Also, when will the Obama Administration show the same eagerness to fight for the rights of embattled non-Muslims in Muslim countries?

(CNN) -- A federal judge's ruling Wednesday cleared the way for a controversial mosque in Tennessee to open in time for the start of the Muslim holy month of Ramadan.

County officials must conduct a final building inspection at the mosque in Murfreesboro, near Nashville, U.S. District Judge Todd J. Campbell said in a temporary restraining order.

The order will allow the mosque to complete the inspection process so it can use its building in time for the religious holiday of Ramadan, which starts at sunset Thursday, the Becket Fund for Religious Liberty said in a statement.

"This is a great victory not just for the Muslims of Murfreesboro, but for people of all faiths. No house of worship should be kept from meeting just because the neighbors don't like their religious beliefs," said Luke Goodrich, deputy general counsel at the Washington-based fund, which represented the mosque in a federal lawsuit.

The U.S. Justice Department and the Islamic Center of Murfreesboro filed separate lawsuits this week, arguing that Rutherford County officials violated federal laws when they denied requests for a final inspection and certificate of occupancy for the mosque.

The center argued that it was being unconstitutionally blocked "merely because local anti-Islamic protests have made the mosque controversial."

Justice Department officials coordinated the timing of their lawsuit with the local case because they thought there would be "irreparable harm" if the mosque were not allowed to open for Ramadan, spokesman Mitchell Rivard said.

Plans for the mosque have resulted in threats to the center and a lawsuit that led to a county judge's order shutting down the project in June. County officials had cited that order when they denied requests for the final inspection.

The construction site had been vandalized multiple times, including by an arson attack in 2010, and federal authorities have charged a Texas man with calling in a bomb threat to the center before last year's anniversary of the September 11, 2001, attacks on New York and Washington.

Tennessee mosque's fate up in the air after court ruling

The center's lawsuit argued that it was ordered to meet "a heightened standard of notice in the zoning process" because of objections by some Murfreesboro residents, a standard no other religious institution has been asked to meet.

"This double standard for the mosque has deprived ICM of its legal rights under federal law and the Constitution, serves no public purpose and threatens to cripple ICM's ability to observe Ramadan," the lawsuit states.

The project had been approved by a planning commission and was under construction when Corlew reversed that approval because of what he said was the insufficient notice. The county followed its normal practice of publishing notice of the hearing in the local newspaper, but Corlew said more should have been done because the mosque was "an issue of major importance to citizens."

Four county residents filed suit to block the mosque in September 2010, arguing it posed a "risk of terrorism generated by proselytizing for Islam and inciting the practices of Sharia law" and that planning commissioners violated their due process rights. They also demanded the judge bar any approval until the Islamic center showed that it was not interested in "the overthrow of the American system of government, laws and freedoms guaranteed by our Constitution."

Were these concerns ever addressed? Or just ignored?

On Wednesday, Campbell ruled that the Justice Department had "demonstrated that the mosque is necessary to accommodate the number of worshipers, especially during the holy season of Ramadan, which begins July 20. The new building, which is ready to serve the community, eliminates the facilities problems, providing ample space for prayer, holiday celebrations, religious meetings and children's play."...

It sounds to me like the case for opening the mosque is pretty consistent with US statutory and case law regarding the building of private buildings, especially places of worship.

In order to do anything significant against the building of mosques such as this one, the US would have to significantly change its laws and practices regarding the freedom of worship. For example, the funding of a mosque is simply not up for legal scrutiny that the funding of, say, a political interest group is. Even funding from Saudi Arabia would not invalidate the right of the mosque to be there under our present legal system.

Are we supposed to blindly follow our laws while we are infiltrated by a religion dedicated to wiping out our freedoms and our way of life? If a mosque is prevented from being opened because of hostility to Islam, we are using exactly the same tactics that prevents churches from being built or maintained in Pakistan or Indonesia.

We have to figure out a way to isolate our treatment of Islamist Muslims, prevent the immigration of any more Muslims, prevent the infiltration of Islamists into our political process, and open a real discussion of what Islam is. And, we want to do so while maintaining our real traditions of religious freedoms and individual rights.

An ominous ruling by Judge Campbell. Murfreesboro Tennessee will be the last straw, which will ignite widespread unrest, throughout the south. I hope I'm wrong.

Honsestly, Domenick, I hope you're RIGHT. Where does this all end? Our politicians and elected officials insist on importing thousands of muslims a year to this country. And of course, the officials they appoint are dancing to the same tune. Our courts can't or won't rule against the proliferation of mosques--same with our county and city officials. We have a military that prizes "diversity" over security--even for its own troops, let alone the public it's there to defend. And don't forget an islamo-friendly administration--with no hope for better regardless the electoral outcome this fall. Not to mention a fawning media and clueless, enabling "interfaith partners."

This mosque is not a "house of worship" but a supremacist Political Power meeting-center representing 1400 years of Arab conquests and subjugation, of conquered peoples through genocide, enslavement and rape, murders that continue unabated into today, the 21st century in the world. I agree with and offer no opposing criticism. I'm not completely convinced that it will resolve the problem with Islam's political agenda. However, I'm sure it will bring meaningful attention to those who have not been attentive thus far, so in that respect I agree with your "I hope you're right" reply to my comment.

Completing a Mega Mosque against the will of the people in the heart of the Bible belt is a far greater throw from an attempt to build one, (thank's to Pam Geller and Robert Spencer) in multicultural NYC.

Meanwhile, Christians and those of other faiths in Muslim countries are regularly denied the right to build their houses of worship, to preach their religion of choice to Muslims and, in general, to be treated as equal human beings by Muslims. Both the hypocrisy and parasitism of Islam stink to high heaven. Only the ignorant or the complicit will assert otherwise. Ah, Islam is so repulsive.

Muslims do not respect kindness, or fairness, or a "good example". They see these things as weaknesses, and will only demand more and more concessions.

First of all, assuming the Chesterton quote is authentic (and/or is free of scribal errors, intentional or otherwise), Chesterton never clarifies there what precisely caused the various savages he cites to admire the Western Colonialists. Certainly, there's the implication that part of that admiration was based on the restraint shown by the Western Colonialists, in refraining from behaving with "tit-for-tat" cruelty. However, that by itself surely would not be enough to arouse admiration from a beheading or cannibalizing or enslaving savage. Does anyone in their right mind think that such robust savages would respect a weak-kneed, passively pacifist Eloi? Nowhere, thus, in that quote does Chesterton provide any basis for disputing the reasonable assumption that, in fact, what helped bolster that savage admiration was not merely the fact that we showed ethical restraint, but also that we backed up our restraint with the teeth of superior force. The problem is to protect ourselves from Muslim colonization, while at the same time, protecting our general liberties.

Unfortunately, the Supreme Court historically blocked a lot of avenues. For example, the McCarran Act kept out immigrants who were committed to a government contradictory to the US system (communists)

It's time to dust off the McCarren Act, and once again exclude immigrants who are in fundamental disagreement with our form of government (almost all fervent Muslims). We both know, if we can't get control of our immigration, it's all over. If Muslims continue to immigrate, they will have their mosque now, or in 20 years. What's the difference?

I don't see any fundamental constitutional problems in excluding non-citizens on the basis of their beliefs in a particular type of government.

Pardon me for being Darwinian about this, but Muslims have shown little regard for the Catholic Faith, nor any faith for that matter except Islam (and even then), so there is no reciprocal moral equivalence between Islam and Catholicism. One has risen to the heights of Western civilization, the other remains mired in Medieval primitive superstitions and blood. The West is stronger, better, more enlightened, richer, technologically and intellectually and morally superior in every way to Islam; it would not have even been a contest had we not developed Arab oil for them and let them soak us to the hilt for petrodollars jizya. Just for the hell of it I went to a Human Relations Commission meeting here in Riverside CA. It was beyond disgusting. It wasn't like they couldn't find any real issues to address they had to actually make up some "pat yourself on the back" awards. In this case it was some kind of "heroes of the community" awards and "scholarships". I was hoping to meet the representitive from CAIR they have sitting on their board but no luck.

They talk about homeless and "multiculteral" issues and oh yeah! "Day of Inclusion". Wow! From the Riverside Multiculteral Council.

It was like a little clique. About twelve people sat around the table, ignoring me, I was the only citizen who attended, in their own little world... ...which I pretty much told them when my "three minutes" came for me to speak.

I asked them about their CAIR member. Mentioned their ties to terror and arrests. Asked if they were going to try and model their commission after the one in Canada.

I asked especially, while they had all this emphasis on minorities and the homeless, if they were addressing the fact that the courts were inflicting economic genocide on fathers for profit. That the courts and child support employees were actively and purposely destroying the two parent family for the purposes of their "cash cow" the created and made up "dead beat dad". "Islamophobia" isn't the only thing that's made up.

I asked what about the millions of black fathers that are left destitute because of "awards" that are far far more than most of them can afford to pay?

I never got an answer of course. And like before the meeting, they ignored me after the meeting. It was weird, I could almost SEE the affect my "voice of conscience" was having on them. They looked almost...subdued? Or I think it was seeing that they wanted to be anywhere but where they were at the moment.

Anyway it was crystal clear that members of the public are definately not something they want to see at their meetings. Let alone participating.

Of course. "Religion" in this country per our US Constitution's First Amendment is sacrosanct. However, political powers, especially foreign political powers, are not.

If Muslims want to practice their 'religion' quietly without disturbing community and our natural human rights, as they are constitutionally protected, then they are left in peace to do so. Criminal activity will never be tolerated, so they should be told that any efforts are subverting our constitution, or attacks on our persons, will be dealt with forcefully. That's police action. But political infiltration of our institutions of learning, government, media, and legal system will be noted and dealt with. We may need new laws to spell that out to Islam, not the 'religion' but the political power. Foreign political power is especially irksome to our nation if they influence internal events, and cannot be, may never be, tolerated. Saudis et al should be put on notice.

Personally, I am not all that worried about Islam. We merely need to get a better fix on them, and make it known to the general public of their intent matched by their actions. In the long run, to quote an adage, they are dead anyway. Islam is dying, way past its 'expiration date'. So no worries. They will be dealt with.

Islam can remain a label, just as we label Bloods Crips and MS-13. The labeling itself does not make it lawful.

If the articles of incorporation for the Democratic Party included a provision mandating that when they are a majority that traitors who leave the party are to be killed by another member then this would be a feature that would make it unlawful to grant legal recognition to the Democratic Party. The fact that capital punishment for traitors from Islam will not be killed in the US until after Muslims are a majority is not grounds to deny legal recognition today. Can any judge say that it is not an allowable governmental interest to ban legal recognition of any organization who's governing documents contains such a death for apostasy provision? Indeed, today, incorporation laws already prohibit recognition of entities who's governing documents advance unlawful ends. No statutory change needs to occur. Here 42 USC 2000cc is a statutory right, not a constitutional right, and thus the statute could also define and constrain the definition of institutions, religious or otherwise, that can invoke the statute. Demand amendment to exclude organizations prescribing death for apostates.

Very good point, that if a religion prescribes "death for apostasy", is it really a religion? This alone is enough to condemn Islam, not even looking closely at all the other unattractive characteristics urging its believers to war on infidels, demeaning to women, permitting slavery, killing homosexuals, etc. None of these are supported by our Constitutional Bill of Rights, as they are universally condemned as in violation of our Human Rights. Islam should be put on notice legally. Cult practices (like Sati), or invasive foreign political powers, are NOT protected by our US Constitution, so it comes down to a Supreme Court ruling, if so; and doesn't even need Congressional action. I don't remember anytime in my lifetime, or within 'recent' history going back, say a thousand years, of Hebrews stoning to death someone who tried to persuade a deeply religious Jew to change his or her religion. Did the MSM fail to report on it, not even in the gossip column? Yet, in Islam it is virtually daily news. So what's your point 99? Are Jewish 'apostates' stoned to death, per Deuteronomy 13:10? This all boils down to a local zoning issue. The government can dictate where to put a Dunkin' Donuts and it is done by local boards comprised of citizens. Not enough Muslims/Dhimmis/free thinkers on the board? Too bad.

There is no carte blanche to build ANYTHING, even a religious structure, without zoning. If the mosque was being built absent permits, then it should be shelved.

The Feds, i.e. Holder, need to be ignored in the name of states' rights. Now that they weren't, we'll see a lot more mosques. This is not a question of reciprocity, "They don't have basilicas in Saudi Arabia." But it is a question of the rights of a community to elect representatives (republic form of government) to carry out their will.

The only "force" that is needed domestically is that which is necessary to enforce a law to expel a self-identified citizen of the Islamic Ummah. The OIC member countries will resist such expulsion by denying them entry, just as they do the "Palestinians". It might require force to control a beachhead on an OIC member country to drop off these enemies of America, these enemies of American freedom. Is a non-Sharia-compliant America, subjectively, no different to them than Guantanamo?

What needs to be said is that the passage of laws will not relieve the problem we have with political Islam. They would have to adhere to it.

Islam is using our own laws to defeat us. Allah and his Prophet and Messenger must be laughing their heads off.

We could call it peer pressure. That is, use Clinton's tactic at the behest of the OIC. Treat it like a street gang, something to avoid and to be subjected to public ridicule. They could choose to modify Islam worldwide to eliminate the capital punishment for apostasy. That is fully within their free will. "Islam" cannot survive without it.

A street gang has a hard time conducting lawfare on behalf of their gang. It would neutralize CAIR's favorite weapon, for now. It may look like a wimpy plan. In short, ignorance of Islam is more of a threat than Islam itself.

The single biggest problem that devides our country is, "OUR PARTY, RIGHT OR WRONG" edict. It presumes and predicts outcome, weather it's RIGHT OR WRONG for America.

For the record, when I wrote above that the idiocy exemplified here (and elsewhere) about the problem of Islam makes me feel that we deserve to be mass-murdered and conquered by Muslims, that eminently reasonable outburst does not necessarily mean I actually think, and worry, that Muslims will succeed in their inveterately imperialistic desideratum. However, unlike Wellington and Battle of Tours among others, apparently, I have acquainted myself sufficiently with the mountain of data about Muslims and their Islam to come to the unremarkably reasonable (yet still rare) conclusion that what Muslims can and wish to do, and will likely do -- and already have done -- is horrific and deadly enough to justify our taking extreme measures against them ASAP.

I.e., Muslims (and, again, for the eternal sophomores among us, we cannot tell the difference, with reliability sufficient for the primary purpose of our self-defense, among the deadly and the ostensibly non-deadly Muslims among us), merely in trying but failing to succeed in their conquest-lust, will wreak unacceptable levels and kinds of violence throughout the West, unless we take effective pro-active measures. I expect that Wellington's leisurely diffidence would provide cold comfort to the grieving family members and friends of the thousands who will be mass-murdered (and tortured) by Muslims in the decades ahead -- not to mention those who already have been.

The "S" in our general Western memo's ASAP continues to be delayed by what Wellington referred to as our general ignorance of Islam (but yet again he fails to understand the subtlety of the situation, for it is not mere ignorance, but rather a more complicated problem resembling ignorance, which I have termed Quantum Ignorance, that is continuing to retard our Great Reawakening and recovery of our former rationality in this regard). And yet, Wellington's and Battle of Tour's remedy for this general retardation about Islam in their society is to help reinforce and perpetuate that retardation; and apparently one motivation for that is that they don't worry too much about Islam -- because they are only (or mainly) looking at Islam as a repellant ideology that they trust will someday soon be generally condemned in polite society; rather than as a psychocultural motivator for ultra-violence that has already resulted in an unacceptable number of horrific mass-murders and assorted tortures, along with an unacceptably escalating number of same, whose qualitative increase (let alone its quantitative increase) we can, and should, reasonably expect -- and damn well worry about, and try to stop.

But if people even in the "Counter-Jihad" aren't worrying about all the myriad violence which Muslims are perpetrating (and continuing to plot worse), nor worrying about how to stop it; then how on Earth can we expect the general, and generally numb, citizenry and its "elites" to ever stop hitting the snooze button and get the fuck out of bed and get to work on this?

Optimally, thought should precede action; and, needless to say, the thought should try to be more, rather than less, coherent and tenable.

I am concerned that many of the rather small (if not tiny) nucleus of Westerners who have sort of woken up to the dangers of Islam still have not fully thought through what it is to be anti-Islam and what actions and policies it should entail. This should be thought through, and a consensus should be reached, so that our movement (which is still not quite a movement, probably partly for this very reason) can become more sociopolitically effective over time. Or we can just keep hammering away at this in a sort of half-assed way, I suppose.

What I think in this regard is fairly well explicated in my various comments above. I have yet to see a persuasive counter-argument to mine. I have seen counter-arguments, to be sure; but, at best (when they are not just snide ripostes or tissues of irrelevant points) -- as they are effectively analogous to someone sitting on the third floor of a burning building calmly sipping his tea and talking about how repellant he finds arsonists, and about how he hopes and trusts that someday the world will agree that, yes, arsonists are scumbags and deserve no respect -- such counter-arguments are obviously untenable.

And then to add insult to injury, my lengthy and detailed proposals backed up by exhaustive arguments are either unresponsively dismissed, or positively rejected on ethical grounds whose ethics are clearly holdovers from PC MC bigotrophobia. The point was a very simple one: It's foolish to suggest that a belief system that calls for death to apostates is not a "religion," because if that were true, then the religion of the ancient Hebrews would turn out not to be a religion after all.

The point that the first amendment doesn't protect the killing of apostasy is a red herring. Of course it doesn't, just as it doesn't protect the practice of polygamy. (To that extent, the citation of United States v. Reynolds was correct.) But the *advocacy* of the death penalty for apostasy, like the advocacy of polygamy and even the advocacy of "the duty, necessity, or propriety of crime, sabotage, violence, or unlawful methods of terrorism as a means of accomplishing industrial or political reform" *are* protected by the first amendment, unless that advocacy "is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.". See Brandenburg v. Ohio, 395 U.S. 444, 447 (1969) (emphasis added; footnote omitted).
