Al Qaradawi: Osama should be tried by Muslim judges

From The Peninsula, with thanks to Twostellas:

Noted Islamic scholar, Dr Yusuf Al Qaradawi has said the Al Qaeda leaders Osama bin Laden and Abu Musad Al Zarqawi should be tried by Muslim judges if they are caught.

A local Arabic daily quoted Dr Al Qaradawi as telling a German magazine in an interview that most Muslims have sympathy for terrorists because of the atrocities being committed against the Palestinians.

He clarified that a Muslim suicide bomber attacking a bus full of innocent civilians was to be differentiated from the one who was carrying out a suicide mission to resist foreign invasion. Islam, Dr Al Qaradawi said, did not allow the killing of innocent women and children.

Good ideal. Let the insane run the asylum.

I wonder if Red Ken has any comments regarding this "holy mans" disparaging remarks regarding Western Justice?

This is the same chap who wants all homosexuals thrown off the tallest building in their home town, right? Is that a foretaste of his Islamic justice? What could we reasonably expect the sentence to be, in light of the fact that OSB would use the central tenets of Islam in his defence?

Maybe thats why he hasn't been bought to book - the Bush administration knows his defence strategy & have chosen Dhimmitude rather than confrontation.

Path of least resistance?

Put the problem on the next Presidents plate?

You would have thought that after his Father was / is villified (quite rightly) for stopping Gulf War 1 when it was just about to achieve something other than saving the ungrateful necks of Kuwait, he would be looking to a legacy, a poignant hook for the West to hang its hat on at the end of his second & final term & say, well at least he got him....

Its reasonable now to be very suspicious of President Bush & his lack of motivation in bringing justice to OSB. Why can't the most powerful, technologically advanced military machine in human history locate & capture him - or just terminate him with extreme prejudice?

He is a cave dweller, how difficult can it be, really?

Satellites with nano metre resolution, Echelon hooked into all servers, MI5, MI6,
GCHQ & NSA on permanent overtime...& still nothing.

It cannot all be down to the dubious commitment of our ally Pakistan - there has to be more to it, a secret we do not know. This world is not that big.

If President Bush actually had used the world good will he was awash with in late September 2001 sensibly, OSB would have been tried & fried by now.

As President Bush hands over power to the next President / Presidentess, there will have to be a stunning, air & water tight reason why OSB is still free or at least not with Allah.

As for Red Kens mate in the robes, well, personally, I & every other right minded Englishman want OSB tried in Central Park live on Pay Per View, interspersed with important messages from sponsors as we sup our Infidel Real Ale & watch the cheerleaders strut their stuff.

Seriously though, if anyone has any suggestions as to what has kept OSB out of reach I would welcome a different take on it.

All conspiracy theories welcome - no matter how ridiculous they are, they cannot be stranger than the truth, whatever it is.

"Osama should be tried by Muslim judges"--and I guess the Germans should have tried the Nazis at Nuremburg.

Osama is a true muslim, and not guilty under Islamic Law cos he`s on a jihad. Those muslims who support him are true muswlims including Dr Yusuf Al Qaradawi.

A bullet is cheaper than a trial.

Scaramouche: "Osama should be tried by Muslim judges"--and I guess the Germans should have tried the Nazis at Nuremburg."

Why not? As I understand it, the Allies had more trouble finding real live Nazis in Germany after WWII than I would finding a "moderate muslim" amnywhere on the face of Allah's green earth!

because of the atrocities being committed against the Palestinians.
And what "atrocities" would those be? Stopping them from exploding in the midst of a crowded shopping center or bus? Any "atrocity" is brought on by the insane hatred of Jews by the paleos themselves.

Would the American government wish Osama Bin Laden to be taken alive, either by its soldiers or by those of Pakistan?

There are pros and cons to what would necessarily ensue.

Cons: he would have to be put on trial (where?), and that trial might become a spectacle for "explaining" the Holy Law of Islam and offering up a list of Infidel misdeeds that would, for hundreds of millions of Muslims, be deeply affecting.
Pros: he would have to be put on trial, and that trial might become the occasion for the prosecution to go deeply into the doctrine of Jihad and showing, for an audience of billions, that the idea that Jihad is either a spiritual exercise, or is purely defensive in nature, is false on both counts, and the trial could be used as an imperfect but still well-publicized means to teach Infidels about Islam.

Cons: A long-running circus, with clever lawyers for Bin Laden, and all sorts of procedural rigmarole, could drag things out for a long time.

Pros: A long-running trial, with a brilliant and uncompromising set of prosecutors on the Hartley Shawcross model, and a judge, or a panel of judges, who would put one in mind of both Lord Deming, and Oliver Wendell Holmes, Jr., might help bring many Infidels to their senses.

"'Vell, sir, I never seen so many pros and cons before,' as the Englishman said when he first caught sight of Place Pigalle."

That's how Sam Weller might sum the whole thing up.

As Bohemond_1069 said, if Osama bin Laden and Zarqawi are taken alive, they should simply be finished off with headshots on the spot, with no trials, no fuss, no messing about.

There's another problem if Osama bin Laden and/or Zarqawi are taken alive. The number of terrorist atrocities is likely to increase, possibly with another 911, major kidnappings or some other atrocities, as Islamic terrorists try to secure their release, and also, they might try to storm the building where Osama bin Laden or Zarqawi are being held, or hijack the van or whatever means of transport is being used, to try to spring their release.

Yes, but if they're killed they become martyrs for their cause. Damned if we do, damned if we don't.

Dead or alive, they're martyrs or focal figures, so they might as well be dead.

A long trial on all the worldwide networks would have more beneifts than detriments. For one thing, the sight of uncle ossie defending all his great works with explicit references to the core books of the islamic faith could well shake loose large numbers of ignorant westerners and their leaders from the 'religion of peace' miasma.

But how likely is it? Not very. There seems little evidence that he's actually still breathing (although the promoters of 'marytrdom' it has to be said, display an incredible tenacity when clinging to life), and even if he is, and is captured, I hold out almost no hope of any of the authorities in the West to be able to hold a trial without completely ***ing it up.

IT is a mute point. bin Laden is probably already dead.
