A New York hotel is staking its claim to have invented a new hospitality niche - birth tourism. The Marmara Manhattan offers "an exclusive package for new mothers that wish to give birth in the USA", with the additional bonus of the newborn child gaining US citizenship.The hotel, which is part of the Turkish hospitality chain, exploits the 14th amendment to the US constitution, which states that all children born on American soil "are citizens of the United States and of the state wherein they reside".
The Marmara Manhattan, which is located in New York's Upper East Side, told The Times: "What we offer is simply a one-bedroom suite accommodation for $5,100, plus taxes, for a month, with airport transfer, baby cradle and a gift set for the mother." There are also medical fees of about £20,500.
However the price is a cheap and easy one to pay for US citizenship. Many will eventually use the newborn - known as an "anchor baby" - as a stepping stone for the immigration of extended family.
The hotel has so far sold 15 of the packages.
According to the US Citizenship and Immigration Services, the practice is entirely legal as long as the women can pay their medical bills.
However there are noises being made in Washington to close the loophole.
Gary Miller, a Republican congressman, told The Times: "They come to this country and have babies. The children are citizens. The children are eligible to go to school.They receive food stamps and social programmes. The American taxpayers are paying for it....

The entire notion of "birth tourism" would seem to go against even the letter of the 14th Amendment. How can someone whose mother came here on a tourist visa be said to "reside" in the US?
They are exploiting the 14th Amendment but it seems some judges have misinterpreted the 14th Amendment.
This needs a Supreme Court challenge, and it should be crafted such that a victory would sweep away most other anchor-baby situations as unconstitutional. In other words, this case might have the elements necessary to decide a broader, more founders-friendly, course of action and prevention.
One parent should have to be a legal resident for the baby to be American. Frankly, I think the baby should have whatever status the parent has. Legal resident parent, legal resident baby. I don't care how long they stay legally. That baby can apply for citizenship after the 7 years, etc. But illegal/tourist parent means illegal/tourist baby.

This process of having anchor babies has been going on for decades with the Latino community. The pregnant women would just cross the border and have their baby. then they go back with the firm knowledge that their kid is an American citizen with all the rights and privileges that they can exercise any time. Remember that Latino kid saying to Michelle Obama that her mother was illegal? No doubt the bleeding hearts had put her mother in a fast track to make her legal. Now the Muslim invaders want to bring this gift of instant citizenship to the Muslims. The 14th Amendment doesn't say a word about the parents, it's talking about person born in the U.S.
There are those who would argue that the children of parents who owe alegiance to other countries shouldn't be citizens, and I'm sympathetic to that view, but a Supreme Court decision in United States v. Wong Kim Ark interpretes it the other way.

This is the caliber of the person who believes the US Constitution—the greatest guarantor of individual rights the world has ever seen—should be changed to accommodate the barbarity of Shari'ah law and "Islamist Value".
I utterly disagree with ending jus soli citizenship. It's a good way to give ourselves a permanent, festering, trouble-making underclass much like the descendants of Falastin Arab refugees in most Arab countries.
Maybe a better way would be to get some Evangelical Christian group to hang around the hotel and pass out tracts in Turkish.
And, we could do a better job of policing our borders, turning away visa applicants in consulates overseas, and turning away would be enterers at borders and ports of entry. In short, let's just enforce the laws already on the books.
There's a simple (in concept, if not execution) remedy to this: Repeal the Fourteenth Amendment, and pass a new one that fixes all the problems that it is creating. Does it occur to you that long before that happens there will likely be forces arise that will guarantee that Sharia law is never implemented in the West, and that it will likely be abandoned in the Islamic world, as well? You should worry about that. Islam may keep a toehold in backwater regions of the world, but it has no future in a modern civilized world.

Even the Supreme Court has reversed itself in the past. Times change. Sensibilities change with them. Not even decisions of the Supreme Court are carved in stone. New reasons can be found to review a past decision. Nothing is permanent.
I'll ask again: how can someone born to a mother here on a TOURIST VISA be said to be a 'resident' of the USA? It's my understanding that children born to diplomats aren't citizens, even though they are born on US soil to people living legally in the USA.
