The Council on American Islamic Relations' legal intimidation tactic, so finely honed over the last few years, has faltered yet again, hot on the heels of CAIR's loss to Anti-CAIR. RALEIGH, N.C. - A federal appeals court on Tuesday upheld the dismissal of an American Muslim civil rights group's defamation lawsuit against former U.S. Rep. Cass Ballenger, who linked the group to terrorists in a 2003 interview.The Council on American-Islamic Relations sued Ballenger for $2 million, saying the congressman's comments damaged its reputation and good name. The group has denied any links to terrorism.
In the October 2003 interview with The Charlotte Observer, Ballenger blamed the breakup of his 50-year marriage partly on the stress of living near CAIR's headquarters, which was so close to the U.S. Capitol that he and his wife worried "they could blow the place up."
He also called the CAIR "the fundraising arm for Hezbollah."
A three-judge appeals court panel in Washington upheld the March 2005 decision of a federal district court judge to dismiss the case.
U.S. District Judge Richard Leon agreed with Ballenger that the comments were made in his capacity as a federal employee and that the suit should be converted into one against the U.S. government.
Then, because the doctrine of sovereign immunity bars most suits against the federal government, Leon threw the case out.
Too bad the wont throw the Cair clowns out of the UNITED STATES of AMERICA.

Now is the time to step up the criticism of CAIR. They are weak - step on the neck or they will be at your throat with a summons!
There is no constitutional constraint put upon the free speech of United States federal legislators, or state legislators.
This must be so, because, in order to have a truly independent legislative branch --- not that we have one, but you know what I'm talking about here) --- you must have actual freedom of speech (i.e., not Sharia or MSM or Georgetown freedom of speech).
So, the nascent Moslem Maiden of the State Department, the stilleto-heeled Condi, must back off on her move to unilateraly constrain free speech, and file an actual lawsuit against the United States to demand that freedom of speech of Americans be curtailed in order to not offend any scowling Moslems, cuz they be so sensitive and all.
Doing this would be a no-brainer in Europe, a constitinon-less zone, but will be a much tougher project win the USA, what with having to queer the Constitution an all that mess(Cf., Associate Justice Bryan White. who has the most thigh-shuddering impressive degrees from Stanford and Harvard and Yale and he's so awesome, even Northwestern, and maybe even Duke too dunno).
I'm all for that. But, just to make sure that we're clear on this, may we put this through the prescribed U.S. process for amending the U.S. Constitution? Condi can stand before the Senate, cow-eyed, and address the cow-eyed Senators and they can work out a constitutional workaround in full public, you know, to subvert the Constitution an all that.

I'm glad he won. I feel really bad about the Reps divorce but I can understand why his wife was so worried. I wouldn't want to live near those savages.
In some respects it's a loss for CAIR, but how deep are their pockets? If they have backing from the Saudis, they can keep on launching these lawsuits. Whether they win or lose, people will still feel somewhat inhibited; some people will still wish to avoid the major hassle and disruption brought by a lawsuit. Threatened with a lawsuit, some people will just apologize or publish a retraction to avoid trouble.

A mass letter writing campaign should commence to all elected officials, calling for them to finally rid America's back of the nasty boil known as CAIR.
