A home-grown terrorist who was part of a group that planned attacks in Melbourne could be free in just over nine months.
After pleading guilty to being part of a terrorist group Shane Kent, 32, was jailed for a minimum term of three years and nine months.
Justice Bernard Bongiorno set a maximum term of five years after saying Kent had not abandoned his violent jihadist views.
The Supreme Court judge also said Kent was not genuinely sorry for his part in the terror group.
He said the group or 'jemaah' planned their terrorist activities to force the Federal Government to withdraw troops from Iraq and Afghanistan.
Kent was an enthusiastic member and he and the others were secretly recorded talking about jihad and the promotion of the Islamic cause by violence against the kuffar - Arabic for unbelievers.
"On each of these conversations, as in many others, he (Kent) spoke as a member of the group and not as an outsider," Justice Bongiorno said.
They talked of members of the "jemaah" needing to be ready to destroy buildings and kill people in a jihad.
"The actions of those who engaged in the 11 September 2001 attacks in the United States and the attacks on trains in Madrid and London were discussed in terms of praise and admiration," the judge said.
Kent, a father of three of Meadow Heights, could be out in just over nine months as he has served 1115 days on remand.
Justice Bongiorno said that Kent had a psychiatric disorder and psychiatrists had said he was remorseful.
"He is doubtless sorry for having imposed the hardship of his incarceration on his family," the judge said.
"However, I am not prepared to accept . . . that he has abandoned the cause of violent jihad."
Kent pleaded guilty to being a member of a terrorist group between 1 July 2004 and 8 November 2005 and of recklessly making a document connected with preparation for a terrorist act.
He admitted helping create an Islamic propaganda jihadist video featuring Osama bin Laden, tributes to "martyrs" and a graphic image of a dead young extremist.

Prior to the trial he warned all of the 1200 potential jurors that came before him that they must put prejudice aside and to excuse themselves if they thought they could not.

Then he ends up giving a three years and nine months sentence

Why is the West so ridiculously & irresponsibly soft on convicted Islamic terrorists? A desire to show sensitivity? There is absolutely no deterrence against home grown terrorists planning mass slaughter - if they get caught they'll probably get gentle judges and just a few years while they are look upon as heroes by jihadists, and of course they will plan terror again.
Convicted terrorists should be executed in short order - laws should be in effect to make this mandatory for this special category of crime. We have got to stop letting liberal sanctimonious morons endanger us.
The most interesting thing about the article is the headline that the Sun-Herald used.

The Sun-Herald should be congratulated for that headline.
Thus, those who only skim the headlines will absorb, almost without knowing it, the proper word to describe people like 'Shane Kent'.
The next step is for the paper to use the term 'jihadist' everywhere that it and other news outlets currently use terms such as 'terrorist', 'extremist', 'separatist', 'rebel', 'gunman', when relaying to us the reports that come in from all the jihad-wracked regions of planet earth where Muslims wage war upon non-Muslims, or upon deemed-insufficiently-islamic fellow Muslims.

With such cursory and unexplained determinations, of what use is a court?

All these judges have obviously never bothered to find out the definition of Jihad in Sharia Terminology, which is:

In 'Sahih Muslim' it is reported on the authority of Abu sa'ad Al Kudri that Muhammad was asked 'What is Jihad?' And he said 'To fight to make Allah's Deen (ie Islam) the highest'
Moreover Ibnu Qayum has laid down certain conditions for Jihad:
i) The Muslims must start or initiate the killing.
ii) The fighting must be against the Kuffar (killing the murtadeen (apostates) is called Qaatal al Ridda whilst killing the Baghee (rebels) is called Qaatal al Baghee, neither of these are Jihad).
iii) Al Ma'niyyah - having the intention of fighting Jihad to make Islam dominant (when conditions are suitable).
So we have these judges, like almost everyone in Kaffir lands, glibly living with and happily accepting the term Jihad, without realising its vicious intent.

The sentencing judge, Justice Bongiorno, noted that Kent was suffering from a serious depressive illness at the time he was a member of the group, from July 2004 to November 2005.
However, Justice Bongiorno in fact rejected submissions by the Defence team that Kent was therefore "psychologically vulnerable" and that this in turn affected his moral culpability for his crimes.
Justice Bongiorno stated that such submissions, could be given "very little weight" in sentencing because Kent's offending was not impulsive and occurred over a substantial period of time.
Justice Bongiorno went on to state that:
"(Kent)had ample opportunity to reflect on his membership of the jemaah (terror group) and appreciate the consequences of it. I am not prepared to accept, on the material proffered, that he has abandoned the cause of violent jihad.
There is no admissible evidence of his having done so, or of his being genuinely contrite for what he did."
So, whilst the sentence is - in my opinion - pretty pissweak, at least the judge did not fall for the usual psych defence bullshit.
Also, in Australia an accused who pleads guilty does - for better or worse - usually get a sentence reduction for this reason alone.

I think the term jihadist is appropriate, as is traitor, but I prefer the Islamic term "mujahid". I like this term because it clearly connects the man and his actions to the Islamic context which explain them. These people clearly see themselves as the mujahideen (holy warriors), and I am not one to begrudge them that title. On the other hand the Islamic apologists would have us refer to men like Shane Kent as "terrorists" or "extremists" or anything else that obscures the Islamic basis for the mindset and subsequent actions of Mr. Kent and other Muslims like him.
