BUFFALO, NY - The jury in the Muzzammil Hassan trial has reached a verdict. Muzzammil Hassan is guilty of 2nd degree murder in the death of his wife, Aasiya Hassan.The jury deliberated for a little over an hour before reaching their verdict.
The judge has scheduled Hassan's sentencing for March 9, 2011, where he faces a sentence of up to 25-years-to life behind bars....
Jurors were told that Aasiya Hassan may have been conscious when the defendant started to behead her on February 12, 2009.
Curtin Gable started off strong telling the jury that Hassan wants them to believe that what he did was in self defense, "not a chance, not even close."
"There is absolutely no doubt that the defendant killed his wife intentionally," said the prosecutor. "He was carefully and deliberately planning to kill her."
The prosecutor told jurors Hassan was efficient and deliberate in killing his wife in just "thirty-seven seconds." While describing the murder, Curtin Gable described how Aasiya was stabbed in the head and from the mouth to her ear. "How is that self defense, stabbing an unarmed woman from behind," she asked jurors.
"He was in control," she told jurors. "Cool, calm, collected and calculating every step of the way."...
Hassan admitted to the courtroom that he did, in fact, have physical altercations with his wife, but that he never beat or abused her. "Men are never put in the victim's box," he said.
The abuser, says Hassan, often comes across to the outside world as charming and friendly, but to the victim it is a very different story. "A victim often feels like a hostage to a terrorist, a slave to an overbearing master."
On multiple occasions, Hassan claims he attempted to move out, but that false promises by his wife brought him back home. He wonders why Aasiya would continuously beg him to return "if I was such a horrible wife beater."
"Think of a dog with an invisible fence," Hassan tells the jury. "He tries to escape, he gets a shock, he keeps getting shocked and eventually stops trying." Hassan likens himself to the dog, saying he received so many shocks through abuse and threats that he simply stopped trying to escape.
He goes on to identify flaws in "the system," attempting to indict it by saying that his enemy is false beliefs in religion. He compares this with the experiences of Nelson Mandela and Gandhi.

Actually, saucymugwump, our legal system about 98% of the time works quite well, but, of course, the other 2% is what is brought to the attention of most everyone. Is there room for improvement? You bet. For instance, tort reform is way overdue. To the credit of Republicans, they have been trying to get this for years now (particularly in the health care sector), but the trial lawyers' lobby is almost entirely in the Democratic Party's hip pocket. And Obama is completely beholden to this group and will do NOTHING to correct things as long as he is President; whenever he avers otherwise, he is, quite simply, lying.
The OJ Simpson case, BTW, was an anomaly. The vast majority of those who commit vicious felonies get their due. I write this to you as the attorney that I am. Our legal system is not pathetic. Far from it. It just needs some tweaking and, I might add, to the extent our legal system is aberrant, it is virtually without exception due to the infection of Leftthink, though traditional common avarice as a villain should not be excluded either.

The reason, Jaladhi, this scumbag was not charged with first-degree murder is because first-degree murder requires premeditated killing. If the prosecution cannot establish premeditation beyond a reasonable doubt (in percentage terms this would equate to roughly 90% certainty), then it automatically falls into second-degree murder status, which is still a damn serious charge. And let's face it, a hell of a lot of Muslim males are hard-wired by their pathetic religion to act on impulse, thus negating true premeditation.
So, this particular SOB faces twenty-five years to life and that should be good enough to keep him behind bars for a long time, and hopefully this will include, as well, his becoming someone's "girlfriend" while there. If the case, he richly deserves such a fate. I'm kinda' hopin' this is what happens. The phrase, "a fate worse than death" resonates in my mind right now.

You can only be convicted of first degree murder in New York if you killed a cop or a prison guard of the witness to a crime to prevent the witness's testimony. Otherwise, for ordinary folk, the worst they can convict you of is second degree murder. So the jury did its job. Any quarrel you have with the conviction is with the New York state legislature.

Thanks for the clarifying comment, Tonestaple. We went through all this "why not a charge of first-degree?" business a year ago when he was charged. Too many people have watched too many lawyer and crime shows on TV, and have soaked up the terminology without realizing that legal definitions differ from state to state. In my home state, there are no "degrees" of murder; the charges are "murder", "manslaughter", and "reckless homicide". And under certain circumstances, the death penalty can be sought for the first.

He was trying to establish the notion that he was presumed to have abused his wife without evidence, based solely on her word, because some forms of accusations are assumed to be true until the accused proves himself innocent rather than vise versa. As an example he said that if he'll accuse you of being Islamophobic people will tend to assume you're indeed guilty of it, and if a Jew (his Jewish lawyer) will accuse you of antisemitism people will tend to believe him, and if a woman accuses a man of abuse or sexual harassment people tend to believe her and assume the man is guilty. From there he continued to argue that people believe he abused his wife only because she said so, even though there is no evidence for abuse (according to him, I didn't follow the trial closely). Mentioning Islamophobia might have been "suggestive" in the subliminal sense, but certainly not in any direct or explicit way.

No doubt the defendant is guilty, but his description of the events leading up to the murder is not entirely implausible and is in some respects quite believable. I write this as a retired psychiatrist.

To what extent is it possible that the defendant's Muslim beliefs and inferred endorsement of honor killings are just that: inferred? I presume that there have been many somewhat analogous spousal murders which have occurred despite the fact that neither of the spouses was Muslim.

Well, anything is possible but considering that the defendant exercised the time-honored islamic method of execution, beheading, my guess is that he felt justified in killing his disobedient, fractious chattel and did so with typical muslim chauvinistic savagery. Spousal murder occurs in all cultures and sometimes the victim is dismembered or cut into little pieces after the fact, but how often do you hear of a man beheading his wife? Slitting her throat would have killed her so why did he go the extra mile?
Honor killings tend to be excessively brutal, as if intended to inflict extreme pain and suffering before death, and they are almost always committed by a close and trusted family member--- brother, father, mother, son, husband, or grandparent. Any culture or religion that sanctions honor killings and/or female genital mutilation is primitive,inferior, and does not belong in the civilized world, multiculturalism be damned.

I agree, but it needs to be well thought out. In Colorado, we had the case of a German tourist who was on a bus when it was hit by a boulder the size of a house. His injuries were severe, eventually costing hundreds of thousands of dollars, and he died within a year or two. The state has a limit of $400,000 or so and did not have to pay over and above this amount. I disagree completely here, as the state was responsible for the incident (state crews played a role in dislodging the boulder). State immunity usually works well, but in this case it did not.
However, if tort reform is the yin, then Wall Street reform is the yang. Why should trial lawyers be regulated when Wall Street is allowed to rape the country with impunity? I find it ironic, or worse, that Republicans seek tort reform -- government regulation -- yet classify Wall Street reform as socialist. If we allow Wall Street to run amuck, we should let trial lawyers do the same to be consistent.
As others have pointed out, Hassan should have been facing charges of 1st degree murder. What he did does meet those parameters.

The legal system and lawyers are one of the benefits of our society. Our legal system is based on objective evidence, clearly-defined laws, and the principle of free choice. The law does not judge you by who you are, or the emotions you engender, but only by what you did. Lawyers can be infuriating, but even when they defend the worst scumbags, they are strengthening the principle of objective justice, available equally to everyone.
Islam, on the other hand, has rejected the idea of causality. Everything that happens, in Islamic thought, is according to the will of Allah at that moment. It is not surprising that many Muslim defendants reject their court-appointed attorneys and make their own emotional pleas. They are not willing to be judged under objective laws and evidence. They would rather be found guilty and retain their world-view that guilt and innocence, act and reaction, are determined moment by moment by Allah's caprice.
I would do anything for the woman I love, and would like to marry,when she is ready to settledown. I hate seeing her hurt, and I only want to make her as happy as she makes me, even if I have to hurt myself to do it.
To think there are so many who by command of thier backwards prophet who abuse thier women and can even violently murder them in this regard makes me sick. It also makes me sad and makes my heart hurt, because I invariably see my own reaction if such a fate were to befall the one I love. Because in New York, first-degree murder is limited to very specific kinds of killing, such as killing of cops, prison guards, and judges, killing for hire, killing by torture, killing while serving a life sentence, or killing to silence a potential witness. Simply killing your wife (or John Lennon) only gets you second-degree murder. Even serial killer David "Son of Sam" Berkowitz was only charged with and convicted of second-degree murder.

In New York, premeditation alone is not sufficient to bump your offense up to first-degree murder. See section 125.27 of the New York Penal Code.
