insurgent can be heard saying, "Mister, mister! Diktoor, diktoor (doctor)!" He is badly wounded. Suddenly, he pulls from under his bloody clothes a grenade, without the pin. The explosion rocks the room, killing one Marine, wounding the others. The young Marine catches shrapnel in the face.
The next day, same Marine, same type of situation, a different story. The young Marine and his cover man enter a room with two wounded insurgents. One lies on the floor in puddle of blood, another against the wall. A reporter and his camera survey the wreckage inside, and in the background can be heard the voice of a Marine, "He's moving, he's moving!"
The pop of a rifle is heard, and the insurgent against the wall is now dead.
Minutes, hours later, the scene is aired on national television, and the Marine is being held for committing a war crime. Unlawful killing.
And now, another Marine has the possibility of being burned at the stake for protecting the life of his brethren. His family now wrings their hands in grief, tears streaming down their face. Brother, should I have been in your boots, I too would have done the same.
For those of you who don't know, we Marines, Band of Brothers, Jarheads, Leathernecks, etc., do not fight because we think it is right, or think it is wrong. We are here for the man to our left, and the man to our right. We choose to give our lives so that the man or woman next to us can go home and see their husbands, wives, children, friends and families.
For those of you who sit on your couches in front of your television, and choose to condemn this man's actions, I have but one thing to say to you. Get out of you recliner, lace up my boots, pick up a rifle, leave your family behind, and join me. See what I've seen, walk where I have walked. To those of you who support us, my sincerest gratitude. You keep us alive.

Anyone who has ever talked to a veteran of World War II in the Pacific knows that the Japanese, like the rebels in Fallujah, were not inclined to surrender and that, on more than one occasion, they killed Americans after feigning surrender. Pretty soon, the Americans stopped making the offer and resorted to flamethrowers and satchel charges to take care of Japanese defenders.

I firmly believe that American soldiers should carefully adhere to the laws of war, even when they engage a savage enemy — as they have in Fallujah. While it may sound strange to some, I believe the idea of restraint in war helps to civilize a brutal human activity and to limit the descent of soldiers into barbarism. But prudence dictates that we make a distinction between killing a prisoner in cold blood, and protecting oneself and one's brethren — as this Marine did.

Was just back from Wis too? In the Hunting country and it was bow season?

These Marines are in a very tough spot. They are fighting a ruthless enemy who believes the Infidel is sub-human. They must act quickly and mistakes are sometimes made. In this particular case it was neither a mistake nor immoral given the situation. I agree with most of the posts so far. Rules regarding appropriate conduct are only effective if followed by all parties involved. If U.S. troops slavishly follow rules our enemy rejects (until it serves their purpose) it is a recipe for failure. We should break the 'rules' of warfare proportionately to how they are broken by our enemy. This is the quickest way to end the enemy's brutality.

During the U.S. Civil War there came a time when Federal troops started treating captured Rebel Rangers as spies by hanging them. Keep in mind these Rangers (most notably serving under Mosby in Northern Virginia) fought behind the lines but they still wore uniforms and flew the flag clearly distinguishing them from spies. Once the hangings commenced Mosby didn't respond by saying how much morally superior they were to the Yankees and saying such tactics were beneath them. Why? Because such moralizing would not bring the practice to an end. Mosby informed the Federals that he would hang one Yankee prisoner for every Ranger hung as a spy by drawing lots. Once the Southerners started hanging prisoners the Northerners stopped and thus ended the whole episode.

If these Jihadists faced the prospect of having their heads sawed off with dull butter knives and their heads dropped into buckets of bacon grease I wonder how many of them would stay so 'brave'. Their bravery is in direct proportion to our benevolence. Bullies invariably treat magnanimity as license. These goons are no different.

Voltaire and others are willing to put our brave troops in danger by forcing them to follow rules that are not only not applicable(these 'insurgents'/terrorists are much closer to spies than soldiers) but are not followed by our enemies. The sooner our fiendish foe recognizes we will not be paralyzed by either liberal guilt or Islamic sophistry, the sooner the enemy can be defeated.

I agree with the suggestion that self-righteous 'observers' like NBC's Seitz should start inspecting the surrendering insurgents. That would get them home in a hurry. Of course not following one-way rules means fewer of our soldiers will be killed; an unfortunate prospect for the MSM in their quest for more anti-Bush fodder. I would rather they make up their anti-Bush stories, as is their wont, than profiting from more fallen American heroes.

I noticed the NBC reporter is saying he didn't destroy the tape because he believed in upholding the truth.

Nice try BOZO,he ws there and did nothing to stop the shooting,reporters shouldn't be exempt from the law that make them an accessory to a crime or murder. The last part of the video that I witnessed showed two wounded men "Not being shot" by the soldiers,and also the Muslims didn't seem to be upset the Mosque was used for waging war and killing people.

Islam is now being seen for what it is,one big scam with special rules to allow lies and murders while it forces any opposition to adhere to respecting "Holy" sites or the Geneva Convetion.
Back in 1864 the creation was to help medical teams remove injured people from further harm,this included civilians and soldier from both sides. Nobody expected the perverse teachings of Islam to be the basis for a battle,Nations use to fight,not civilians to expand their religion.

The Marine wasn't in Geneva when he shot the terrorist,he was in a war-zone where soldiers made a free will choice to dress as civilians and use religious buildings for a safehouse,they also chose to exploit the "White-flag" of surrender

How was Sites "mute?" Answer: he was not.

Directly after the shooting he did EXACTLY what he should have done. He went to the Marine commander, showed him the videotape, and told him exactly what he saw.

He is not an accessory to murder, even implying that proves you don't know what the legal term means.

Sites then released the video.

The reaction of many was the kneejerk hatred of Kevin Sites, which what we get from many here and from the majority of posters over at Little Green Footballs that I took head-on over at my Blog that was picked up by Instapundit.com.

Sites did exactly what he should have done.

He did his job and taped what he saw, he took that tape to the responsible authorities, and he did his job and sent out teh tape, even knowing the firestorm it would bring down on him, knowing it would alientate him from the men he spent time with under fire.

The First Amendment does not only apply to the speech you like, folks. Sometimes some of you seem to forget that.

I don't know if the Marine was right or wrong in his shooting of the wounded terrorist in the Fallujah mosque, and neither does anyone here. We simply don't have the personal context to justify actions one way or the other without being there.

The Marine will most likely be given the benefit of the doubt, and will be set free without any charges filed. He did make a judgement call, and even if it was the wrong call, it was not a crime. He was just doing the job he was trained to do under extreme circumstances and pressure.

Sites even offered the Marines to hold the tape until more information was available. The Marine Corps declined his offer.

What else would you have him do?

I did not in any way feel like I had captured some kind of "prize" video. In fact, I was heartsick. Immediately after the mosque incident, I told the unit's commanding officer what had happened. I shared the video with him, and its impact rippled all the way up the chain of command. Marine commanders immediately pledged their cooperation. We all knew it was a complicated story, and if not handled responsibly, could have the potential to further inflame the volatile region. I offered to hold the tape until they had time to look into incident and begin an investigation -- providing me with information that would fill in some of the blanks....
When NBC aired the story 48-hours later, we did so in a way that attempted to highlight every possible mitigating issue for that Marine's actions. We wanted viewers to have a very clear understanding of the circumstances surrounding the fighting on that frontline. Many of our colleagues were just as responsible. Other foreign networks made different decisions, and because of that, I have become the conflicted conduit who has brought this to the world.

Marine public affairs officers are supporting Sites. The fact of the matter is that we need the truth, no matter how ugly it may be.

Please try to rationally explain how releasing videotape reviewed by the Marines constitutes in any legal or moral way "Aiding and abetting the enemy." Feel free to use Constitutional law or the Uniform Code of Military Justice to support your argument.

The liberal and Islamic media have not affected to rules of engagement. You are just wrong, dear, in your assumptions.

It is still kill or be killed, and that hasn't changed for thousands of years, and isn't likely change for thousands more. If you think otherwise, you vastly overestimate the affect the influence of the media on combat troops. The Marines have one standing order: You, as a Marine, are not allowed to die. Any violation of that rule will piss off your superior officers and result in paperwork. Am I clear? There isn't a single man down becuase they hesitated becuase they were contemplating what Maureen Dowd might say about them.

Revolution from Afghanistan to Iraq.
In September and early October 2001 we were warned that an invasion of Afghanistan was impossible — peaks too high, winter and Ramadan on the way, weak and perfidious allies as bad as the Islamists — and thus that the invasion would result in tens of thousands killed and millions of refugees. Where have all these subversive ankle-biters gone? Apparently into thin air — or to the same refuge of silence as all the Reagan-haters of the 1980s who swore that a nuclear freeze was the only humane policy of dealing with Soviet expansionism.
After the seven-week defeat of the Taliban, these deer-in-the-headlights critics paused, and then declared the victory hollow. They said the country had descended into rule by warlords, and called the very idea of scheduled voting a laughable notion. We endured them for almost two years. Yet after the recent and mostly smooth elections, Afghanistan has slowly disappeared from the maelstrom of domestic politics, as all those who felt our efforts were not merely impossible but absurd retreated to the shadows to gnash their teeth that Kabul is not yet Carmel. Western feminists, homosexual-rights advocates, and liberal reformists have never in any definitive way expressed appreciation for the Afghan revolution now ongoing in the lives of 26 million formerly captive people. They never will. Instead, Westerners simply now assume that there was never any controversy, but rather a general consensus that Afghanistan is a "good thing" — as if the Taliban went into voluntarily exile due to occasional censure from The New York Review of Books.
The more ambitious effort to achieve similar results in Iraq is following the same script, despite even more daunting challenges. Fascistic neighbors rightly see elections in Iraq as near fatal to their own bankrupt regimes. Some have oil; others have terrorists; still more, like Iran and Saudi Arabia, have both. Unlike Afghanistan, there is no neutral India or Russia nearby to keep Islamists wary, only the provinces of the ancient caliphate to supply plenty of jihadists to continue the work of September 11. Our mistakes in the reconstruction of Iraq were never properly critiqued as naïve and too magnanimous, but rather they were decried by the Left as cruel and punitive — as if being too lax was proof of being harsh.
Yet, thanks to the brilliance of the U.S. military and despite the rocky reconstruction and our own election hysteria, there is a good chance that the January elections can begin a cycle similar to what we see in Afghanistan. And at that point things should get very, very interesting.
Just as the breakdown of a few Communist Eastern European states led to a general collapse of Marxism in the east, or the military humiliation in colonial Africa and the Falklands led to democratic renaissance in Iberia and Argentina, or American military efforts in Nicaragua, El Salvador, and Panama City brought consensual government to Central America, a reformed Afghanistan and Iraq may prompt what decades of billions of dollars in wasted aid to Egypt, Jordan, and the Palestinians, the 1991 Gulf War, and 60 years of appeasement of Gulf petrol-sheiks could not: the end of the old sick calculus of Middle East tyrannies blackmailing the United States through past intrigue with the Soviet Union, then threats of oil embargos and rigged prices, and, most recently, both overt and stealthy support for fundamentalist killers.
The similar effort to isolate Arafat, encourage the withdrawal from Gaza, and allow the Israelis to proceed with the fence have brought more opportunity to the Middle East than all of Dennis Ross's shuttles put together, noble and well-meant though his futile efforts were. The onus is on the Palestinians now either to turn Gaza into their own republic or give birth to another Lebanon — their call before a globalized audience. They can hold elections and shame the Arab League by being the embryo of consensual government in the Middle East, or coronate yet another thug and terrorist in hopes that again the United States will play a Chamberlain to their once-elected Hitler.
If someone wonders about the enormous task at hand in democratizing the Middle East, he could do no worse than ponder the last days of Yasser Arafat: the tawdry fight over his stolen millions; the charade of the First Lady of Palestine barking from a Paris salon; the unwillingness to disclose what really killed the "Tiger" of Ramallah; the gauche snub of obsequious Europeans hovering in the skies over Cairo, preening to pay homage to the late prince of peace; and, of course, the usual street theater of machine guns spraying the air and thousands of males crushing each other to touch the bier of the man who robbed them blind. Try bringing a constitution and open and fair elections to a mess like that.
But that is precisely what the United States was trying to do by removing the Taliban, putting Saddam Hussein on trial, and marginalizing Arafat. Such idealism has been caricatured with every type of slur — from both the radical Left and the paleo-Right, ranging from alleged Likud conspiracies and neo-con pipe dreams to secret pipeline deals and plans for a new American imperium in the Middle East shepherded in by the Bush dynasts. In fact, the effort not just to strike back after September 11, but to alter the very landscape in which our enemies operated was the only choice we had if we wished to end the cruise-missile/bomb-'em-for-a-day cycle of the past 20 years, the ultimate logic of which had led to the crater at the World Trade Center.
Oddly, our enemies understand the long-term strategic efforts of the United States far better than do our own dissidents. They know that oil is not under U.S. control but priced at all-time highs, and that America is not propping up despotism anymore, but is now the general foe of both theocracies and dictatorships — and the thorn in the side of "moderate" autocracies. An America that is a force for democratic change is a very dangerous foe indeed. Most despots long for the old days of Jimmy Carter's pious homilies, appeasement of awful dictatorships gussied up as "concern" for "human rights," and the lure of a Noble Prize to ensure nights in the Lincoln bedroom or hours waiting on a dictator's tarmac.
In the struggle in Fallujah hinges not just the fate of the Sunni Triangle, or even Iraq, but rather of the entire Middle East — and it will be decided on the bravery and skill of mostly 20-something American soldiers. If they are successful in crushing and humiliating the fascists there and extending the victory to other spots then the radical Islamists and their fascistic sponsors will erode away. But if they fail or are called off, then we will see Days of Sorrow that make September 11 look like child's play.
We are living in historic times, as all the landmarks of the past half-century are in the midst of passing away. The old left-wing critique is in shambles — as the United States is proving to be the most radical engine for world democratic change and liberalization of the age. A reactionary Old Europe, in concert with the ossified American leftist elite, unleashed everything within its ample cultural arsenal: novels, plays, and op-ed columns calling for the assassination of President Bush; propaganda documentaries reminiscent of the oeuvre of Pravda or Leni Riefenstahl; and transparent bias passed off as front-page news and lead-ins on the evening network news.
Germany and France threw away their historic special relationships with America, while billions in Eastern Europe, India, Russia, China, and Japan either approved of our efforts or at least kept silent. Who would have believed 60 years ago that the great critics of democracy in the Middle East would now be American novelists and European utopians, while Indians, Poles, and Japanese were supporting those who just wanted the chance to vote? Who would have thought that a young Marine from the suburbs of Topeka battling the Dark Ages in Fallujah — the real humanist — was doing more to aid the planet than all the billions of the U.N.?
Those on the left who are ignorant of history lectured the Bush administration that democracy has never come as a result of the threat of conflict or outright war — apparently the creation of a democratic United States, Germany, Japan, Italy, Israel, El Salvador, Nicaragua, Panama, Serbia, and Afghanistan was proof of the power of mere talk. In contrast, the old realist Right warned that strongmen are our best bet to ensure stability — as if Saudi Arabia and Egypt have been loyal allies with content and stable pro-American citizenries. In truth, George Bush's radical efforts to cleanse the world of the Taliban and Saddam Hussein, bring democracy to the heart of the Arab world, and isolate Yasser Arafat were the most risky and humane developments in the Middle East in a century — old-fashioned idealism backed with force in a postmodern age of abject cynicism and nihilism.
Quite literally, we are living in the strangest, most perilous, and unbelievable decade in modern memory.

Besides, is America based on the Constitution, or international law? Last time I checked, it was the former.

The Marine did nothing wrong, he did an excellent job in fact. If there was anything wrong with what he did wouldn't the other soldiers take Sites camera and destroy the evidence? By letting Sites keep it just proves that nothing wrong happened.

Its kill or be killed when dealing with Islamic fundamentalists... just ask any Russian Soldier who served in Chechnya, Serbians who were in Kosovo or Indian Soldiers in Kashmir.

Hi, sorry for the additional post, but what exactly is the petition for? Is Kevin Sites in jail because of the shooting and we are petitioning for him to be freed?

The marine had little time to make a decision--his life or the life of a possibly armed murderous pig--I believe he made the correct decision. They are fighting an enemy who does not wear a uniform, who hides in crowds of women and children, who fakes dead and then opens fire, who pretends to surrender only to open fire, who booby trap the bodies of their dead to explode and kill our soldiers if they get too close. Next time let the camera man go and see if the guy is really dead, or just pretending.

I agree that he has made the correct decision too. But what exactly is the petition about? Was he charged in court? Convicted? Court Martialed? If the US Army isn't making a big deal out of this, then why are we making a big deal out of this? I rather sign a petition to support all the troops and mourn the loss of those fallen in battle than to make a big hype about this issue.
