If Muslims want to be stupid, it's because they carry a parallel universe with them within the confines of their own minds, everywhere they go. One day at work I had an angry muslim man demand that I re-staple the paperwork he brought to our office becuase he didn't like where I placed the first staple. I told him to do it himself and he became very angry and told me my gov't is run by a bunch of pigs... because I was at work I couldn't really say anything in defence of this. I could only laugh about it with my co workers who was there to see how ignorant he was and how angry he became over nothing. Not just crime but a hate crime? We all know that if the person spat upon was just a plain vanilla white person it would not have been a "hate crime". So under our new American "wergild" (apologies to King Ine of Wessex) it must be someone much higher up in the pecking order, a "person of color" possibly Hispanic, even a recent immigrant. Isn't living in the midst of a multicultural society just great?

While I'm glad she was charged, I take exception to the whole category of "hate crimes" even though I might personally gain from such legislation. A crime is a crime. To call crimes committed against certain categories of people "hate crimes" flies in the face of our constitution which declares all of us have been created equal. It also presumes that the police and prosecutor can accurately read the mind of the perpetrator. When you charge someone with a crime, it is safest to go with what you can actually prove to a jury.
This crime was a particularly vulgar, vile, disgusting battery committed on a person who was only trying to help the woman. The time to address the seriousness of the motive is in the sentencing phase. To victimize someone because of race, gender, religion, etc, is utterly inexcusable and deserves the maximum penalty the law allows, even if that penalty is a death sentence.
Hepatitis A & B are rampant in the Middle East. The victim should be tested for Hepatitis along with other diseases that might be transmitted via saliva. In my state, the need for the victim to seek medical care following a battery could elevate the charges, with a penalty up to 10 years and/or $10,000 fine.

So yes, there is a tie between the attacker's muslim religion and the crime she is accused of committing against an Infidel. Spitting on someone is one of the more humiliating gestures of contempt. It is throwing bodily waste on another human being. That, in itself, is a separately identified crime of assault and/or battery in some states. It is more serious than a simple assault or a simple battery.

I don't know about the hate crime aspect of this but I do know that spitiing at someone, especially in the face, has become a more serious crime due to possible deliberate transmission of the AIDS virus or other biological contaminants or other transmissible illnesses.
