CAMDEN, New Jersey (Reuters) - A U.S. federal judge on Thursday denied bail to five Muslim men accused of plotting an armed attack on New Jersey's Fort Dix army base.
Judge Robert Kugler rejected claims by lawyers for the men that they had been denied proper access to information that may be used against them at trial. The lawyers argued the men needed to be released on bail in order to get proper access.
The five men pleaded not guilty in June to charges of plotting to kill U.S. soldiers at the Fort Dix military base, located about 40 miles east of Philadelphia, and to possessing illegal weapons.
They are Yugoslav-born ethnic Albanian brothers Eljvir, Dritan and Shain Duka, all illegal immigrants who ran a roofing busineses in Cherry Hill, New Jersey; Mohamad Shnewer, a Jordanian-born taxi driver from Philadelphia; and Serdar Tatar, a Turkish-born convenience store clerk.

The judge, who previously denied bail to the men shortly after their May 2007 arrest, rejected a request by prosecutors to make public a video that they say was used by Shnewer in the detention center to attract recruits to jihad.
Kugler said the "inflammatory" video includes "exhortations" by a figure that looks like Osama bin Laden, and images of dead and maimed people who "could be Muslims."
Public access to the disc would risk prejudicing a jury whose likely members have already been exposed to extensive media coverage of the charges against the men, he said.
The trial, already postponed twice, is currently scheduled to begin on March 24.

Muslim inmates conducting Da'wa (that is, a great many of those inmates) should be segregated in Muslim-only wards. On what grounds? On the grounds of national security.
But how is this argument to be made? Not by those who simply know little or nothing of Islam. The ground has to be properly prepared -- the mental ground of the prosecutors, and of the judges who will be decidiing such cases. If the argument is properly presented (and this requires prosecutors well-versed in the texts and tenets of Islam, and the Western scholarship that will support them)nds, any challenge brought under the equal protection clause should be met with the claim, not hard to prove, that national security -- keeping people from conducting work to multiply the number of "Jihadists" permanently hostile to this country's political and legal institutions, and prepared to act on that hostility -- is a state interest sufficiently compelling to withstand any such Fifth-and-Fourteenth-Amendment challenge.
It can and should be done. The in-prison Da'wa proceeds apace,and it is not enough to suggest that missionaries of other faiths should go and do likewise. The systematic and well-financed (with or without money from foreign, especially Saudi, sources) campaigns of Da'wa, targetting prisoners (especially black prisoners) have to be not merely monitored, but curtailed. If there are Muslim-only cell-blocks or, better, prisons, especially for those arrested for these kind of offenses, that will make the conduct of Da'wa impossible.
It will be a case of preaching to the reverted.

Make it Muslim-only prisons, regardless of the offense. Wards can't be cordoned off reliably.
The big problem: can Muslims be denied employment as guards at this or any other prison on the same national security grounds? Otherwise they pose a security risk, in that they can serve as interlocutors, carrying messages out of and into the prison. The same goes for the imam.
National security and civil rights bump up against one another. Civil rights will win because otherwise we are judging people for who they are and not for what they have done.

....there are empty prisons in the US, such as Alcatraz that could be readily refurbished and filled with Muslims only....
My brother-in-law is sitting in Fort Dix right now. He'll be going to Iraq eventually as an MP and will most likely be guarding a prison full of 'detainees' in central Iraq for a year or more.
I had a visit with him while he was home on leave and gave him the P.I.G. and asked him to read it so that he'll understand some background and so he'll get a perspective to balance out the official explanation of Why, How, Who and What. He said he would - he'd have plenty of time on the way over to Kuwait. I hope he passes it on. I think he will.
