NEW YORK - A judge declared a mistrial after a jury deadlocked Thursday on whether a San Diego student lied about his associations with a Sept. 11, 2001, hijacker in the days after the terrorist attacks.The jury in federal court in Manhattan could not decide whether Osama Awadallah, 25, lied to a grand jury investigating the attacks after an old phone number of his was found in a hijacker's car...
The case against Awadallah, a San Diego State College student, had faced a bumpy road even before the trial began three weeks ago.
Awadallah was detained as a material witness in the terrorism probe after FBI agents went to his San Diego apartment nine days after the attacks to ask him about his associations with Nawaf al-Hazmi, a hijacker on the plane that hit the Pentagon.
The government alleged that he admitted his associations with al-Hazmi but initially denied to a grand jury that he knew al-Hazmi's friend, Khalid al-Mihdhar, a second hijacker.
In 2002, Scheindlin tossed out two perjury charges against Awadallah, saying the government had used "duress or coercion" to get him to consent to FBI interviews and a lie detector test in the probe.
The charges were reinstated by the 2nd U.S. Circuit Court of Appeals, which said a jury could find that Awadallah was not forthcoming about what he knew about the hijackers.
The jury was repeatedly warned that Awadallah was not accused of participating in terrorism.
Berman had told jurors that his client met al-Hazmi at a San Diego gas station where both of them briefly worked and at a mosque...
He said Awadallah initially denied he had written the name of al-Mihdhar in a school exam book but realized his mistake and corrected it five days later at his next grand jury session.
"He just got it wrong and corrected it right away," Berman said of his client's testimony on Oct. 10 and Oct. 15, 2001.
Berman said prosecutors confronted Awadallah with a fuzzy fax rather than the actual exam booklet and that Awadallah wanted to be sure he was accurate.
Born in Caracas, Venezuela, and raised in Jordan, Awadallah moved to the United States in 1999 to begin college. His father and three brothers had moved to the United States years earlier.
Scheindlin said before the trial that if Awadallah was convicted, he could face deportation but little or no prison time

TEHRAN, Iran — Iran is producing fuel rods for nuclear reactors, state radio reported Thursday in the government's latest attempt to boost a nuclear program that world powers are trying to curb.
Power-control rods, or fuel rods, contain low-enriched uranium and are inserted into a nuclear reactor's core to make the reactor run.

The obligation of the state to protect citizens against mass murder is so overwhelming that a strong presumption of danger must exist against any non-citizen who 1) holds religious beliefs (the ideology motivating the hatred of the United States and its citizens) in common with enemies of the state and 2) has had contact with these enemies.
Deportation in these cases should be automatic.

This snippet brings up a question or line of questioning of which we may never learn the truth: those 19 Muslim youths, the ones who killed 3000 Americans, did they have meaningful friendships within the Muslim community, mosque structure? Are juries fully informed about the role of deception in Islam? Have taqiyya and kitman been discussed by the prosecutors in court? Has there been introduced into evidence the relevant passages from the Qur'an and Hadith that any Believer who attends mosque, who has given evidence of being a good and perfectly orthodox Muslim, would certainly be familiar with, and would, if he is (as he claims) to be a Believer, would -- well, believe. And if he so believes, there would be nothing surprising about his actiing as the defendant is charged with acting. No, what would be surprising would be a devout Muslim who did not act to promote Jihad, using whatever instruments came to hand.
If the criminal justice system, and therefore juries, are going to be the line of defense against those who do not wish us, our laws, our customs, our manners, our Constitution, our anything at all (save, of course, to exploit those laws to the fullest to bring into being quite a different kind of country and people -- which, even if the goal seems fantastic to us, is not fantastic to everyone) well, who would if they could would have Islam dominate, and Muslims rule (we would not have to disappear, but we would have to acknowledge the dominance of Muslims and Islam, as non-Muslims over 1350 years have been disciplined, through the dhimmi system, into doing, everywhere that Islam conquered) -- then at the very least the doctrines of Islam need to be taught to all those who serve on such juries. Not the doctrines as offered up selectively by CAIR, not the bowdlerized comical deceitful "Approaching the Qur'an" of Michael Sells (who, if he wants to live with himself, ought to declare a public mea maxima culpa and take that dangerously misleading book off the market - but is he capable of such? Could he do such a thing?), not by lean, mean, jogging John Esposito, not by the pitiful Karen Armstrong, but by the greatest Western scholars of Islam, who lived and published before the last half-century of self-censorship and apologetics descended (the scholars whose works make up the contents of "The Legacy of Jihad"), and by such modern writers as Bat Ye'or, and Robert Spencer's works intended not for scholars, but for the mass audience of Infidels who have sensed the disconnect between what they see before them, and what they are constantly assured Islam must be, and have decided to find out for themselves.
If such an education is not going to be given by the Prosecution, if judges likely to hear such cases do not inform themselves, then justice will miscarry. And miscarry. And miscarry. As it has been recently -- just look around.

Once again, the civilian courts are treating this as a crime. Osama Awadallah was involved with an act of war. He should be in front of a military tribunal! Not a criminal judge. Deadlocks such as this almost never accur in the military judical system. There would be a verdict. Either innocense or guilt. Terrorists are war criminals. Why do you think it takes the military to handle terrorists domestic and abroad?

We need help here in San Diego! We cant secure our borders and illegals from Mexico to the mid-east are draining our social services!
