Ann Arbor, Nov 13, 2008 / 06:56 am (CNA).- A Marine veteran whose anti-terrorist and anti-Islam vehicle decals hindered him in visiting the grave of his fallen son at Arlington National Cemetery has filed a federal lawsuit challenging the military order which rebuked his display of the decals.

Jesse Nieto, a 25-year Marine veteran, served two combat tours in Vietnam. His youngest son, Marc, was one of the seventeen sailors killed in the terrorist bombing of the U.S.S. Cole in October of 2000.

Since 1994 Nieto has been a civilian employee at the Marine Corps Base Camp Lejeune in North Carolina. In 2001 he began displaying various decals on his vehicle expressing sentiments such as “Remember the Cole, 12 Oct 2000,” “Islam=Terrorism” and “We Died, They Rejoiced.”

On July 31, 2008, two military police officers ticketed Nieto for displaying “offensive material.”

After Nieto refused to remove all allegedly offending decals from his vehicle, the Base Magistrate issued a written order ordering Nieto to remove his vehicle from the base until all decals were removed. The order banned his vehicle from all other federal installations, and reportedly prevented him from driving onto the grounds of Arlington National Cemetery.

The Ann Arbor-based Thomas More Law Center filed a federal civil rights lawsuit this week on Nieto’s behalf against the Camp Lejeune Commanding Officer and the Base Magistrate in the U.S. District Court for the Eastern District of North Carolina. The lawsuit claims that the military’s ban on Nieto’s vehicle decals violates his constitutional rights to freedom of speech and the equal protection of the law.

The banning of these decals is political correctness run amuck in the military,” charged Richard Thompson, President and Chief Counsel of the Thomas More Law Center. “Our troops are being killed by Islamic terrorists, 9/11 was caused by Islamic terrorists, these terrorists want to destroy America, the Islamic countries persecute Christians, and now the military is victimizing a father whose son was killed by Islamic terrorists while serving our nation.”

Thompson speculated that the Marine command would have to eliminate the Marine’s Hymn because “the phrase ‘to the shores of Tripoli’ celebrates the Marine victory over Islamic forces in the Barbary Coast War and the Battle of Derne.”...

Of the three mottoes on the decals quoted above, it seems likely that the one most objected to is likely to be "Islam=Terrorism". Because it contradicts the superior wisdom of the present POTUS who assured us that Islam is a religion of peace.
And yet the decal is more in line with the holy Hadith, ie - the word of Mohammed, who said: " I have been made victorious by terror!" Is Dubya supposed to be a higher authority on Islime than old Mo?

A good illustration of Islam=terrorism was in today's Daily Telegraph. About a young boy who grows up a normal innocent fun loving kid. His only education was the Koran, like many in rural pakistan. He wanted to learn more about his idol, Mohammed so enrolled at the local Madrassa. He graduated a fully indoctrinated Jihadist. He and a comrade in arms, armed with AK47s and suicide bomb vests were soon launched at the Serena Hotel in Kabul. For some reason he took off his vest and awaited arrest after shooting many people (though the other guy detonated his) and we can now hear his story first hand as a journalist interviews him in jail.

The fundamental problem with all "hate crime" legislation is displayed clearly in paragraph 21:

21. During this appearance, Plaintiff asked Defendant Hessen what the criteria were for finding the decals “offensive.” Defendant Hessen responded, “It’s just what I think,” or words to that effect.

Call me skeptical, but I don't believe Defendant Hessen was thinking at all; if Hessen had been honest, he would have said "It's just what I feel".

I have a question for those in academia, in media, and now in our government who think this kind of stuff makes for a better society: what happens when we all start making up our own rules, and living based on how we feel? Suppose we don't feel like going to work, or paying our taxes, or putting up with these type of extra-legal rules that bureaucrats think are the right thing to do? What happens when half the population doesn't feel like living in peace with the other half?

You cannot expect all non-Muslims to indulge in the kind of cognitive dissidence it takes to find Jesse Nieto's decals offensive.

I'm starting to believe we need another establishment clause; one that puts a wall of separation between stupidity and state. If you're in government and cannot face the reality that violent Islamic scriptures animate a lot of violence by Muslims; quit and find a different job. It may save you from feeling intensely guilty at some point in the future. Otherwise, start using some common sense, before our whole society pays the price.

Someone needs to hang; and I don't think it is the Marine.

The focus in the posts above has been on the sticker saying "Islam=Terorism" but I would point out that the gentleman in question was told to remove them ALL.

It is indeed correct that in the military one must obey all lawful orders-- whether one agrees with them or not-- and that military personnel do not have the same freedom of expression as civilians; that is part of the job. So, the commander and MPs were within their technical rights to give the order to remove all decals from the car and even to ban the car for failure to obey such an order.

Nonetheless, circumstances sometimes occur which make a need to fight even lawful orders. Billy Mitchell became a hero after the fact for doing just this. The case seems to me similar here. The defense will present the prefectly correct argument that the commander and MPs had every right to do what they did. Therefore Nieto's lawyers must show why he is right to resist the orders given.

I hope Mr. Nieto wins his case. He should, but I frankly doubt very much if he will. The officers were within their rights to give the orders and the political views of the day favor those orders. That was true in Billy Mitchell's case as well-- right up until 12/7.

You seem to overlook a couple of salient points in your post above.

Firstly, Mr Nieto challenged the orders to take down the signs in his capacity as a civilian working on the camp, having retired from the marines some years ago. (1994)
Secondly, according to the Complaint PDF document linked to above, there were all kinds of bumper stickers on many other vehicles at the camp - political, sexual, religious, humorous; much of it offensive to various groups. Eg: "Why experiment on animals when there are so many Democrats?"
Yet only the Islam-critical signs were considered bannable, for reasons or criteria unexplained.

Nieto is asking for fairness and consistency.

Too much to ask?

He is no longer in the military, however if one wants to enter a military base, one must obey the rules and regulations of that installation. Sure they can tell him he's not allowed to drive on base with those stickers on his car. They're asshats for doing so, but then military intelligence is and oxymoron.

Is the military preventing him from visiting his son's grave? No. The military is forbidding him from taking the car with the stickers onto military installations. I don't see anywhere that he is forbidden from walking onto a base or getting a ride in someone elses car. Sure, he should go ahead with his lawsuit - it's his privilege and his right. He should also find an acceptable (to the military) means of transportation and pay his respects to his son.

My niece is 5. This summer her tantrums started to begin with a new twist: "Why are you making me break the rules." Of course, with my brother that tactic is a non-starter. She tries it twice and it's time-out. This is a similar situation. The military is saying "our house - our rules". I do the same - just try lighting a cigarette in my house - I may throw a bucket of water on you before I politely ask you not to smoke in my home. Sue me.

Citizens of the United States have no statutory or regulatory mandate "to be thoughtful to others." We have laws based on objective actions and interaction with others. Still, Jesse Nieto is being thoughtful by voicing his opposition to a violent philosophy in a peaceful manner.

Just as Marxists try to eliminate competition for money and unwittingly release the competitive spirit for raw political and military power; the over-sensitive speech censors may succeed in trampling free speech, and in doing so loose far worse horrors on us and between us than a few hurt feelings.

T hope that any reader who is a veteran is publicizing this matter at his/her local American Legion or VFW post.

Why should anyone be suprised by this? The public stood by and allowed the military to ban Confederate decals on cars, and there was hardly a peep from anyone.
When are people going to realize that when you allow government to violate one persons freedom of speech, they concede to government the power to ban everyones freedom of speech.

Mr. Nieto needs to get the public behind him on this. One thing base commanders fear is public outrage, especially over a issue of preventing a father from visiting his son's grave. If the base commander gets a thousand phone calls and reporters wanting to question him I can guarantee this grandee will fold like like a tent if he doesn't want to look like shit heel.

Court isn't a good idea in this case IMO. The USMC has tremendous legal resources and they can tie up Neito for a decade and by the time its settled the base commander will be retired and making millions working for Lockheed.

As for the "my house my rules" crowd. They don't get Neito has broken no military regs only a arbitrary rule by a politically correct asshole of a commander and his MP stooges. These arbitrary rules serve no other purpose than to harass those the base commander doesn't like for some reason. And the fastest way to break these rules is to expose them to the public.

Sorry, but these words speak the very truths about islam and how the vast majority of muslims around the globe feel about us. When you join the U.S. military you take an oath to defend the U.S. Constitution.

I will add that you are also asked if you have ever belonged to an organization that advocates the violent overthrow of the U.S. Government. I honestly do not see how one may be a Muslim and not answer yes to that question.

Like many of our government officials, the Base Magistrate does not see the Constitution as a guideline to follow and likely despises the principles outlined by our Constitution and Declaration of Independence. He sees these documents as obstacles to outwit and get around.

One may try to excuse his behavior by claiming that he is serving the powers that be. Remember that if two parties, individuals or groups, hold the same principles, the winning of a disagreement will go to the more consistent of the two. When two men hold opposing principles any compromise between the two will benefit only the more evil of the two. "They" are persecuting an American citizen for displaying a fact on his vehicle, his private property no less. From top to bottom Marines should be refusing to enforce this stupidity, and be willing to face and fight any injustice as a consequence.

Never happen at the moment. We now have a Commander-in-Chief Elect who says the muslim call to prayer is "one of the prettiest sounds on earth at sunset." I can see B. Hussein Obama signing the US up for the UN's proposed religious anti-defamation "law," not the other way around, as you (hopefully) state.

Here in the UK, our soldiers are harassed and spat on, by the left wing and of course Muslims. They are also not allowed to wear their uniforms in the hospitals as well as being banned from Harrods(owned by Mohammed Al Fayed a Muslim) because they offend people.

This is just a long list of more political correctness. It's disgusting. I however have to say, what will it take for the people to win against this disgusting political correct bureaucracy?
I have a feeling that complaints and petitions are going to do nothing. I fear that the West may need to take up arms and revolt against their rulers, or else we are sure to be Islamised.
When "jaw, jaw" has stopped working, it's time for "war, war"(to alter Winston Churchill's famous quote).
We are being shafted by Islam, they are winning easily and yet the people are doing nothing, because Islam is protected by the very people who wage wars against them killing our children in the process.

Yeah, I'm with Leon - comfortable abusing the brass when they deserve it. The brass, after all, are the ones behind the persecution of the Marines from Haditha.

As other posters have mentioned, the base is acrawl with a display of decals, each of which is sure to offend someone. This ruling against one man for having facts in the shape of decals on his car is pure horse-hockey.

However, the correct thing to do is to make a rule stipulating that no decals or stickers of any kind, except those issued by the base for entry at the gates, are permitted.

This solution is so obvious, I can't believe the base commander has overlooked it. It would suck, but it would be fair.

Me, I love bumper stickers and decals. They lend a bit of spice to driving, whether they make me laugh, or roll my eyes. I think everyone should be able to keep theirs at Camp LeJeune.

No one has earned the right more than a father who served in the military, himself, and sacrificed a son, who also worked and lived, and died for his country.

I'll get the finger for suggesting it, but do you suppose the Military Police who ticketed Nieto are sympathizers? or, (horrors), Muslims? (Not impossible, since one of the policemen in the recent Muslim demonstration in NY was! He just looked the other way when one of the demonstrators assaulted a female onlooker who carried a sign upholding America!)

I worked as a civilian contractor in Iraq for 2 years, many times working with the civilian population. During that time, I tried to get a better understanding of how they thought and felt about we, "non muslim infidels". The one thing I came away with was that Islam IS a religion of peace and love, when dealing muslim to muslim.

For we infidels, we have three choices, 1) pay a heavy tribute to the local muslim authority and agree to live as less than third class citizens, honoring their wishes in all matters, 2)converting to Islam, or their personal preference, 3)we should be killed.

Sounds like peace and love to me! I find it very interesting that the Arab nations have a large legal fund set aside for prosecuting any iitems that they see as unfavorable against Islam here in the U.S.

I can only hope that we can come to a remembrance of what it took for us to become a free and independant nation, ONE NATION, UNDER GOD, WITH LIBERTY AND JUSTICE FOR ALL!

And I will end my diatribe with the now politically incorrect, Amen.

Nowhere did I state that this man’s stickers were really, really bad. Read more carefully what I wrote. I wrote that the military were asshats for forbidding this man from driving his car on base. And as for bombing Pakistani villiages with unmanned drones, yes I’m in favor of that. That is when we are taking out leaders of Al Qaeda or Taliban. Or are in hot pursuit of fighters who have come across the border to attack U.S. forces and then retreat back over the border. UAV’s rock!

Finally, if this man fails to visit his son’s grave, in Arlington no less (it is a distinguished honor to be buried at Arlington) over some stickers, than that is just sad. As I wrote (feel free to read it over again) he should by all means proceed with his suit but it should be understood that he is not forbidden from visiting his son’s grave.

My heart is ripped open for this proud,devoted father.
Sounds like Gordon England's pet CAIRing pal, the "Legendary" Hesham Islam, holds sway over even Arlington Cemetery. Of course, the White House has the ear of Emir Norquist also.
The indecency of this is all that keeps such issues from being farces.
Potomac swamp fever, like any other disease can have effects on the mind. But this recent blight has evidently rotted the soul as well.

I think what the Senior Chief failed to explain is that, as a Military Retiree, we are still subject to the UCMJ.

It seems like the Base CO, possibly following DoD directives, is going too far. However, that's the military. I don't agree with the essential banning of the First Amendment. In addition, when entering most military bases, one also waives a couple of their other rights. Even though I had a Permit to Carry, I couldn't even take my unloaded weapon on the base without fear of retribution. Then there's the arbitrary vehicle searches. (For scheduled searches, the Base CO usually issues a letter of authorization)

I find myself thinking that this article is a poorly derived joke or a misinterpretation of the facts… I just cant imagine this would happen. If this is indeed true then SHAME on those officers; here is what I think.

I as well as many of you... spent many years in the service defending the right for our citizens to practice Freedom of Speech, as well as the other rights they enjoy; and whether we agreed with what they said or not was backseat to the RIGHT for them to express it. We have put our lives on the line for them; protecting them and their posterity and safeguarding these rights. As members of the military we too enjoy those same rights. No regulation or policy can supersede the CONSTITUTION !!! Do these officers understand that? The CONSTITUTION is the highest law in the land.

Freedom of Speech is Absolute!
There can be no filtering what is freedom of speech and what is not... It is what it says, FREEDOM TO SPEAK, to EXPRESS YOURSELF, with no strings attached...

Our founding fathers did not impose restrictions on that statement! There is no clause that says you can have Freedom of Speech except for.....

Freedom of Speech either stands for all to practice this right or it stands for none. There is no gray area here.

As far as that Magistrate; Ship his ass off to IRAQ or Afghanistan... and the commanding General should either rescind this Magistrates edict or resign his own commission. We don’t need leadership like that in the military. Both of those Officers are a joke!

And if either of you Gentlemen want to discuss this with me then respond and leave your ph#, I will be more then happy to say this to your face.

I've been reading for a long time about Formerly Great Britain's fall before the forces of Islam.

Chesterton says somewhere ("The Ball and the Cross", I think) that he didn't like the cresent symbol of Islam because it tends to come together, forming a complete circle that closes us all in.

I really think the English are past saving. You have a country where people have been arrested for selling produce in pounds and ounces instead of kilograms. Where RFID chips are put in wheelie-bins to make sure you're throwing away the right stuff in the right bin. And just recently, a small-business owner was visited by the Rubbish Authority (or some such government official) and fined £300 for throwing a sandwich wrapper in his trash can.

I read that one a few weeks ago, and reporting it now, it seems so outrageous and far-fetched that I had to see if it's real. It is (here's the UK Telegraph):

I would rather see a million British immigrants on our(US) shores than one Mohammadan.

Yes, Nieto is a civilian which I did overlook, but even civilian employees of the military sign papers to place themselves partly under military regulations-- including these types. I fully agree that Mr. Nieto should win his case, but realistically I think the deck is stacked against him and he won't. Politics does generally trump justice.
