The Washington Post today contains a story about several men who are being held on secret evidence without charge. There is a full-throttle weepy component to the story, what with the children of one of the men coming to the prison to visit him and not being able to play, but later on we're told this:
Mahjoub, 44, is accused by the government of belonging to a radical splinter group of the Egyptian Islamic Jihad organization, working on a Sudanese farm run by Osama bin Laden, staying briefly with a top-ranking member of al Qaeda, and lying about the stay when he entered Canada in 1995. He was working as a store clerk when he was arrested in 2000.Adil Charkaoui, a Moroccan who worked in a pizza shop in Montreal, has been held on a security certificate since May 2003 for allegedly training at an al Qaeda camp in Afghanistan. Similar allegations have been made against Hassan Almrei, 30, a Syrian held since October 2001; Mohamed Harkat, 36, an Algerian held since December 2002; and Mahmoud Jaballah, 41, of Egypt, who has been held since June 2000 for allegedly making phone calls to an Egyptian Islamic Jihad group in London.
Well, what should be done with such men? If they are released, or even deported, they could become part of a terrorist strike. This is the Canadian government's dilemma:
"You can't use the ordinary machinery of law," responded Bissett, the former immigration director. "To wait for an offense to be committed and then use due process of law is fine for dealing with criminals. It's not fine for terrorists. You can't wait for them to blow up several thousand people and then charge them."

Hearts and Minds
Go read this post at BlackFive from a Marine Gunnery Sergeant in Iraq, and know that we have friends: The Heart of America.
As you know, I asked for toys for the Iraqi children over here and several people (Americans that support us) sent them over by the box. On each patrol we take through the city, we take as many toys as will fit in our pockets and hand them out as we can. The kids take the toys and run to show them off as if they were worth a million bucks. We are as friendly as we can be to everyone we see, but especially so with the kids. Most of them don’t have any idea what is going on and are completely innocent in all of this.
On one such patrol, our lead security vehicle stopped in the middle of the street. This is not normal and is very unsafe, so the following vehicles began to inquire over the radio. The lead vehicle reported a little girl sitting in the road and said she just would not budge. The command vehicle told the lead to simply go around her and to be kind as they did. The street was wide enough to allow this maneuver and so they waved to her as they drove around.
As the vehicles went around her, I soon saw her sitting there and in her arms she was clutching a little bear that we had handed her a few patrols back. Feeling an immediate connection to the girl, I radioed that we were going to stop. The rest of the convoy paused and I got out the make sure she was OK. The little girl looked scared and concerned, but there was a warmth in her eyes toward me. As I knelt down to talk to her, she moved over and pointed to a mine in the road.
Immediately a cordon was set as the Marine convoy assumed a defensive posture around the site. The mine was destroyed in place.
It was the heart of an American that sent that toy. It was the heart of an American that gave that toy to that little girl. It was the heart of an American that protected that convoy from that mine. Sure, she was a little Iraqi girl and she had no knowledge of purple mountain’s majesty or fruited plains. It was a heart of acceptance, of tolerance, of peace and grace, even through the inconveniences of conflict that saved that convoy from hitting that mine. Those attributes are what keep Americans hearts beating. She may have no affiliation at all with the United States, but she knows what it is to be brave and if we can continue to support her and her new government, she will know what it is to be free. Isn’t that what Americans are, the free and the brave?
If you sent over a toy or a Marine (US Service member) you took part in this. You are a reason that Iraq has to believe in a better future.
The legal system is outdated and needs to be updated to face the threat posed by islamist/jihadi terror.
This isn't a new sentiment and it has been expressed here previously.
Any lawyers among us can point out which secvtions of the law need changing? maybe we can them mail senators and congressmen of our district with those notes?
Tsk, tsk, tsk. Preemptive detention of indeterminate length? The horror!

Our Canadian allies won’t be able to resist internal pressure, let alone the barrage of international condemnation for this action. Especially when the claims of torture, humiliation and mistreatment begin.
It takes us to a serious issue relating to retention of such menaces. It is to be seem in the light of UK's top court's recent ruling that holding such people without trial is 'illegal' (and subsequent display of glee by the BBC)
The problem is, we are attempting to measure 21st Centuary's terrorism with outdated criminal justice system.
The criminal justice system has not envisaged a system such as Al-Qaida and their members, who engage in psychopathic killing, yet cannot be declared mad and sent to asylums. This is a new ideology driving people who are out to destroy what they hate, supported by a religious ratification, lending the necessary psychological rational to justify the heinous crimes they commit.
It is time the west starts respecting the limit to personal freedom. There is a strong right of an individual to live. This right is to be held superior to the killer's right to plan, hate and execute a terrorist activity. It should be clearly understood that Terrorism is a new category and allegiance to any terrorist organization automatically disqualifies a person from availing those rights granted to the ordinary citizens. I turn bitter to see those scheming maniacs enjoying the benefits of the liberal values they are bent upon destroying. I also feel cheated that for abiding the law I am not appreciated. I am sure there are more like me out there.
Under the current law, the rigts are allowed to those scumbags. Ask your representative to review it. It will really scare the sh** out of those bravados, because, deep inside they know it is not the false God who is helping them, but the weak Judicial system of the west.
If U S can add organizations to a list of terror organizations, why not go further and say that those who have become members or are associated in one way or the other, automatically forfeit their right to be protected by the Constitutional rights. They will be measured by a new set of laws.
Of course, you cannot say that cold and AIDS are same as they are both caused by virus.
I would like to see what the members think about this idea?
Reminds me of Hicks and Habibie in Gitmo. They employ the above tactic quite successfully.
The bleeding heart brigades, Amnesia Int'l, human rights activists and of course the muzzies make sure that they are not forgotten.
Most western governments are baffled by the dilemma they find themselves in: They have terrorists behind bars and they have nothing to charge them with,- unless they let them out to kill people for the cause of Islam and the bloodgod Allah.
The law as we know it will not hold up in the face of this conspiracy.
Another Gitmo in Europe? We need something like that! I would rather opt for assasination squads, (may be messy but effective) at least for a while. But anything less than that will not earn you any respect with muzzies...

So now your're asking how he would get a fuel-truck without a license or even draw attention
from the Police since "Refugee's" get all the welfare benefits but can't get the right to
be employed until their hearing is over.
