California: Muslim students want district attorney removed in case over their "peaceful and tempered" shoutdown of Israeli ambassador

It is clearly planned: a succession of carefully placed individuals pre-coordinated to cause disruption at specific intervals, and a very loud cheering section for each incident. In which bizarre parallel universe was that a "peaceful, tempered" protest? An update on this story. "Muslim Students Want DA Off Speech Disruption Case," from the New York Times, March 11 (thanks to all who sent this in):
SANTA ANA, Calif. (AP) — Eleven Muslim students charged with disrupting a speech by the Israeli ambassador to the U.S. at a California university sought Friday to have the district attorney pulled from the case.
Prosecutors illegally obtained search warrants and focused on the religion of the defendants by dubbing the case the "UCI Muslim case," said Dan Mayfield, one of the students' attorneys.
"We are asking the attorney general of the state of California to step in and take over the case," Mayfield said during a news conference after the students' arraignment was postponed until April 15. The courtroom was packed with supporters.
Orange County Deputy District Attorney Dan Wagner said the allegations were not grounds to pull his office from the case.
The students are each charged with one count of misdemeanor conspiracy to disturb a meeting and one count of misdemeanor disturbance of a meeting.
The students were arrested on Feb. 8, 2010, after shouting in protest at a speech at the University of California, Irvine, on U.S.-Israeli security, forcing Ambassador Michael Oren to halt his remarks for 20 minutes.
The case has stoked an intense debate about freedom of speech.
District Attorney Tony Rackauckas filed the charges last month, prompting a public outcry by Muslim and civil rights advocates who say prosecutors were discriminating against students exercising their right to dissent, just as many other college-goers do without punishment.

Prosecutors contend the protest was a premeditated attempt to disrupt Oren's lecture and infringed on the rights of the hundreds of people who had gathered on campus to hear him speak.
"We look forward to the actual evidence coming out," Wagner said. "Anyone who was at the assembly could tell you, the First Amendment rights of the speaker and the audience were being violated clearly by these defendants, and that's the principle on which we are prosecuting this case."
Students and their advocates contend they did nothing wrong and have already been through a rigorous disciplinary process at the university, which revoked the Muslim Student Union's charter for a quarter and placed it on two years of probation.
"These students merely stood up and expressed deeply rooted political dissent in a manner that was peaceful and tempered," said Reem Salahi, one of the students' attorneys.
Eight of the students attended UC Irvine and three were from the nearby campus of the University of California, Riverside.
If convicted, they could face a sentence ranging from probation with community service and fines to up to six months in jail.
Jacqueline Goodman, one of the students' attorneys, said there had been discussions about a possible plea deal but no agreement was reached.
About 150 people packed the courtroom Friday to show support for the defendants, including relatives, community leaders and students.

Claiming victim status over clear and massively documented misconduct:

Ojaala Ahmad, a senator with the student body government at nearby California State University, Long Beach, said her organization had passed a resolution in support of the defendants.
"If we as a student body government don't speak up against it, it could be any one of our students from any of our universities next," she said.

This is indeed a disturbing trend and needs to be stopped now. I hope these students are prosecuted. When I go to cair's website and look at some of the talking points that they attempt to pass off as important to all Americans not just muslims in America, it makes me cringe. I do not like the thought of being put in the same ideological basket as the muslims in our midst. In my opinion, there is nothing American about them.

Also, I was reading the comments on a WSJ article on the King hearings the other day and noted how anti israel the comments were. It would not surprise me to find that many of these comments were authored by muslims. You could almost tell by the tone. So this systematic campaign to influence extends not only to presence at rallies (look how many muslims were in attendance at the King hearings) but also to seemingly benign comments in the mainstream media (I suppose knowing full well they'd get their a@@es kicked if they posted on a site like this keeps them away here).

I guess this could be considered a "peaceful, tempered protest" by people whose usual methods of protest include stone throwing, carbecues, and murder.

SO how would muslims react if sosmeone behaved like the above in one of their events?

I don't see the problem...Everyone is entitled to free speech, but not everyone is entitled to 'create a disturbance'...This is called a 415 in police talk in California...A 415 can be verbal or physical...Creating a 415 is illegal...What these 'students' did was deliberately create a disturbance, a 415, and they all should be charged with disorderly conduct, and the university should take appropriate action on its part...

Just who and what does she mean by "we", "our students", and "our universities"?

Fines and six months in jail. Plus, expulsion from the university, and for those here on an F-Visa (student visa), expulsion from the U.S. Close down the MSA and other student groups involved in organizing the demonstrations.

U.S. universities now have social science courses extolling the virtues of civil disobedience, even making coursework assignments involving sit-ins and disruption of public proceedings, in the furtherance of political agendas. The agendas in question are, of course, always Leftist causes.

The states that are in fiscal trouble could solve part of their budgetary problems by eliminating all the departments within the state system (there are ten campuses in the UC system) that have been created since about 1970 by Leftist radicals. Having no marketable skills that add value to society and culture, they have instead managed to create an academic cottage industry built around grievance mongering and in the process absolutely ruined higher education in this country, what with all the Political Correctness and emphasis on diversity replacing good old fashioned merit and achievement as the social metric. Prime candidates for deletion or trimming back would be most departments of sociology, ethnic and womens' studies or any department constructed around a "diversity" theme, and every department receiving funding from foreign sources. Number one on the list of deletions would be any department specializing in "Community Organization." The list is long, but so is the size of the budget deficit.

All the talk about the King hearings stirring up anti-Muslim sentiment is BS. It is this kinda of stuff, a minority imposing their will on the majority, that makes me have a very bad taste in my mouth when I see and or hear Muslims like this.

Paper and practice.
The West was once known for putting laws on paper and then enforcing them in practice. But this seems to be increasingly in jeopardy because of political correctness, multiculturalism, and fear of backlash. We must demand, through all possible means that justice must be done and in this case, the muzzie students should be given the maximum permissible by law. Why? To set the example that infringement of free speech, whether by childish behavior and tactics or other more nefarious means, will not be tolerated. On this issue alone, the future of Western civilization will be decided. Note that free speech has many consequences such as deciding on muslim immigration, muslim deportation, anti-Sharia legislation and enforcement, etc.
Sadly, in Europe, political correctness, multiculturalism, and fear of backlash have fed through to laws curbing and disabling free speech. Now, it is the left(wrong)wing and the muslims who demand justice IAW the laws on muzzlement---sad and tragic. Any reason that the university did not remove ALL Muslims from the audience after the first "jihadi" stood up to wage verbal jihad against the Ambassador? This would have prevented subsequent verbal "jihadis" attacks.

More than likely, a certain percentage of these Muslim jackasses are guests in our country studying on F1 student visas. Why we allow them into America to study in our universities in the first place is beyond me! Every Muslim student who was in that auditorium, whether they stood up or not, should be expelled from the university immediately because they all participated in and waged jihad at some level or another. Moreover, the university should also disband the Muslim Students Association (MSA).

The claim that the hecklers Muslimness is sufficient to remove any particular county prosecutor from exercising jurisdiction cannot be distinguished from insisting that any and all county prosecutors also lack that authority, as well as the state attorney general. Would their special claim of a blanket Muslimness exemption from the application of general law simply vanish if the state attorney general were the prosecutor? No. The assertion of exception by reason of Muslimness was not satiated earlier by cowing the school officials not to expel the thugs. It would not be satiated here if any county prosecutor were to yield to the Muslimness of the bad actors.

The substitution of the attorney general is considered appropriate when a county prosecutor's office is tainted in favor of a potential criminal defendant (for example, a public official) and where the public's right to have the law vigorously enforced would otherwise be thwarted. It is invoked when someone will not face prosecution.

The notion of seeking the removal of the prosecutor here is so far removed from reality as to be something dreamed up for some science fiction plot. It is, however, no more preposterous than the OIC demand to criminalize criticism of Islam or criticism of the advocates of violent imposition of Sharia, or criticism (as here) of the very violence that is used to impose Sharia. I can reasonably conclude that this represents their belief as to the meaning of free speech itself, precisely in the context of their Muslimness.

I have often wondered how it is that mobs of many hundreds or many thousands of violent Rage Boy's can gather in flash mobs to vent their mob anger. They rage against the law in general but they target (personally and individually) any identifiable person who stands in their way. In this case it is The Prosecutor. Their belief in the righteousness of their cause does not allow them to temper their expression in any way, by way of self restraint. If there were no anti-heckler restraints how might they have expressed their righteousness? Would they have been in any way less vigorous if The Prosecutor would not seek to prosecute? Certainly not.

These "students" should have been summarily expelled. Will they feel, or even feign, any hint of contrition upon conviction? Again, I think not. Still, this prosecution itself will prove wholly ineffective as a deterrent; it will be a pyrrhic victory. Expulsion would have been a more effective remedy, on behalf of the remaining students, and would likely have made the prosecution itself superfluous.

(A question not asked:) Should the public seek removal of the school officials who chose not to expel the hecklers? How else might one communicate to Ojaala Ahmad (if she ever becomes a public official herself) that some conduct is considered unacceptable? Picture Ojaala Ahmad as the responsible school official, and ask what she would do with an opportunity for an Israeli official to be the subject of some local school gathering. Ask Ojaala Ahmad, in her quest for elective office, how she would treat the Israeli official if she were the President of the school? Would she promote the OIC quest to ban any hint of criticism of Islam, and use the police and prosecutors and jail to punish any written publication evidencing such criticism? Would she favor throwing Molly Norris in jail?

Would Ojaala Ahmad instead promote freedom by seeking the republication of the Motoons, in solidarity with those who love freedom, undoubtably against the wishes of the defendants in this case? Or even lift a finger in defense of someone who did?

If found guilty, give 'em a Sharia-compliant sentence: cut out their tongues.

If convicted, they could face a sentence ranging from probation with community service and fines to up to six months in jail.

Kick them out of University!

Then kick them and their families out of the country.
