Melanie Phillips: "Even now, in this purported mea culpa, Goldstone does not take responsibility for the Big Lie he helped perpetrate"

A detailed rebuttal to Goldstone 2.0, the full text of which can be found here. "Richard Goldstone recants. What price the Israel witch-hunt now?" by Melanie Phillips for the Spectator, April 2:

In an extraordinary article in the Washington Post, Richard Goldstone has now admitted that his infamous report was wrong. Having fuelled the blood libel that in Operation Cast Lead in Gaza Israel had targeted civilians and possibly had committed crimes against humanity, he now says that, as a result of the final report of the UN committee of independent experts and other evidence that has emerged since his report was published, he accepts that
civilians were not intentionally targeted as a matter of policy
and further states that
if I had known then what I know now, the Goldstone Report would have been a different document.
What self-serving rubbish. There was ample evidence at the time from numerous sources that Hamas was telling lies about the number of civilians who were killed by Israeli fire. There was ample evidence that Hamas was deliberately putting civilians in harm’s way. There was ample evidence that Hamas does not operate under the rule of law or uphold human rights. There was ample evidence that Israeli rules of engagement required the IDF to avoid hitting civilians wherever possible. There was ample evidence that Israel always investigates allegations of misconduct made against its soldiers and holds them to acount under the rule of law. Yet Goldstone, having accepted the poisoned chalice from the UN Human Rights Council to subject Israel to a show trial whose verdict preceded the evidence (despite his protestations that he modified this odious remit), chose to believe the propaganda put out by Hamas and its proxies among NGOs with a long track record of malevolent hostility to Israel.
Even now, in this purported mea culpa, Goldstone does not take responsibility for the Big Lie he helped perpetrate with such terrible consequences in putting rocket-fuel behind Israel’s delegitimisation as a pariah in the eyes of the world. Instead, he blames his false conclusions upon Israel’s refusal to co-operate with his inquiry.
So for the second time, he is again blaming Israel for its own victimisation – first at the hands of Hamas, and now at his own hands. [...]
Can you believe this? He appears to have expected genocidal aggressor Hamas to behave in a civilised fashion by investigating its alleged abuses -- while he chose to throw the book at its democratic victim, Israel. And now the most he will acknowledge is that expecting Hamas to do so

may have been a mistaken enterprise. [...]
Regardless of its manifest moral and intellectual inadequacies, however, his recantation carries inescapable consequences. All those who have used Goldstone’s report as a basis for their own delegitimisation of Israel now also stand revealed as having endorsed one of the worst officially sanctioned international falsehoods in history. All their attacks on Israel which relied upon Goldstone’s report are now shown to be equally baseless and discredited. Any future such attacks which use this report as an authority will be demonstrably false and malicious. The UN should now declare the Goldstone report null and void. Any less will make it knowingly and demonstrably party to a travesty of justice.
But of course, like all previous blood libels against the Jews, the poison this one has injected into the global bloodstream has no antidote. The damage is done – and no amount of self-serving recantations by Richard Goldstone will undo the terrible harm he has done.

It's a brilliant article, but what do you at Jihadwatch think about the comments she makes in her article 'How I Became a Hate Suspect' at www.melaniephillips.com/articles-new/ :

Goldstone got caught with his pants down, and when he attempts to pull them up, he gets stuck in the zipper...OUCH...and now stands exposed...
Pastor Jones gets savaged for causing deaths by burning Qurans, while Goldstone struggles to get free from the zipper...
Phillips is doing her best to help him get unstuck...It's embarrassing for him, but he needs all the help he can get...He is guilty of all he is charged with, so she is not being too gentle about it...I don't think she can get him unstuck, but she can called attention to his exposure...

What the UN should declare null and void are the memberships of the 56 countries of the OIC who have never signed the Universal Declaration of Human Rights, until they sign the Declaration. Their membership has made the UN a travesty of justice ever since its beginning. At best they should be present only as observers, with no votes, only a very limited right to comment, and no benefits from any of the aid programs.

Mr. Goldstone, what is known "now" was all in fact "known" when you wrote your sham report.

ebonystone: I think you will find that all OIC member states and Arab/Muslim leaders would like the dozing West to know that they subscribe to all Human Rights documents, charters and principles, but always qualified insofar as they do not contradict the demands of Sharia.

In other words, using New Age doubletalk, we agree that humans have rights, but only those granted by Allah.

Interesting indeed, for in the version of Mrs Phillips, that JW assertion applied a line of reasoning* mostly seen in comments from someone who was banned at JihadWatch not so long ago.

I have a surrealistic feeling about the whole issue.

I have no doubt that Israel is carrying out genuine investigations of civilian deaths in Gaza, and that Israel has a firm policy of not targeting civilians.

The fact is, that Israel refused to cooperate with the Goldstone commission while it was investigating. So, how can Israel claim that it was victimized? It seems to me that Israel shot itself in the foot on this issue. It made a HUGE mistake, but now it takes its lumps and moves on. The proper US response should be, as usual, to veto any proposal for sanctions against Israel. We can even discount the report as it stands. What we cannot do, it seems to me, is to demonize Goldstone for having put out the report, with no Israeli cooperation, that is unfavorable to Israel.

You don't understand. The UN agenda is driven by the OIC. The OIC is the largest bloc there and it has Third World allies and other allies that give it automatic majority. That's why Israel gets more condemnations than all other countries in the world combined. Any UN innitiative targetting Israel is biased from the onset.

More importantly, Israel insists on conducting its own investigations like other sovereign nations and not have all its actions judged by an international panel, let alone an international panel launched to a large extent by Israel's mortal enemies.

By cooperating Israel would give legitimacy to this kangaroo court and its judgement that is extremely likely to be biased, and give up bit by bit its sovereignty since unlike any other country in the world Israel won't be able to take any action in self defense without having to stand trial before an international body, which will make Israel's statehood inviable even if that international body wasn't dominated by Israel's mortal enemies.

These are all traps. Every time there's a debate in Israel about the least damaging way to deal with the trap. Cooperate or not cooperate? If we cooperate maybe the judgement will be less damning, and maybe not since we know the UN is biased, but then we'll give it legitimacy and have to accept the verdict even if it's completely unfair, and we'll also set a precedence for the next action Israel takes.

The supposed "fact finding" commission could still behave like a real fact finding commission and involve witnesses - and actual members of the commission - who are not Israeli, yet not anti-Israel (some of the members there have known extreme anti-Israel positions). It could have involved military experts who could analyse the findings on the ground and offer their perspectives. It could have taken the list of casualties and investigate their backgrounds and see if indeed the overwhelming majority were innocent civilians - some bloggers did that immediately after the list was released - they checked hundreds of names claimed to be civilian casualties and searched them solely on the Internet. They found many of them were mentioned before as Hamas people and other terror connected activists. The commission had far more resources than common bloggers. The commission made a choice not to do any of these. There were several critical analyses of the Goldstone report based solely on the information known at the time which contradicted the "findings" of the commission. If they were honestly interested in fact finding they could have employed more serious and comprehensive methods of getting at the truth even without Israel's cooperation.

I hope the US realizes that Israel is the front line of our defense. If the international organizations gather enough power to hurt Israel, they will constrain the US in exactly the same way.
