Philadelphia: Muslim sues trucking company after being fired for refusing to transport alcohol

Another lawsuit proceeds according to the principle that American businesses must change the way they operate in order to accommodate Muslims, rather than that Muslims must adapt to American society, laws, and mores. Not too long ago in America, a suit like this would have been laughed out of court, and Vasant Reddy would have been told to find a job that didn't involve his violating his religious principles. No more. Now it is up to the unlucky business where Vasant Reddy chooses to work to change the way it does business in order to suit him.

A Muslim man claims he was fired by a trucking company after refusing to transport a load of alcohol, according to a civil-rights lawsuit filed recently in federal court.

Vasant Reddy, 35, of Northeast Philadelphia, said it's against his religious beliefs to "consume, possess or transport alcohol or tobacco," according to the suit.

He claims he told this to his supervisors at the Philadelphia branch of Schneider National Inc. when he was hired in May 2009. They told him they could accommodate his beliefs, but the next month he was assigned to transport a delivery of Miller Lite, said Reddy's attorney, Justin Swidler.

When he complained, Reddy's supervisor told him that his refusal to transport the beer was an "operational violation" and that he would be fired, the suit said.

Reddy said he was assigned another nonalcoholic load that he transported successfully and that another driver moved the Miller Lite shipment, according to court documents.

Two days later, though, Reddy was given a choice: Resign or be fired, Swidler said.

"There is no dispute that he was fired for denying to transport alcohol," Swidler said. "They fired him because they felt like it was an insubordination for him to request such a thing."...

Swidler claims that fewer than 5 percent of Schneider's transports contain alcohol and, therefore, accommodating Reddy's religious beliefs wouldn't have been difficult for the company.

"The law is clear that if it creates an undue hardship, you don't have to accommodate someone," Swidler said. "Clearly, a bar doesn't have to hire someone who is Muslim, but it's different if it's only 1, 3 or 5 percent of your business."

If it's against his religious beliefs to transport tobacco, then they're not Moslem, since tobacco was unknown to the Moslem world until almost a millenium after Mohammed. If he still claims to be a Moslem, then he's guilty of innovation: introducing new beliefs after the "final" prophet, Mohammed, and so he's asking for a death sentence from the orthodox.

His suit makes about as much sense as a Muslim signing up to become a pig farmer then immediately bitching that he should still get paid without having to deal with the pigs in even the most remotely remote of fashions.

This appears to be a disruptive tactic. Firstly they make accusations of Islamophobia for not being hired so they put in place positive discrimination legislation to cover religion. Then when they are employed they cause more disruption by vexatious litigation and generally becoming a pest so most employers will think twice about employing them. So they make accusations of Islamophobia... Etc.

The company stepped in it when they said they would make an accommodation. Hopefully. the Accommodation is viewed to be a violation of The Company's Employment policy in general. Accommodations need to apply to all employees, equally. If no accommodations of a religious nature is afforded to others then none should apply in this case.

In a sane world anyway.

Britain has thousands of 'Off licences' (liquor stores) owned and operated by muslims.I believe most of them have at least some unbonded liquor in stock. It is complete hypocrisy and criminality. Seldom are they raided by the police.The police, of course, as as much use as a chocolate fireguard.

Did they say that? I have to wonder if this is what the company told this guy or is it something he just assumed? If the company says "we'll see what we can do", that's not a direct action for accommodation.

I have been given this line enough times to know the company won't take action but are saying they might just to get you hooked in and take the job. Will they act on the accommodation part? Probably not. I am deaf so I deal with this issue quite frequently.

Reasonable accommodation and undue hardship. Employers are legally required to accommodate an employee's religious belief, practice, or expression. The Manual gives extensive guidance on accommodations that might be reasonable for an employee who requests a scheduling change (to observe religious rituals or a Sabbath), an exception from usual dress or grooming requirements, or breaks at work to pray. The Manual indicates that employers would be well-advised to follow the "interactive process" required by the ADA in working with employees to come up with a suitable accommodation. Although the Manual notes that any expense beyond administrative costs is considered an undue hardship under Title VII, it also states that an employer might be expected to pay premium wages (for example, overtime pay to another employee) as a temporary accommodation for an employee who needs time off for religious reasons.

What isn't clear from the article is how the business operates. If the alcohol deliveries are a large portion of the business, then this guy is pretty screwed and should just find another job.

If by this guy refusing to deliver certain shipments places undue hardship on the business itself, then again he's pretty screwed for the lawsuit.

Otherwise as it reads, he has a pretty good case.

Now as for whether he's doing it deliberately to advance the cause of Islamic Supremacy, that we have to find out. If I were anyone involved in the case, I would look into who is involved beyond the plaintiff and his lawyer. If CAIR is providing support then we know what's really going on.

Can someone point out where it explicitly states alcohol and muslims don't mix or is this more like the covering of women to the eyeball and simply a cultural thing? Is it officially written that muslims can't handle alcohol. Oh, and I agree that I doubt they said they would accommodate him; probably made up or embellished truth to justify the lawsuit.

Why was this guy hired in the first place? I'm sure there are thousands of Americans with trucking experience looking for work who would happily transport whatever needed moving. Accommodation my a**! Let them look for work with some "halal" trucking company that won't offend their sensitivities.

What if it were rubbing alcohol, the kind people use to treat a bug bite or a strained muscle? Would he be able to transport it then? Alcohol is not going to stop existing just because this person didn't like it. I'm not sure what he was trying to accomplish. No one asked him to take a drink. The only thing he could do was push his religion on others (de facto). Because he didn't want to go somewhere, other people risked not getting their alcohol either. It doesn't make any sense. Why didn't he bring this up before he took the job? Doesn't he know that people use alcohol in the culture where he lives? Sigh... I guess he couldn't miss the opportunity for more frustration.

I wonder how Vasant gets to work. Unless his car is a diesel, he's using -- and "transporting" -- alcohol as part of his fuel. And are there still any full-service gas stations in Philly? In most parts of the country, self-service is all that's available, so he's also pumping alcohol into his tank.

You are as sharp and as funny as ever ebonystone. The company ought to hire you as their attorney. It seems that they don't understand that nearly everyone who works in America is hired "at will," and can be dismissed for almost any reason. The company ought to sharpen that executive staff. Still, I sympathize with them and I hope they don't get mauled too much.

To accommodate these Muslims, any work contract must have a clause that indicates that anything that is against the religion, which ever it is,has nothing to do with the company and the solicitor must agree to that. Vasant means "spring" in Indian and can also mean a musical theme/Raga in Indian music culture. Also a Sikh tradition. So doubtful a muslim would carry this name.

If at all the man has converted to Islam he should be going by a different name. And, of course, Hindus do not have any kind of religious restrictions whatsoever.

Vasant Reddy is a Hindu name and we Hindus have no such non-sensical restrictions about carrying or consuming alcohol. In fact, personally I enjoy a (Danish) ham sandwitch and (Danish) beer just because Denmark has good cartoonists. In any case, something is wrong here. The article states that the claimant "claims" the "company" would accommodate his religious beliefs.

The Company stepped in it simply because the Company has the right to inform the applicant that if he was not willing to deliver Booze, then he could not be considered for the position.

The real issue is what the formal company policy is with regards to "accommodations". Especially with relation to the constancy of its application to all.

The very first question I would have asked as the company's Attorney is if the Claimant is as faithful as he claims. Like, does the claimant pray during work hours? Does he attend prayers on every Friday? Is he known to consume any non halal food or beverage?

I have had fellow Christians claim they will not work on Sundays because God said it was a day of rest and reflection. Only to admit later in the interview to their preforming all other kinds of "work" on Sunday.

People sue for everything in today's world.

The Courts understand hypocrisy. They just put Company's through an expensive wringer in the process. Despite what is commonly believed. Company's are viewed as guilty until proven otherwise well beyond any doubt. Reasonable does not count. Even then it may not matter one wit.

Hindu practices are more varied than any other practices of other religions. Some are very strict vegetarians while other eats meats. Some have to pray to god's idols while other don't need them since for them god is everywhere and in everything. But despite these differences you never see Hindu sects fighting each other over which sect is more Hindu than the other sect

No responsible trucking company should ever turn a muslim loose in a large truck. It is pure insanity to hire a muslim, an invitation to heartache, remorse, and costly litigation. I seem to recall reading something about this on one of the Muslim sites. It's the same question that comes up with regard to alcohol in various kinds of medicine, mouth wash, etc. The answer, as best I remember, is that the restriction only applies to the drinking kind of alcohol, not rubbing alcohol (isopropyl) or methyl alcohol (which will make you blind), or the kind of alcohol used in fuels.

The danger in this suit is that if the company caves and accommodates this bozo, then that would make it possible for Muslims to target EVERY business by picking some non-shariah compliant aspect of the business, getting hired, refusing to do what he/she was hired for on the basis of some minor matter, and then taking the business to court to force compliance - as well as making a handsome profit when the company opts to settle rather than take their chances with a legal system that has shown itself to be susceptible to Muslim pressures.

Yes, the guy should be unceremoniously booted from his job, and in whatever documents are generated in the court case the religious issues should be squarely addressed. Since the plaintiff is invoking religion, then he should be required to cite the specific justifications as called for in his "holy texts" as the basis for his action. And then in his rejecting the suit the judge should explicitly lay out the constitutional reasons stating why these religious reasons are irrelevant. The company should then file a counter suit against the plaintiff (and CAIR or whoever is behind it) for filing a frivolous law suit and assess a hefty fine. If done right it could provide an important precedent that would cut off the possiblity of using this kind of lawfare to undermine the system. Of course, this would require a judge who is knowledgeable about Islam, and they don't seem to be in great abundance.

Just make sure that every job application has a space to declare ones religion. Problem solved. It will be easy to find another reason to not give this Muslim a job without declaring that he was a misfit and potential troublemaker.

Also, it would be a good idea to introduce a clause on all immigration documents stating that your religious beliefs shall not interfere with your future job. If in doubt it would be then up to the sorry soul to not pursue this career path - rather than take the job and then cry foul.

Third idea - don't come to my bloody country in the first place. The rules are different here and because you won't follow the rules then you will not be welcome. And besides, if you still decide to come and create a fuss, then we will shun you, mock your religion, draw cartoons and totally piss you off. The ball is now in your court whiner, bleater, sorrowful, lame, weak creature that you are...

Whilst employers are required to be reasonably sensitive to the religious beliefs of their workers, I would stress that the phrase is "reasonable". Islam may forbid its members from the consumption of alcohol and pork products- but it says nothing about driving or carrying them around(pace the Saudi Tesco employee who claimed that carrying around boxes of beer and whiskey violated his "human rights"(who are Saudis to complain about human rights violations- avowed Jews are banned from entering the Kingdom and Christian worship even in private homes is proscribed and where is "human rights" mentioned in the Koran BTW?). If this individual is so profoundly Islamic that even the act of driving or carrying booze or pork products is an affront to his religious beliefs, then let him find work to under no circumstances includes proximity to such "haram"(forbidden) products. After all, pacifists don't sign up for the military, vegetarians don't work in abbatoirs and pro-lifers don't apply to work in abortion clinics!

If a worker is not hired, they file suite for discrimination and Islamophobia, but then when they are hired they file religious discrimination

Lets see, this guy was hired in 2009, and he told the company, that he could not transport alcohol....ohhh so in 2009 there were so many jobs for drivers that they could pick and choose. Next, jewish drivers won't transport non-Kosha foods.

perhaps the real solution is for every religion to be recognized and insist that they are accommodated as well. they must be allowed to take off for every single religious holiday, pray during working hours, not transport anything not sanctioned in their religion, so Hindus don't need to transport any meat products, etc. Our freedom of religion never included a religion's right to destroy us and we are allowing this to happen. who is going to take the blame when shariah takes over?

Just to reassure you Bob, Hindus are not easily offended by anything concerning their religion. You can make fun of all our gods and godesses in good humor and we wont be offended. Even if we are, we dont issue death threats or resort to violence. There are many Bollywood movies that make fun of Hindu practices or gods, and we have a good laugh ourselves. In Hindu culture every living thing and person is an image of God. Therefore, you are God too. A popular saying in our culture is "Athithi Devo Bhava", translated, it means "The guest/visitor is God himself". Hindu religion also does not "dictate" any rules to its followers or to anyone else. At the most it will tell you what the consequences can be for certain actions. Ever heard the word "karma"? No Hindu temple, religious leader, or priest has any power to declare any Hindu an apostate or ex-communicate a Hindu from his/her community. We dont even need a priest for our marriage ceremonies. The priest is there to read the scriptures which the couple finds difficult but the priest has no power to declare a couple man and wife.

Let me digress and state, that if God were to come down today and rewrite the Bible or the Quran, then he would have written the US Constitution. There are many Hindus in America and youll never find them insulting Americans or disrespecting the Constitution. It simply annoys me that some muslim jerk (probably a Pakistani) walks around with a Hindu name. But we have no problem with that either. Hindu culture has seen more terrorists and tyrants over hundreds of years than any other people. Yet no one could destroy it. Truth never dies, we just see all religions equally. But now I have to wonder about Islam and its morons. They dont qualify to be called a religion anymore.
