Abdullah Al-Muhajir (José Padilla) guilty on terror charges

MIAMI (AP) - Jose Padilla was convicted of federal terrorism support charges Thursday after being held for 3 1/2 years as an enemy combatant in a case that came to symbolize the Bush administration's zeal to stop homegrown terror.

The Chicago native was once accused of being part of an al-Qaida plot to detonate a radioactive "dirty bomb" in the U.S., but those allegations were not part of his trial with two co-defendants.

Padilla, Adham Amin Hassoun and Kifah Wael Jayyousi face life in prison because they were convicted of conspiracy to murder, kidnap and maim people overseas. All three were also convicted of two terrorism material support counts that carry potential 15-year sentences each.

U.S. District Judge Marcia Cooke set a Dec. 5 sentencing date for all three defendants.

The three were accused of being part of a North American support cell that provided supplies, money and recruits to groups of Islamic extremists. The defense contended they were just trying to help persecuted Muslims in war zones with relief and humanitarian aid.

Padilla had lived in South Florida in the 1990s and was supposedly recruited by Hassoun at a Broward County mosque to become a mujahedeen fighter.

The key piece of physical evidence was a five-page form Padilla supposedly filled out in July 2000 to attend an al-Qaida training camp in Afghanistan, which would link the other two defendants as well to Osama bin Laden's terrorist organization.

The form, recovered by the CIA in 2001 in Afghanistan, contains seven of Padilla's fingerprints and several other personal identifiers, such as his birthdate and abilities to speak Spanish, English and Arabic.

Padilla's lawyers insisted the form was far from conclusive and denied that he was a "star recruit," as prosecutors claimed, of the support cell intending to become a terrorist. Padilla's attorneys said he traveled to Egypt in September 1998 to learn Islam more deeply and become fluent in Arabic.

To read the article you would think this was more about the Bush administration violating his constitutional rights than about the fact that he's a jihadist piece of crap.

Two thoughts:

How come Al-Qaeda, et al., seem able to recruit non-Arab losers who seem to have a gift for learning Arabic, but our own intel agencies are desperate for Arabic speakers...and

the federal prison system is too good for his ilk, although I never understood why Moussaoui wasn't treated as an enemy combatant. His trial in the federal civilian court was a travesty, but at least he was convicted.

"Iran summons Argentines over probe into bombing of Jewish community center"

"An Iranian court has summoned five former Argentine government officials to journey to Iran and answer charges involving their roles in an investigation that implicated Iran in the 1994 bombing of a Jewish community center in Argentina's capital.

Iran is charging them with working against the country's security, the state television reported Thursday. Eighty-five people were killed and 200 were wounded in the Buenos Aires bombing.

The Tehran court summoned former federal Judge Juan Jose Galeano, Interior Minister Carlos Corach, chief prosecutors Eamon Mullen and Jose Barbaccia, and Ruben Beraja, a banker and former head of the Delegation of Argentine Jewish Associations.

The report said the five officials had been informed of the summons via diplomatic channels and if they did not travel to Iran and appear in court in the coming days, international arrest warrants would be issued against them.

More Argentines could be summoned in the future, the report added.

Argentina's foreign ministry rejected Tehran's request, saying it seemed to be a political reprisal to Argentine efforts to find and detain Iranians involved in the community center bombing."

Two prominent Muslim American organizations took steps yesterday to reverse what they called a Justice Department effort to smear the entire Muslim community by naming some of its largest organizations as unindicted co-conspirators in a Texas terrorism trial.

The National Association of Muslim Lawyers, which is not named, sent a letter to Attorney General Alberto R. Gonzales objecting to the list, which it said breached the department’s own guidelines against releasing the names of unindicted co-conspirators and did not serve any clear law enforcement purpose.

The letter, also signed by the National Association of Criminal Defense Attorneys, said the “overreaching list” of more than 300 organizations and individuals would further cripple charitable donations to Muslim organizations and could ratchet up the discrimination faced by American Muslims since the Sept. 11 attacks.

In addition, the Council on American-Islamic Relations, or CAIR, which is on the list, announced that it would file a brief today asking Judge A. Joe Fish of the United States District Court for the Northern District of Texas to remove its name and all others from the list.

The brief, a copy of which was released yesterday, says the list furthers a pattern of the “demonization of all things Muslim” that has unrolled in the United States since 2001.

“Most people don’t understand what an unindicted co-conspirator is,” said Parvez Ahmed, CAIR’s board chairman, adding that the release of the list prompted death threats and hate mail against the council. “They think that being related to a terrorism case means we are terrorists.”

The unindicted co-conspirators were named in the case against the Holy Land Foundation for Relief and Development, which opened July 16. The charity and five of its officers are accused of providing material support for terrorism by funneling millions of charitable dollars to the Palestinian organization Hamas. The federal government ordered the foundation shuttered in December 2001.

Technically, the prosecution can introduce statements made by any individual or organization named as an unindicted co-conspirator without such statements being dismissed as hearsay. Those on the list have not been charged with anything, but they are concerned that the label of unindicted co-conspirator will forever taint them, particularly if the Holy Land group is convicted, and that they will have no legal recourse.

On July 13, Judge Fish barred lawyers from discussing the case with reporters. A Justice Department spokesman, Bryan Sierra, said the order prevented him from commenting about the list, as did the spokeswoman for the United States attorney in Dallas, Kathy Colvin. Before the judge’s order, however, the prosecution, while acknowledging that the list was unusually long, maintained that the names of the organizations would have come up in the trial anyway. Defense lawyers accused the Justice Department of using the list to create the aura of a vast conspiracy where none existed.

Both the National Association of Muslim Lawyers and CAIR said they were working in uncharted legal territory, as they had been unable to find firm legal precedents about how an unindicted co-conspirator could be removed from such a list.

Many organizations named are foreign, but among the most notable in the United States are the Islamic Society of North America, the largest Muslim umbrella organization, and the North American Islamic Trust. The Islamic Society said in a statement that it, too, was seeking a legal recourse, while the North American Islamic Trust did not respond to telephone calls seeking comment.

The consept of Padilla actually being guilty seems to be beyond their relm of conceivability.

It is really hard to figure out what they expected the Goverment to do with someone like him. Put him in a Luxury Suite in the LUXOR Resort in Vegas???

Why does it take 4 months to get to sentencing? If the judge needs a litle time to think about it, take a long lunch. I think the sentencing guidelines do most of the work, the judge just needs to follow along.


Do I understand this correctly , CAIR wants to Sue several John-Doe's and smear their names while making them targets for the Jihadists to behead , yet when CAIR is tied to funding Terrorism they say that it's unfair to smear a group of people for "Alleged" actions.

The report on NPR this morning was nauseating, worse than the article above. They emphasized his being held 3 years without trial. We heard from his poor mother who says she's going to appeal because he never did anything wrong. We heard from his imam who taught him Arabic, who's shocked because he's such a nice boy. They used words like allege and claim to describe the government's point of view, even though he's now been declared guilty, which means in the eyes of the law, he DID do those things. I know he's innocent until proven guilty, but now he's been proven guilty, so stop acting like he's still innocent, ok NPR? If you didn't know any better, you would come away from the report thinking a miscarriage of justice had been done. Where's my puke bag?

Why did the DoJ and the media refuse to accord the convicted the honor of his name, Abdullah Al-Muhajir. Had he simply failed to legally change it on his passport etc.? I'd whisper "conspiracy" if I thought there was any truth to it.
