I'm more interested in discovery requests and responses.
So does is this guy really alleging that his failure to get to the airport early enough to allow for the extra security that we all endure, is somehow USAirs fault?
Maybe if he and his religious cohorts would quit blowing up airplanes and flying them into buildings, we could all get through airport security a little faster.
When I was a kid and wanting things my dad would ask me, how does it feel to want? And that question should be posed to them. And then they should be thanked and dismissed. No reason to be rude, but if one must - then rude would be very satisfying too because I know how persistent muslims can be when they want something - like gnats that just won't go away.
a kick in the ar-e and a ticket to some Islamic cesspool is what they deserve.
Of course that won't happen. But "comes the revolution (but that ever come will it?) more imams than the flying ones and their "congregations" will have sole imprints on their rear-ends as they are sent flying to the cesspools of the umma.
"It seemed pretty much like boiler-plate until it got to the alleged damages. It started with Ahmed Shqeirat:
Ahmed Shqeirat: Plaintiff Shqeirat has suffered intangible losses including pain, suffering, loss of liberty, loss of enjoyment of life, emotional distress, humiliation, and the like. Because the damages are intangible, it is difficult to itemize the dollar amount of each element of the alleged damages. Plaintiff estimates the dollar amount of his damages to be well in excess of $100,000.
[So that's well in excess $100,000 in intangible damages. We haven't gotten to the tangible damages yet.]
Mr. Shqeirat's tangible damages include expenses incurred as a result of the inconvenience of traveling on airlines other than US Airways.
[It should be noted that Mr. Shqeirat, or any of the other imams, are permitted to fly on US Airways, so the inconvenience is purely manufactured.]
Additionally, Plaintiff has incurred expenses in time and money caused by increased scrutiny by law enforcement during air travel.
[I would be interested in knowing exactly which law enforcement agencies have been regarding Ahmed Shqeirat with increased scrutiny, so that I could commend them.]
As a result of US Airways and MAC [Metropolitan Airports Commission]'s conduct on November 20-21 [2006] and the following defamatory statements, Mr. Shqeirat's reputation has been badly damaged. Mr. Shqeirat's freedom to conduct meaningful business opportunities has been limited. Mr. Shqeirat is a businessman in addition to being a religious leader. Following the november 20-21 incidents, his transactions have been scrutinized delayed and his merchandise has been withheld.
[There has been no mention in the media of Ahmed Shqeirat being a businessman. Now I'm curious to know what his business and merchandise are.]
This has resulted in loss of business opportunities, profits and potential clients. These tangible damages will be determined at trial.
The damage claims for each of the other imams included intangible damages of well in excess of $100,000, and tangible damages to be determined at trial. The only other thing that caught my attention was something in Omar Shahin's damage claim...
Mr. Shahin's time and money opportunity has been diminished as a result of not being able to travel freely and on time. His tickets are always marked (XXX). He has been searched each time he flies. This has limited his ability to attend seminars and events on time.
I have a number of questions about this. Is it just one airline that has marked Shahin's ticket (XXX), or is it every airline on which Shahin has flown? Has Shahin flown on more than one airline? I believe so. Is the TSA responsible for the ticket markings and the searches? Is Shahin searched at the security checkpoint, or somewhere else? This is interesting, because I have complained loudly and bitterly about the TSA's lack of action regarding the Flying Imams. Perhaps the TSA did do something after all."
How about 100,000 kicks in the butt each, for being lying, flying Imams. The airline staff and passengers who had to deal with these swine should be first in line.
Plaintiff Shqeirat has suffered intangible losses including pain, suffering, loss of liberty, loss of enjoyment of life, emotional distress, humiliation, and the like. Because the damages are intangible, it is difficult to itemize the dollar amount of each element of the alleged damages. I wonder how much of that 100 grand. If this Muslim opportunists manages to secure the money will go to terrorist organizations
This is pre-trial machinations. I have been both plaintiff and defendant. Their claims have to be justified. For example, if one claims emotional distress, show me a shrink's bill. Costs associated with extra police scruitiny, show me some recepts for lawyers or prove that you have lost wages or other increased costs. Pain, suffering, show me a doctor's bill.
I was told that when lawsuit values are made in the brief, they are inflated six to ten times what they actually expect to get.
The article does not mention punitive damages, so they will get very little.
pelayo,
They might be pretrial moves but that doesn't mean much. Airlines have to expend money fighting the lawsuit and paying court costs. Once the costs reach a certain level, the airlines will probably offer a settlement to make the case go away. It would probably be sealed in order to discourage copycats. Whether or not the imams see a dime, the lawyers on both sides will be remunerated. The judge should have laughed the case out of court the first day. He/she didn't.
Disbar the plaintiffs' lawyers and deport them to Islamdom. It's where they belong.
Oh, anything you want. Just sign this paper first. What, oh nothing it's part of the process. And here, and here. Thank You. Here are your tickets. What you don't understand! The money will be deposited in a Nigerian bank account. When you land in (pick a country were it's 8-10 hours behind us) you can contact the bank. I believe they will need you to sign a check for $1000 to get the process rolling for you to receive your $100,000.
I trust that once they are bound for Islamdom, their names will be put permanently on the "no entry into the US" list (or whatever it's called). I hope we could do this quietly, with no fuss or bother.
This kind of legal abuse is just the beginning with B. Hussein Obama.
There could be, if he were elected, a direct line into the White House from the Nation of Islam - Farrakon and the Black supremicists also have his ear through his activist church which he chose to join in the first place.
Would he rule against his bretherin ? He has worn their uniform amd thus identified himself.
About Obama, isn't it interesting his choice of word in his referring to the Clintons' suggestion that he was a Muslim, calling it 'scurrilous'. So being a Muslim is scurrilous according to Obama? I know that's not what he meant, but that doesn't matter, because he's taking it for granted that associating him with Islam is an attack. That's the implication here, but of course, that thought is perished soon as it forms.
What about the John Doe's?
I’m sure they suffered” intangible losses including pain, suffering, and loss of liberty, loss of enjoyment of life, emotional distress, humiliation, and the like”
.
What about the other people on the flight who were delayed.
The “flying Imams” called the negative attention on themselves by their actions.
I think the Imams should have to pay up.
This seems to be the M O;
Make a spectacle of yourself and then cry because you get the negative attention you deserved.
Look at what is going on right now in Israel.
Palestinians have been shooting rockets in to Sderot, trying to destroy civilian lives.
Some 4000 rockets have fallen on Sderot since Israel’s disengagement from Gaza 2½ years ago.
Israel defends itself and, we here the same “CRY”.
” Palestinians they suffered” waa waaa … intangible losses including pain, suffering, and loss of liberty, loss of enjoyment of life, emotional distress, humiliation, and the like”.
How about “STOP TRYING TO KILL THE CIVILIANS OF ISRAEL” and then Israel will not have to defend itself.
Let’s see,that reminds me;
Ishmael was about 16 years old when he abused the just weaned Isaac.
The 16 year old abused the 2 year old, and gets what he deserved, the boot.
Then he and momma cry to God over it.
Lucky for them God answered their cry, not Allah.
Is it no wonder Muslims don’t want to be responsible for their actions.
Ishmael and Mohammad were not the best of role models.
If you're going to continue this silly line of reasoning, at least you can spell Farrakhan's name correctly at this point, no?
Robert has exhausted this point beyond thoroughness, denying that he is a closeted Muslim, but also acknowleding the problems of his presidential candidacy, in general.
There are a million reasons not to vote for Obama and all his "dreams for his father" bile, but the direct correlation that he is a Muslim is not one of them.
The first question is why a Christian pastor would talk approvingly of a militant Islamist in the first place. For all that I have learned, they should not be fast friends.
He should be attacked on his associations, yes, but as an attack on the company he keeps, not necessarily, what he is, nor what you portend him to be.
PMK, you are absoutely correct, the desire to settle out of court will be tremendous. This is what drives up the cost of everything.
My wife and I were defendants in a car accident, our insurance company settled merely because the other driver accepted far less than the cost to defend the suit. She sued for $100K, and accepted $12K. Her lawyer got 30% of that. What is so funny about that case, no one, I mean nobody was issued a citation for a violation, and it was not clear if anybody was at fault.
-- for the over one million Europeans (and early Americans) enslaved by Muslims:
Historian Robert Davis in his book "Christian Slaves, Muslim Masters - White Slavery In the Mediterranean, the Barbary Coast and Italy", estimates that North African Muslim pirates abducted and enslaved more than 1 million Europeans between 1530 and 1780. These white Christians were seized in a series of raids which depopulated coastal towns from Sicily to Cornwall.
If one claims emotional distress, show me a shrink's bill~Pelayo
Better yet, ask for the psych records in the discovery process. If they are not forthcoming, subpoena them.
----------------------------------------------
This raises an interesting point - what kind of shrink are we talking about here? Western or Islamic? Do a Google search on Islamic Psychology and you'll find that it ain't the same as Western psychology (but you won't be surprised to learn this will you?).
So who's psychological evaluation would a court accept? If the Flying Imams insist on using an Islamic psychologist, with a degree presumably obtained from an institution that offers the appropriate "training", the evaluation would be completely predictable. What to us appears to be insane or unbalanced behavior is likely be judged acceptable by an Islamic psychologist.
A principle needs to be established in our courts concerning this point, and that is that Western psychology, not Islamic psychology, will be the standard.
Wanna bet that sooner or later this particular point will come up in our courts?
"Plaintiff Shqeirat has suffered intangible losses including pain, suffering, loss of liberty, loss of enjoyment of life, emotional distress, humiliation, and the like."
Whaaaaa!
More tangible proof that Muslim men are girly men.
These imams should be indicted for what they did. They played deliberately on passengers´ fears of hijacking after 9/11. If they can´t be put in prison for that kind of behavior on an airline, how nice if a civil suit could be filed against them so they might have to pay $100,000 each.
Crossword Bebop's a nice guy too. Really glad to see he's following this story as much as other's are.
The imam's can whine for whatever amount they'd like- they're going to have a fight on their hands. I don't believe the airline or airport will roll over in this case. Asking for a jury was a good sign they're willing to fight. Bring on the discovery!
How about a kick in the ol’ derriere and directions to the door?

Circus is back in town - what a bunch of clowns.
Countersue - libel and damages.
Until this enemy gets Uncle Sammed, we're going to suffer these daily outrages by the soft jihad.

(but that will never come, will it?)
