More suicidal lunacy from Britain: the sacred right to style hair even though one's own hair is not visible has been transgressed against, and the offender must pay for the Hurt Feelings of the hijabbed hairstylist.

The owner of a hair salon has been ordered to pay £4,000 compensation to a Muslim stylist who was turned down for a job because she wears a headscarf.

Bushra Noah accused Sarah Desrosiers of religious discrimination when she failed to offer her a job at her Wedge salon in King's Cross, central London.

An employment tribunal panel dismissed the 19-year-old's claim but upheld her complaint of indirect discrimination.

Ms Desrosiers said she needed stylists to showcase alternative hairstyles.

During the hearing Ms Noah, who lives in Acton, west London, told the tribunal that she was "devastated" that she was not offered the job of assistant stylist "due to my headscarf"....

When the applicant arrived for the interview she claimed the Canadian salon owner was clearly shocked by the fact she wore a headscarf.

Ms Desrosiers told the tribunal she was surprised it had not been mentioned earlier and expected her staff to reflect the "funky, urban" image of her salon.

The panel found that Ms Noah had been badly upset by the 15-minute interview .

She was awarded £4,000 damages for "injury to feelings".

In its judgment, the panel stated: "We were satisfied by the respondent's evidence that the claimant was not treated less favourably than the respondent would have treated a woman who, whether Muslim or not, for a reason other than religious belief wears a hair covering at all times when at work."

It added: "There was no specific evidence before us as to what would (for sure) have been the actual impact of the claimant working in her salon with her head covered at all times."

Speaking after the ruling the salon owner said: "I never in a million years dreamt that somebody would be completely against the display of hair and be in this industry. I don't feel I deserve it."...

Indeed.

How much more will people take? When does this all end?

These stories are surreal, like bad dreams that are funny and unnerving all at once. Except this bad dream is apparently real.

And what is wrong with those non-muslims who aid muslims in these social subjugation ventures? How can they be so twisted? It's ultimately a suicidal impulse at work, and it desperately needs to stop or we all end up dead. If not literally, then culturally, socially and morally dead. And that's just as bad, if not worse.

There may be grounds for an appeal (even to the European Court of Human Rights) - but appeals are costly.

A great deal of Wahabbi money is floating around the UK (and other countries in the west) to promote Islamic values.

Now is the time for all small-businesspeople to band together in the face of a common threat. They should pool their resources to set up a fighting fund to tackle this problem. If they don't they deserve what they are going to get: Muslims presenting themselves at job interviews for any job available, demanding employment and suing for 'racial discrimination' and 'injured feelings' if they don't get it.

Actually the UK unions "Won the right" some years ago for muslim workers - say in supermarkets - to refuse to handle pork.

I always thought this was a back door way of getting such "rights" into law. If there were an outcry when such a law was introduced they would say, "What’s the problems? We are only formalising something that has been accepted in society for years!"

This is a bit ironic considering the article yesterday about hair salons being targeted.

This poor salon owner will be run out of business. Don't business owners get to decide who they hire anymore?

So, they presume to tell her how they think her business would be impacted? Are they in her business line? And there was no evidence? Wouldn't you have to actually have something happen by hiring her first for there to BE actual evidence? Instead of the owners business sense?

How to avoid being sued by parasites:

1. Tape full interview.

2. Full standard interview plus ask the applicant if a prayer room is expected to be made available, if the applicant intends to wash ones feet in the sinks, can the applicant work with products that contain alcohol?

3. Thank applicant for their time, inform applicant that other applicants need to be interviewed and that applicants will be informed of outcome by post.

4. Send letter 2nd class post to failed applicant when post has been filled, thank them for their time and inform them that unfortunately on this occasion they were unsuccessful. (no tangible reasons to be given )

5. No further correspondence with failed applicant.

6. Winning candidate came across well during their interview also had best personality and attitude.

My husband offered that in the U.S. "injury to feelings" would be called "Discrimination."

Anyone know if that's correct? If this same situation happens here, which it probably will, and probably sooner than later, the Mohammedan Complainant will win on grounds of "Discrimination." Is that right? Or, is "Injury to feelings" a completely different animal?

It is likely that Sarah Desrosiers does not have the wherewithal to appeal the case, but some group should think about bankrolling her. In my parents' city, which has a substantial Muslim minority, I had my hair cut a few years ago at a very nice, new salon. The salon owner was from Iran, I believe, but dressed completely in stylish Western clothing and--as one would expect from a salon owner--in full makeup and with perfectly coiffed hair. What shocked me was that she had a younger relative working in the salon as well who was swathed in black from head to toe--even her hands were covered in black gloves. (She did not wear a niqab, at least.) She wore not even a trace of makeup.

I asked the stylist who was cutting my hair if the employee in hijab made any customers feel uncomfortable. "Yes," she said, "and I'm sure we've lost a lot of repeat customers." She also said two talented stylists had recently left the salon in part, she felt, because of their discomfort with the employee in hijab. (They were gay men--wonder if that had anything to do with it? Perhaps they felt judged.)

I've never gone back to that salon, in large part because the hijab-wearing employee was quite rude as she was ringing me up afterward, although I was polite to her. (Could she have anything but contempt, I wondered, for women paying for frivolities such as hairstyling, makeup, etc?)

In any case, while I believe women living here have the right to dress as they like, it is very offputting to see someone cloaked in 7th-century Arabian garb in a beauty salon. To make a comparison, I have nothing against overweight people, but I would be surprised to be waited on by an obese person at, say, a health food store!

Jeez, hijab or not, her innate ugliness should be grounds enough not to hire her in the beauty trade.

I know this is probably unfair to the ‘allah’s superior ones’ but, hijab or no hijab, as anyone else ever wondered why muslimah often seem so nasty ugly? That hag, Mrs. Noah, has got a ‘beak’ that would put Macbeth’s witches to shame and thus frighten away potential hair appointments.

Hopefully, this treasonous, insane decision will be appealed successfully, but in the unfortunate case it isn't, I hope that this ugly Muslim spends a fraction of her $8,000 of jizya on eyebrow tweezers, or, better yet, a full burqa, so that we don't have to look at her depressingly ugly and smug physionogmy, or better yet, a one-way ticket to Riyadh.

Welcome to my ignorant country. So desperate is our government to garner the muslim vote they are allowing them to dictate how we live. This ruling will open the flood gates to all muslims like this woman who use their religion to play the victim card in order to wage jihad against the kuffar.

Take heart, the wind is changing and cases like this can only work in our favour. Britain isn't done yet. History shows we take a long time to wake up to extremist threats posed to our country (like the Nazis) but when it does we will fight to protect what we have and what the undeserving want to take.

Cases like this, if they are allowed to continue will only make more people disgusted with islam. Just think of all the regular customers of this salon that are outraged let alone the people worldwide reading about it. This kind of thing is happening everywhere in the West. This is just the non violent muslims way of doing thier part in the worldwide jihad. Most likely coached by thier local mosques or thier husbands. It is working for them. Its a win win situation. The more people they piss off, the more they can cry Islamaphobia! Lord help us!!

Nothing like 40% but they have had a big push in a last four years to employ more minorities. They had a director general called Greg Dyke and before he was fired from running programmes claiming the Iraq war was illegal he described the BBC’s staff as “Hideously white”.

As a result Muslims and other minorities are very noticable on television in all sorts of programmes. Women are particularly well represented and they all wear modern Western dress so no hijabs – yet?

I find one aspect of this determination quite amusing. The BBC's main “serious” station is Radio 4 and in the last year it has employed an announcer with a heavy West Indian accent. There are plenty of educated black British people with regular British accents who could have done the job but they obviously wanted someone with an accent that announced to the world “This chap is black and we are multicultural”.

Second thoughts.

A neighbours daughter was a highly qualified beauty therapist and got job interviews with the top city salons but never got the job. She was shall we say rather plain with no figure worth noticing and so no advertisement for her craft. I wonder if she could/should have sued?

We CANNOT do to our women what they do. Check out Yemen. Yeah, sure, it has one of the world's highest fertility rates...because half their girls are married off at under-fifteen and have a baby every year till they're fifty (unless, of course, they die in childbirth first...as many of them do).

And all the women are married off whether they want to be or not (even in the Middle Ages, western men and western women did not HAVE to be married and breed - they could choose to live a single life, enter a monastery, be educated, compose music and paint pictures as Hildegard of Bingen did).

Centuries before the era of contraceptives and easy divorce and abortion, the Muslim hordes annihilated the intensely religious, fertile, family-friendly societies of Hindu India and Christian North Africa and came damn close to destroying Christian western Europe. I don't think Byzantium in 1453 was an MTV society, or a 'f***-a-thon'. Nor was Vienna in 1683, in a Europe that was agonising its way through the Reformation and Counter-Reformation.

But first, BTW, if you think Mohammedanism promotes 'stable homes and fertile relations', and you think that it therefore might be preferable to, or superior to, 'the West': go read V S Naipaul and Phyllis Chesler and Nonie Darwish and Wafa Sultan. Reflect on the shocking number of girls and women who are obliterated every year, in every Mohammedan community, by 'honor' murders (sharia killings), often on the basis of the flimsiest of rumours; have a little think about the horrendous psychological fallout from talaq divorce and polygamy, among both women and the children that they bear. Go find out about the rates of incest and child abuse in Arabised Islamised societies, not to mention wife beating. Sure they produce a lot of kids - and then they program them with stuff that poisons and stunts and kills their souls.

I'll take Britney Spears warbling a pop song, any day, over an imam chanting Surah 9:5, or earnestly explaining the niceties of beating your wife so it doesn't show.

How do you propose we outbreed the Muslims? Forbid women to be educated past year 7 (hell, don't waste money on educating them at all)? Every girl aged 12 MUST be married off and bred immediately and keep on breeding till she reaches menopause or dies, whichever happens first? Ban all contraception, even that which is judiciously employed by married couples to space their babies more than a year apart - gotta keep pushing out those babies, one every year? Free up lots of angry young men for war, but still keep the birthrate high, by lifting the ban on monogamy?

The West is not as bad as you think it is; and even as bad as it presently is I still prefer it to the Islamosphere.

For a year, Sarah has been facing financial ruin, due to a compensation claim for £34,000 brought by Bushra, 19, who has maintained she is due that figure after being turned down for a job at the Wedge salon in London's King's Cross.

Bushra Noah says that Sarah Desrosiers 'hurt her feelings' by not employing her after a ten minute interview

Although this is a smaller sum than she'd feared she might have to hand over, Sarah, 32, is still outraged. 'I am a small business and the bottom line is that this is not a woman who worked for me,' says Sarah.

'She is simply someone I met for a job interview, who, for a host of reasons, was not right for the job. I cannot see how she deserves £4,000.

'As for the notion that I've injured her feelings - well, people's feelings get injured every day. I dread to think the sorts of things that people will try to claim injured feelings for now that this precedent has been set.'

At the tribunal, Bushra was asked if Sarah had made derogatory remarks about her headscarf.
She replied: 'She did not. She just asked me if I wore it all the time, or whether I'd take it off.'

Meanwhile, Sarah Desrosiers is wondering how to raise the £4,000 she has been ordered to pay Bushra. She has spent her savings on her legal battle and simply has no money left.

'I am a one-woman band, and am already in debt due to the set-up costs of opening my own salon,' says Sarah. 'I dread to think how many haircuts I'm going to have to do to earn the £4,000 I have to pay Bushra. This has, without doubt, been the worst year of my life.'

In March 2006, feeling ready to spread her wings, she wrote a business plan, secured a loan and invested £5,000 of her savings into the lease on a small salon on Caledonian Road.

She named it Wedge, and planned to specialise in 'urban and edgy' cuts, rather like the cerise colour she often dyes her own hair.

'I'd never felt as proud as I did on the day I picked up the keys to my salon,' says Sarah. 'I was prepared to put my heart and soul into my business in order to make ends meet, and for the first few months, I worked 12 hours a day, six days a week, all by myself.

'I barely saw daylight, but I didn't mind because I was fulfilling my ambition.

'Of course, there were a few nerve-racking moments, such as when another salon opened a few doors away. But that is part of owning your own business, and I felt proud of all I was achieving.'

By March 2007, the business was doing so well that Sarah needed to take on another stylist. To minimise her overheads, she decided the best way to do this would be by renting out a chair in her salon to an experienced stylist - who would take a share of her profits - and employ a junior to work for both of them.

'One day she rang up to see if I'd got her CV and begged me for an interview. I told her I had concerns about where she lived, but she sounded so desperate that I agreed she could come in for a chat.'

A few days later, Bushra duly arrived at the salon.

'I have to say I didn't take to her,' says Sarah. 'She waltzed into the salon and hung up her coat as though she already had the job.

'As she left, Bushra turned to me and said that she'd been turned down for jobs before,' says Sarah. 'And I admit I thought: "Well, what do you expect?"

Using her savings of £2,000, Sarah employed a lawyer who helped her draft a statement about her meeting with Bushra.
But with his fees at £280 an hour, she knew she couldn't afford to fight a satisfactory legal battle. Her parents - her mother is a nurse, and her father is retired - weren't in a position to help her out financially either.
'I was at my wits' end, and I had no idea how I was going to pay for my legal fees,' says Sarah.

'For months, I couldn't sleep, I couldn't eat, I felt as though my whole life was on hold. All I could see was that I'd be forced into bankruptcy and lose my business.'

In the course of preparing for her trial, Sarah estimates she has lost £40,000 of her salon's annual income.

She also faced a further blow when it emerged that Bushra had increased the figure to £34,000 to compensate for hate mail she had received following Press coverage of the trial.

In March, Sarah faced a three- day employment tribunal, and endured four hours of cross-examination.

'I managed to defend myself and not cry, but it was incredibly difficult,' she says. 'I'd even had to ask my accountant, who is a Muslim, and another Muslim friend to write letters confirming that I am not racist.

'I kept thinking: "I've worked hard all my life - how can it be possible that someone can come into my shop, talk to me for ten minutes and then sue me for £34,000? How is that possibly fair?".'

Although Bushra is believed to have been acting alone, in the past similar cases have been championed by Muslim traditionalist groups. [like Hizb ut-Tahrir]

I'm not sure this Mainstream Muslim is going to win this one.

Disney does, in fact, have image standards which their employees, the ones who work in the park, must fit, and they've had them for as long as I can remember. That's a pretty long time, as my father was one of the carpenters who worked construction on the place.

No moustaches, no beards, no overweight people, no earrings, no necklaces, no bracelets, no visible tattoos, no unusual piercings (tongue studs, eyebrow rings, nose studs, etc.) and probably a few things I don't recall. The point is, anyone who will be seen in the park must fit a specific "look".

Now, if one doesn't want to work in the park proper, the rules are different. Behind the scenes rules for appearance are relaxed.

So does that mean Bald hairdressers should be banned?

Fully agree w/ you. Altering our societies in the image of those troglodytes is only going to hurt us, even if one accepts the point about infidelettes needing to be more of the married barefoot and pregnant types.

I like carpadiem's idea the best - give her a store coupon which only Bushra can use - no sisters, cousins, wives-in-law, et al. That way, Sarah doesn't have to appeal the decision, but if Bushra's feelings get hurt again, it's she who'll have to take the matter back to court, not Sarah.

Oh, and Bushra doesn't get the hair styling unless she removes that head-shroud.

Two things:

  • It's entirely up to any business as to what the rules are for their employees. Just as some offices may require formal attire, businesses are free to require that their employees follow a certain dress code. In fact, a business can make any crazy rule under the sun, and it's upto potential employees to determine whether that's a work restriction they are comfortable with.
  • The point Sarah made was that she used the hairstyles of her employees to showcase what was offered by her business. In other words, if she had 3 colleagues, each would pick one of the styles offered, so that women passing the shop could stop there if they saw something they liked. That was one added value Noah wasn't willing to provide.

Oh, and they would presumably be fixing each others hair, and setting up the live ad.

She targeted this salon because she wanted to force them to change and adopt muslim rules and regulations. Because she KNEW that the stupid dhimmi courts in London would force the Wedge to accomodate her.

If she, the owner of the business, chooses to make that a requirement for her hairstylists, then it is nobody's business -- not yours, not mine, especially not the governments.

Since you're such a fair-minded guy, I know that you'll agree with me on that point!

Mr. ------Constantinople, one more thing: I know barbers who cut their own hair. What makes you think that the hairdresser doesn't do her own hair? Plenty of women do their own hair.

Here's a really obvious point that, again, I know a reasonable guy like yourself will agree with: MAYBE THE HAIRDRESSERS DO EACH OTHER'S HAIR!! In that way, they REALLY DO show off their own work!

Why is this so difficult for you, Mr. ------Constantinople?

One have a hard time understand those brits, a 10 minute chat about a potential new junior part time assistant position that the person never was even contemplated for much less promised any employment reward an $8000 penalty for the employer (an one person business). But a big company that sack a buss driver due to him stand for a political party in an local election, he had never had a complaint made about his duty, is not rewarding any reprimand from the Employment Tribunal.

The former Bradford City member for Wibsey worked as a bus driver for Wibsey worked as a bus driver for children and adults with special needs and had never had a complaint made about him.

In 2004, he announced he was to stand for the BNP in local elections and was returned to office in June.

My question is why wasn't the other 25 establishments the musliminah interviewed at raked over the coals like Ms. Desrosiers has been? It sounds like all the other interviews caused her 'hurt feelings', too, so what gives?

I think it's because the other salons avoided mentioning the headscarf--even though I'm sure that was the first sign of Bushra's unsuitability for all of them. I'm sure in many cases the salons either did not contact her at all, or else blandly noted that they had hired someone else.

It was at least in part because Sarah Desrosiers was nice enough to give her an interview (because Bushra sounded so desparate), and tried to take her seriously even after she showed up in full hijab. That Desrosiers asked Bushra if she always wore her hijab was probably her downfall, in the current insane climate.

I also wonder about the alleged fervent nature of Bushra's "lifelong dream" of cutting hair. I never heard that she had any sort of training. Here in the US only a few shops actually train their own hair stylists--I think I read that the huge discount haircutting chain Supercuts trains their own barbers, but this is rare.

Most aspiring stylists go to a barber college, or beauty or cosmotology school. I doubt it is very different in the UK. That a person would try to get hired at any salon without any training seems rather unrealistic--that they would expect to be hired by a very chic, trendy salon seems questionable. Was Bushra just naive, or did she hope that one of her interviewers would be impolitic enough to mention her hijab?

This is true. Not only has Supercuts told me that, but EVERY Supercuts at which I have gotten my hair cut has given me a consistently good haircut.

How in the world did little Muslima think she would fit in there? Why would she want to be there?

Possible reasons:
-Sour grapes
-A chip on her shoulder
-Thinking she is better than everyone else

Maybe she is trying to force Islam down their throats, and put herself in charge of the business in the process.

We've seen Muslima's way of perhaps trying to win converts to Islam. Let's compare that to the way a Christian might try to win some converts to Christianity. Here's some things the Christian might do:
-Stop by and ask how they are doing today.
-Spend some money there, in order to be a blessing to the owner of the business.
-Slip a Gospel tract quietly to the owner.

The owner might actually believe that it's worth considering Christianity, because of the love shown by the Christian.

I doubt, however, that Muslima's approach will win her very many converts. That's why Muslims have to intimidate you and stick a knife in your back in order to get you to convert.
