NEWTON -- Law enforcement and Newton Free Library officials were embroiled in a tense standoff last week when the city refused to let police and the FBI examine library computers without a warrant.Police rushed to the main library last Wednesday after it was determined that a terrorist threat to Brandeis University had been sent from a computer at the library.
But requests to examine any of its computers were rebuffed by library Director Kathy Glick-Weil and Mayor David Cohen on the grounds that they did not have a warrant.
While one law enforcement official said he was "totally disgusted" with the city’s attempt to hold up a time-sensitive investigation of a potential terrorist threat, Cohen is defending the library’s actions, calling it one of Newton’s "finest hours."
"We showed you can enforce the law...without jeopardizing the privacy of innocent citizens," Cohen said.

Newton is now on Osama's list of favorite vacation spots. Thank goodness we have librarians protecting our right to send terrorist threats by email. Someone reported seeing Harry Belafonte at the Newton library the same day. He must have been emailing his buddy Chavez in Venezuela.
Change the facts a bit. The threat has been nade not to Brandeis, but to the A. M. E. Episcopal Church, from the Aryan Brotherhood. From the same computer, in the same Newton Library. Are you quite sure that the holier-than-thou librarian, Elaine Glick-Weil, would still be on her high Dewey-Decimal horse, standing bravely at the bridge, protecting "our liberties" and let the A.M.E. Episcopal Church fend for itself?
Would the Mayor, David Cohen, still proclaim that in preventing the FBI from investigating such a threat, that this was his, or Newton's, or someone's "finest hour"?
The behavior of these people can only be explained by megalomania, tha they, and they alone, without deferring to the judgement of those whose full-time duty it is to protect us, can decide whether or not the threat is serious. Most likely it was not. But why are we to entrust Kathy Glick-Weil, and Mayor David Cohen, with making that decision for us?
After all, the police and the FBI haven't exactly been hotfooting it every day over to the library, just doing their damnedest to destroy our liberties, to undo the legacy of John Peter Zenger and the Magna Carta in one deadly blow for the Administration and its presumably gestapo dreams.
The only conceivable justication for this refusal to allow, as quickly as possible, study of the computer to try to figure out who sent the threat, would be the bland assumption, by the librarian, and her back-her-to-the-hilt mayor, that the threat could not possibly be taken seriously.
And that, one may be sure, was influenced by two things. The first was the target of the threat -- see paragraph one above. They would not have dared to behave that way had the target been, as I suggested in the hypothetical, the A.M.E. Episcopal Church, and the presumed sender a member of some Aryan Brotherhood. Try out the hypothetical on them - send a note to the Mayor, or to the Librarian, and ask them that "what if..." question. And then, when they reply, as they are now locked in to replying "We wouldn't have done anything differently" (but not meaning it) see how others now react, as they begin to think -- but, but, that church could have been blown up.
Second, ask yourself this: do you want a librarian and a mayor deciding when a threat is not serious, or its target not one they need be quite so solicitous of, or when they have decided that timing is not critical (meaning that the police should in leisurely fashion obtain a warrant, when the whole point of this part of the relevant legislation was to provide for the need for haste.
It doesn't matter that the threat may have been a hoax this time. There is something else involved. It is the attitudes, and the attitudinizing, of the librarian and the mayor, who think of themselves as heroic figures (my god, that "finest hour") but who are far, very far, from being so.
They were only doing what they see/hear from their great Ted Kennedy every day.
Most libraries have a sign-in-to-use system. The librarian could have just provided the user name for that particular computer and the police could have gone from there without taking the computer at all. Just shutting it down until the warrant was obtained. I'm sure they didn't offer that up either.

The real problem is that those who are "standing up for rights" have no negative consequences regardless of their actions. In this case, it appears to have been a hoax, and therefore they were "right" in "defending freedom". Had the building actually blown up before the computer could be searched, they would have been leading the charge blaming the FBI(et al) for being so slow.
Personally, based on this situation, I would have allowed them to look/take the computer without a warrant. It is entirely reasonable. Unfortunately, not all people in positions of leadership (Corporations, libraries, ect) are reasonable. Some decision makers make decisions based on personal agenda, personal feelings.
Just to throw this out there, so we don't give ourselves away, a little reminder from Ben Franklin (No, I don't think it applies here):

You'd think, as a public facility, the library would have terms of use that would take into account the possibility for abuse, and the library's own need to have its bases covered in a legal sense.
Workplace computers are subject to surveillance, as are computers in academia-- both the on-site computers and the system-wide email.
So why should a computer in a public, taxpayer-funded place be as private as in one's own bedroom?
If it's not your equipment, you should be prepared to play by someone else's terms of use... if they have any... which apparently this library doesn't.

How many students does the university have? Thousands of people being threatened sounds like terrorism. Should a person who makes a bomb threat get a degree from the people he threatened? This is really absurd. Do not the librarians, and does not the mayor of Newton realize that the computers are public property, bought by the taxpayers and owned by the city? The computers are theirs and not those of someone who walked in and used them.
If you allowed your neighbor to use your computer, you would not need to get a warrant to observe what your neighbor looked at on your own computer. Your neighbor has no right of provacy on your computer.
The police are city employees, as are the librarians. Does one branch of a city government need to get a warrant to look at another branches computers? If that is the case, then shouldn't the police department then be required to obtain a warrant to look at its own computers as well?

In regard to this incident, do you know how easy it is to get a warrant in this situation - and the fact that the Mayor was involved meant that by the time the Mayor got involved the warrant could have been had.
I also highly doubt that any information gathered would have been of a pressing nature. Its not like they were expecting to find the guy at the computer, they just wanted to find out where he lived and who he was probably. Which means if he was not a serial e-mailer for Osama - getting on a plane right after he hit send - then he was probably going to be found or not found at the location they found out from the Library. I just do not see the need NOT to get a warrant in this case.
But it really isn't about this case. After everything we have been through lately, especially with this administration in charge, how can anyone trust the authorities when they say we NEED to do this or we NEED to do that. Why are the rules that we have been living under FOR VERY GOOD REASON all of a sudden not any good? People have needed to get information on people for years in a timely manner and the warrant process is in place for a reason. It prevents all sorts of abuses of the very real police power of the state. And you know what, if the state is BUSH and CHENEY. I WANT THOSE PROTECTIONS THERE. Jesus Christ, do you know how many people were arrested for no good reason over the last 5 years. Do you know how many interrogations or wire taps were deemed justified in any way shape or form. You have to know that Bush salivated after 9/11 to carry out a personal agenda - very dubious in national urgency. AND PEOPLE DIE FOR IT.
And so too do police enforcement officials salivate at times like these because they get to do whatever they want without following the very rules that keep their buts SOMEWHAT HONEST AND ACCOUNTABLE.
And then they use cases like these to get people like you riled up about what they NEED to do their job. The only thing they need is a warrant, just like they always have.
JUST GET THE WARRANT AND STOP ARGUING WITH THE DILDO LIBRARIAN. Case closed.
But on a final note. You all know - or should - that all this crap about needing more powers because of 9/11 is a sham. WE HAD ALL THE NECESSARY INFORMATION!!! We knew who the peeople were taking flight classes. We knew what Osama was up to. We knew all the things we needed to know but did not act accordiningly. That is not blame - just fact. I do remember this though - and you probably don't. When Bush got into office he retreated into an isolationist shell - balming Clinton for being too involved abraod. No one talks about that any more do they?
But you guys just keep looking for terrorists in American libraries. lol
