Jail and Lashes for 3 in Camera Phone Sex Assault

RIYADH, 7 January 2005 — Two young Saudis have been sentenced by the high court here to prison terms and flogging for orchestrating and filming a Nigerian driver sexually assaulting a 17-year-old girl, Al-Watan newspaper reported yesterday.

Judge Muhammad ibn Abdullah Al-Luhaidan sentenced the main defendant, Barjis ibn Faleh, 27, to 12 years imprisonment and 1,200 lashes, while compatriot Abdulrahman ibn Haif, 22, was sentenced to two years and 200 lashes, Al-Watan reported.

“The Nigerian driver who appeared in the film, Youssef Abkar Mohammad Abdullah, was sentenced to a six-year imprisonment and 600 lashes,” the paper said.

The scandal, which shocked the conservative Saudi society, broke out after the accused circulated footage of the assault through mobile phones equipped with cameras.

The trio used the camera phone Panda and distributed the phone clip using Blue Tooth and on websites.

The trio came to be known as the Panda gang.

The phone clip shows the girl pleading as she is assaulted by the driver, while one of the two young men, apparently her former boyfriend, hurls abuse at her.

Legal sources told Al-Watan that the high court’s decision was not final and that the accused could appeal the decision to the supreme judicial council which will issue a final decision.

Sources also told Al-Watan that the lashes would not be delivered at one go but would be distributed every Friday until the punishment is completed.

The two Saudis were arrested last July after the girl’s family lodged a complaint.

Many people in Saudi Arabia had expressed anger at the men’s behavior on Internet sites. They had demanded tough punishment for the three so it will be a lesson to everyone.

Once the video clip was distributed, the police arrested the three gang members and detained them in Al-Sulaimaneya prison for investigation and later transferred to Al-Hayer prison southeast of Riyadh.

Court finds 68-year-old guilty of murder

AMMAN — A 68-year-old father sentenced to six months in prison in 2002 for killing his daughter had his sentence increased to 10 years last week after the case was returned to the Criminal Court.
Hussein Ahmad, from Hitteen Refugee Camp, was originally sentenced to a six-month prison term by the court in December 2002 after being found guilty of stabbing his 18-year-old daughter Amal 25 times in the chest and stomach on April 21, 2002.

Ahmad murdered his daughter after signing a guarantee at the administrator's office in which he pledged not to harm her.

After a review by the Court of Cassation, the Criminal Court last week overruled the original charge of “misdemeanour” and found Ahmad guilty of premeditated murder.

“The defendant confessed that he plotted to murder his daughter after signing a guarantee that he wouldn't harm her, therefore, he does not benefit from the fit of fury clause used in the previous ruling,” the Court of Cassation ruled.

During the original trial in 2002, the Criminal Court invoked Article 98 of the Penal Code “because the defendant committed his crime in a fit of rage.”

Article 98 stipulates: “He who commits a crime in a fit of fury caused by an unlawful or dangerous act on the part of the victim benefits from a reduction of penalty.”

The Criminal Court sentenced Ahmad to death but immediately commuted the sentence to 10 years because the defendant's family dropped the charges.

Prior to the murder the victim went missing for four weeks and was eventually found in Aqaba by the police, according to the court.

Court transcripts said the defendant received a call from the administrative governor on April 21 to inform him that his daughter was in government custody. The father went to the governor's office where he signed a guarantee not to harm or kill his daughter, the court added.

Shortly after arriving home, according to court transcripts, the defendant admonished his daughter for her behaviour.

But after the girl replied: “It is my life and I am free to do what I want,” the defendant became enraged, drew a switchblade and stabbed his daughter to death. He then went to the nearest police station where he claimed to have killed his daughter to cleanse his family's honour.

Medical officials who examined Amal at the time of the murder said she had not been involved in any sexual activity.

Amal told interrogators when she was in government custody that she often left the house because her father was restricting her mobility.

The verdict, handed down by justices Natheer Hiari, Zuhair Salhi and Azam Obeidat, will automatically be reviewed by a higher court within the next 30 days.

In a second ruling by the same tribunal, the Criminal Court sentenced a 25-year-old man to a seven-and-a-half-year prison term for killing his nephew with a machinegun in June 2002 in Madaba.

The tribunal declared Amer A. guilty of killing his nephew Mahmoud on June 6 following an argument over a plot of land.

But his verdict was immediately commuted to half by the tribunal because the victim's family dropped the charges.

According to court documents, the defendant met the victim in Um Buheira market on the day of the incident and they began arguing about the land owned by the family.

“The victim drew a machinegun and threatened the defendant with it, prompting the defendant to run towards his pickup truck and grab his own machinegun and shoot his nephew to death,” court papers added.

The verdict will automatically be reviewed by a higher court within the next 30 days.
