In FrontPage this morning I call for justice to be done to Judge Mark Martin in Pennsylvania:
The facts of the case are clear: Ernest Perce, a young atheist in Pennsylvania, marched in a Halloween parade dressed as “Zombie Muhammad.” A Muslim, Talaag Elbayomy, grew enraged when he saw Perce’s costume, and began choking him while trying to pull off the fake beard that Perce had glued onto his face. Perce went to the police, and so did Elbayomy – the latter under the mistaken impression that it was illegal in the United States, as it is in many Muslim lands, to insult or mock the prophet of Islam. Elbayomy was mistaken, of course: it isn’t illegal to mock Muhammad in the United States, but it may be soon, courtesy Judge Mark Martin, who dismissed the case against Elbayomy.
Martin claimed in a message trying to explain away his mishandling of the case that he dismissed the case for lack of evidence: “In short, I based my decision on the fact that the Commonwealth failed to prove to me beyond a reasonable doubt that the charge was just; I didn’t doubt that an incident occurred, but I was basically presented only with the victim’s version, the defendant’s version, and a very intact Styrofoam sign that the victim was wearing and claimed that the defendant had used to choke him. There were so many inconsistencies, that there was no way that I was going to find the defendant guilty.”
Martin didn’t mention in his apologia that Perce was filming at the time Elbayomy attacked him, and the video evidence is quite clear. Nor did he mention that a police officer on the scene, Sgt. Bryan Curtis, backed up Perce’s version of events. Both the video and Curtis’s testimony give the lie to Martin’s claim that “I was basically presented only with the victim’s version, the defendant’s version, and a very intact Styrofoam sign that the victim was wearing and claimed that the defendant had used to choke him.”
Nor did Martin mention that he lectured Perce at length about how his Halloween costume outraged Islamic sensitivities, concluding: “And what you’ve done is you’ve completely trashed their essence, their being. They find it very, very, very offensive. I am a Muslim. I find it very offensive…You are way outside your bounds of first amendment rights.” Martin later denied that he was a Muslim, and so when he told Perce that he was one, he may have been speaking conditionally, as in, “If I were a Muslim, I, too, would find it offensive.”
However, despite the best efforts of the Organization of the Islamic Cooperation (OIC) and its increasingly compliant enablers in the Obama Administration, it is still not illegal to offend Muslims in the United States. In fact, it is only illegal to offend Muslims and Islam under Islamic law. In lecturing Perce at length about how he had “trashed” Muslims’ “essence” and then ignoring two important sources of evidence that proved the charge against Elbayomy, Martin was effectively enforcing Sharia in an American courtroom. For under Islamic law, Elbayomy would have been perfectly within his rights, and even to be commended, for choking Perce for mocking Muhammad. The only criticism that might have been leveled against him had this case been brought in Jeddah or Tehran was that he didn’t finish Perce off altogether.
Pamela Geller interviewed Perce, who articulated the implications of the ruling: “Martin’s decision effectively says that Muslims do not have to learn to accept blasphemy against their religion without violence. Yet when you are a citizen of the USA, you accept our Constitution. Free speech is our foundation.”
Indeed. With the OIC engaged in a years-long struggle to compel Western states to criminalize truthful speech about jihad and criticism of Islam under the guise of criminalizing “religious hatred,” Martin’s skewed and biased ruling is particularly ominous, especially insofar as it coincides with Sharia prohibitions on speaking ill of Muhammad, the Qur’an, and Islam....
The single most significant discriminator between our free society and others I have experienced around the world has always been a discerning, mostly impartial system of justice. I cannot claim to be in agreement with all the Supreme Court rulings; however, the system of checks and balances has worked remarkably well until the last three years.
The absolute disregard for the Constitution demonstrated by Judge Martin is, to my thinking, prima facie cause for immediate impeachment (and disbarment if he is a lawyer).
Reading this article a few minutes after the American Thinker article on Fast and Furious gives me, worse than indigestion, confirmation of my growing concern that we as a country may be passing the Rubicon in terms of maintaining our democracy.
"All that is necessary for evil to triumph is that good men do nothing", and there seems to be a severe shortage of good men in positions from which they might act.
This judge should be removed from the bench immediately.
Any petition or facebook page to impeach him?
All US citizens on this forum belonging to the State in question must write to the requisite authorities to remove him from his post.
He is a dhimmi and hence cannot uphold the US constitution in letter or spirit.
The judge ruled the plaintiff was not eligible to file the religious defamation lawsuit and sent the case back to the state prosecutor’s office for further investigation. The first lawsuit against Sawiris was thrown out by a different court earlier this week on similar grounds.

This typical Muslim religious nut violated the very essence of the American Constitution and the essence of the atheist. Why does the judge not think about that? OT, but I just read that Turkish Airlines has now started daily flights from Mogadishu in Somalia, the first major carrier to do so. Presumably to enable the smooth passage of Islamic maniacs into Turkey to further destabilise it.
Send this judge to Saudia, Afghanistan or Pakistan or Somalia or any other Islamic hell hole where he can give his sharia judgement. But he should be fired on the spot for not following US constitution to which he has swore allegiance. If he didn't (since he is a Muslim)why was he appointed in the first place?? There are amny more like him in the government who should be impeached as they are open not following US constitution.

The job of Judge Mark Martin was to decide the case based on the legal merits of the case.
His job was not to lecture a U.S. citizen on Islam.
Nor was it the judge's job to make false claims; e.g., that the Founding Father's did not intend the First Amendment's guarantee of free speech to piss off other people or cultures.
The First Amendment protects unpopular speech, including speech that pisses off other people and cultures. Many of the Founding Fathers were racist and anti-Catholic. They had no issue voicing such opinions.
Judge Mark Martin's projection of his Multicultural and Politically Correct bias into his interpretation of the First Amendment and the rights it guarantees on the part of U.S. citizens suggests, in and of itself, that he is unfit to preside as a judge in a U.S. court.
I've read the judges comments and I've watched him interviewed on you tube.
My opinion is that this judge is still failing to recognize that this is America and not Iran or Saudia Arabia
In this interview on CNN Judge Martin is still reflecting that he is trying to keep the victim in line with Muslim sensitivities in his community, or another words judge Martin is being sharia compliant as he admonished the victim instead of the perpetrator which he clearly failed to do and absolutely should have since the Muslim perpetrator is clearly ignorant of American law.

I just saw this interview. thank you for posting this. this judge has no clue about the first ammnement or I should better say this he is trying to change the first amendment to cater to muslims. he should be impeached. is there a petition here for this?

Bridgette Gabriel's Act for America group has the right idea when it comes to political activism.
They create a nicely worded letter that targets what they are after.
They research and list all the emails of people that need to have this letter sent to.
Then they encourage you to BCC email to all the people in the list at once so you don't have to do 25 emails.. but just one email to 25 people.
It makes sense, its nice and neat for busy people like me and allows me to continue to participate despite by busy life.
Just need someone to take up the footwork in finding out who needs to be targeted for emails and create the letter.
If someone decided to do this, I would jump at the chance to help out. This happened close to my hometown. All my HS friends live in Mechanicsburg PA. and this judge just pissed off my sensibilities.

Advocating sharia is treasonous. Using sharia in a US court of law should result in deportation.

Poor Judge Martin, he didn't study legal History very well because in 1859 there were Judges and lawyers just like him that endorsed Slavery and felt that all 13 Colonies in the new Unions should be allowed to practise Slavery since it was the Law in some States or areas.

Mark Martin is the real doofus. He is a disgrace to the American judiciary and should be removed from the bench. And his understanding of the First Amendment is so awful that he, in effect, has betrayed the Constitution by his enormous ignorance of it.

This judge should not only be removed from the bench, he should be sued for creating a precedent. He actually incited hatred and violence by ruling that it was okay for Muslims to physically attack non muslims.

This man in effect practiced Sharia Law and sided with the Muslim perpetrator, thus denying his victim justice under AMERICAN law. Ever hear of the separation of church and state? Jewish judges recognize the separation of synagogue and state and don't expect non-Jews to abide by the Torah. Christian judges recognize the separation of church and state.

Jaladhi and Skeen, it seems most likely that Judge Mark Martin is *not* Muslim after all.
Apparently he said, "I'm not Muslim, but I'm offended". He claims to be Lutheran.
It seems he is, instead, an unhinged "multiculturalist", who felt the time he spent in Muslim lands was "beneficial"—apparently including the realization that atheists and those who have the temerity to mock Islam will be *killed* there.
He is someone who would apply Shari'ah law out of an insane "respect" for that savage and unjust code.
Ultimately, of course, his motives barely matter. His treatment of Ernest Perce, the callous trampling of his rights, and his application of Shari'ah norms has no place in an American court of law.
