Inherent in that statement is a challenge to prosecutors to examine the Qur'an, ahadith and Sira themselves and confront the passages that call for open-ended warfare to effect the conversion, subjugation, or death of unbelievers. It would be great if such an examination of Islamic texts and teachings were actually to take place, but Benbrika surely knows that officials are much more likely to be confounded by the politically correct article of faith that Islam is peaceful (or at least, that all religions are equally prone to violence), and the resulting inability to move beyond apologists' insistence that armed jihad and the imperative to establish sharia law only exist in the minds of misunderstanders and Islamophobes.

The leader of an alleged Melbourne terror cell admitted to his supporters he had been "evasive" when asked for his views on jihad during a television interview, the Victorian Supreme Court has heard.
Abdul Nacer Benbrika, 48, a self-taught religious instructor, told an ABC television interviewer he did not encourage followers to take part in so-called holy wars (jihads) overseas or in Australia.
He said he merely passed on the teachings of the Koran.
"When I teach, I teach what Allah and his prophets said," Benbrika told the interviewer.
"I'm not telling people to go .... the student understands.
"I tell him what Allah said and he can then decide."
Prosecutor Richard Maidment, SC, said the statements Benbrika made in the interview were at odds with other evidence already presented to the jury.
"Benbrika is being as evasive and shifty as he can possibly be," Mr Maidment told the jury.
The interviewer also asked Benbrika if he had ever planned to carry out an attack in Australia.
Benbrika replied that it was against his religion to kill innocent people.
"I would have done it a long time ago," Benbrika said.
But Mr Maidment pointed out that in secretly-recorded conversations already in evidence, Benbrika told his followers in Melbourne that killing innocent Australians was acceptable.
But did he call them innocent himself? That's an important distinction for prosecutors to grasp.
"He is completely deceptive," Mr Maidment said.
After the ABC interview, according to the secretly-recorded conversations between Benbrika and his followers, the cleric admitted he had been misleading.
"I was being evasive," Benbrika said on the tape.
"I told him (the interviewer) this was what Allah said, this is what the Prophet said."
Benbrika and his 11 co-accused in Australia's largest terrorism trial have pleaded not guilty to charges including being members of a terrorist organisation.
The trial before Justice Bernard Bongiorno is continuing.

This is unlikely to happen for two reasons.
First, making such an examination of Islamic texts and teachings, followed by the sorts of observations and conclusions which Robert Spencer has reached, would cause such an official to meet with rejection and condemnation by one's superiors. So long as the head of government embraces the article of faith that Islam is the religion of peace, it takes a lot of courage to buck the system.
Second, undertaking a critical examination of Islam will lead to peer rejection, and condemnation for Islamophobia and bigotry.
Third, pointing out faults with Islam will potentially subject the critic to violence by Muslims. (Not all Muslims will react violently, but it only takes a small percentage of Muslims who are willing to undertake extreme violence to cow individuals into silence.)
Fourth, doing or saying the wrong thing in certain contexts in modern Western society and under our modern legal system may expose the critic to the risk of litigation under anti-discrimination laws (or anti-hate-speech laws.)
One remedy is that we need someone in a position of leadership (such as the leaders of a few Western nations) to use their bully pulpit in an effort to openly examine and discuss the problems with these religious texts, rather than to sugarcoat and whitewash them. We need a spokesperson on Islam like Tom Tancredo was for illegal immigration, a leader who will not shut up until everyone has heard him and a majority understand and agree.
A second remedy is that we need to change our system of laws so that Muslims can no longer hide behind their religious status while conducting various types of jihad aimed at our destruction.
Benbrika himself gave the answer about a week and a half ago. He said that he had been interviewed by a journalist about Islam and he(Benbrika) said that it was not permitted to attck innocents.
In court, Benbrika commented on the stupidity of the journalist who did not ask what he meant by "innocents". (Can't recall the date, but I think that particular article was in the HeraldSun).
People just don't ask the obvious questions becasue they think that everybody shares the same mindset.

Tancredo spoke up against Islamic terrorists as well as against illegal immigration. For starters, the people listened but the lawmakers didn't. They all but ignored him. The press demonized him as a racist. Now he's leaving the House.
Tom Tancredo has all but vanished from the scene. He made a great show of saying that other candidates had adopted his stance and so he could quit the presidential race. Those candidates have also quit. Look at who's left. Barring a sea change in the electorate, the next president of the United States has already gone on the record as favoring amnesty.
I supported Tancredo but he didn't accomplish all that much. Wherever he spoke, it was to the choir. In the House, every seat might as well have been empty. His message never got through to most members of Congress, where the power lies. It will be the same with Islam, whoever emerges as a spokesperson. The audience that needs to be persuaded resides in the Capitol. If 9/11 didn't wake them up, what will?
