The charges were reduced from hate crime status. Still, one wonders what would have happened if he had thrown a Bible into the toilet. Probably he would have gotten some kind of award from the Pace Art Department.

NEW YORK (AP) -- A former Pace University student who twice threw copies of the Koran into a toilet at the school after disputes with Muslims pleaded guilty Monday to disorderly conduct in connection with the incidents.

Stanislav Shmulevich, 24, pleaded guilty as part of a deal in which he must do 300 hours of community service. He has completed about 80 hours of the service at a hospital, his lawyer said.

Shmulevich, of Brooklyn, admitted he tossed the Muslim holy books into toilets at Pace on Oct. 13, 2006, and Nov. 21, 2006. A criminal complaint says the Koran that was recovered in the October incident "was covered in feces."

In both cases, a teacher found the books in a men's room on the second floor of the school's main building in lower Manhattan.

Muslims consider the Koran a sacred writing that contains the direct word of God, and desecrating it is seen as an offense against God.

Is that a point of American law? Did that figure in this criminal complaint? Should this case really have been treated any differently from how it might have been if he had thrown, say, The Conscience of a Conservative into a toilet?

Detective Faisal Khan, who prepared the complaint, said Shmulevich told him "he committed the acts out of anger toward a group of Muslim students with whom he had a recent disagreement."

Shmulevich, a business major and immigrant from the former Soviet Union, initially was charged with two counts of criminal mischief as a hate crime. The charge is a felony punishable by up to four years in prison.

His lawyer, Glenn Morak, said he believed the disorderly conduct plea was an appropriate disposition.

"There was no hate crime here," Morak said. "He accepts responsibility, and he is repentant."

Good. After all, "if they repent, and establish regular prayers and practise regular charity, then open the way for them: for Allah is Oft-forgiving, Most Merciful" (Qur'an 9:5).

He should have argued that they were destroying a "work of art" in progress. Perhaps he could have got a grant from the National Art Society.
He was merely inspired by the great works of artists who placed the crucifix in urine or sculpted the virgin Mary out of shit.

Why was a Muslim policeman allowed to prosecute this, wasn't he considered "too close"? That he might have a personal interest or involvement? I'm sure an outwardly Christian policeman would be allowed to be involved if it had been a New Testament or Jewish policeman if it had been a Humash (printed Torah). More preferential treatment for sharia...

300 hours seems a bit much. It's not like there's a shortage of Qur'ans..........

So if the motoons believe that their god is offended then why doesn't he do anything about it?" can't allah protect himself? the creator of the universe has to go beg muslims to defend hid honor? the most this guy could be charged with is "hurting the muslims' feelins". but is hurting feelings of others a crime? Are we ready to jail all artists? all comedeans? end all tv shows and commercials? because at one time or another they all had hurt feelings of others? where will all this lead to?

The felonious 'hate-crime' charge was bogus from the onset. I agree with Briars that there is an obvious double-standard here, but the fact of the matter is that Shmulevich used Pace University property.

Hopefully someone else will similarly stage a protest against the Qur'an, with their own purchased books, at an appropriate location.

Since no 'crime' could then be brought forth, the response would be quite interesting, if not altogether expected.

A disorderly conduct plea makes it almost impossible to get a CWP .Not a smart move.

So the guy was genuinely guilty of vandalizing public restrooms. That he did it with some books that happen to be copies of the Quran should be irrelevant.

Nope, the investigating officer has no personal agenda here.

In my view it is not environmentally sound to flush or burn Korans. The Koran shoud be disposed in a waste paper container to be recycled into toilet paper.

This shows the problems with any kind of hate crime legislation. So what if I hate Muslims, why should that be a crime? In the past when people burned crosses, it wasn't the cross burning per se, but the implied threat of violence behind the cross burning that was wrong (and I don't know if cross burning would be illegal today without a real threat of violence).

This was an act of vandalism and, perhaps, petty theft. There was no threat of violence only a threat of insult. It would be quite different if this person went into a mosque during prayers and stole a koran and defiled it. He didn't.

"Ye must not throweth this book down a toilet"?

If I was to walk down a street, take out a Qur'an and throw it against a wall, or on the pavement, or in the trash can et cetera...is that illegal now beacause it's a Qur'an?

It is not clear from the complaint who owned the object that was in one instance left in a public toilet and, in the other, dropped into the toilet of the same facility. It refers instead to damaging the property of another.

I realize that the inferred "hate crime" is the alleged disrespect toward someone's cherished publication. However what property exactly was damaged (in the legal sense in the complaint), the room, the toilet or the book?

Another question - could he have avoided those 300 hours of community service by converting to Islam? It would have been fascinating to see what the Muslim reaction would have been had a judge refused to commute his sentence on those grounds.

Shmulevich probably had more freedom in the USSR than he has here. After all, there, the worst he'd have had to do was follow Communism, which still wasn't alien to Russians. Here, he has to defer to Islam, which is not only alien to the US, but to him as well.

Ohhh that is too funny, that idea could make someone some big bucks. Lots of people spend probably 15 minutes a day doing what they do in bathrooms, now if they had a toilet paper koaran in there with them they might be reading while they are in there. Who knows, thousands might become mahometans and when asked they probably would never admit how they came to that belief.

I think that you should get in touch with our saudi friends and tell them of your idea, they could stock every airport, every restaurant with free qouaran tp as a form of religious outreach.

When a book is regarded to be above other books we have a problem called favoritism. Imagine if for example Mien Kampf was found in a toilet insted of that Quran, would there have been a witch hunt?

What if we found the Communists Manifesto print in a toilet basin would that have caused a shake down?

I say the Quran is Qurap but frankly what ever someone does with thier book has nothing what so ever to do with those who subscribe to its content.

That's a lot of community service for $5-10 worth of books (as per online prices for similar copies).

Why not just a fine of replacement value and/or clean the aforementioned toilets for a week?

No. That would be animal cruelty, because of what you've done to the goat.

This is a shocking story. To put a Koran in a toilet is a grave offense to toilets, those Western wonders of modern technology and hygiene which make no small contribution to our high quality of life and overall good health. The offender should have been sentenced to 300 hours of plumbing work, without pay.

Re. the comment about the book being "covered with feces" when it was retrieved...this is no doubt overkill, for something that is already full of s**t.

In all seriousness, I personally disapprove of defacing, damaging, or destroying any books, no matter how repugnant; it sets a very bad precedent. And no doubt quite a few Muslim feelings were hurt by this person's actions, just as my feelings would be hurt to see a King James Bible, a Shakespeare's Complete Works, or To Kill a Mockingbird thrown in the john, but unless those books were actually my property, or the property of someone other than the perpetrator, I would know there was nothing I could do about it beyond reporting the offense to building maintainence, not the police. If these Korans were the legal property of the person who threw them in the toilet, why has he been prosecuted for damaging them? Does the concept of property rights no longer exist when it comes to "sensitive" religious material? Has anyone asked that question?

answers, 1. yes, but it will give the goat a terrible case of gas, and goat farts are the worst, so be sure you leave it outdoors for a day or two after feeding it.
2. yes, but then you can't have it for dinner (just like having sex with a goat; it's o.k. but then you can't eat it), but you can sell it to someone else for their dinner
3. no, because the goat would think it had become a messenger of Allah, and who knows what that might bring. After all, look what happened when the angel "fed" the Koran to Mohammed.

I think profitsbeard is right--a better lawyer would have beaten this thing and made Mr. Scmulevich appear the victim.

The attorney could have spent hours in court reading what the Quran says about non-muslims. That's enough to make anyone toss that thing where crap belongs.

Mr. Schmulevich needs to get a new lawyer and appeal this now.
