The system allowed a suspect to be held indefinitely or deported on the basis of evidence presented in secret.
The case was brought by three men who deny accusations of links to al-Qaeda.
'Fair process'
The Supreme Court has given parliament one year to rewrite the section of the Immigration and Refugee Protection Act - under which the certificates are issued - to comply with the constitution.
"Before the state can detain people for significant periods of time, it must accord them a fair judicial process," wrote Chief Justice Beverley McLachlin on behalf of all nine judges.

As reported front page in the Toronto Star, they termed it a "begining of a return to sanity for Canada" or something like that. One must conclude that Canadian law has been insane for nearly 30 years. That same paper refused to even name the Jihadists who hatched the plan to blow up the Canadian Parliment as Muslims.
A media in denial, a government handcuffed by judges so that it can no longer deport a foreigner on well-founded suspicion of terrorism, and keep secret evidence which will likely be a matter of national security?

I am from Canada, migrated here nearly 12 years ago and I am from India , a Hindu. Despite being from a majority religion in India,I used to feel very insecure in India because of the policy of the govt to give in to some unrealistic demands to the Islamic population.
In Bombay(now Mumbai),it was noticed that about half a million bangladeshis muslims had migrated illegally in search of better work and life and built slums in a place called Dharavi. This place was the hotbed of crime. Everyone knew most of these people are illegal and not Indians.
We tried to bring this to the notice of the local politician that land/electricity/water was being gobbled up by these non tax paying illegal immigrants and we the legal taxpayers were loosing out.The progress of the city was hampered because of this. But the politician was actually elected because of these illegals ,because somehow they had managed to get the Election ID cards and they knew this politician granted them immunity for their illegality.In other words the illegals were the vote bank of the politician (A muslim himself)and he wanted more of them there rather than them gone out.
We were branded as non-secular , hindu fanatics. The truth was we never brought religion into the matter. It was just about our tax money being used by illegal immigrants . We never even uttered the word hindu or muslim in the whole issue. But they painted it as if we had hindu-muslim agenda on our mind. We were harrased by this politician and the police too.
Eventually I migrated to Canada , because I saw a bleak future of the country because of this demographic invasion of my country by the muslims and more importantly our politicians turning a blind eye to the issue just for political gains,not understanding the fact that it was not just about politics but suddenly it was jihad against infidels. On the contrary they were promised employment because they fell in the below poverty line category.What the politicians do not understand is give a muslim an inch and he will take a mile as his birthright and kill for it if required.
I am sorry to say 12 years later ,I suddenly have the same feeling of fear I had back then . Canada is going the same route and it wont be long before, Canada unknowingly submits itself to these Islamic people by giving one concession after other under the name of multiculturalism and tolerance.
Last but not the least ,I remember the words of my old friend Mr John Ziegler ,who recently died in a heart attack. He had predicted this demographic invasion from Islam long back but we used to not take him seriously. He used to point out that Westerners/Hindus do not give birth to many children unless they are sure they can take care of them financially. But he pointed out that Muslims have children,even if they are bankrupt because all they cared was increase in numbers ,not caring whether they could afford to give the newborn a good life or not.
We used to crack jokes at this prediction of his.
Suddenly the words of Mr John seem so prophetic and true and his vision so precise.

Rajesh_singh, it seems that politicians are the same world wide. they will do everything to get the vote and get elected, and if that means selling out your soul and your neighbours's soul that is fine with them.
Canada and many other Western nations have improved with immigation over the years, but the problem with muslims as you say, they do not assimilate, make demands and give nothing in return. l try to educate some of my so called educated brothers and sisters, and all they say is that l am a racists. Even when l give them information of the problems in other countries such as India, Thailand, Dafur, etc. islam is the common thread, the cause of poverty, class warfare, killings, you name, it brings down your property values. so Rajesh keep on telling Canadians your story!

I tried telling my story intially to few people in Canada. But result was as similar to as it was in India,only the word racist was probably added to it.
Instead of understanding that it was not religion I was concerned about but my hard earned tax money,of which benifit went to people who were not even my countrymen. But to make it look like I was the villian In India i was brandished as hindu fanatic.
And the truth of the fact is I hardly ever visit a temple or have read the hindu holy book. Despite tihs I was called A Fanatic .I am not at at all into god and religion. It was just tax money and land prices and growing crime rate I was worried about
In Canada ,after I told my story to few people,I got the impression they frowned at me and thought I was non secular and intolerant. I did not want to create this untruthful impression about myself in new country. I wanted to be a peaceful law abiding citizen.So very soon I learned to keep quiet and ignore .
Besides the Islamic demographic problem 10-12 years back was not so bad as it seems to be today
But lately all the incidents , especially the planned NEWmarket,Ontario mosque incident reminds me of the old days and I just felt at least I could give my experience here in jihadwatch, without the risk of being branded a racist hindu fanatic.
What's happining in the United States, Canada and others, kinda reminds me of the old movie RED DAWN a little. Once old moe gets a foothold in our goverment he will slowley eroude are laws to better suit him. And of course the politicans are all to happy to help. I'm not sure I'd put Bev MacLachlin on a par with Ruth Bader Ginsberg. MacLachlin, having been one of the learned judges who bought the "artistic merit" argument in defence of the notorious Vancouver pedoph!le Robin Sharpe's right to publish poetry extolling the virtues of peder@sty, is a perfect example of the law being an @ss.
It's very interesting to note that this law went onto the statute books when the father of the Charter of Rights was still prime minister. For all of his liberal mindedness, Pierre Trudeau had it straight about public safety being prime and recognizing those who would resort to violence to impose their beliefs on others. What's truly depressing about this decision is the unanimity.
This is a victory for the Western values of impartiality and equality. If you object to partiality and inequality in Islam, then you should object to it in our laws as well. You can't have it both ways!
