BERLIN (Reuters) - A Moroccan man won a landmark legal victory on Tuesday when Germany's highest court set strict limits on the ability of police to trawl electronic databases at random in search of possible terrorists.The Constitutional Court said such data trawling, for example to identify foreign male Muslim students, was only lawful if there was a concrete threat to Germany or one of its regions, or a danger to human life or freedom.
"A general threat situation, of the kind that has existed continuously in regard to terrorist attacks since September 11, 2001, or external political tensions, are not sufficient," the court said.
"The pre-condition is, rather, the existence of further facts pointing to a concrete danger, such as the preparation or commission of terrorist attacks."
The case arose from a complaint brought by a Moroccan student after the September 11 attacks on the United States, when German police began scanning local authority and university databases to identify Muslim men aged 18 to 40 who were current or former students.
Men who met that description were then subjected to further police checks in an attempt to uncover more al Qaeda "sleepers" like the three Hamburg-based Arab students who led the suicide hijack attacks on America. None were actually found....
The German court ruling said general police trawling of electronic records exposed the people concerned to an increased risk of further investigation.
It added that if such measures became publicly known, they could "reinforce prejudices and stigmatise the affected social groups in the perception of the public".

Everyone wants civilians' blood before they go ahead and do something. A lot of innocent Germans must die before this judge takes back this ruling. Man, what a world I live in.

I have an idea....of course a person would have to have a lot of money. In large city newspapers, take out a whole page ad and have some of the koran, hadiths and suras printed, along with some of the silly things muslims do below it, how they treat their women and chldren, and how they worship a criminal and print the things he did. Nearly everyone reads newspapers, and have it on the second page or so and this way those without access to the internet can learn about this cult.
We are so used to hearing about terrorist alerts and their blowing each other up, that we have a tendency to overlook the articles. Until we get the grassroot population understanding where all the terrorism is coming from, they will just think it's extremists instead of their "religion".

this German judge should be careful for what he wished for, as he may get it in th end! seems they are not happy till they get in the thick of things these Germans. they will only wake up till the bombs go off or are surrouned by crazed muslims.
Some people have to learn the hard way that freedom is not free, that appears to be the case with this judge. The good news is a recent survey shows that average Germans know exactly who the enemy is.The "prejudice and stigma" about Muslims is the direct result of the actions of Muslims.
Germany and France make me despair on a regular basis. I question why we even care about defending such slaunchways nations from anything bad... From now on I'm going to focus solely on animals and the environment -- no more posts at JW. That should make several of us very happy, I think...

By the judge's own wording this data searching is already be legal, since there is a constant and ongoing "danger to... freedom" in Germany from sworn jihadists.

That court decision will open the door to more terrorist activity in Germany. It is a thoughtless and dangerous decision that will make it virtually impossible to take preventive action against Islamist groups that plan attacks against individuals, institutions, or the government itself. Of course, Germany's judiciary has for many years placed a crabbed and selective view of "Human Rights" ahead of public safety and generally understood legality. This can also be found in areas of criminal prosecution. Tremendous concern and deference is shown the defendant, but the actual victim of the offense is given short shrift.

Bear in mind what is considered Right Wing in Europe is Jihad watching in the U.S. While many will hail the censure of Stormfront, it is a small step (considering the demonstrated dhimmitude of Belgium) to extending that censorship to anything "Islamophobic". And I suspect that is all that is behind it. Stormfront is a U.S. Based website, outside of Belgium's authority, but as Stormfront elicits no sympathy and has a lot of opprobrium no voice will be raised, and I suspect it is being used as a red herring to deflect attention from the real target of censorship.. those who dare suggest Islam is not a religion of peace and tolerance.

And thus - as German muslims habitually answer any criticism by: "You just treat us as your grandparents treated the Jews" - let's for heavens' sake do nothing to offend them! But who forces us to listen to such an outragous infamy and to hold our tongue instead of teaching them a history lesson? NO ONE! And that's why I have explained the difference (which is obvious to every normal person) to Muslims about a million times... and about a million times they just failed to understand it or - more probably - just refused to listen.
In a big Muslim forums people have cheered about that legal victory today and asserted, that they Muslims are the ones, who maintain law and democracy in the country and the ones who are needed to protect all citizens from injust persecution.
Re the Fall of Europe. Some posters have pictured this as if it would happen across all Europe simoultaneously.
I'm thinking it may be necessary for the first country to fall to sharia ( at the moment leading contenders are Sweden, France and Holland -in that order) and the resultant chaos within that country ( museum burnings, public beheadings, stonings etc. ) may shake the rest of Europe into action against the tide of "Eurabia". But I think it will take the complete destruction of one country to cause this wake up. I would almost welcome it, tragic as it would be, to put an end to this creeping Islamization. Rather like amputating a limb to avoid death of the whole body.

We all know there are no Moslem extremists in Germany or in the UK, well perhaps not that many. Ok ok, so there are some. But no more than five million such persons in Germany can fit that description; so let's not exaggerate the threat here. But if we are nice to them, they will learn to love us! By golly, we need more dialogue between religions! We also need atheist and Islamic dialogue for better secular understanding and brotherly love. It will all work out so nicely. We can discuss all of the areas of commonality such as bowel movements and eating and drinking fluids - basic human experiences. Once we see each other for the brothers that we are, all will be better! And if we don't investigate them for suspected acts of terror, they will love us all the more!
Germans still have the puppy dog syndrome. We need the UK and France to show Germany it is ok to crack down on these Moslems. They fear being called NAZI racists. After decades of hearing that, the Germans have suffered a devastating blowback effect. It is time for them to make it clear they are still sorry for their former atrocities, but they can no longer be shackled by their past. In so doing, they can begin to fight back.
