Palestinian Authority gives pardons or suspended sentences for honor murders

Islamic apologists in the West continue to try to convince gullible Westerners (of which there are so very many) that honor killing really has nothing whatsoever to do with Islam, and that all evidence to the contrary is just “Islamophobia.” 91% of all honor killings occur among Muslims? Coincidence! Bad study! (Not that any good studies are offered in its place, mind you.) Jordan and Syria — and now the Palestinian Authority — have relaxed penalties for honor killings? Well, yes, but a lot of important people have spoken out against this — well, yes, no one is listening to them, but…still!

If the apologists for the Islamic character of honor killing cared about women as much as they care about covering for Islam, they would devote their energies to stamping out the attitudes within the Muslim community that give rise to honor killing, rather than demonizing those who are standing up for victimized Muslim women.

It is no accident or coincidence that Muslims commit 91 percent of honor killings worldwide. A manual of Islamic law certified as a reliable guide to Sunni orthodoxy by Al-Azhar University, the most respected authority in Sunni Islam, says that “retaliation is obligatory against anyone who kills a human being purely intentionally and without right.” However, “not subject to retaliation” is “a father or mother (or their fathers or mothers) for killing their offspring, or offspring’s offspring.” (‘Umdat al-Salik o1.1-2). In other words, someone who kills his child incurs no legal penalty under Islamic law.

Syria in 2009 scrapped a law limiting the length of sentences for honor killings, but “the new law says a man can still benefit from extenuating circumstances in crimes of passion or honour ‘provided he serves a prison term of no less than two years in the case of killing.'” And in 2003 the Jordanian Parliament voted down on Islamic grounds a provision designed to stiffen penalties for honor killings. Al-Jazeera reported that “Islamists and conservatives said the laws violated religious traditions and would destroy families and values.”

Nonetheless, the media drumbeat is constant: honor killings have nothing to do with Islam. And so they continue, as no one ever challenges Muslim authorities to do anything to stop them.

Ramallah: The Palestinian Women’s Movement is awaiting the implementation of the reconciliation deal between Hamas and Fatah, which will pave the way for a legitimate parliament to approve the long-awaited legislation which abolishes the legal clauses that allow crimes of honour.

In an interview with Gulf News, Rawdah Baseer, an activist of the Palestinian Feminist Movement and head of the Palestinian Women’s Studies Centre, said the legislation once approved will be a key achievement for the women fighting against this menace since the 1990s.

“We resent those two clauses which led to the death of many innocent women in our land,” she said.

She said that the movement has studied the Palestinian Criminal Law, which is originally Jordanian, in detail and came up with amendments.

An average of 12 women are killed annually in the Palestinian Territories on honour grounds,” she said. “Men are taking advantage of the law,” she stressed.

A man who kills a relative is either pardoned, given a suspended sentence or six months to three years imprisonment which is reduced further once appealed, she said. However, when a woman murders her unfaithful husband, she is given a minimum of 15 years imprisonment. “This is not acceptable any more,” she said.

The Palestinian courts do not even investigate the women’s cases, and once the accused men claim they had acted on honour grounds, their claims are approved and sentenced accordingly,” she said. “This is unfair.”

A recent study by the Arab World Research and Development revealed that 74.5 per cent of the youth want the clauses abolished.

    That’s all. I thought they’d get a medal or at least some humus. I mean they are after all holding up the honor of Islam.

    It’s like this: In Islam murder and rape of non-Muslims and Muslim women are sanctioned by Mo/allah( their so called pedophile god). Of course Muslims won’t and don’t punish Muslim who follow this Islamic creed!! No surprise here. They transform from human beings to demons when they follow Quran and Mo/allah and then they stay demons. Nothing will ever help them to regain humanity unless and until they stop following Mo/allah.

    A woman in north-eastern Afghanistan has been arrested for allegedly strangling her daughter-in-law for giving birth to a third daughter [rather than the hoped-for son].
    The murdered woman’s husband, a member of a local militia, is also suspected of involvement but he has since fled.
    The murder took place two days ago in Kunduz province. The baby girl, who is now two months old, was not hurt.
    There were signs of torture on her body”, police added.

    A common apologist claim is that the Quran forbids honour killings, because it forbids killing of those who don’t fight. This claim is misleading, because the Quran allows a major exception, allowing killing for “a just cause” (25:68, 17:33, 6:151) or for “spreading mischief” (fasad, 5:32-33) in society. Thus the Quran leaves open the question of whether some kinds of honor killing are permitted. As Robert has noted before, the story of al-Khidr (in Sura 18) suggests that there are cases where Allah approves of killing children who might grow up to commit disbelief or rebellion. The Quran is not sufficiently clear on the issue of whether Muslims are permitted to kill children who transgress Islam through apostasy or sexual impropriety, etc. It does not, in fact, say that Muslims can’t kill their own children who apostatize or significantly transgress Islam.

    Another apologist claim is that Muhammad in the Hadith did not permit the killing of children, and that this policy should in effect prohibit honor killings as well. This is only partly correct. Muhammad did prohibit Muslims from killing children, but he allowed exceptions, including this one which related back to the story of al-Khidr (or al-Khadir, “The Green Man”) in Quran Sura 18:

    “This tradition has been narrated by the same authority (Yazid b. Hurmus) through a different chain of transmitters with the following difference in the elucidation of one of the points raised by Najda in his letter to Ibn Abas: The Messenger of Allah (may peace be upon him) used not to kill the children, so thou shouldst not kill them unless you could know what Khadir had known about the child he killed, or you could distinguish between a child who would grow up to be a believer (and a child who would grow up to be a non-believer), so that you killed the (prospective) non-believer and left the (prospective) believer aside.” (Sahih Muslim, Book #019, Hadith #4457)

    This is a remarkable hadith. It says, don’t kill children, unless you could know what Al-Khidr knows, namely that the child will grow up to be a disbeliever. Apologists might claim that since no one knows what Al-Khidr knows (unless they are guided by Allah), then no Muslim can simply take it upon himself or herself to kill a child. But another obvious interpretation is also available: A parent can know when a child grows up to be a disbeliever when that, in fact, occurs, such as a child that grows up only to apostatize from Islam, or engages in such transgressions of Islam that amount to blasphemy or apostasy. Note that this interpretation is available precisely because Muhammad made it so: In other hadiths he ordered that the penalty for apostasy is death.

    In Islamic law, an apostate past the age of puberty can be put to death.

    The underlying problem here is the value system laid out in the Quran and Hadith. Together these texts, which inform Islamic law and custom, state that the following must be put to death:

    -A Muslim woman who has a voluntary sexual relationship or marriage with a non-Muslim man

    In addition, fornication is punished by 100 lashes (Q 24:2) plus one year of banishment from the society.

    The very severe penalties prescribed in traditional Islam for these sin-crimes do overlap considerably with the kinds of so-called honour killings and honour violence carried out by Muslims. Honour killings persist in Islamic societies in part because the Islamic value system promoted by the Quran and Hadith is so similar to the honour traditions that encourage such violence and killing.

    Another apologetic line: Islam forbids vigilante punishment and killing. Again, this is only partly true. In the Hadith, a man killed the woman who was the mother of his children. The reason he killed her was because allegedly she repeatedly transgressed Islam by insulting Muhammad. Here’s the hadith:

    Sunan Abu-Dawud Book 38, Number 4348
    “Narrated Abdullah Ibn Abbas: A blind man had a slave-mother who used to abuse the Prophet (p.b.u.h) and disparage him. He forbade her but she did not stop. He rebuked her but she did not give up her habit. One night she began to slander the Prophet (p.b.u.h) and abuse him. So he took a dagger, placed it on her belly, pressed it, and killed her. A child who came between her legs was smeared with the blood that was there. When the morning came, the prophet (p.b.u.h) was informed about it. He assembled the people and said: I adjure by Allah the man has done this action and adjure him by my right to him that he should stand up. Jumping over the necks of the people and trembling the man stood up. He sat before the prophet (p.b.u.h) and said: Apostle of Allah! I am here master; she used to abuse you and disparage you. I forbade her but she did not stop, and I rebuked her, but she did not abandon her habit. I have two sons like pearls from her, and she was my companion. Last night she began to abuse and disparage you. So I took a dagger, put it at her belly and pressed it till I killed her. Thereupon the prophet (p.b.u.h) said: Oh be witness, no retaliation is payable for her blood”.”

    In other words, Islam permits vigilante justice if the vigilante punishes someone who transgresses Islam, in this case by disrespecting Muhammad.

    In summary, while the Islamic texts do not state explicitly that Muslims can kill their children who significantly transgress Islamic rules, they don’t clearly say they can’t kill such disbelieving or rebellious children, either. Moreover, the fact that the Islamic texts indicate that apostasy, blasphemy, and sexual impropriety are all grave offenses warranting severe physical punishments including killing, shows how consistent traditional Islam is with the honour traditions associated with it. Notions of strong parental control, and dress codes for young women, stated in the Quran and Hadith, also contribute to this idea that the parents must police their children, especially their young women. As Robert noted, such notions of honour are incorporated directly into Islamic law and the laws of some Muslim countries today in a way that validates the “honour” traditions.
