New York synagogue bomb jihad plotters: the Feds put us up to it!

The thing about this is, if someone came up to me and said, Hey, let's bomb a synagogue, I just wouldn't go for it. Ever. Under any circumstances. No matter how much I got "badgered."

Defense attorneys say an alleged plot to bomb New York synagogues was hatched and directed by a federal informant.

Lawyers for four men from Newburgh have filed a motion to dismiss the terror indictment against them.

They said the informant badgered the defendants until they got involved in the plot.

They said the informant chose the targets, supplied fake bombs for the synagogues and a fake missile to shoot down planes. The motion said he also offered to pay the defendants, who attorneys alleged weren't inclined toward any crime until the informant began recruiting them.

"The government well knew that their case had been a government-inspired creation from day one and that the defendants had not been independently seeking weapons or targets," the motion said....

Nice video, but admitting that pre-Koranic scriptures are authentic would legitimize non-Islamic faiths, thereby opening the door to treating non-Muslims as equals, which would be un-Islamic.

Jaish-e-Mohammad—that would be the "Army of Mohammad".

They are primarily a Jihad terror group out of Kashmir. They are responsible for numerous terror attacks, including a suicide bombing of the Jammu and Kashmir legislative assembly building in the Indian-administered Kashmir capital of Srinagar in October 2001 that killed more than 30.

In July 2004, Pakistani authorities arrested a JEM member wanted in connection with the 2002 abduction and murder of US journalist Daniel Pearl. In 2006 JEM claimed responsibility for a number of attacks, including the killing of several Indian police officials in Srinagar. JEM members also were involved in the 2007 Red Mosque uprising in Islamabad. In 2009, Pakistani authorities detained several JEM members suspected of taking part in a 3 March attack on the Sri Lankan cricket team in Lahore.

In June 2008, they expanded their activities, and began attacks against US and Coalition forces in Afghanistan.

The idea that it represents a great leap for a group involved with the vicious beheading murder of Daniel Pearl to bombing synagogues is ludicrous.

I hope the prosecution presents information about this barbaric Jihad group to the judge and jurors.

It seems that there is a tradition in the US to use agent provocateurs:

In the United States, the COINTELPRO program of the Federal Bureau of Investigation had FBI agents pose as political radicals to disrupt the activities of radical political groups in the U.S., such as the Black Panthers, Ku Klux Klan, and the Student Nonviolent Coordinating Committee.

New York City police officers were accused of acting as agents provocateurs during protests against the 2004 Republican National Convention in New York City.

Denver police officers were also found to have used undercover detectives to instigate violence against police during the 2008 Democratic National Convention. This ultimately resulted in the accidental use of chemical agents against their own men.

Creative defense but I doubt the truth of it.

I'm serious. The defense they're using is the exact same one as used in a Law & Order episode I saw. Hang on, let me see if I can find the title of the episode.

I found it! The episode is called "Great Satan" and aired on October 9, 2009.

Similarities between this and the Law & Order episode:
• both involve a plot to bomb a New York synagogue
• both involve missiles to shoot down planes
• both involve a police informant who the defense claims badgered the other men into going along with the bombing and supplied the materials, which came from the government (in the episode, it's from the police who were working in cooperation with the FBI.)

Here are some quotes from a summary of the episode:

• "Sameer insists he is not a terrorist and that he loves this country. As they move him to the car, he says his friends are going to do something to hurt America. He says he can help them [the police] ... Later, we see Sameer entering a diner and he meets up with his friends ... Sameer tells him to wait, he wants in. He’s heard them talking, saying that the stuff the country has been doing is wrong and they have to pay. He knows electronics and that can help. The guy tells Sameer to come to his place tomorrow and they will talk. Later, in the interrogation room, they [the police] listen to the recording Sameer made of the meeting. He says the guys have been talking about justice, jihad, blowing things up – in New York."

• "They [the police] found C-4 residue and maps of the synagogue. They had plans to shoot down military planes with stinger missiles."

• "Cole [one of the terrorists] admits that he gave Jackson [from another terrorist group] a detonator, and Cutter and Rubirosa are stunned to hear this, since he got the detonator from the police. He was supposed to test it but never got around to it. It seems the bomb that destroyed congregation Beth Sinai was set off using a detonator that came from the New York City police, not from the defendants."

• "Cutter [the prosecutor] is very upset about how this whole thing looks – they supplied the real detonator for the real bomb. He says the defense will argue the whole case was manufactured by the police."

McCoy [prosecutor] says with tempered sarcasm, “Just because we gave them the bomb, the detonators, the power supply, the remote control and motivational drugs?“ Rubirosa says they may want to drop the charges against Hassam and Darwish, but McCoy says no. They went to that synagogue with a bomb that hosts a shelter for non-denominational women who were sleeping there at the time."

• " She [the defense lawyer] has them listen to more of the recording, and points out that it seems Sameer [the informant] encouraging the others about the plan."

• "On the stand, Sameer testifies for Cutter, saying he didn’t have to talk anybody into anything, they are always talking about ways to hurt America and he did not like it, saying this is the best country in the world ... He only helped them get stuff they wanted. But the defense attorney says that the guys were just talking until Sameer got involved. She also said that he helped push things along"

So are terrorists now getting both their inspiration for their plots and their defense from old Law & Order episodes? =P

In Denmark this situation would not be possible, because the use of agent provocateurs are strictly regulated by law (Administration of Justice Act § 754).

As a general principle the use of agent provocateurs are prohibited - policemen under cover may not in any way assist or tempt citizens to break the law.

This prohibition does not apply if all of the following three conditions are met: 1) Strong grounds to suspect that the law has been broken or attempted to be broken, 2) other investigative steps will not be sufficient to provide evidence in the case, 3) the investigation is related to a crime punishable with minimum 6 years in prison.

As a general rule undercover police agents may not cause the criminal act to be more serious and can only be initiated by court ruling, and in case of a charge the defence lawyer should be notified about this measure.

Agent provocateurs cannot be used in cases regarding investigation of crimes against the safety and securety of the state or cases about crimes against the constitution, state authorities, terrorism etc.

There must have been a very, very sound reason why these agents approached the would-be terrorists in the first place.
They don't just go up to your average "arab-looking" Ahmed on the street and ask them if they'd like to go and blow up some synagogues and possibly an airplane.

These dudes must have been discussing such an idea and trying to hatch the plot when the agent stepped in to give some assistance, example..."hey, I know how it can be done and I even know someone who will pay to have it done and supply everything you need."

We'll see what the prosecution has on their plate.
If these guys do get off on a technicality like "Agents provocateur" then it will definitely set a precedent for future cases.

Any lawyer who can act out such nonsense deserves a role in Hollywood. It must be hard to keep a straight face when discussing the case with colleagues. I suppose some self flagellation and tongue biting techniques may help to keep a straight face.
