And as for his being a "nonpracticing Muslim," remember that Hassan was a self-identified Muslim enough to start an Islamic TV station, Bridges TV, designed to improve the image of Muslims and Islam in the U.S. It isn't as if he was indifferent to his faith.

Franczyk has scheduled a May 4 hearing to consider defense challenges to an alleged confession Hassan made to Orchard Park police about an hour after his wife was killed in the office of their Bridges cable television station.
During a brief court session Friday, Franczyk kept in place his order barring a psychiatric defense for Hassan, but he agreed to reconsider if Hassan's attorneys file motions in coming months.
Bogulski recently claimed that the victim drove her husband into an uncontrollable homicidal rage, and he and Rogers said Friday they are confident they can convince the judge of the propriety of their defense strategy. They acknowledged they need the court-approved release of some of Hassan's funds to finance their effort....
The two attorneys also said they will begin court action to try to get Hassan's two children returned from Pakistan, where they were taken by Aasiya Zubair Hassan's relatives.
Hassan fears the children "will be radicalized" in Pakistan, Bogulski said.

I don't know about anyone else, but I am extremely offended that the advisors of this cretin would have the nerve to say that just because this beast beheaded his wife, and because we the public are horrified and outraged by this, that now we, the public, are to be accused of being Islamophobic! As if we are doing something terrible! Talk about shifting the blame! I am just beside myself at the arrogance and sense of entitlement these people display! Judge Franczyk should require Hassan's attorneys to show how the public's opinions in this case have any bearing on the facts in the alleged murder. Perhaps Hassan feels that Islamphobes drove him to behead his wife? How? What is the mechanism?

That's pretty weak! Phobia is defined as an irrational fear limiting an individual's appropriate and effective response to reality. If there is any irrational fear here, it must be Hassan's gynophobia instilled by his devout albeit "shirking" belief in Islam. I suppose that shirk can also be blamed on Islamophobes, but that's just as weak. After all Islam is supposed to be the supreme religion. How possibly could the opinions of najis kaffirs have any negative effect on Muslims, "The Best of Peoples"?
If Judge Franczyk eventually allows Hassan to cop to insanity, it will only be judicial recognition that Islam is flawed by its insane dogma and dictates, and the too-sensitive and "weak" nature of its gullible adherents.

Hassan might have a potent defense argument here. He feared that his wife, after the divorce, planned to take their children back to Pakistan, where they would be radicalized, or made into terrorists. He, on the other hand, wanted to keep them in the U.S. where they would receive a secular and humane Western education. He had to kill her to save his children from a fate worse than death.
This hadith from Sunan Abu Dawud doesn't refer to a domestic situation, but does refer to a beheading of a woman:
"(1) Narrated Aisha, Ummul Mu'minin: No woman of Banu Qurayzah was killed except one. She was with me, talking and laughing on her back and belly (extremely), while the Apostle of Allah (peace_be_upon_him) was killing her people with the swords. Suddenly a man called her name: Where is so-and-so? She said: I I asked: What is the matter with you? She said: I did a new act. She said: The man took her and beheaded her. She said: I will not forget that she was laughing extremely although she knew that she would be killed. (Book #14, Hadith #2665)"
Examples of women being beheaded by Muslims can be found in Islamic history and in the news today.
Is Mr. Hassan being accused of beheading his wife or of being a Muslim? His lawyers are understandably confused and challenged. Think how simple this case would be if it did not involve a Muslim as the perpetrator. We all know by now that a criminal act committed by a Muslim, anywhere in the world, is not a simple matter to prosecute. In fact, the defense lawyers have a politically correct advantage over the prosecution, which is forced to appear as the instrument of Muslim victimization in such cases.
It is easy to envision Sharia courts being adopted in the US at some point. We are stretching credulity and sanity beyond reason to accomodate Muslims committing crimes. Our legal system is incompatible with Sharia Law and cannot function effectively with politically correct injunctions to comply with.
Our brilliant lawyers, judges, intellectuals, and government are turning what should be a "no-brainer" criminal case into a very complicated one by comingling PC, multiculturalism, diversity, fear of retribution, fear of being called 'racist', and other forms of cowardice.
Look at recent cases involving Muslims, whether honor killings, or the imprisonment of Rifqa Bary. How can one not conclude that Muslims are slowly subverting our legal system, weakening it, corrupting it, contorting it, squeezing it, into their image of what is 'just' and 'right'.
He may be described as a "non-practicing Muslim", but he appears to need no more practice. He's fully qualified in beheading - as required by the Qur'an for all good Muslims.
