"Elevating" women under sharia, in the way "below sea level" is referred to as a level of "elevation."
Of course, apologists will always label practices that result in bad publicity for Islam as "cultural," discounting the fact that "culture" is a projection of a population's values, and interestingly, the religious fervor of Muslim societies manages to stamp out all manner of "cultural" practices, but never the supposedly "cultural" subjugation of women.
As was the case with communism, we're told the system will bring about heaven on Earth, except for the fact that no one ever seems to be doing it "right" (because the lack of real accountability to the people removes the most practical motivation to govern well, even if the mode of government were actually a decent one). But, hey, let's allow sharia to take root in, say, Britain, or some other Western country, and, seriously, this time things will be different. Honest.
"Muslim women in the streets against ‘talak’ or Islamic divorce," by Kalpit Parajuli for Asia News, December 1:
Kathmandu (AsiaNews) – Hundreds of Muslim women along with their supporters took to the streets of Nepalgunj, a town in western Nepal, to protest against ‘Talak’ or Islamic divorce. The demonstrators, including 465 divorced Muslim women, human rights activists and about 100 Muslim men, marched on 26 and 27 November to demand immediate compensation from the women’s former husbands as well as equal division of assets after divorce.
Many Muslim women said that after divorce they were left with no support. Some said that they had to go back to their original families or find shelter at human rights organisations.
“Muslim men release (talak) their wives from the marriage, i.e. divorce them, but then no one thinks about them,” said Sima Khan, president of the Muslim Awareness Federation, one of the protest groups that organised the demonstration. “Women don’t get any of their husbands’ assets, or any support. This has increased the incidence of divorce in the Muslim community. We must achieve equal rights for these women,” she added.
“My husband divorced me five years ago. Now all my children are with him and I live with my parents,” said Roni Ansari, 39, who marched in the front of the demonstration. “I don’t have anything except a small job for my basic needs. Where will I be if my parents did not allow me to stay with them in my old age?”
Homelessness is in fact a problem for many Muslim women. Some are driven out of their parents’ home once the latter pass away.
“I escaped when my husband and mother-in-law tried to burn me with kerosene,” said Shano Khan, 17, who divorced three months ago. “Now I am staying with my parents who are not that happy for me to live with them. I don’t have a job. What can I do?”
“Many women go hungry or get into prostitution to make ends meet after divorce,” explains Nitu Haluwai, a Muslim human rights activist.
The situation is due to the fact that Nepali Muslims do not adhere to the country’s divorce law which requires both parties’ consent. Instead, under talak if a woman wants to divorce she must ask for her husband’s permission, and then pay him a certain sum.
“The existing divorce law does not respect our religious precepts,” said Nazrul Hassen, president of Nepal’s Muslim National Federation. “We have a different system and therefore do not consider it [the national law] as binding on us.”
As reported by the Nepali Times the situation is dramatic in Nepalganj where 236, mostly rural Muslim women have been divorced by their husbands on the basis of talak.
However, Muslim leader Maulana Abdul Jabbar said that talak, which is based on the Qur’an, has been badly interpreted over the years.
“Divorce proceedings ought to take place in accordance with the law but without transgressing religious values,” he said.
At the risk of sounding like W, I thought that Nepal was a Hindu nation. Apparently it has entire Muslim provinces. That explains a lot.
Can we stop referring to talak as 'divorce?' It's not. It's literally 'repudiation.' Marriage = sex slavery; divorced = fired as a sex slave. And of course it's always phrased in the passive construction (as it's accomplished simply by saying or even texting a phrase), since Muslims are so good at taking responsibility for their own actions. I'm not even a big fan of marriage but I find it incredibly offensive to refer to Muslim "marriage" as anyhing but sex slavery. That's all it is. That's all it ever can be. Even if it's carried out under free-world civil law, the Muslim "stamp of approval" lowers it to the status of sex slavery.
Can we declare a ban on using decent, positive terms to refer to something that Muslims have lowered to such despicable practices as to be inappropriate to discuss in mixed company? Muslims don't even say their word for 'wife' in mixed company, so this is their opinion too, not just mine. 'Wife' = 'that which' (not 'she who') 'is legal to penetrate.' They just call their 'wives' 'cousins,' since the term is too offensive to say. Anyone with me on this?
Talak is an Arabic word meaning "to release" or "to divorce". Under the Muslim law, talak means "to untie the matrimonial knot by articulating a word denoting divorce."
If a husband utters the word on his wife, the two of them would automatically be divorced and the wife would be in a state of iddah. If, during iddah, the parties wish to reconcile, the divorce may be revoked without their having to go through the process of nikah. Allah says:Take them back on equitable terms or part with them on equitable terms." Qur'an:65:2 Muslims can not live in western nations without the "cultural" subjugation of Islam.
But no! Islam is supposed to "elevate" women! What could have happened?
Casey, 'talak' means 'you are repudiated.' 'Nikah' means 'sex,' 'rape,' 'sex slavery,' 'child molestation,' 'incest,' and 'marriage.' In practice, it is sex slavery. Read any buku nikah ('permission to penetrate'). It is a legal contract between two men which makes a vagina legal to penetrate. Those are not my terms. Those are Sharia's terms. Remember, there are no 'women' in Islam. There are only 'vaginas.' There is no 'marriage' in Islam. There is only 'nikah.' There is no 'divorce' in Islam. There is only 'talak.' These terms do not exactly translate the way you think and I think that we would be doing the world a service by calling them what they are. It would also be respectful of the Muslim World for us to use their terms to define their sick practices and laws, just as it would be respectful of the Free World to not denigrate our customs and laws by associating them with Mohammedan sex slavery/child molestation/incest.
Another nice custom the Chinese muslims(Hui) retained, was foot binding.
What's interesting is following the discussions of pious muslimahs themselves over Islamic nikah practices. (I agree with jdamn on this; the Muslim form of codified relationship between a Muslim male and female(s) should not be called "marriage," as the latter word carries connotations of love, exclusivity, and sacrifice that the word and actuality of 'nikah' does not. Jdamn is correct in that 'nikah' is no more than a contract between two males regarding the right to the sexual penetration of a woman, in return for a one-time cash payment and her ongoing feeding until she is disposed of.)
The hijab-pulling over polygyny and the dreaded triple-talak is amusing, until you realize two things: that they are truly, seriously fearful, and yet they absolutely cannot see that what they worship is the wellspring of their fear.
It's very common to see the word 'dowry' used for 'mahr'. A dowry is given by the bride's family to the husband.
'Mahr' is a bride-price, paid by the husband for the use of the wife's genitals (booza).
The French 'niquer' meaning 'to f***' comes from Arabic, via Algeria
Étymol. et Hist. 1. 1890 arg. milit. « posséder charnellement » (à Alger, d'apr. Esn.); 2. 1918 id. « attraper, punir » (d'apr. Esn. Poilu, p. 370). Mot sabir d'Afrique du Nord, tire de l'ar. nāk : i-nik, 3e pers. de l'ind. prés. « il fait l'amour », Lanly, p. 101.
[Marriage] carries connotations of love, exclusivity, and sacrifice...
It also carries connotations of consent rather than the sale of one's person under physical duress and threat of death. It also carries the connotations (and the literal meaning in the Judeo-Christian tradition) of "love, honor, cherish." "Nikah" merely implies the relationship between a slave and its owner.
Silvester, the French translate it loosely and clean it up a bit. They don't call rape, incest, and child molestation "faire niquer." They make the same mistake as this article does by associating Mohammedan sex slavery with Judeo-Christian marriage, when in reality the two have nothing in common. What do you think they have in common, Silvester? Remember that cows breed too and it's not elevated to the level of marriage.
jdamn
Nepal doesn't have any Mohammedan provinces. Only 2% of the people are Mohammedan - like Outer Mongolia.
Of course, that hasn't stopped the new Maoist regime - virulently anti-Hindu and anti-Buddhist (the largest religious minority) from working for special rights for Mohammedans. In fact, in this case, they even let Mohammedan 'rights' trump women's rights.
Why am I not surprised?
jdamn I was agreeing with you. Your explanation of the meaning of 'nikah' is borne out by the French usage of 'niquer', coming from 'nikah', which means to f***, not to marry. The pieds-noirs obviously understood the distinction, ie that it's not a contract to marry in our sense, but to f...
'Only 2% of the people are Mohammedan...'
Are you listening America? Such a small percentage of the poplulation, and still inroads are made for Shari'a.
Watch, and learn.
Silvester, the French distinguish between consensual sex and child molestation, rape, and incest. That was my point, although I wasn't very clear. 'Sposer' is French for 'to marry' if memory serves me correctly. It's true that they understood it as merely a sexual thing and that they therefore separated it lexically from marriage.
Nepalganj or Nepalgunj only began to get a sizeable muslim population when Democracy was introduced by the late King Birendra Bir Bikram Shahdev.
I visited Nepalgunj a number of times because I had many relatives who live there.
The illegal Muslim population are aliens who have crossed the non-defended border of Rupadia (India) and Nepalgunj (Nepal).
Their operations throughout the 1990s gt more intense and more daring, even sparking off a riot which they paid heavily for when Gurkhas pulled out their Khukris and gave them a good lesson.
With the Late King, a lot of mistakes were made including the building of a mosque in the capital.
During the Rana rule and the King's rule, Muslims were not welcome in Nepal. Now, thanks to so-called democracy, they hold government positions and allowed into the country.
Many Pakistanis have purchased their citizenship and have set up Madrassas in Nepal and have also set up Terrorist networks to attack India.
Now there are mosuqes in even the most remote regions of Nepal, something unheard of before.
God knows what will happen now.

Nepal is not the only place that is applying the Sharia law ,It is happening right here in Tennessee.
Judge Donna Fields threw out of the house, the wife and the two boys. They would have been in the street if they did not have a friend opening her home..
Prior to her ruling, Judge Donna Fields,Circuit court, Division 7 in Memphis, requested 2 meetings with the boys. The transcript of the first meeting was sealed . In the second transcript, Judge Fields threatened the boys to be thrown in the alley if they don't accept to go with their father.
Judge Fields totally refused to look at the father's link to terrorism.

Do you know why the Sharia law is creeping in the family courts?
Sharia law is very explicit about divorce, custody, and assets. The man keeps full custody of the children, and is the one who will teach religion to the children and will decide their education. The woman has no say. The children are the husband's total property, especially if they are boys.
The wife is usually sent back to her family. There is no alimony , no support, only shame .
The only assets the wife is entitled to is the sum of money written in the automatic agreement made on the date of the wedding by the families. Most of the time, the man is buying the woman. He has to pay or bring jewels before the marriage. In case of divorce, the woman keeps the jewels.
This is only a simple draft of Sharia law.
In the USA, Judges in divorce and custody cases are supposed to follow the law of the state. Most of the time , the children stay with the mother, especially if the mother was a homemaker. The father is given visitation rights. The assets acquired during the marriage are equally divided and the woman is never left on the street with the children. When the children reach a certain age, they can go and live with the parent of their choice. If proof of abuse, neglect, or danger is brought up, supervised visitations are ordered to protect the children
How can radical Muslims introduce Sharia law without creating a conflict, and what are they using to do so?
1) Ignorance of Islam
Most judges in family court don't have any education about Islam, and they take for granted what is presented on their desk by lawyers.
2) Political correctness
Radical Muslims are masters in using U.S. discrimination laws to further their cause, even citing Sept. 11.
3) Corruption
Radical Muslims know the power of money . You can "buy your way" almost anywhere in the middle east . The first thing they will try is to pay someone for a favor. In high profile divorce cases, predatory lawyers are making the rules, not the judges. A predatory lawyer is what we call a "high powered attorney". He is not the one who knows the law best , but he is the one who knows the judge. He will start by giving a very good accounting of the assets. Then the show will start…… Children are used as pawns, given one or two attorneys ad item who are supposed to listen to the voice of the children.
Children are sent to appointed psychiatrist who are working under a court order and have to go in the direction they are told to. Everybody is on the pay roll. Predatory divorce lawyers can charge five-to-six hundred dollars an hour.
They know how to keep the fire going. At the end , they will give favor to the one who had the money. Radical Muslims will use this, and pay in order to have their way in court.
Once an example is set, and the woman has lost everything in court, her children are forced to be Muslim, forced to go to Haj, forced to live with their father AGAINST THEIR WILL. It is an open door to the Sharia law. It creates a precedent, and then other women in this country are scared to face the law.
What can be done to stop this creeping Sharia?
We first need to make sure that every law school in the country is teaching the principles of Sharia law so lawyers and judges can recognize it when it comes on their desk. But most important we must make sure that the lawyers and the judges who don't follow the laws are punished . The only way is to put the pressure on the politicians. In the State of Tennessee, the House of Representatives has power over the Tennessee Judiciary. Attached are some articles pertaining on my case. Judge Donna Fields broke the laws of Tennessee . I went in front of the legislature to testify, and if you listen to the tape, you will hear that I was told not to mention terrorism. Because the case got some media attention, the complaints against the Judge are going in front of a panel.
This panel should be public; and the people who made the complaints should have a voice. It is not the case. Everything is kept secret. Politicians and the local media are silent. It will take someone from out of state to expose this judge as an example of a promoter of Sharia Law, in order to "clean up the place".
We must abort the growth of Sharia law in family courts. Let us start by showing an example and learn from it.
Isn't that what this county is all about? Justice and protection of its children?
IF THIS JUDGE GET AWAY WITH HER EVIL ORDERS, IT WILL WIDE OPEN A DOOR TO THE SHARIA LAW IN TENNESSEE AND FROM THERE IN OTHER STATES.

Tartine, you're awesome for testifying. Please keep up the good work.

I will never stop until those greedy lawyers and corrupt judges are stopped.
IF we let those Mohamed Ben youssef rule our court system through the corruption , fear or greed, we will suffer.
They are a dark cloud over this country and it need to be exposed.
by the way , I had fun reading all the explanations given here for the french word "niquer"
It sounds like most of the french teachers are learning slang before Voltaire.
It is a very very slang word if used in a sexual meaning but there is also another meaning venant de "Faire la nique a quelqu un " and this would mean
defy somebody.
