Spanish lawyer accuses Obama at International Criminal Court of crimes against humanity for killing of bin Laden

Does Daniel Fiol think that the 9/11 attacks were a crime against humanity? Did he file a complaint with the ICC about them? I would expect not. This is just more of the hard Left's moral myopia -- and ironically directed at a man who has drastically misdiagnosed the problem of jihad and apparently thinks that if he goes after al-Qaeda but allows the jihad to advance on every other front, all will be well.

A Spanish lawyer has formally accused Barack Obama of crimes against humanity for ordering the assassination of Osama bin Laden.

Daniel Fiol lodged a written complaint at the International Criminal Court accusing the US president of breaching the Geneva Convention.

Navy Seals acting on Mr Obama's orders shot the al-Qaeda leader dead on May 2 after storming his compound in Abbottabad, Pakistan.

In his written complaint, the Majorca-based lawyer said bin Laden should have been "pursued, arrested, tried and convicted" on behalf of "the victims of some terrible and appalling atrocities". The killing of bin Laden was even worse as it took place in foreign territory, Pakistan, without the permission of that government, he said.

...which is a blot on Pakistan's record.

"I am not being paid by al-Qaeda," Mr Fiol joked....

No, but you might as well be.

I have had a close relationship with Spain in the past.

What I discovered, very troubling was their immeasurable ignorance and hatred of everything that have to do with English speaking societies.

The US has not yet ratified its founding treaty and with a bit of luck, this little stunt will make sure it never does.

This is probably a legal practitioner who isn't getting much work and somebody is prepared to pay him, plus a way of trying to make his name - probably backfire when the ICC laughs him out of court?

Frankly I think this has more to do with Spain being accused of the Deadly E-Coli outbreak in Germany....

Spain is trying to embarrass Obama as the E-coli was a manufactured bug made by Monsanto...Spain was first to be accused of this outbreak...it hurt them financially as countries refused to import their produce due to being scared it was contaminated!

Sovereignty is violable where harborage obstructs justice. Of course, Obama would hardly admit that his Paki pals knew of bin Laden's presence 1000 feet from Pakistan's "West point."

Spain is upset because the US takes out bin Laden? What business is it of theirs anyway? bin Laden used to go on TV to brag about the attack on the twin towers and we're supposed to sit idly by and let him get away with it? Just shows what idiots the international court is anyway. They should have no jurisdiction over the US anyway. We see justice turned upside down when we read nonsense like this. Bin Laden convicted himself with his own mouth, the only question is why it took so long and how could he live where he did w/o the Pakistani authorities knowing where he was. The action that took him out should be used every time a hand is laid on an American citizen.

I agree with you completely. Any country that subjects itself to an outside jurisdiction runs the risk of being second-guessed when it acts to protect its vital interests. Worse, non-elected bodies such as the EU are subject to capture by ideologues who use their positions of power to advance their ideological agendas.

As Commander in Chief Obama is the only one who can make a decision til kill a suspect leader of a terrorist group who by his own admission planned, and let his followers carry out a number of very serious crimes against humanity.

So if a war crime was committed by Obama's order to apprehend or kill Osama bin Laden Obama then everybody in the chain of command down to the soldier who pulled the trigger and actually killed the leader of Al Qaeda is legally responsible, as per the the Nuremberg principle.

As a good democrat with respect for due process of law I will of course consider Obama innocent until he is proven guilty.
The burden of proof is on the prosecution, which has to collect and present enough compelling evidence to convince the trier of fact, who is restrained and ordered by law to consider only actual evidence and testimony that is legally admissible, and in most cases lawfully obtained, that the accused is guilty beyond a reasonable doubt. In case of remaining doubts, the accused is to be acquitted.

Everybody can file a complaint to the ICC, even a Spanish judge, if he suspects that a person has committed war crimes or crimes against humanity. That is how the system works. But have no fear. As long as the member states of the African Union does not hand over the president of Sudan or the Libyan president both indicted for crimes against humanity by the ICC, the system is not working. The system does especially not work in the U.S. because the country is not a signatory state to ICC, so impeachment of Obama is the only possibility. Maybe the Tea Party movement can add crimes against humanity to the impeachment case they are building against the President? Who knows? ;-)

It is a federal crime under U.S. law to "interfere with a Federal officer". Whenever people like Daniel Foil pull this baloney they should be promptly indicted by a federal grand jury on this charge, and a request for extradition should be drawn up. Has Daniel Foil ever heard of Roman Polanski?

Maybe this will curtail BHO's foreign travels. If he faced an arrest warrant as soon as he stepped off Air Force 1 in a foreign land, he might stay at home. Think of the savings of our tax dollars!
This might also cure the Left of its love for all sorts of treaties limiting Amrican sovereignty, and for the citing of foreign laws in American court cases.
Master Fiol's complaint should also cite the Secretary of Defense (and possibly the Secretary of State), and whatever under-secretaries, chiefs of staff, and admirals and generals were in on the plan. They're just as "guilty" as BHO. Under the rules of war, an unlawful command must be refused. Obeying it makes the soldier just as guilty as the one who issued the command.

I detest obama and I'll be overjoyed to see him convicted of this even though I hate Osama more.

I wonder if this will cool the American Left's ardor for making US soldiers subject to the whims of the International Criminal Court?
