Australia: Judge back silence on cleric deport

Interesting legal development in Australia. Of course it makes sense for national security reasons: there may be others involved, ongoing investigations, etc. But there will be civil rights protests without any doubt. From AAP, with thanks to Dale:

A LEADING Muslim cleric may never find out why he is being deported after a judge today ruled ASIO does not have to disclose why it considers him a threat to Australia's security.

Iranian-born Sheikh Mansour Leghaei, 43, took action in the Federal Court to avoid deportation after the Australian Security Intelligence Organisation assessed he was "directly or indirectly a risk to Australia's security".

Mr Leghaei, who has lived in Australia since 1994, says the Federal Government failed to accord him "procedural fairness" when deciding to deport him because he was not told the grounds on which ASIO made its assessment.

The Sydney father of four asserted he had a right to know the nature of the material which led to the adverse assessment so he could challenge it.

But ASIO claims that telling Mr Leghaei could endanger national security.

Federal Court Justice Rodney Madgwick last month dismissed Mr Leghaei's application to have the assessment declared void.

In his written reasons, which he handed down today, Justice Madgwick said he accepted that national security concerns took precedence over Mr Leghaei's right to know why he faces deportation.

"In my view ... the applicant was accorded procedural fairness to the extent that the interests of national security permitted," he wrote.

" ... it appears that it was not possible to put even a summary of the case against the applicant to him without compromising the interests of national security."...

Here is how a deportation must be done.

No allowing of grandstanding, no claiming of civil rights,

No allowing of a bully pulpit ala Saddam, ala Sami Al Aryan, all taquiyyah.

As the war heats up, this dude will be fortunate to escape a more serious remedy.

My best guess on this is that if there is a trial, the defence will have the right to see all the evidence against Leghaei, thus allowing for the exposure of other serious on going investigations in court hearings.

1) organize your mates to spread the truth about the Muslim threat. Show people who the enemy is. Get the word out through talk-shows, printed leaflets and the internet.

2) protest to the authorities for the lack of rule of law.

3) direct your anger to remove the politicians who let this happen.

4) Create a text message network so that a sign of trouble you can call hundreds of your mates for help.

5) Join or create a political organization that can vote in good civic leaders.

As someone who lived in New York, before the crime rate went down (pre-Gulliani) and who formed part of a neighborhood watch that, with police help chased the drug dealers out, it can be done!

We called our selves the Inwood 100 (a neighborhood in Manhattan) and published a manifesto to local politicians of what the citizens demanded. IN SPITE OF THREATS FROM DRUG DEALERS it worked. We were part of the grassroots movement that put Gulliani in power and changed the New York.

Why not the "Cronulla 1,000". One thousand citizens who put their name on a declaration to the authorities and the Muslims community demanding a change.

A LEADING Islamic cleric was discovered returning to Sydney with a 150-page notebook on tactics for warfare, intelligence and martyrdom, a court has been told. ASIO translated Mansour Leghaei's notebook, which focuses on "infiltration, deception tactics, martyrdom and the euphoria of fighting a jihad outside one's borders".

Details of the notebook are contained in documents lodged in a Federal Court case brought by Sheik Leghaei to stop his deportation. ASIO has twice assessed Sheik Leghaei, who runs an education centre and charity in suburban Sydney, as a risk to national security, leading to multiple visa cancellations.


Questioned about spying ASIO has interviewed the Iranian-born Shi'ite cleric at least three times since he arrived in Australia with his wife and children in 1994.... Peter Hanks QC argued that the court should quash ASIO's 2004 assessment against Sheik Leghaei or declare it void because of this lack of procedural fairness. One section of the notebook, which customs officers photocopied after discovering it in his luggage at Sydney airport in 1996, asks: "With whom should a holy war be fought?


"The enemies of Islam are to be categorised under three headings: 1, the infidels who do not accept the Koran as the Book of Heaven. 2, the oppressive and the unjust and whoever takes up arms against the Prophet. 3, heathens living in the Islamic countries who have broken the agreement to pay tribute to the Muslims."

This is the same procedure Canada uses where it's termed a "Security Certificate". A judge must grant one after viewing the evidence after which the accused is not permitted a full trial with access to all the evidence. This is to avoid comprimising intelligence sources. I believe the Supreme Court is or will be reviewing the use of certificates. While the accused can appeal, the government can hold them in detention indefinately pending an appeal. The certificates as far as I know have only been used in deportations and cannot be used against Canadian citizens.

You know, since this started I haven't heard a peep about the sexual harrassment and rape the Moslems were doing.

Apparently, Moslems threatening white women with violence is a-ok down under.

Not a bad article there otterfish. I was particularly interested in the account given by the Punchbowl Boys High School after he had suffered a breakdown:

Between 1995 and 1999, students armed with knives had threatened classmates, teachers were assaulted and gangs invaded classrooms. On one occasion, the principal had a gun held to his head by a Lebanese gang member who threatened to shoot him. One of his students was convicted of murdering a Korean schoolboy and three other students were jailed for their roles in some of Sydney's most notorious gang rapes.

This is only coming to a head now and Australian's are being defined as racist. I think tolerant rather than racist is much more appropriate.

Oh please, just get rid of this creep asap! It's gone on long enough, deport him already! We've been stuck with him for TEN years.

It's amazing how they invade countries. Show up and then refuse to leave, using and abusing the system, daring us to throw them out. He was rejected at least once for a Permanent Resident Visa, and has been on a bridging visa while using lawyers to demand we accept him. Meanwhile, he's plotting our demise.

Can we deport all of the CAIR leadership. I don't know about the rest of you, but I wouldn't CARE if they were to be deported.
