Radical cleric Abu Qatada has won his appeal against deportation from the UK to Jordan, at the European Court of Human Rights.The judges accepted the UK's deal with Jordan to protect the cleric from abuse was sound.
But the court said he should not face trial for terrorism on evidence obtained by the torture of others.
Home Secretary Theresa May said the European judges' decision was "not the end of the road".
The British government can make a final appeal before the judgement becomes binding in three months' time. If it does not appeal, the cleric will have to be released from detention.
Abu Qatada, whose real name is Omar Othman, is one of the most influential Islamist clerics in Europe, supporting jihadist causes. British judges have described him as "truly dangerous".
He has never faced trial in the UK, but has been detained without charge and had his movements restricted by a control order, a form of house arrest.
The Palestinian-Jordanian preacher has been convicted in his absence of involvement in two major terrorism plots in Jordan.
But he says that those convictions were based on evidence extracted by the torture of co-defendants and he would face similar treatment if returned. He originally fled to the UK in 1993 after being tortured twice.
The government signed a memorandum of understanding with Jordan as part of its efforts to expel him, one of a number of deals with foreign regimes which are designed to protect the human rights of anyone deported from the UK.
In the ruling, the Strasbourg court accepted that diplomatic assurances given by Jordan to the UK meant that the cleric would be protected from torture if he were returned.
But it added that the deportation had to be stopped because Abu Qatada was likely to face retrial in Jordan - and that torture had been used to gather the evidence against him....
Strasbourg said that it was highly probable that the "decisive" evidence against the preacher had come from abusing these defendants.

Hmm. It seems as if Hitler's misfortune was to lose the war back in 1945 instead of 2012. It’s time we started getting tough on terrorists who are allowed to stay in infidel countries. If the courts feel that it’s not safe to send them back home, then we want to make them feel that it’s no picnic for them to stay here either.
Terrorists that remain here need to be re-jailed, separated from other convicts (so that they can’t proselytise other inmates) and forced to attend de-islamisation classes inside prison. They should have no access to the Koran, be made to eat whatever food they are given (including bacon) and forced to wear prison outfits (clean-shaven, no beards, no sandals). They should be made to labour hard to pay for their keep whilst inside, under the watch of domineering female prison guards (ouch, women in charge?).
They should carry out demeaning tasks such as washing women’s clothes (laundry duties), making poppies for Remembrance day (all sales proceeds to war veteran charities of course) and making skull caps (for bar-mitzvahs and so on).
We should not tolerate their crap!
I'd be inclined to ignore the ruling and send him back to Jordan. What can the ECHR do other than wring their hands in anguish? It's high time someone stood up to these leftist human rights organisations, who only care about terrorists and criminals and are undermining our civilisation.
Who cares if some of the evidence against him was obtained by torture? I'd quite like to obtain some damning evidence from him by torturing him myself, and I'm not talking about sleep deprivation here.
I think you're on the right track, Bob. We can't do unto him as he did unto others because we are not vicious jihadi. But to say that he can "go free" because he is effectively an asylum seeker is absurd.
He needs to be arrested and given a fair trial in Britain. If there isn't enough evidence to convict him of terrorism, pin something else on him. Let him live out his British life in a British jail.
As you say, keep him away from all the petty offenders whom he might corrupt. I don't see why he should be forced to eat bacon - he can always choose to go hungry without complaining, as an imprisoned Jew would do. And I don't think female guards are a good idea, because I doubt any woman is large enough to handle ward full of men like him safely.
Maybe we could work together to write an excised Qur'an, suitable for prison inmates? No tricks, just a straightfoward statement that this is a collection of selected readings from the Qur'an and not the whole thing. The passage about the bee is quite nice, and it's good to be reminded not to commit infanticide or steal.

Don't be silly. There are only 2m Muslims in the UK - I know because I heard a Muslim say that on BBC radio 4 only yesterday. Ah got it - taquiyya.
Actually some 20 years ago it was Government statistics which claimed that only 2.5% of the population were from ethnic minorities. At the time I worked in a very large Northern Authority which was far from a haven for ethnic minorities. The Government figures didn't seem to fit so we did our own local research. We had at least 5% and they were just the ones we could identify by analysis of electoral roll and school attendance etc.. If we had 5% + goodness knows what the real figures were both there and elsewhere. Now? Well now it will be frightening but the chattering classes hardly see it because they live in their own cocoon amongst indigenous Brits.
My best guess is that the UK now has a minimum of 6-7m muslims (more than 10%) and growing daily. If we aren't yet an islamist country we soon shall be. I have little doubt that the muslim population deliberately hide their numbers - a classic tactic of war.
