Muslima sues Disney: demands to wear hijab while appearing before customers

"The Constitution tells me I can be Muslim, and I can wear the head scarf. Who is Disney to tell me I cannot?" A private company with a dress code that it is (at least so far) still free to implement. But the point of this case is to reinforce the principle that wherever Islamic law and American law and practice conflict, it is American law and practice that must give way.

LOS ANGELES (KTLA) -- A Muslim woman who worked as a hostess at a Disneyland restaurant is suing Disney, claiming the company wouldn't let her appear in front of guests while wearing her headscarf.

It's a dispute that's been going on for about two years, but now the American Civil Liberties Union is getting involved.

It all started in August 2010 when Imane Boudlal, a Morocco-born U.S. citizen, worked at the Storyteller Cafe in Disney's Grand California Hotel.

Boudlal wears a headscarf, or hijab, but Disney said the garment didn't comply with its strict dress code.

Disney offered up a compromise hat for her to wear, but Boudlal said it made her look like a joke.

"The hat makes a joke of my religion and draws even more attention to me," Boudlal told KTLA at the time.

"It's unacceptable. They don't want me to look Muslim. They just don't want the head covering to look like a hijab."

And her point is that she wants to look Muslim. She wants to force Disney into featuring Muslims and showcasing the Muslim presence there. Disney doesn't want people to look like adherents of any particular religion -- they want people to get into the spirit of fun and fantasy that their games and rides and shows represent. But for Islam all must give way.

Boudlal had worked at the resort for two and a half years, but only realized she could wear her hijab to work after studying for her U.S. citizenship exam.

She became a citizen in June 2010, and decided to challenge the Disney dress code a couple months later, on August 15.

When she wore her headscarf to work, Boudlal says she was told to take it off, work in the back where customers couldn't see her or go home.

She chose to go home, but reported to work for the next two days and was told the same thing.

Boudlal subsequently filed a complaint against Disney with the U.S. Equal Employment Opportunity Commission..

In a prepared statement, Disney spokeswoman Suzi Brown said the company "values diversity and has a long-standing policy against discrimination of any kind."

"Typically, somebody in an on-stage position like hers wouldn't wear something like that, that's not part of the costume," Brown said.

"We were trying to accommodate her with a backstage position that would allow her to work. We gave her a couple of different options and she chose not to take those."

But Boudlal maintains that wearing a headscarf is her constitutional right.

"My scarf doesn't do anything to harm Disney or the guests," she told KTLA.

"The Constitution tells me I can be Muslim, and I can wear the head scarf. Who is Disney to tell me I cannot?"

Well, she may or may not have a headscarf right, but Disney has a right to assign her wherever they want in the business...They could probably fire her if they wanted...many people sign up with a provision that they can be terminated for any reason or no reason...

I love how she complained that the compromise Disney hat - which presumably covered her hair and thereby satisfied the ostensible "modesty" requirement of the head-covering - was nevertheless unacceptable, as it didn't make her look "Muslim enough".

So she isn't just trying to satisfy the modesty requirements of her faith, she's demanding to be showcased as a Muslima.

Next up, she will take a job as an extra in a Shakespeare in the Park production of Julius Caesar and demand to wear her headscarf instead of a Roman costume.

What is the point of giving parables that no one understands? Parables are used to make complex concepts clear, not to make them more difficult to understand. Something does not sound very sound, sane and rational in this verse.

This sort of situation needs to be dealt with, legally, for once and for all. Employers are within their rights to ask for compliance around uniforms. Islam must step down.

BlueRaven, just wanted to say that I don't think this muslima is clueless--I think she knows EXACTLY what she's doing--and she has the usual culprits, CAIR, ACLU, etc, underwriting what she's doing. Muslims want to fundamentally change our culture. They want their religion--and THEIR religion ONLY--to supercede free enterprise, i.e., freedom. And, if this ruling goes against them they'll still have the satisfaction of publically retailing "discrimination" and bleeding the kuffar capitalists in the process.

This is one of the few times that I would have to disagree with you Robert. I think that is it high time for Disney to change their dress code policies. Allowing Muslim women to wear the hijab is not an unreasonable request, as long as it doesn't pose a safety threat to anyone and does not make the wearer unidentifiable (like the burqa).

Now, I'm not an Islamic supremacist, but I am for religious freedom. I believe that a Sikh should be allowed to wear a turban and a Christian should be allowed to wear a crucifix to work, and the same goes for all other people including the Muslims.

I know you're not anti-freedom of religion, but I can't say the same for some of your readers here. It seems to me like some of your readers would rather have all religion disappear from this earth or at least have everybody pretend to be atheist outside the walls of their homes.

Dinsey is a private company. It can essentially mandate whatever dress code it wants as long as it is religiously neutral or impartial. If it requires that everyone wear black socks, it can do so. If it requires that no one can have hair longer than a certain length, it can do so. If it mandates than no one can wear a head covering (which would include a yamaka, a Sikh turban, dare I say a cardinal's hat, etc.), it can do so. If you don't like the dress code, look for employment elsewhere. Welcome to the free market, the "free" part here being especially something Islam has no sympathy for.

What this is really all about is what Robert Spencer already stated, to wit, when Islam comes up against anything which is in opposition to Islam, it is the Muslim position that the opposition must give way to everytime, which definitely functions as ipso facto evidence of the rancid control-freak aspect of Islam. Disney is a private employer. The First Amendment applies to government restrictions. Congress has however engaged in legalistic gymnastics to try to make it apply to private companies and even to the conduct of private people.

Insist that any remedy also be religiously neutral. If Congress cannot pass a law that says that Muslims are special then neither can a judge by way of a remedy provided by Congress. A judge is bound by the First Amendment, even when crafting a potential remedy. Insist on it.

This Muslima (is that not a jab itself?) might just as well wear a shirt or cap that reads:

This is what her gangware means. Others can rebut then with some sort of sign that means: Never Again!

It's about what Gladwell, in a most interesting book, calls "the power of context".


Except as justification, Coptic conversion isn't what motivates these state sponsored plunderers. What they really want is Coptic wealth. Islam provides the taking of it without fear of punishment.

Following your logic, one need only declare Nazism or the Ku Klux Klan a religiously based organization (which some sorta' do already), and then Disney prohibiting swastikas and hoods would be forbidden. Wise up. If civilization and law and common sense are to prevail, then your argument has to go. Also, if you're prepared to argue that Nazism and the Ku Klux Klan are "merely" political phenomena, be careful, because Islam, Islam in its entirety, is about as political as you can get.

I would encourage American jihadwatchers to write to whoever's in charge in Disneyland, encourage them to stand their ground against this arrogant Mohammedan Gang Moll who wants to wear her Bondage Gear in front of the public, and enclose for their further information about the *real* meaning of the Hijab/ Slave Rag (not Modesty, but Violent Domination and Enslavement) a copy of the N Maruani article that I have linked above, highlighting the passages to which I have drawn attention - e.g. "the veil is the symbol, the flag and the keystone of the Islamic system" (that is, it symbolises Sharia and the summons to Sharia, an abusive system of sexual and ideological apartheid with Muslim males on top and everybody else - women and non-Muslims - kicked to the kerb and trampled underfoot).

I'm willing to bet that you're not the only Muslim (ex-Muslim) to note that Allah doesn't need money--especially as a loan.

Given, as we're told, that Muslims are not supposed to raise such issues--on pain of pain or worse in some places.

So, really, now, tell me true: Do those active Muslims who've figured that out just keep it under their, uh, hat for the rest of their lives; never broaching the subject, not even with their immediate family?

And, of course, it's not just 2:245 that astute Muslims know/realize is a crock.

So, in their lives, are these little sticking points ever noted and debated within Muslim families?

The veil is a symbol of slavery in Muslim countries, but the symbolization seems to be different when Muslims are "on the march" in non-Muslim countries. Here the side of the Muslim woman which matches them to Muslim males, ie the viciousness, comes into play as here Muslim women have people to feel superior to, which is us. Not just a little superior, either, but hugely superior. It is their time of fun, where they can get up to all kinds of supremacist behaviour, knowing that the rewards - the loot and plunder and triumphalism - are theirs too (before they inevitably run out and there are no non-Muslims left to feel superior to and play with as cats play with mice, as this woman here is doing.) There is still that slave-like status, as they are being used by their men to push Islam's agenda, but they don't seem to mind or notice.
There is a woman around here called Sherene Hassan (I think) who devoted herself for years to school dawa (why did the schools let her? Who knows) and then panicked when some of her menfolk decided the time was right to start pushing for sharia law in Victoria. Suddenly it wasn't a game any more and she could see her status shrivel with the prospect of sharia - any sharia at all. So she was up in arms against it!

Ps: Of course, globalisation is affecting the hijab question too. Muslim women are dressing up in Muslim get-up voluntarily in Muslim countries to show their men and the whole world that they are part of the "push" and they mean business. They know they are being watched by us all and that the entire world is getting pretty nervous about them. Their moment in the sun, as it were...pity about the Vitamin D they miss out on in the process...

@Meryl: Of course private companies have the rights to require their employees to dress anyway they want... But just because they can do it does not always make it right...

Forgive my crudeness, but take this as an example... Say you have been working for company H**ters for xxx numbers of years. Then one day the company decided that all female employees must have certain "physical requirements" to work there and you're just one letter too small. And your employer tells you "Either go under the knife and reach the requirements or resign". Now, the employers have the rights to do so but that doesn't make it right does it?

@Wellington: First of all, I must say any hate group shouldn't even be allowed to exist.No doubt that part of Islam is political, but part of it is also religious. It is true that the political part of Islam is intrinsically evil, like the KKK or Nazism. But here's difference between Islam, and KKK or Nazism is you "might be able to, if you are willing to risk your life" in Islam reject the political part and still have a religion while the core of KKK and Nazism is white supremacism and hatred for other races.

Long story short, you'll be able to find Muslims who reject Shariah and want to coexist peacefully with others but you will never find a KKK or Nazi wanting to coexist peacefully with non-whites or Jews.

It is true, those who reject the political part of Islam isn't exactly following the true Islam and most Muslims would consider those people apostates or "bad Muslims". But following that logic, Catholics can call the protestant "non-Christians" or bad Christians and vice versa but doesn't change the fact that both groups are Christians.

This is about religious practice. Some religious practices are illegal in America.

The Aztecs used to select a human sacrifice by playing a kind of football game. America cannot ban a game that consists of nothing but kicking a ball around in a safe courtyard. But it can ban the "prize" of ripping the champion's heart out of his chest. Of course, such a ruling would completely negate what the Aztec religion stands for. No blood-atonement means no appeasement to the gods. The ball-game was just window-dressing; the really important ritual was the human sacrifice. So the Aztecs might complain that modern America was against their religion.

Bad luck. America is, we hope, opposed to certain religious practices. People have the choice of giving up those practices or going to a place where such practices are legal.

The Muslima has a choice. She can follow the dress code. Or she can work where she is out of sight. Or she can seek work elsewhere. Unfair? No, she chose to be a Muslim, so she can pay the price without complaining.

There would be no point in my signing up for a brothal and then complaining that because my religion forbids me to commit fornication, I could not do that aspect of the job. Nor could I join the band of Merry Men in Sherwood Forest and then complain to Robin Hood that my religion forbade me to steal. If my religion places restrictions on my behaviour, it is my responsibility never to place myself in a position where I will be required to violate those restrictions. This isn't always possible in practice - but it is certainly possible in a workplace situation where one always has the option of changing one's job.

I think that she should adhere to the dress code and rules of a private organisation. She cant force them to bend their rules for her.

And as for her religion demanding that she wear a hijab as a hostess I think that is a lie. Her religion demands that she does not work as a hostess where she will be exposed to other men - period. Could she work in a similar job in Morocco? I doubt it very much.

Now, I know that orthodox Muslims would interpret the Koran based on the hadiths and the old Muslims scholars which would make reforming Islam almost impossible but history shows that it can still be done.

For example the Christian reformation. During the Christian reformation, Martin Luther did not actually go back to the early Church Fathers and see how they interpreted their scriptures but interpreted it on his on accord. And in spite of him breaking from the Christian tradition (which is to interpret the bible according to the teachings of the early Church fathers), he somehow still managed to gain many followers, most of them who are orthodox Christians (aka. the Catholics) and even turn parts of Europe protestant. If Luther could do it, why shan't the Muslim reformers who decide to break with tradition (interpreting the Koran on their own accord and not according to the Hadiths)?

Not quite correct. Some books and traditions provide a much more permissive setting and much more favorable soil for reform and reinterpretation than other books and traditions. That's the essential point, which your above-quoted statement is blind to. Teachings and books exist along a spectrum running all the way from insanely totalitarian to profoundly free-thinking, and along every point in between those two poles.

The Islamic tradition (Qur'an, Hadith, Sira, and Islamic jurisprudence), as is clear to those who are sufficiently acquainted with it -- makes reinterpretation not merely quite dangerous, but a possibility unlikely even to suggest itself to the minds of many heartland Muslims. In many ways Islam is specifically designed to abort in the womb every nascent reinterpretation, and where abortion fails, Islamic doctrine and tradition arrange for the death of reinterpretation at other junctures. Islam is a particularly totalitarian culture for manifold reasons.

Al Qur'an disagrees with you! Al Qur'an says that has been sent by God and is crystal clear; interpretation is not required. Also, Al Qur'an provides the solution for verses that contradict each other; you take the most recent verse as the correct one. Therefore, Al Qur'an abrogates hundreds of verses. For example, The Verse of the Sword (Sura 9) abrogates over 120 earlier verses.

I am writing from Europe where labour laws are often more rigid than in the US, and I personally like to dress as informally as reasonably possible reserving dress formality for meeting with anyone not in my closest team.
Having said that, if you work in a position in the show business or anything comparable with this, such as with Disney, you are expected to show some of the life style of the company.
If I visited a park in the style of Asterix and Obelix the Gauls, I would expect to re-live an experience modelled on the Gauls and the Romans, by Teutates, if you do not like to wear a winged helmet or a Roman gladius, you should not work there.
You cannot work there with an out-of-style dress such as an hijab, you would spoil the effect of the park, by Belenus.

Some traditions, like some materials, are too rigid to bend, too static to go through metamorphosis, and thus can only break or shatter under stress, not bend or deeply change. A few isolated individuals or small groups can claim to "reinterpret" and "reform" Islam, but there is no large mainstream Islamic movement in the world today that clearly rejects the totalitarian core aspects of Islam and of Muhammad. The totalitarian aspects are so profoundly and pervasively bound up with everything else in Islam, that removing them leaves not a reformed Islam, but something so different from what Islam's core texts teach as to be utterly unrecognizable. Thus, though it's not impossible that the Islamic culture, jurisprudence, law, and politics could be explicitly reformed on a large scale globally, it's about as likely as pigs flying when you're awake. Islam should be checked and contained at every point until the religion's rigidity in the face of historical change and human life puts Islam under sufficient stress some day to bring about its own spiritual and physical shattering into fragments and dust, somewhat as other totalitarianisms have collapsed.

Perhaps the physical and spiritual shattering/collapse of Islam -- through its own sheer rigidity -- is happening to some extent today in Iran under the mullahs. Statistics show the economy there is a disaster. By world standards, there is a shocking prevalence of drug addiction in Iran -- apparently the problem is something like an order of magnitude worse than in Europe or the U.S. And there are relatively many apostates from Islam in Iran.

Hijab is not a requirement of Islam. If that were true, millions of Muslimas around the world who do not cover their heads would be considered apostates.

In the US, hijab is a political statement of sharia promotion and compliance. Asking Disney to change its dress code to accommodate hijab is asking it to change policies to conform with sharia.

The same thing happened at the Olympics this year, and the IOC buckled to pressure. The athlete involved was not even really qualified to compete at that level; it was all about setting precedent.

As for Muslims who only want the religion part of Islam but not the political or Sharia part, good luck with that. I know such Muslims exist, but they are ignorant of their own religion (kinda' like Communists during the Cold War in countries like France and Italy who really did believe that Communism could co-exist with non-Communist parties and that eventually Communism would take over in a gradualist manner). Still, under the Constitution, such Muslims have every right to be confused about their religion. Were only such Muslims around, the problems we have with Muzzies would be greatly reduced no doubt, but don't forget that even just the pure religion part of Islam still has many troubling, hate-filled sentiments replete throughout it. Reading the Koran confirms this overwhelmingly, no Sharia needed.

Bottom line: Islam is not just another religion. It is also a totalitarian ideology and, I would strongly contend, a death cult for a certain percentage of Muslims when they don't get their way. About no other major religion can this be said. And so, so-called peaceful, just religious, Muslims don't really help things much. In fact, one could argue that they obfuscate the problem, the problem being the whole damn phenomenon known as Islam, which is indeed stretching the Constitution to its limits just as other matters have, such as the right of a state to secede from the Union (no longer a constitutional possibility since the Civil War) and abortion. Welcome to Constitutional Law 101.

I believe that most here would agree that Islam mandates some not quite clear definition of modest womens' dress, leaving the precise nature of such clothing open to interpretation.

As numerous Muslims themselves, around the world, have no unified definition of what constitutes that modest dress for Muslim women, the lawsuit should make clear that the woman's personal understanding of that nebulous Islamic requirement is no more accurate or definitive than many others.

A judgement that hijab is a cultural interpretation, would also give precedence to force Muslims in America to prove their assertions in other cases, such as the assertions of some taxi drivers that Islam prevents them from transporting passengers who have alcoholic beverages with them.

Imagine if, instead of merely accepting that claim by Minneapolis taxi drivers, they had been forced to prove that claim--which I think they'd have been unable to do.

So what if the K.K.K. adherant wanted to wear their garb in a Disney restaurant. No it is not a religion but an ideology, or Wiccums who were also exhibitionists. Nothing on but a hat. Can you see United Airlines flight attendents or pilots in full muslim garb. You don't even see that in muslim companies. This person works for Disney and as such has agreed to a uniform. If they want to wear a religious symbol, fine but a uniform is a uniform and what is a hijab but a uniform for some muslims. Can Jews wear armbands with the star of David on them in the restauant, NO. Who said to be a muslim you have to wear a head scarf? Mohammed wore some sort of head gear but do muslim men follow the fashion of the 'prophet' NO, why? because it is out of fashion and they want to look cool. But stick it to the women right? Would you want a policeman to pull you over in a full Mohammed costume or dressed like Thor? Think about it.

Were I on the jury in this case, I would vote to throw it out. As others have written here, the Constitution applies to religion, but one is not allowed to "practice" if it infringes on the "rights" of another.

What hasn't been mentioned, I think, is that about "accommodations" and how this might apply. When a person has a job and is or becomes disabled, the company must make "reasonable" accommodations so the employee can keep and do the job. If "reasonable"...meaning they can handle the cost associated with the request and the job requirements can be adjusted so others can share the load, etc., then accommodations must, by law, be made. Otherwise, if the employee cannot do the job assigned, and there are no other open positions for which this one is qualified, the employee can be legally "let go."

Disney offered this woman accommodation. She refused. Not only did she refuse, but her reasoning was that she didn't want to be "behind the scenes" and hidden from view. (I am recalling what she said earlier in the case.) Now she says that the hat Disney gave her to wear would cause her to be looked at even more. "It draws even more attention to me."

She is contradicting herself in that she doesn't want to be hidden and yet, seems to want to avoid "more attention."

Isn't this what she wants? To have "attention?" Of course, but only in her muslim costume so everyone will know that she is muslim. Were a "man of the cloth" to be hired, would he be allowed to wear his official robes while on duty at the restaurant? Would one of Jehovah's Witnesses be allowed to carry their magazines and hand them out while on duty in the restaurant? Would a Native American be allowed to dress as in the old days, perhaps wearing only a loin cloth such as might be worn to his sweat lodge meeting?

They offered her accommodations. She refused. Were she disabled, and it could be argued that she is...mentally...and refused the accommodation, Disney could legally fire her.

I had a position once where it was easier for me to do my job when I wore a ball cap...no logo...just plain blue. A new manager came to the job and sent out new "dress code" memos and "outlawed" sandals and head coverings, among other things. (Thankfully, I was in compliance with the shoe thingy.) I went to him and explained why I needed the cap. He said, "Sorry, but we sometimes have "visitors"...people who came to see us work..."and we want everyone to look a certain way." Not really an exact quote, but close enough.

It made it more difficult for me to do my job, but I complied.

Not very long afterward, I began to see a young woman there wearing...ta da...a headcovering. The religious kind. And fancy sandals below her filmy, billowy pants.Somehow it was okay for her but not for me...my ball cap didn't showcase me as a muslim...thankfully I am not one...and hers did.

Just as this woman suing Disney wanted to have attention as a muslim...not as a "character"...getting attention for her reasons.
They offered accommodations. She refused. This should have ended it. Perhaps it will in Court.

One more thing:

She worked there for some time before demanding her "rights." If her religion is so strict, how did her conscience allow the time spent without the head scarf? It could be argued that she was told, perhaps by CAIR, to wait until she became a "citizen with rights" before making her demands. But anyone inside the U.S. is protected by the Constitution. (except the unborn babies). She had the same rights before that she has now.

But she knowingly worked there without the scarf and suddenly she realizes Disney has a dress code, but she doesn't have to comply. It's all a little too cheesy. Sorry cheese.

And what are the chances of a women being even semi-naked in Islam....

HIGH, if the woman is a slave.

The hijab is a garb of a free Muslima. A Muslim-owned slave does not wear it, whether she is a Muslima or not. In fact, the only dress requirement is that she be clothed from the waist down. At her master's behest, she can be naked from navel to neck, and she must be naked above the neck.

She is fair game, both to her master and to men on the streets. So Rayhana was committing a very brave act when she refused to wear the hijab.

We're only just getting underway and the more people join up the better. Even if one simply joins as a humble financial supporter - if, for example, one lives in a remote rural area and is not able to attend meetings (until and unless one is able to create a local 'chapter', so to speak) - it all helps make a difference.

The more people there are in the Resistance, the more pressure can be applied judiciously to politicians and to aspiring politicians.

Even if you are not a Christian, I encourage you to check out the four excellent information booklets that Barnabas sell (for a purely nominal price) from their website. These comprise: 'What is Islam?', 'What is Shari'a?', 'Islam and Truth' and 'Islam and Slavery'. They are brief, clear, easy to read (though based on rock-solid scholarship), nicely-presented, grimly accurate, and presented in a cool, calm 'just the facts, ma'am' manner.

Although Barnabas Fund are a Christian body, these pamphlets do not proselytise for Christianity; they merely set out the unpalatable truth about Islam. They would be suitable to hand out to uninformed non-Muslims of any background, to get them started on the 'waking up' process. I would encourage any member of the Resistance to obtain multiple copies and keep handy to give out as opportunity presents; and if one runs a business with a waiting room, to keep a few of these pamphlets strategically placed among the glossy magazines, for the information of the public.

My impression is that BK is assuming an axiom, without actually checking the data to see if the axiom applies in this specific case -- to wit, the axiom being "all religions and all religious people are approximately the same, and thus all are approximately comparably capable of reform and/or laxity".

This axiom has become hard-wired into the modern Western worldview. It is very hard to dislodge it. It becomes doubly unpalatable to even entertain the thought of refraining from reflexively applying it when the religious-sociocultural group in question happens to appear to be comprised mostly of "ethnic" people -- for that ostsensible datum, in turn, triggers a second modern Western axiom: "Never think ill thoughts of anyone you perceive to be an ethnic people" -- this axiom being a kind of anxious assurance to avoid the possibility of "bigotry" and what is assumed naturally flows (for white Westerners, that is) from "bigotry" -- such as hate crimes, lynchings, rounding up, putting in camps, ethnic cleansing, and genocide.

Meanwhile, Muslims all over the world -- because of their Islam -- are getting away with hatred, hate speech, abuse of women, children and animals, oppression of minorities, slavery, bigotry, intolerance, murder, massacres, attempted genocides, and 1,001 other hideous atrocities. And they are getting away with it even in lands where they don't belong, because of Western stupidity applying these axioms without thinking.

There is more complexity to this heartbreakingly infuriating formula and dilemma, but I want to keep it relatively simple for now.

Oh yeh... tell me what a greek slave advising the Roman Emperors or even the Ottoman sultans would consider to be the similiarities with a black in the southern states. You show yourself to be an idiot. If a woman is forced to wear clothing by a control freak husband and her personal freedom is curtailed at his express wish then I consider that a form of slavery. Now jog on.
