The White House is considering an end to its effort to prosecute the suspected Sept. 11 plotters in a civilian court and may send them instead before military tribunals, in an apparent retreat from President Obama's pledge to overhaul the Bush administration's detention policies.Last year, the Obama administration announced it would try Khalid Shaikh Mohammed and others in federal court in New York. That step came after Obama overhauled interrogation policies and ordered the shutdown of the U.S. military prison at Guantanamo Bay, Cuba.
But safety concerns about the trial have grown, and support for holding the trial in New York has eroded.
"It is politically untenable," said one official, speaking on condition of anonymity because a decision had not been made. "No place wants to hold a trial."...
Uh, no kidding. And also, a civilian trial would simply serve as a propaganda platform for the jihadis.

There is the huge cost of providing security if it is a civilian trial, while a military held outside a major city, on a military base, will require very little, if any, additional security and therefore expense.
There is the worry that a civilian trial, with all the attendant coverage, and drama involving juries (juries that might not be quite as knowledgeable about Islam as they should be, with some showing sympathy for the devil or trying to score their own private points against the government), could more easily become an object of Muslim propaganda.
There is, finally, the effect on Americans themselves, and on other non-Muslims in other threatened countries, who deserve to see these attacks as acts of war, and not merely those of common criminals, who normally are out for private gain, while these Muslim Jihadis are out to promote Islam, to further the aims of Islam, which is to terrorize the Unbelievers (see 9.5) in order to get them to submit to Islam, that is to remove all obstacles to the spread, and then the dominance, of Islam. It's important that this be understood not merely as the acts of separate criminals, but as those who have made themselves slaves to a Total Belief-System whose effects, on the minds of its adherents, over the past 1350 years of conquest and subjugation of many different populations of non-Muslims, can be studied, can be understood. No need to further confuse people about what it is that threatens them, what it is that is being put on trial.
As long as this president continues to cater to his leftwing camp the greater majority of the American people are going to reflect a no confidence attitude with Obama's terribly misguided moves. This president has got to learn that you cannot govern this country from a leftwing ideology and because he is the American people continue to grow angrier every day.

Hey Robert, you've must read this article I found on Rachel Maddows twitter account. She's openly advocating via this article a moral relativism between Al-qaedas Dr. Fadl's theological justifications for takfirism with Bush's and John Yoo's enhanced interrogation tactics. There is simplely no correlation here, this article should have been honest and stated Al-qaeda did not go outside its realm of traditional Sharia law.
These people litterally think of the Bush government as Al-qaeda without directly saying it.

I think that the real reason it is no longer possible to hold the trial in a US court is because of the idiotic statements by Obama, Gibbs et al. When they said that the murdering scumbag terrorists (my words - not theirs) would be found guilty and get the death penalty it was no longer possible to have a fair trial.
It was always open to challenge after those comments.
So I fear the relocation was for political expediency more than common sense. Obama couldn't afford to fail to secure a conviction, which was always cast into doubt after those statements.
I just don't buy the 'war' label.
The Muslim world's 1400 year old religious war against 'unbelievers' is their belief, and their's alone.
We haven't declared war on the government of any nation, nor they us.
The only folks who've declared war on us in this poorly named 'War on Terror' are Muslim clerics who represent no government and have no authority to declare war as we understand it.
We are not ignorant peasants cowering in fear as we await being invaded by an overwhelming force of Allah's Holy warriors. This is not the eighth century, or the tenth, or the fifteenth, and we have no obligation to participate in their fantasy.
Najibullah Zazi and the Christmas day 'would be bomber' are driven by the same fictional nonsense, were trained by the same organization (I believe) and had the same criminal intention of murdering people on our soil--not waging holy war on our soul, but murdering people; yet Zazi was treated as a criminal and people are up in arms that underwear boy wasn't treated as an enemy combatant.
It's not hard to understand why everyday Americans art still scratching their heads trying to figure all of this out.
And I definately believe that KSM and other Muslim terrorists should be given a public platform to propogandize their 'war' on we filthy kuffar--with all the references to Qur'an and Sunnah that goes with that.
The American public NEEDS to see and hear Muslim fundamentalists rail against Crusaders, Zionists, and the Great Satan and what better way to put the 'religion of peace' mantra to rest than to hear KSM and other 'slaves of Allah' tell us that Islam oh, so graciously offers, offers us, reversion, dhimmitude, or warfare.
And how much terror will such a public spectacle generate in Dearborn?
Our man-made, secular legal system does not recognize the acts of Muslim terrorists here as acts of war, but as criminal acts that violate OUR laws.
I don't know how the whole affair should be properly defined, but war ain't it, IMO.
I'm not sure where they should be tried, but I do believe it should be very public.
A civilian trial, with a jury of 12 peers, almost certainly to contain a Muslim or two, could result in not guilty.
What better way to enrage the US public than to acquit an admitted terrorist responsible for killing 3,000 Americans. Current administration is doing this not because of principles, but because of political reasons.

Dan Riehl makes the excellent point that once these people are in the US their lawyers will demand a civilian trial - and they would have a good chance of winning that demand.
Wait, I've just come up with a brilliant solution no one has every through of: Military trial in Guantanamo! Brilliant! [pats self on back].
The current administration is starting to realize that the American people are looking at the bottom line and what it's going to cost us and how we are reacting to the price tag as well as the imminent collateral danger that will surely foment wherever these guys are tried in the USA. We have muslim communities everywhere here and they are bound by their doctrines to blindly support the ummah to which KSM and his cohorts belong. I wish Judge Roy Bean could be here today. It would have been a cheap trial and sentence would have been caried out the same day. Those were the good old days.
Unfortunately, PRCS, These people don't think it's all a fantasy. But I would like to see an interview on a major network so that the American people can here from KSM himself what their motivations really are. It would be eye-opening.

PRCS: You may actually have a very good point. It would be great if, in one of America's media centers, we tried KSM and got to hear his rantings. Further, due to the Obama Administration's having openly said that it wants a guilty verdict and death sentence, KSM's lawyers would have an almost iron-clad case. Most NYC area judges would probably be unable to distance themselves from procedural dogmas in place since the early 1960's, and KSM would walk.
The outrage that would follow such a trial would probably force the Obama administration to resign, or, if it happened in an election year, the administration would be utterly trounced.

A military tribunal trial in Guantanamo for these terrorists is such a no-brainer that I feel like I'm in Alice's Wonderland with all these mature adults convinced that NY trails are the way to go. What do they think would be proved and worth it by going through all the extra risk, trouble, great taxpayer expense and time that is not already assumed anyway?
