Apr. 6 - KGO - A Lodi man convicted on terrorism charges heads back to court today, hoping to get a new trial because of jury misconduct charges.A jury found Hamid Hayat guilty last year of undergoing terrorist training in Pakistan.
Hayat has filed a motion that accuses the jury foreman had a bias against people accused of terrorist activities and hid his bias with dishonest answers while jurors were chosen.
Hayat faces up to 39 years in prison.

How gauche of us Westerners to consider violent jihad as something bad. It just goes to show how culturally blinkered we are. It's forward thinkers such as Hamid Hayat that have made places like Gaza and Iraq the garden spots they are today.

what these islamist fail to realize is that in US/British,ect you are assumed innocent until proven quilty. muslim mindset is already prejudiced, in that you are guilty if you are a non muslims, ie Jews,Christinas, Hindu.. it seems muslims have no grasp of Western values..
Presumably, this court challenge will be rejected. But it does highlight the fact that the American jury system is broken on many levels, the most noticable of which is the unanimous-jury vote. One recalitrant jurist with an agenda can thwart the dispensation of justice.
As the Muslim population in America continues to grow, it is increasingly likely that Muslim citizens will be called up for jury duty in terrorism cases. It would be unconstitutional to disqualify them from such cases just because of their religion. Defense attornies can be expected to fight hard to have Muslims included on the juries hearing their cases.
When we reach the point where convictions of Muslim terrorists becomes increasingly difficult regardless of the evidence, that's when it will be open-season on America.
THE ANSWER?
We need to either create special tribunals to hear terrorism cases....or failing that, dispense with the unanimous-jury system. We need a 'super-majority' system where only 8 or 9 votes out of 12 are needed for a conviction or acquittal.

Even before a final jury is selected to hear the case,possible selective jury candidates will hear the charges filed against the defendent. The defense was given the right to screen all the potential jurists until they settle for 12 plus 2 alternates. Such an appeal would have to be absurd or almost frivolous to overturn on its face. Once the trial begans the prosecution will layout its case and its evidence against the defendent. The defense has a right of discovery to all evidence submitted. When a jury has heard all the evidence than it will have developed its biass based on that evidence as to the guilt or non-guilt, another words there is no way to get away from a biass especially since all of us can or have been effected by the acts of terrorism IE 9-11 Etc.--- Do you know anybody in America let alone the entire planet who is not aware of 9-11 and who the 19 perpetrators were?

This is the kind of thinking one often sees with sociopaths. I once worked for a major insurance Co. and suspected dummy claims and embezzlement as I looked over data. The guy who was embezzling actually claimed to the FBI and the Co. that it wasn't him on a bank camera cashing Co. checks. (This guy was at least 400 lbs and looked like the ED-209 from the movie Robocop. He was distinctly recognizable.)
It is amazing how people with this mind set will lie and believe their own lies. Because most folks live in reality, the initial response to such lies is to doubt oneself for a brief moment. The denial of reality by such people is so outrageous that a normal mind goes into temporary-momentary cold-shutdown. The normal mind cannot comprehend an outrageous denial of material reality. But never forget how really dangerous such people are and how important it is to get criminal minds like this Lodi liar off the street.

Of course it is quite odd that this chap, who was born in nearby Stockton, doesn't have a command of English. Well, not really. Apparently in the Lodi Pakistani community, lots of American born children can't speak English that well, and when reporters from the Oakland Tribune did a story on the Pakistani community, even the American born kids needed translators (Urdu to English). Lodi is just like Manchester or Bradford in England in that respect. Or to use an American comparison, Dearborn.

If you are, then you are selected as a jury member.
