1 Introduction to a Series on Islamic Shariah Law
The Scope and Reach of Shariah in Western Societies

This series of articles on Islamic shariah law is intended for judges, lawyers, legislators, city council members, educators, journalists, government bureaucrats, think tank fellows, TV and radio talk show hosts, and anyone else who occupies the “check points” in society; they initiate the national dialogue and shape the flow of the conversation in society. They are the decision and policy makers.

As intellectuals, they may believe the critics of shariah exaggerate (and maybe some are guilty of it). Islam is a world religion, after all. It deserves respect.

They are also moral relativists who believe in tolerance for all religions. At first glance, this is a commendable outlook.

Even Thomas Jefferson said, “But it does me no injury for my neighbor to say there are twenty gods, or no God. It neither picks my pocket nor breaks my legs.” [1]

In essence Jefferson was saying that beliefs that do not harm us monetarily or physically should be tolerated. Islam has neutral and even positive aspects to it – they do no one any real damage in those ways. Therefore, those specific parts should be tolerated in a religiously diverse society like America.

The Five Pillars are examples. Muslims are required first to declare their faith in a formula statement; second, pray five times a day; third, give a charity tax; fourth, fast during Ramadan; and fifth, take a pilgrimage to Mecca. We can include parts of Islamic theology, like the oneness of Allah, or other rituals like washing before entering a mosque or never eating pork.

All of these things are part of shariah – divine Islamic law, which traces its origins ultimately back to the Quran and Muhammad’s example or life. None of these words and rituals harms society. It is true that a required charity tax could be interpreted as harming one’s income, which “picks my pocket,” but in a free country outside of Islamic civilization one does not need to join Islam, or one could leave it.

If Muslims were to follow only the positive and harmless practices and rules in shariah, the world would enjoy a lot more peace.

Unfortunately, however, this series of articles is not about the harmless parts of Islam, but the harmful ones. Many parts of shariah have rules that are incompatible with the modern era. This series has to expose those teachings of shariah.

Even Thomas Jefferson had his limits. He sent in the marines to take back captured American merchant sailors and to open up the trade routes that were hampered by the Muslim Barbary pirates in North Africa, who had sold the captives into slavery or demanded a ransom. [2]

In some cases Islam does pick our pockets and break our legs.

TEN ITEMS OF CONCERN

And here we begin with some basic concerns about Islamic aggressive policies, whether formally part of shariah or not. These ten items are the tip of the iceberg, representing others.

Item One

At this time, fifty court cases in twenty-three US states involve shariah

The Center for Security Policy finds fifty “relevant” or “highly relevant” cases on the appellate level where shariah has entered into consideration and where some judges defer to it.

Our findings suggest that Shariah law has entered into state court decisions, in conflict with the Constitution and state public policy. Some commentators have said there are no more than one or two cases of Shariah law in U.S. state court cases; yet we found 50 significant cases just from the small sample of appellate published cases. Others state with certainty that state court judges will always reject any foreign law, including Shariah law, when it conflicts with the Constitution or state public policy; yet we found 15 Trial Court cases, and 12 Appellate Court cases, where Shariah was found to be applicable in the case at bar. The facts are the facts: some judges are making decisions deferring to Shariah law even when those decisions conflict with Constitutional protections. This is a serious issue and should be a subject of public debate and engagement by policymakers. [3]

An objector may ask about Jewish law or Catholic canon law. In reply,

[T]here is literally no instance of Jewish law or Christian canon being applied in a state court where a litigant is likely to be deprived of a constitutional liberty. And, the reason this is so is because neither of these religious laws occupy the space of authoritative state law. Sharia is problematic precisely because it is the secular law in almost all of the Muslim world, either as the law of the land simply or as the authoritative law in matters of family relations and citizenship or what is sometimes referred to as “identity law” in those Muslim countries which require their citizens to declare a religious affiliation for their “identity” cards — such that the law treats Muslim citizens differently from non-Muslims. [4]

That is, Jewish law and Catholic law are different from Islamic law. The former laws do not “occupy the space of authoritative state law,” while Islamic law does.

Item Two

Muslim judges, lawyers, and jury members, living in the West, must try to implement shariah, whenever possible

The Assembly of Muslim Jurists of America (AMJA) is made up of religious scholars, most of whom have their doctorates in Islamic law or other Islamic subjects; they have the credentials to write fatwas (religious rulings or opinions). They advocate Muslim judges and lawyers and jury members actively implementing Islamic law, while they work in the Western system. They must realize that Islamic law is superior to Western law.

Furthermore, since attorneys are representative of their clients, it is permissible to practice law within the scope of permissible, just, and legitimate cases that are filed to demand a right or alleviate a grievance. Similarly, it is permissible to study, teach, and understand man-made laws for the purpose of realizing the superiority of the Islamic laws, or practicing law in an environment that does not recognize the sovereignty of the Islamic law, intending to defend the oppressed people and retrieve their rights. This is, however, contingent upon the possession of enough Islamic knowledge, in order to avoid becoming an unwitting participant in sinful actions and transgressions. [4]

AMJA says judges and jury members must “maintain displeasure in [their] hearts” about man-made (i.e. Western laws) and their decisions must “be in compliance with Islamic law.”

In addition, one should judge between people according to Islamic law as much as one can. Furthermore, while in this position, one should maintain displeasure in his heart to the man-made laws. Needless to say, this ruling is an exception that is governed by the aforementioned provisions and restricted to necessity only. AMJA further clarified that it is permissible for Muslims to serve as members in a jury proceeding, with the stipulation that their opinions be in compliance with Islamic law and with the intention to establish justice for all. [6]

Item Three

Shariah courts are strong in the UK

In 2008, while arguing for the need to formally introduce Sharia law into the law of the United Kingdom, the Archbishop of Canterbury claimed Sharia law was “inevitable” in the UK. He denied it was an “alien” system and called for “constructive accommodation” of Muslim law. He did this in a calculated and provocative manner, while denying a place for its more “extreme punishments.”

It is unlikely that many members of the Muslim community would be satisfied with an Anglican primate determining the limitations of the Quran and Sharia law.

This argument was rapidly followed by the Lord Chief Justice: Lord Phillips helpfully said there was a place for Sharia law, particularly in mediation. He lamented the “widespread misunderstanding” of Sharia law. The newly established Muslim Arbitration Tribunals immediately put a picture of the Lord Chief Justice on their website in appreciation of his endorsement.

In the United Kingdom, the many thousands of Sharia courts can quietly go about their business of implementing “justice” in a form totally “alien” to the Judeo-Christian tradition, denying human rights to many of our citizens — particularly women.

The “constructive accommodation” of Muslim law reached a logical conclusion with the declaration this year of Sharia law controlled zones in a number of areas geographically spread over the country, where the Islamist militants enforce their will. Their posters declare: “No music or concerts, no porn or prostitution, no drugs or smoking, no gambling, no alcohol.” A reign of terror has begun, with threats of implicit violence against anyone who “insults” Islam, changes religion, or fails to dress appropriately. I have already been contacted about assisting two individuals subject to Islamist threats.

The police stand passively by, adhering to their diversity training. [7]

Item Four

Highly placed Muslims use labels like “Islamophobia” to stifle legitimate criticism of Islam [8]

Prof. Ekmeleddin Ihsanoglu, the Secretary General of the Organization of Islamic Cooperation (formerly Organization of the Islamic Conference), an international organization consisting of 57 member states and based in Jeddah, Saudi Arabia, writes that “Islamophobia” is finding a home among critics of Islam, because, these critics claim, Islam does not respect freedom of expression.

Anti-Islam and anti-Muslim attitudes and activities, known as Islamophobia, are increasingly finding place in the agenda of ultra-right wing political parties and civil societies in the West in their anti-immigrant and anti-multiculturalism policies, as was evident in the manifesto of the Norway killer. Their views are being promoted under the banner of freedom of expression while claiming that Muslims do not respect that right. [9]

The “Islamophobia” charge is related to shariah only when it is wielded like a weapon against critics of shariah. The term seeks to stifle free speech.

On the positive side, the professor’s statement in other places does condemn violence against non-Muslims and calls for dialogue among people of different faiths. But he also writes: “The Islamic faith is based on tolerance and acceptance of other religions.”

However, this series, especially the first few installments, contradicts his claim. “Islamophobia,” a term invented to stifle critics, is not the problem. “Religiophobia,” which is Islam’s fear and dislike of other religions, especially when they are dominant and it is not, is the problem.

Item Five

Collaboration between the Obama Administration and the Organization of Islamic Cooperation (OIC)

The Obama administration is working to implement U.N. HRC Resolution 16/18 against religious negative stereotyping and “Islamophobia.”

Nina Shea, director of the Hudson Institute's Center on Religious Freedom and a member of the United States Commission on International Religious Freedom, writes:

WASHINGTON (BP) -- An unprecedented collaboration between the Obama administration and the Organization of Islamic Cooperation (OIC, formerly called the Organization of the Islamic Conference) to combat "Islamophobia" may lead to the de-legitimization of freedom of expression as a human right.

The administration is taking the lead in an international effort to "implement" a U.N. resolution against religious "stereotyping," specifically as applied to Islam.

To be sure, the administration argues that the effort should not result in free-speech curbs. However, its partners in the collaboration, the 56 member states of the OIC, have no such qualms.

Many OIC states police private speech through Islamic blasphemy laws that the Saudi-based OIC has long worked to see applied universally. Under Muslim pressure, Western Europe now has laws against religious hate speech that serve as proxies for Islamic blasphemy codes. [10]

Item Six

New Jersey trial court defers to shariah in a marital rape and domestic violence case

The plaintiff, who accused her husband of abuse, offered this description, summarized in the appellate court’s account:

However, on the night of the reconciliation, defendant again engaged in nonconsensual sex three times, and on succeeding days plaintiff stated that he engaged in further repeated instances of nonconsensual sex. According to plaintiff, during this period, she was deprived of food, she lacked a refrigerator and a phone, and she was left by her husband for many hours, alone. [11]

The trial court judge asked the local imam what Islamic law said about sex between a husband and wife when she does not consent. The imam said the husband has sexual rights over his wife’s body.

At the conclusion of this testimony, in response to the judge’s questions, the Imam testified regarding Islamic law as it relates to sexual behavior. The Imam confirmed that a wife must comply with her husband’s sexual demands, because the husband is prohibited from obtaining sexual satisfaction elsewhere. However, a husband was forbidden to approach his wife “like any animal.” The Imam did not definitively answer whether, under Islamic law, a husband must stop his advances if his wife said “no.” However, he acknowledged that New Jersey law considered coerced sex between married people to be rape. [12]

The trial court judge ruled that no restraining order was necessary, because a divorce was effectuated, and no communication between the husband and wife was necessary. However, the appellate court said that the trial court failed to give consideration to the fact that the she was going to have a baby, so they would have to communicate. The appeals court writes:

As a final matter, we find that the judge failed to give sufficient measured consideration to the imminence of the birth of the couple’s child — an event that the judge acknowledged would bring the two into contact and almost inevitably be a source of conflict. In this regard, we note that defendant’s previous misconduct consisted not only of sexual acts that were unlikely to be repeated given the couple’s estrangement, but also acts of assault and harassment that were more likely to be repeated in the future.

Viewing the evidence as a whole, we are satisfied that the judge was mistaken in determining not to issue a final restraining order in this matter in order to protect plaintiff from future abuse and in dismissing plaintiff’s domestic violence complaint. We therefore reverse and remand the case for entry of such an order. Reversed and remanded.

Thus, fortunately the appeals court reversed the trial court’s decision.

Item Seven

In a 2003 poll, shortly after 9/11, 81% favor shariah

[A] poll conducted in Detroit area mosques during 2003 found that 81% of the respondents endorsed the application of the Sharia where Muslims comprised a majority. [13]

To repeat, that is only two years after 9/11.

Item Eight

A satirical newspaper office in Paris, France was bombed for practicing its freedom of speech

The fiercely anti-clerical magazine said the move, which included renaming the publication “Sharia Hebdo”, was intended to "celebrate" the victory of Islamist party Ennhada in Tunisia's election.

Charlie Hedbo's editor-in-chief, known as Charb, told France Info radio: "We no longer have a newspaper. All our equipment has been destroyed or has melted."

No injuries have been reported

A single Molotov cocktail was thrown at the offices of Charlie Hebdo in Paris’s 20th arrondissement at around 1am. The ensuing fire was rapidly put out, but a large amount of material in the office was destroyed, police said.

“We cannot, today, put together a paper,” said Charb. “But we will do everything possible to do one next week. Whatever happens, we’ll do it. There is no question of giving in,” he said, adding that the magazine is filing a legal complaint against persons unknown.

According to Europe 1 radio, police are searching for two suspects seen near the scene.

Charlie Hebdo's website has also been hacked with a message in English and Turkish cursing the magazine.

The message said: "You keep abusing Islam's almighty Prophet with disgusting and disgraceful cartoons using excuses of freedom of speech.

"Be God's curse upon you!" [14]

Item Nine

The Islamic Circle of North America (ICNA) says spreading Islam will be ultimately successful when a worldwide caliphate and shariah dominate

All religions in a free country are allowed to preach their message peacefully. They are further allowed to convert as many as they can. That is religious freedom. However, Islam entails the ideological and judicial or the political and the legal, on top of the religious. (Yes, it is a religion.)

In March 2010 ICNA’s New York branch published a handbook for its members. Some parts are positive, like developing the virtues. However, the handbook also teaches that the worldwide caliphate and shariah must arise and dominate all aspects of life.

"Islamic movement" is the term used for that organized and collective effort waged to establish Al-Islam in its complete form in all aspects of life ... It is our obligation as Muslims to engage in the same noble cause here in North America. [15]

After explaining the differences between the One Muslim Community (al-Jama’ah or worldwide Islamic state) and a specific, local Muslim community (jama’ah), the handbook says:

[The term al-Jama’ah] implies the united Muslim Ummah [Community] in a united Islamic state, governed by an elected khalifah [caliph or caliphate] in accordance with the laws of shariah ... Leadership of al-Jama’ah (or an Islamic state) has the authority to enforce Sharia’s political, educational, criminal justice system etc. that is beyond the jurisdiction of a jama’ah [local community]. [16]

So shariah is understood to cover many major areas of society by legislative and political means, not only by propagating one’s faith through persuasion and preaching with words alone.

Islam is a religion, but it is overlaid with the political and legal.

Item Ten

Headscarves that do not cover the face are allowed in police photos

Boulder County Sheriff Joe Pelle will allow a Muslim woman to wear her head-covering in a jail booking photo, provided she push the scarf back far enough to expose her hairline and ears.

The compromise puts an end to a controversy sparked when Maria Hardman, a University of Colorado student and convert to Islam, refused to take off her hijab for a booking photo when she reported for a two-day work-release sentence.

The decision came a day after a Boulder County judge denied Hardman's request to either serve an alternative sentence or keep on the scarf, which exposed her face. However, Boulder County Judge Noel Blum asked jail officials in his ruling to consider whether some accommodation could be made.

Pelle said his office looked at how other jails handle religious head-coverings and how other agencies that require ID photos handle the issue. Pelle said he wanted a policy that wouldn't allow someone to come in wearing a burka or full-face covering and claim an exemption and one that would allow law enforcement officials to recognize the person even if he or she wasn't wearing the head-covering. [17]

We live in a free society. If a woman wishes to wear a headscarf or even a veil that covers her face except her eyes and it is safe to do so, then that is her choice. Compromises and accommodations are positive in many cases.

However, not allowing the veil that covers her face is right for business. Also, for the specific purpose of a photo ID, the headscarf should be removed. A woman police officer or a female photographer at the Department of Motor Vehicles can take the photo, if modesty is the problem.

At the police station, don’t some suspects get thoroughly searched, even strip-searched? What if the suspect insists on keeping her headscarf on, but she’s hiding drugs or a small weapon in her hair? Therefore, she must take it off.

It should be pointed out that France has banned the burka (full face covering), for women in public. This may be too restrictive of women’s religious freedom. [18]

CONCLUSION

Those ten items will become outdated in a few years, so readers are encouraged to search the web for new cases.

But the ten items reveal deep problems, right now.

Where do the problem cases come from? Only from a distorted and fanatical interpretation of early Islam that was actually pure and peaceful many centuries ago? Or do the problems come from original Islam itself?

Yet another purpose of this series of articles is to answer those questions.

For the record, what would happen to Jefferson’s hypothetical neighbor who believed in twenty gods and lived in an Islamic nation that was based on shariah? He is known as a polytheist or one who believes in many gods – another term is pagan. The closest example to a polytheist today is an animist, one who believes things have souls.

In original Islam, he would have to convert to Islam and pay the required charity tax; or if he did not convert, he would have to die. In today’s Islam he would be persecuted and arrested and “reeducated.” Maybe he would be executed. [19]

As for Jefferson’s hypothetical atheist neighbor, in original Islam he would be given a chance to repent, or die. In today’s Islam he would suffer persecution, ranging from “reeducation” and prison or exile and maybe ultimately to execution if he criticized Muhammad.

Islam and sharia are inter twined and cannot be separated...
Sharia is Allah's laws, and because they are Allah's laws, they all share the same value, they are all of maximum importance...That's why there is no such thing as 'sharia lite'...If you diminish sharia, you diminish Allah's words and if you diminish Allah's words you diminish Allah...What a dreadful sin that is...Just thinking about it is apostasy...
Mahoundians may settle on sharia lite on a temporary basis, but lite is not their religion...full on sharia in all it's glory is their religion...so they will push for it until they get it, no matter how long it takes...Allah has plenty of time...after all, he invented it...

I don’t mean to quibble here; I appreciate this clearly well-intentioned effort, which is overall very valuable, but there are a couple of problem points that need to be highlighted.

First, with regard to the “Five Pillars,” in the point about what this article describes (not very accurately) as a “charity tax” (more accurately “Zakat,” which is generally forbidden to be given to non-Muslims) given that, according to Islamic law, one of the eight possible avenues for the direction of that monetary giving is jihad warfare, I would hardly call that an entirely harmless element of the ideology. The Zakat can indeed “break my legs” (and a whole lot worse), to paraphrase Thomas Jefferson.
From Umdat al-Salik (The Reliance of the Traveler):

H8.17 The seventh category is those fighting for Allah, meaning people engaged in Islamic military operations for whom no salary has been allotted in the army roster (O: but who are volunteers for jihad without remuneration). They are given enough to suffice them for the operation, even if affluent; of weapons, mounts, clothing, and expenses (O: for the duration of the journey, round trip, and the time they spend there, even if prolonged. Though nothing has been mentioned here of the expense involved in supporting such people’s families during this period, it seems clear that they should also be given it).

Also, the “oneness of Allah” is an absurd expression of intolerance. All it means is that Islam is the only true religion and all others are fake, and thus must be made subservient or eliminated all together. I’m not saying that we should curtail free speech by making it illegal to state this. But I can’t just let that absurd expression be used in an essay and painted as benign without at least clarifying what it means in case anyone reading this doesn’t know. It is not some “we’re all one” type of kumbaya expression. It is an expression of intolerance.

There are some other questions that can be raised about some of the other “Five Pillars,” as well, but I’ll leave it at this for now.

Great article, but would disagree with the statement that the Five Pillars which "Muslims are required" to follow do no harm.
Required in Islam is coersive and threatening. By national law based on sharia, the general public is bombarded with calls to prayer all day long. By law, food cannot be eaten in public, or even a drink of water taken, during the month of Ramadan. So-called Islamic charity traditionally means giving money to jihadists (remember Holy Land Foundation).

Also, the standard rote Islamic prayers are themselves calls to jihad and explicitly call for attacking Christians and Jews. Prayer in Islam is repetition, no DIY free prose.

Hardly a non-threatening aspect of Islam.

Many parts of shariah have rules that are incompatible with the modern era. This series has to expose those teachings of shariah.

Say no more… Actually, please, do say a lot more… so people of all walks of life will understand what Islamic Sharia has in store for us, given their chance to impose it on us. Of course, that is exactly what Islam, the Koran, top mullahs and Islamic clerics, Muslim Brotherhood et al, have in mind, to impose Sharia on the world. There should be Sharia specific dedicated pages, such as Jihad Watch-101, Islam-Watch, Answering Islam, Religion of Peace et al, for people to find quickly on web search engines, Google/Yahoo/bing etc. All people, both non-Muslims, atheists, agnostics, Christians, Jews, Hindus, Buddhists, Jains, and so on, as well as Muslims; all should gain quick and easy access to Sharia, and compare it to their beliefs as well as their moral and cultural values, and their personal conscience. Then let the people see how corrosive and damning is this Arab 'religion' - that in fact is a foreign Political Power inveigling itself into the West though deceit, fraud, threats and violence. Their ultimate goal is Sharia, and all the power it gives Muslims over the people, especially non-Muslims. From footbaths to jizya, Sharia finds its way into our way of life. If Thomas Jefferson were alive today, he's be horrified it had come to this, probably burn his Koran in protest. Yes, education and easy access to Sharia/Jihad/Koranophilia, so all must learn what Islam really is all about. Especially this is imperative to gain such in depth knowledge of Islam and Sharia by people of responsible office, judges, government officials, politicians, educators, police, zoning boards, corporate chief executives, and media personnel; they all should learn their Islam. Educate, educate, educate all, and more. Knowledgeable intelligence is our best defense against Sharia encroachment. Jefferson would have heartily approved.

I have to disagree with the assertion that veils or burkhas should be allowed in public, in a free society.

We are not simply a conglomerate of individuals who happen to live in the United States. It is necessary to retain some core of commonly-shared values, or there will be no government and no constitution and certainly no freedoms.

One of the core aspects of our freedoms is that individuals should be free from physical coercion, other than government enforcement of the laws. Granted, that principle is violated by criminals and sometimes sanctioned by government agencies, but it remains a principle nevertheless.

In the matters of a veil or burhka, there is simply too much violation of our commonly-held principles. Women may not have had the vote in early America, but they were protected by law, and enjoyed basic rights. An anonymous woman in a veil is cut off from outside contact, and may not even know she has a right not to be abused by her husband and family. A veiled woman on the streets simply violates too many bedrock foundations of US society. It implies she is less than human.

A covering completely masking a person's features and identity should simply not be allowed in public. It's not just a matter of safety. It's a matter of maintaining our identity as a free society of individuals. It's about taking a stand.

From the get-go, two civilians ("out of context" and "Max Publius" above) in the comments section pointed to major flaws in Arlandson's piece. And there are a couple more in addition which this civilian spotted, in 60 damn seconds.

What does the "Ph" in Arlandson's degree stand for? "Philarky"?

Our lives are at stake here, and the lives of our women and children. But methinks that Arlandson, like Spencer, has an eye on saving Muslims for the Gospel; and thus has a stake in believing the paradigm of Many Good Muslims Out There Who Need To be Saved By Us -- in this case, a kind of Christian Wilsonianism. And for such a putative mass of salvageable Muslims to exist, one needs a special, putatively harmless Islam to exist for them -- whether that special Islam is real or not.

Well, to this concerned citizen, the lives of my friends, family and fellow citizens is the #1 priority; and way down on the list -- not even making the top ten -- may be the hypothetical mass of Muslim VOI ("Victims Of Islam").

First red flag:

Okay, I thought; maybe Arlandson is just throwing a bone to the PC MCs likely to read his piece. Let's read on:

Offensive, in fact; not only to our intelligence, but to the grief of millions who have suffered from the rapes, tortures, massacres, intolerance, hatred and oppression of the members of this "world religion", not to mention to the memories of all the real victims of Islam around the world. FTS, all the way. No tolerance for TKOS.

Arlandson then invokes Jefferson's dictum that would make the careful distinction between religion, and whether a religion foments and perpetrates violence. An excellent distinction, which I believe is appositely applicable to Islam (as I argued in my essay It's the Violence, Stupid). Where Arlandson errs grievously is where he artificially creates a benign Islam out of thin air (well, not quite out of thin air -- he likely is just thoughtlessly borrowing the invention more or less from the Politically Correct Multi-Culturalist paradigm at large):

Has Arlandson never taken, or taught, a Sociology 101 class? Has he never read anything about sociology or modern anthropology? Is he wholly unfamiliar with the commonplace fact that many human systems in general -- whether they be a culture, or a subculture, or an ideology, or a religion, or a cult -- are not composed of discrete blocks or parts which one can detach at will and rearrange into pleasing new configurations like so many Leggo pieces, but are rather systemically interconnected of most or all of the aspects we may be able to distinguish intellectually, but which for the human beings actually living and composing these human systems is a living organic whole?

This truism goes doubly for totalitarian type systems which, as inhuman and inhumane as their principles and practice may be, tend to cohere into a unit more strongly than do freer, more humane social systems. And we know that Islam is not only totalitarian but, indeed -- as the scholar of legal history G.H. Bousquet wrote (hat tip to the inestimable (if nowadays invisible) Andrew Bostom) -- it is doubly totalitarian, in the way it regards the world as fit only for totalitarian subjugation, and in the way it regards its own system as a totalitarian submission, embracing all aspects of life and society, to an obsessive-compulsive framekwork of ultra-Pharisaic laws fanatically and pathologically derived from the holy texts of the Koran and the Hadiths, and meant to force conformity not only socially, as a system of tyrannical imposition on members, but also psychologically, by inculcating a culture where members impose it upon themselves willingly and come to love their Big Brother of the Muslim Brotherhood, Mohammed.

Now, Arlandson's oversight here is no innocuous slip; it could have actual consequences in real policy if enough people believed it -- wait, enough people in high places do believe it, and real policies every day are being implemented to favor the continuing deadly sedition Muslims, through their Islam, are fomenting throughout the West. So why is someone sorta kinda in the Counter-Jihad movement reinforcing the paradigm that leads to such policies?

Thus spake Arlandson, expanding on his ludicrous claim we quoted above ("Islam has neutral and even positive aspects to it – they do no one any real damage in those ways" -- reminding one in an incipiently-upchucking sort of way of McCain's infamous “I admire the Islam. There’s a lot of good principles in it...!”):

Therefore, those specific parts should be tolerated in a religiously diverse society like America.

Hang on, sloopy. Not so fast with that "Therefore", kiddo. You can play fast and loose with your artificial hologram of a Second Benign Islam composed of your cherrypicked Tinnker Toy "specific parts" all you want -- but don't publish major official papers conspicuously bedecked with a PhD pushing it; for real lives are at stake here, and you are only recklessly reinforcing the very same paradigm that continues to retard our general progress toward recovering our rationality by which we can begin the complicated process of protecting our men, women and children.

Speaking of those "specific parts" which only Islamo-illiterate (and curiously unimaginative) non-Muslims think can be detached from the holistic tapestry of Islam, Arlandson goes on to mention a couple:

Again, the ordinary un-PhD'd civilians "out of context" and "Max Publius" in their comments above mine here handily demolished this -- and believe me, Arlandson would not want to press the point in protestation; for further learned elucidation and facts brought to bear would only further pulverize his ridiculous claim that these five pillars are harmless to non-Muslims. That wouldn't stop an Arlandson from obtusely persisting in his claim, of course.

Ditto for the other "parts" Arlandson includes in his recreation of the Battle of Trafalgar made of marzipan:

The fact that Arlandson seems blithely unaware of the fact that zakat has been found to be funding terrorism from the pockets of Muslims throughout the world -- as documented with numbing frequency here over the years on Jihad Watch -- is stunning. If Arlandson is going to publish a lengthy article on Jihad Watch, it might be useful for him to take the trouble -- as we concerned civilians have -- to read (actually carefully read, not just gloss over with glazed eyes) some Jihad Watch articles. Indeed, the PhD-holder should be given the assignment to read at least 5 JW articles per month, from 2004 to 2012. Doing the math, that would tally at 540 articles he should read, before publishing anything here that shows such an egregious ignorance of the very issues this site is reporting.

If Muslims were to follow only the positive and harmless practices and rules in shariah, the world would enjoy a lot more peace.

And speaking of Bousquet, aside from his useful insight of the doubly totalitarian nature of Islam, his explication of this bears closer scrutiny in this regard, for it exposes the specious idiocy of Arlandson's "parts" around which revolves his spin on the problem of Islam, and persuasively argues (based upon a greater scholarly knowledge of the subject, I dare say) that Islam is a tightly woven whole whose warp-and-woof cannot be so lightly picked apart.

Bousquet wrote (bold emphasis mine):

...[Islamic Law] is a hodgepodge: we find measures in which we recognize moral precepts, juridical rules, indications of a ritual order, but all these norms that we judge essentially different are treated in the same spirit -- casuistically, it may be said -- by the Doctors of law, that is to say, by the real representatives of Islam, a religion without priests. After Arlandson's introductory remarks, and after the devastating comparison one makes by shining a Bousquet upon them, one has no time to waste on the bloated, and doubtlessly unoriginal, exposition on the "harmful parts" of Sharia that follows.

Very good LemonLime, excellent summation of where this whole Islam as 'religion' fails miserably. It's first of all a Totalitarian system, doubly so, because it not only controls your person in body and mind, but it seeks to control your soul. Islam acting in such violently inhumane ways down all its history into the present is where this (foreign) double Political Power Totalitarianism has proven itself totally inimical to human existence. Islam is a scourge beyond salvation. The only way out for Muslims is to truly get out, and then pray they not be 'killed for changing their religion', as claimed per Mohammad's dictum.

Dr. James M. Arlandson is not taking that existential threat seriously enough.

Arlandson's piece is a big disappointment for me, because I am an admirer of his work after having read many of his articles over the years. (His article on Islam's Goal is one that stands out in my mind as particularly good). Unfortunately, the present piece suggests the author has taken too many steps down the path of accommodationism. I'm not sure how much of this accommodationism is just the usual persuasive writer's method of trying to appear impartial, but assuming these are Arlandson's genuine views, I have to say it suggests a surprisingly naive view of Islam's and sharia's supposedly innocuous elements.

I wouldn't malign Arlandson if the divergence he takes were not so directly related to our safety, and our ongoing project to turn around and re-orient our culture from its disastrously reckless orientation vis-a-vis Islam.

The latter statement appears to be merely presenting the belief commonly-held throughout the West, and especially in the U.S., i.e., that if something is a religion (especially a monotheistic one), it is therefore good. (It is an unchecked assumption that is surely at least as absurd as the claim that because something is a political ideology, it is therefore good). I didn't take Arlandson himself to be endorsing that view, though in reading the rest of the article it does appear that he does have some respect for Islam's "positive" elements and "virtues."

But Arlandson's article contains a number of strange comments that seem to me difficult to excuse. He then writes [regarding the leaders, journalists, educators, etc.]:

To whom? Does Arlandson think it is commendable at first glance? Probably not. Then why does he suggest he believes it to be the case? Why not say that some people might think it to be commendable at first glance? (Or why say anything about this? After all, do we really want to waste time addressing the child-rape-is-okay-in-context crowd?)

In other words, accept Islamic deception, hook, line, and sinker. (And then they'll break our legs and pick our pockets openly when they have the power to do so, in a few decades when the West is too old, decrepit, and divided to defend itself from opportunistic usurper Islam). The only person more dangerous than an outright murderer is a deceptive one who pretends not to be a murderer. As the Quran tells Muhammad (and by extension all Muslims) to tell the disbelievers, "Say to them "Peace," but they will come to know" (43:89). I.e., presenting a peaceful face to non-Muslims for the intended purposes of fooling them and then conquering them later is a foundational principle of Islam itself and cannot be removed without denying the entire religion.

The one thing that Muslims could do to be most successful in conquering the West would be to do it slowly through immigration and birth rates, without pressing their demands or engaging in violence. Then, once they are a majority or are large enough to form a coalition with sympathetic power-hungry non-Muslims (e.g., hard leftists), they could simply vote in sharia government, and then reveal their true colours once they have power (having already populated the much of the police and military by that time). That would be the most dangerous scenario for the West, due to the deception involved. Fortunately, there are enough Muslims who can't seem to keep their mouths shut and who can't seem to help themselves in repressing violent actions or holding back on the triumphalist supremacist outbursts that we have a pretty good idea as to Islam's long-term plans for the West. Islam's project is what it always has been: Conquer the world and bring every area of it under Islamic rule. Not only are the superficially seemingly nice for-presentation-purposes-only aspects of Islam not helpful to non-Muslims, these elements are actually dangerous to non-Muslims because of the deceptive and two-faced aspects of Islam.

Anyways, does Islam have elements that are neutral or even positive toward non-Muslims? No. Muslims are only permitted to behave in a seemingly positive way to non-Muslims for the purposes of da'wa and jihad or for the protection of Muslims. In other words, Muslims are only permitted to be seemingly nice to non-Muslims for the purpose of defeating the "disbelief" of the latter. Any action that weakens Islam and helps the kufr camp in any way is regarded as sinful. "...Never help the disbelievers," warns Quran 28:86, which in light of the rest of the Quran, we can take to mean, don't help them as such, unless it is an action that ultimately weakens the kufaar and strengthens/protects the Muslims. Even allowances for Muslims Islamic charity (under sadaqa) to non-Muslims are restricted by the overarching principle that such help must not be contrary or work contrary to Islam; all of it must benefit Islam and Muslims in some way, otherwise it is sinful.

The shahada is not a mere religious declaration but rather puts the Muslim's loyalty to Islam and Muhammad (a military commander) in direct conflict with whatever non-Muslim nation he or she may inhabit. The majority of Muslims identify with Islam more than their nation of residence. By agreeing to the shahada, a Muslim is saying he will put his life on the line and struggle to the utmost to defend and promote Islam and Muhammad, to make Islam "superior," "dominant," over all other religions, no matter whether or how much the disbelievers dislike it (48:28-29, 9:32-33, 61:9). A Muslim in pronouncing the shahada is saying that he will fight all people until they too pronounce the shahada. Islam is a project "to conquer all humankind" (e.g., Ishaq 204-208; 470-471). Likewise, Qaradawi, citing the famous hadiths (famous to Muslims, anyways) about conquering the entire world, wrote:

"1. In his Sahih, Imam Muslim recorded that Thawban quoted the Prophet (peace and blessings upon him) as saying: “Almighty Allah has gathered the earth for me so that I could see all its corners. My nation will rule over all that which Almighty Allah has gathered for me.”
2. Ibn Hibban quoted the Prophet (peace and blessings be upon him) as saying: “This matter (i.e. Islam) will spread to cover all areas where there is night and day. Allah will never leave a house in a rural area or in urban community without its people being Muslims. Honor is for those who embrace it (i.e. Islam) while disbelievers are doomed to disgrace and humiliation.”
This hadith, along with many others, give us glad tidings that the patch of the Muslim state will expand to cover the whole earth and that the strength of this state will grow and become obvious to all. This also denotes good news for the long-cherished hope of revival of Muslims’ unity and rebirth of Islamic Caliphate."

In sum, in saying the shahada, a Muslim is agreeing to conquer the world, to bring non-Muslims under heel, on behalf of Islam. He is sinning and violating the shahada if he does not at least agree to this in principle and at minimum hope for it to happen, and that is the least of his belief.

2. Praying five times a day the prayers in question simply reaffirms Islamic identity as apart from non-Muslims, reaffirms the hostile attitudes toward non-Muslims and disbelief generally, and gives Muslims an opportunity to socialize apart from the non-Muslims. I fail to see how psychological preparation for warfare and conquest, by Muslims against non-Muslims, is a positive aspect.

3. Zakat is not quite a "charity tax." It is mandatory for Muslims to provide zakat money for maintaining the Islamic totalitarian system and for the Islamic war chest, where by war I am referring to support for both the militant and non-militant forms of jihad (e.g., da'wa, propaganda jihad,, etc.).

4. The fast during Ramadan is not positive, but is instead a largely harmful activity that causes problems for diabetics, causes loss of concentration, is associated with increases in accidents, causes economic instability and food price increases; and is enforced upon non-Muslims. Moreover, the fasting itself can be used as a preparation in training for military expeditions. That's not good when it is jihadists training to attack us. (Positive for the jihadists, yes). It gives dopey Western politicians and idiot media types the opportunity to produce endless puff pieces about Islam. So, no, Ramadan is not a positive element and is at best an irrational superstitious bit of nonsense carried over from the tribal polytheists; it has no intended benefits for non-Muslims.

5. The pilgrimage to Mecca is a money-making scheme in place before the advent of Islam, a scheme which was then acquired in a hostile take-over by Muhammad and followers when then had (and still have to this day) a monopoly on the money that flows in to Islam's central coffers, which in turn then funds more Islamic propaganda, more jihad, more sharia, etc. The most immediate product of the pilgrimage is Saudi Arabia. The pilgrimage is an exclusively Muslim exercise; non-Muslims are excluded on the grounds that they are "filthy/abominable" (9:28) and thus are not allowed anywhere near the Meccan "holy site". This is not a positive element for non-Muslims (!)

It depends on what one means by tolerate. We can't (and wouldn't want to) throw people in jail simply for insisting on the oneness of Allah or observing irrational and arbitrary dietary restrictions. But from the standpoint of expressing an opinion, no, we don't need to tolerate any of those things in expressing our views.

However, this all seems to miss the point about Islam, which is a totalitarian program hostile toward our societies and which cannot be practiced in full except when our societies are completely subverted and conquered. To a Muslim, insisting on the oneness of Allah is a political and legal requirement; it is something that must be implemented in law and enforced. If anyone denies that "oneness," he or she can be killed according to Islamic law, and the majority of Muslims want any blasphemers to be at least criminally prosecuted and punished.

I suspect Arlandson is simply making the point that we don't legally punish people merely for practicing some basic rituals in their religion, i.e., that the whole opposition to sharia is not an attempt to deny Muslims basic rights afforded to all religious people. The problem is that the majority of Muslims don't see it this way. For them, Islam is a project where, in the context of the rapidly-growing Muslim populations in the West, implementing that project means implementing elements of sharia and Islam piece by piece, gradually, incrementally, but with a ratcheting effect.

Arlandson [my brackets, and bolding]: "All of these things [five pillars etc] are part of shariah – divine Islamic law, which traces its origins ultimately back to the Quran and Muhammad’s example or life. None of these words and rituals harms society. It is true that a required charity tax could be interpreted as harming one’s income, which “picks my pocket,” but in a free country outside of Islamic civilization one does not need to join Islam, or one could leave it."

In the abstract, in theory, a religion that required some limited fasting and peaceful prayer etc. might be relatively harmless. But we are talking about Islam. I've mentioned some of the harms associated with the five pillars, above. When it comes to Islam, donation to Islamic charities for example can definitely wind up being harmful to our societies (in the form of funding jihad attacks, etc.).

One cannot freely leave Islam, even in the West, because apostates are under an implicit and often explicit death threat from their own communities if they attempt to do so.

If Muslims haven't realized by now that they can obviously get away with quite a bit of violence here and there without jeopardizing their long-range plans of infiltration of the West -- and that, indeed, a certain amount of violence actually, by a perverse paradox rooted in the incoherence of Western PC MC, helps Muslims infiltrate the West more deeply and broadly -- then Muslims would have to be extraordinarily obtuse. Muslims may be a lot of things, but I don't think they are so stupid they can't see the massive opportunity which Western PC MC affords them to exploit.

The trick is not to avoid any violence -- but to avoid perpetrating too much violence, lest they awake and provoke the sleeping tiger that is the West. But, given that the "sleep" which enervates the West currently is, precisely, its PC MC irrationality, a certain degree of violence actually strengthens the PC MC tendency to bend over backwards to placate Muslims and to defend them from "bigotry" irrationally defined so as to include rational scrutiny, surveillance, investigation -- not to mention other reasonable measures of protecting our societies from them.

The calculation of just enough violence vs. too much violence may be a fine line to navigate, but Muslims would have to be strangely dim bulbs not to notice that whatever they're doing is going swimmingly well thus far. In such a long-term scenario, there is a theoretical moment when a bold risk will have to be taken, to tip the balance, with an attack -- or series of attacks -- so spectacular they will make 911 seem like a parking lot fireworks display. The problem is that such an attack cannot be premature, lest it rouse the tiger; but it can't be delayed too long either, when signs seem to point to its ripeness.

That's where the Huma Abedins, and countless other less famous perfectly moderate-seeming Muslims come in, to play their various multifarious roles in getting all the complex ducks in a row spanning a patient plot that would take decades to set in place. Nothing would stop such a plot -- as long as our own stupidity and ethical qualms about "tarring all Muslims with a broad brush" continues to thrive.

Continuing on in response to elements of Arlandson's article:

"If Muslims were to follow only the positive and harmless practices and rules in shariah, the world would enjoy a lot more peace."

There is I detect a tautological defense here, whereby any cited example to the contrary could be dismissed as not being one of the positive and harmless practices Arlandson alludes to. What are these practices that are positive and harmless viz. non-Muslims? I can't find any, and I would ask Arlandson to provide examples.

Why spend time suggesting that there are harmless and positive aspects of sharia, when we know that how Muslims act depends on how much power they have, and that the policies for outward behaviour change drastically depending on that balance of power between the Muslims and non-Muslims? Even supposing there were significant genuine positive elements of Islam (which there are not, as far as non-Muslims are concerned, as I already argued), one would have to attach various qualifiers, such as "They are peaceful--for now, until they have the power to put us under the sharia, massacre us with impunity, etc." A temporary peace that is in preparation for conquest cannot be considered a positive element. (And this is to say nothing of the Islamic notion of peace, i.e., everyone conforming to Islamic terms and rules).

Again, are there any significant Islamic policies toward non-Muslims that are positive and/or harmless?

More like most of the time (and the rest of it is image management). One doesn't use the phrase "in some cases" when we are talking about normative behaviour over 1400 years and in innumerable places in the world today.

Not positive unless genuine and without loopholes etc.

"Virtues" with regard to policy toward non-Muslims? I can't find any.

However, not allowing the veil that covers her face is right for business. Also, for the specific purpose of a photo ID, the headscarf should be removed. A woman police officer or a female photographer at the Department of Motor Vehicles can take the photo, if modesty is the problem."

If modesty is a problem, then the person with that problem is in the wrong country. There is no need or justification whatsoever for any kind of face veils or head covering where visual and photo identification is needed. Any compromise here is a compromise in security (or in financing, which results in a drain on resources), and there is no need for it. If someone is so "modest" that she can't bear to have her face photographed by a male professional then she is in the wrong country.

I'm not sure that Arlandson has considered the numerous ways in which the burqa and niqab can be dangerous not only for the wearer, but for the non-Muslims who wind up on the receiving end of whatever various thugs and criminals decide to do whilst disguised by such coverings. If he has not done so, I recommend he read Daniel Pipes' compilations of examples of such problems.

Burqa and niqab, and the ban is not too restrictive unless you want lots of camouflage and confusion for the various criminals, terrorists, etc., who make use of this identity-obscuring garb.

You also spoke skeptically of man being made in the image of God. But isn't the human body a kind of image of the infinite? No other species is so anatomically unspecialized, so universal. That is related to the fact that human beings can think, can consciously contemplate the universal. There is great wisdom in the Old Testament saying that we are made in God's image (the image of the universal). Meanwhile, your statement suggests that you are (unconsciously) making humanity in your own image, aren't you? Your skeptical iconoclasm doesn't go far enough, and needs to bend back on itself.

May I make one small exception:

With respect to burkhas and niquabs, I think there is a more persuasive reason to not allow them, other than their obvious value as camouflage for criminals. These garments portray a loathing and horror of women, and a relegation of women to subhumans, not fit to show their faces.

This has no place in a free society. It puts women at risk, not theoretically, but actually, at being physically coerced. We have a responsibility to not allow such a mechanism to occur in our society. The wearing of a niqab is directly contradictory to the foundation of our liberal society. It should not be tolerated, and should be illegal in public.
