Parliamentary immunity as a matter of law and public policy is intended to protect lawmakers and allow them to speak openly and freely about matters important to public health and safety.
Removing immunity at the whim of the majority is no immunity at all. Lawmakers from all parts of the political spectrum are harmed when political speech is criminalized; especially speech that when spoken is permissible, and is made criminal AFTER the speech is made.

I don't think this would ever be allowed in the US. I can envision some wild-eyed liberal someday wanting to impose such limitations on speech, but because we have a constitutional provision against passage of ex post facto laws, it couldn't happen. That is, you cannot make a crime from something that was not when the act was committed. I suppose there is no corollary in Austrian or Belgian law.

After this Austrian fiasco, I wouldn't be surprised to learn that they're arresting school-teachers for teaching their 3rd-graders that the Earth goes around the Sun. I hope Winter makes a meal of this. It deserves all the publicity it can get simply because it deals with one of the raw facts concerning Mohammed's barbarity.This is an attack on free speech and truth and as long as this story gets the exposure that is necessary, ordinary Europeans will be faced with the reality an undeniably insane and unjust attempt to suppress the truth, and even the so-called liberals won't be able to argue with that. This is an important case which hopefully will lead to more light being thrown on the dark unmentionables of Mohammed's life. As a teacher here, I will be using this situation in class, to wake my students up to the facts about Islam and the threat we are faced with.

cornelius: thanks for your concern. My trendy keffiyeh wearing tertiary level students here in Switzerland need the facts and information they are deprived of about Mohammed. These can be taken objectively from Islamic core texts, as Robert has done with his book on Mohammed. They should know that a leading figure in their culture is being penalised for exercising free speech and telling the truth and who is not indulging in defamation and racism.It's fashionable for young people here to be left, progressive and 'tolerant'. They are brainwashed by the MSM, Hollywood and pop culture into the usual cultural relativism and moral equivalence while they know nothing about Islam and the threat it poses to their cosy Swiss comfort zone. Basically, they are very smart at their chosen narrow subjects but downright ignorant of everything else.

But if you meant the former, I have to say that you're simply wrong to think that Muslims are in inward denial about Perv Mo, because they know all about him and they love everything about everything he did. Denver Rodeo, I'm with Hugh in thinking, wishfully maybe, that many Muslims aren't really Muslims and that many are on their way out. I've told you before that I don't trust that couple but that I nonetheless hold out hope for them, and in any event being evil to them and confirming their worst suspicions about Jews is probably unwise in any event. They do seem different to me, much more genuine than the other Muslims I know. I can't really explain it. I just think that, as time goes by, they may very well apostacize. Yes. This is *absolutely critical*. In the U.S., if a statement is true, it *cannot be slander*--even if the statement is put in an unflattering manner, or if the speaker is critical. We have to defend speaking the truth.
People and institutions have the right, under slander laws, to be spoken of honestly. They *do not* have the right, any of them, to a guarantee that no one will ever be critical of their words or actions.
Being the one who wrote the original post for GoV, let me answer a few questions posted here:
1. MP Winter has indeed lost her immunity this past Tuesday. The vote was unanimous, i.e. her own party friends alos voted for the loss of her immunity. Her trial starts January 22.
2. No one I know of in the FPÖ (Freedom Party) knows what is at stake at this trial. I am working hard to convince them, but it is not easy. Actually, moving a mountain the size of Mt. Everest would be easier. But I will not let up because our very freedom depends on this trial.
3. On Tuesday, Austria will have a new government. It will be sworn in, and its plans regarding limiting freedom of speech will be dangerous to us all, whether Austrian or non-Austrian. I will write a post for GoV about the government's plan to silence us all, you and me. Trust me though, there are quite a few who will go to jail, if we do not FINALLY get up and move our behinds.
