WASHINGTON - A federal judge has dismissed a $2 million lawsuit filed against former Rep. Cass Ballenger by an American Muslim civil rights group for linking it to terrorists during an October 2003 interview with The Charlotte Observer.In a seven-page decision released Wednesday, U.S. District Judge Richard Leon agreed with the Hickory Republican's argument that he made the comments "in the scope of his employment as a federal employee" and that the suit should be converted into one against the U.S. government.
And because a doctrine called sovereign immunity bars most suits against the federal government, Leon threw out the case.
In the newspaper interview, Ballenger blamed the breakup of his 50-year marriage partly on the stress of living near the group's Capitol Hill headquarters, which was so close to the Capitol that he and his wife worried "they could blow the place up."
He also called the Council on American-Islamic Relations "the fundraising arm for Hezbollah."
In its lawsuit, CAIR said that these and other comments by Ballenger damaged its reputation and good name.
But it ain't over:
Arsalan Iftikhar, CAIR's national legal director, said Wednesday that the group plans to appeal the ruling, all the way to the U.S. Supreme Court if necessary.

Members of the government should be less afraid of speaking out about Islam. No need to be so inhibited. And telling the truth will win votes from Infidels. Very nice, that sovereign immunity.
I don't know what it cost Rep. Cass Ballenger to fight that CAIR lawsuit but I doubt very much that it was the ACLU which defended him and his right to free speech. As long as CAIR files these lawsuits which are intended to silence all critics of Militant Islam and of CAIR'S role in spreading Jihad to every county in the USA, then it's very likely that CAIR will continue to win or settle out of court. These are victories for CAIR and for their promotion of Jihad against the West. What needs to happen, and happen quickly, is to force CAIR to pay all court costs, plus penalties, for filing these anti-democratic lawsuits.
Of course, given that "our friends" the Saudis underwrite the expense of exporting Jihad, then it's doubtful that even pay court costs will have much of an effect on CAIR's campaign of hate.
Yes the ACLU is a curious organization, isn't it.
Prepared, to defend Nazis' right to march through a Jewish neighbourhood, etc., but could anyone imagine them coming to the assistance of the National Review for promoting the sales of a book by a Catholic priest detailing the life of Mohammed as narrated in the Koran, but actually putting his conduct into a moral context?

Like when they attacked Radio host Paul Harvey, another older gentleman, and an American institution. It must be a real bitch for Arsalan, Dougie, Omar and Nihad to have to wake up every day knowing that they have to go to work and try to keep the true version of Islam away from everyone.
They should be embarrassed to have to try to defend the honor of a savage who had no honor to begin with.

This organization of CAIR sucks! They came after my life because I e-mailed them my opinion and they used their corrupt influence and contacts to get me indicted. It was a 17 month experience. I was shocked when I had to deal with the FBI in Nevada and they did not even have a clue who CAIR really was. They really did think that they were just some civil rights group, and I know that because they asked me why did I feel the way that I did. I ended up speaking with quite a few people from the government. Very few people actully really knew how dangerous that CAIR is to our way of life. The one's that did know where scared to speak their mind because they did not want to get fired or make any waves. Anyway, keep up the great fight people! This is a fight that you can feel good about fighting. CAIR truly is an evil organization and the only freedom that they are fighting for is to take yours away.
CAIR and other Islamofascist groups will continue to attack our First Amendment rights for free speech is anathema to such a controlling ideology. They have already censored Boeing and National Review and others.
If we are not careful our First Amendment and other Constitutional rights will swept away by this insidious group.
The only positive thing here is that CAIR suffered a setback, but I expect CAIR, the AMC, MSA etc to become increasingly aggressive, as they ramp up their agenda and activities, the public will get wise and hopefully a reaction will set in, and the public will start demanding protection from our dhimmi government.
As I stated more than once, Muslims can be distinguished from westerners by one word - arrogance, and that arrogance can be and will be if employed like ju jitsu, their downfall.

CAIR consistently shows that there is almost no limit to their power. They cow and bully virtually anyone into submission. It's nice to see one judge make a good decision.
No group, except possibly the ACLU, uses the Constitution to attack the Constitution more effectively. All those quotes from the Founders which warn us that freedom must be defended suddenly seem more relevant.
Here it is April 1st, and we're discussing CAIR. How fitting.

How about sending a note of support to Judge Richard Leon, and to Rep. Cass Ballenger? We should encourage anti-dimmitude wherever we find it!
On another thread, I suggested that we send notes trying to boulster the courage of organizations like Home Depot, AMEX, Dell, Boeing, and the National Review.
There is no question that if these businesses circled the wagons, they could be effective in defending themselves against CAIR. CAIR is funded by the Saudis and other obedient Muslims, so they have what amounts to unlimited funds at their disposal to sue American businesses. This is one of the reasons they capitulate to CAIR's intimidation.

We have to support American businesses; for the most part, because of the Leftist attacks on business over the years, they think they are out there all alone, without the support of the people.
Write them a one or two liner just encouraging them to stick to their guns, and to band together to protect themselves against CAIR's attacks.
As we well know, one of Islam's more important targets is our economy.
