A Glendale man accused of slaying his daughter in an "honor killing" will not face the death penalty.After sparring with the suspect's defense attorney over its death penalty review process, the Maricopa County Attorney's Office has said it will not seek death for Faleh Almaleki, 49.
The Iraqi immigrant is accused of slaying his daughter, 20-year-old Noor Almaleki, for being "too Westernized."
Police say he used his Jeep Cherokee to run down his daughter and another woman in a Peoria parking lot Oct. 20. Noor Almaleki later died of her injuries.
Almaleki is charged with first-degree murder, aggravated assault and two counts of leaving the scene of a serious accident. He has pleaded not guilty to all charges.
The decision not to seek the death penalty comes after Almaleki's attorney, Billy Little, a public defender, asked a judge to take special precautions to ensure the County Attorney's Office wouldn't wrongly seek the death penalty because Almaleki is a Muslim.
Little requested that the office make public the process it uses to determine whether to seek capital punishment.
"An open process provides some level of assurance that there is no appearance that a Christian is seeking to execute a Muslim for racial, political, religious or cultural beliefs," Little wrote, referring to County Attorney Andrew Thomas' Christian faith....
Prosecutors said Almaleki has admitted killing his daughter because she disgraced the family by not following traditional Iraqi or Muslim values.
They liken the case to honor killings that occur in the Middle East, Africa and other parts of the world. In tribal societies where the practice occurs, male family members feel they must kill a rebellious female relative who shames them by not adhering to traditional values.
Noor Almaleki had reportedly married a man in Iraq and returned to Arizona to live with a boyfriend and his mother in Surprise, police said.
Appalling. I hope the DA changes his mind. This man committed murder and should be executed .
Not only is this a violation of justice for Noor it is a slap in the face to all Americans to give special treatment to a Muslim because he is Muslim.

Did anyone review the Arizona death penalty statute to see if it requires proof of factors beyond premeditation to warrant the DP?

The man committed first degree murder. Under Texas law he should die for his sin. So, apply the law as set forth in the Texas judicial constitution.
Moral cowardice is to be expected from our PC/MC judiciary but this decision may have an unintended consequence. Placing this animal on death row will sequester him from the general population and, eventually, deliver him to his 72 virgins.
In this case he will be thrown in the general population cesspool (where he is the virgin) to live out the rest of his life in confinement, fear and, with luck, as someone else's property (IOW a big heaping spoonful of the life he wanted to feed his daughter). At the time of the murder, the press insisted that Noor AlMaleki violated her father's 'Iraqi' values, not his Islamic values, as there are no such Islamic values. Now it turns out there are; not only Islamic values about what constitutes 'dishonor', but Islamic values concerning the rights of the parent in resolving a dishonor event.
This official admission is worth a lot. Too bad that we still can't talk about it - we wouldn't want to give the appearance that Christians are weighing the merits of Islamic values over Christian values. Critical examination also constitutes an affront to Islam.

The prosecutor should turn this argument on its head by actively seeking the death penalty, because by not doing so, we are "giving the appearance" that Islam is a violent creed and not the ROP. The defendant has tried to "give the appearance" of being a devout Moslem in his actions, and thus has tried to "hi-jack" this "noble religion". If we accept his devotion as an excuse, it means we accept the idea that Islam is a violent religion. When, of course, we all know it is the ROP.
I'm surprised some imam or other hasn't declared him an apostate for his efforts to besmirch the good name of Islam.

The first thing that went through my mind was what the Arizona state position with respect to capital punishment was. I found an interesting PDF document here http://www.azag.gov/CCC/section2.PDF. Ten circumstances have been defined any one of which would give the state a basis to decide that the death penalty should be imposed.
These circumstances are very narrowly defined and, if we presume that the prosecution would have to establish these circumstance beyond a reasonable doubt, that state may have opted to go for reduced penalty in order to ensure its chances of conviction.

The court is not a public relations expert...The court is supposed to enforce the law, and not indulge itself with social engineering in the form of dhimmitude...In other words, the court has no business worrying about the feelings of Muslims...Where is that in any law book?
Also note that the article reports that it is the defense that has proposed that the death penalty be passed over in this case due to the defense's red herring of the possible "optics" in the Moslem world should a Moslem be executed for a capital offense. The state's reasons for not seeking the death penalty were not stated in this article, but possibly are as I speculated earlier.

I think any lawyer worth his or her salt could have this decision overturned as un-Constitutional, since it essentially sets up a "religious test" for a legal matter.
In this case, providing a judicial edge and clear benefit for merely being a Muslim.
I notice that this guy is pleading not guilty to all charges. The DA has set a precedent to allow his religion / culture to detract from the penalty-phase. So, will Alameki's lawyer try to run with that & base his actual trial-defense on religious grounds?
This DA has set reasoning on its head. The fact that this guy is muslim has everything to do with his case. I oppose on ultimate principle the criminal death penalty with regard to Muslims, because it only perpetuates their status as citizens of our societies, subject to our criminal laws. In fact, I oppose on ultimate principle any criminal punishment of any Muslims in the West. I realize that while we are in this absurd situation of permitting Muslims to immigrate, as well as permitting Muslims to continue to be, and to become, citizens, we need to control them through our laws (if our dhimmitude doesn't blunt the force of our laws too much).
But ultimately, the West will not be able to manage the problem of Muslims -- and it will only continue to get worse and more unmanageable as each decade passes and more and more Muslims plant their roots deep within our societies and our institutions, facilitated by our prevalent PC MC culture -- without considering all of them under the category of enemy combatants. Once that realization sets in, deportation will be the most humane thing we can do.
"If honored by Arizona Courts" - This Honor Killing not only inserts Sharia Law into our country it also implies to Islamic Muslims that Sharia Law has superseded the laws of America & "killing of Americans – if necessary” to achieve their religious or political goals is clearly on the menu.
