Free speech victory: Dutch parliament revokes blasphemy law

While other Western nations flirt with introducing blasphemy laws under the guise of "hate speech" codes, the Netherlands, of all places, affirms free speech. "Dutch Parliament Revokes Blasphemy Law," by Frud Bezhan for RFE/RL, November 29:

Insulting God will no longer be a crime in the Netherlands after the Dutch parliament decided to revoke a decades-old blasphemy law from the statute books.

The law, which was drafted in the 1930s, had not been used for half a century, leading legislators to decide there was no longer a need for it.

Discussions over whether to formally abolish blasphemy restrictions in the Netherlands began a decade ago as part of a debate about the limits of freedom of expression.

But Marc Veldt, a media-law lecturer at the University of Applied Sciences in Utrecht, says the November 29 decision was made possible by national elections in September, in which two liberal parties emerged victorious. Far-right and conservative parties, which had opposed lifting the blasphemy ban, took heavy losses in the poll.

Veldt says the move to lift the ban on blasphemy was also an indirect result of the legal case involving anti-Islam Dutch politician Geert Wilders. In June 2011, a Dutch court ruled that Wilders had the right to criticize Islam, even though his opinions insulted many Muslims.

Wilders, who leads the Freedom Party, had described Islam as "fascist" and compared Islam's holy book, the Koran, to Adolf Hitler's autobiography and political manifesto "Mein Kampf." Amsterdam judge Marcel van Oosten said Wilders' statements were directed at Islam and not at Muslims. Van Oosten said the statements were "gross and denigrating" but still "acceptable within the context of public debate."

Wilders said at the time that the verdict was "not only an acquittal for me, but a victory for freedom of expression in the Netherlands."

The decision to abolish the country's blasphemy law has been hailed by activists internationally, who have long called it outdated and a threat to free speech.

Push Back Against Blasphemy Laws

One of them is Padraig Reidy, a news editor at "Index on Censorship," a magazine based in London that is devoted to protecting freedom of expression.

Reidy says many European states still have laws prohibiting blasphemy, although in many cases such legislation has not been invoked for decades. Different European countries have taken their own trajectories on the issue in recent years, making it hard to discern a clear trend.

Britain, for example, scrapped a blasphemy law in 2008, which had made it illegal to insult Christianity. But it has since replaced it with a more general law against incitement to religious hatred.

Ireland introduced a new law in 2010 that makes blasphemy a crime punishable by a fine of up to 25,000 euros ($32,485). The Irish law defines blasphemy as "publishing or uttering matter that is grossly abusive or insulting in relation to matters sacred by any religion thereby intentionally causing outrage among a substantial number of adherents of that religion, with some defenses permitted."

Reidy argues that blasphemy laws are no longer relevant in the 21st century. He says there is no place for a law defending religion, which he calls an "ideal." He says it should be people who have rights, not ideals.

"There's no question that blasphemy laws are a severe restriction on free speech. Any push back against blasphemy laws -- [against the notion that ideas] should be protected -- is a good thing. It's very important that blasphemy laws should be repealed," Reidy says....

Indeed.

It was more fun calling Allah, Satan, when it was naughty. I guess I'll have to think up nastier things to call Allah to retain the thrill.

Well, it definitely sounds like a triumph for free speech, but is it?.
I hope that it is applied hard and furious to the detriment of Islam, but it may not. You'll always get the Christian-bashers, but I'll only be convinced when those that wish to point out the truth about Islam are protected by this new law.
I suspect that they won't be.
I think that anyone who criticises Islam won't benefit from this, and the lack of a blasphemy law won't help them. I suspect that they'll be stopped by other means, possibly by laws condemning 'hate speech'.

The thing to do is for a group of people in the Resistance to *test* the waters, as soon as possible.


Do some research; find, and then have a group of people, preferably a fairly large group, gather and read out aloud in public, one after another, assorted statements that are known to have been deemed blasphemous, in the past, preferably the recent past. Things that some Jews have called blasphemous, and things that some Christians have called blasphemous, and things that some Hindus have called blasphemous, and things (e.g. a true and accurate description of Mohammed, pronounced by Mr Geert Wilders) that Muslims have called blasphemous.

After each statement, have a few people shout 'Blasphemy!' and another set of people reply calmly, "But that isn't a crime here in Holland any more".

Alternatively, a selection of 'identified-as-blasphemous' statements of this kind could be published, in series, in a newspaper (as 'advertisements', paid for by the Resistance).

One could always publish a paragraph of C S Hurgronje, or from Hugo Grotius or Spinoza, soberly giving their scholarly assessment of Islam, and see whether *that* got pounced on as 'hate speech'...

Here's C S Hurgronje, on Muslims:

"...we must always recollect that reason, education and other similar influences gain no hold upon the self-esteem of Mohammedans until they find themselves opposed by irresistible force. Such is the tendency of their doctrine and their practice accords therewith." [The Acehnese, Volume I, p. 170].

Here's Hugo Grotius, the great Dutch jurist:

"This religion (Mahometanism), altogether contrived for the shedding of blood, delights much in rites and ceremonies, and would be believed without all liberty of enquiry thereinto."

Here's the great Jewish Enlightenment philosopher, Spinoza, who lived and wrote in the Netherlands:

"Mahomet was an imposter, since he completely abolishes the freedom which is granted by that universal religion revealed by the natural and prophetic light, and which I have shown ought to be fully granted."

Print *those* three statements in a bunch of daily newspapers, or turn them into posters and stick them up in public places, and see what happens next.

Will the PC brigade try to dig up Hugo Grotius and hang his skeleton upside down to punish him for committing 'hate speech' (namely, pronouncing what are manifestly true statements) against Islam?

Reciting the anti-shehada from time to time is an exercise in purifying the soul. I always feel good afterwards.

Here it is: I am not a Muslim. I will never become a Muslim. I totally reject Islam!

Moral and psychological detoxification is needed in the Islamically-polluted times in which we live!

Not so fast. If I know the Yurruppeens, people will be free to knock Christianity right and left, and perhaps a few brave and foolish souls will--in the name of solidarity with Falastin--be able to trot out _The Protocols of the Learned Elders of Zion_ (and get away with saying they're not anti-Semites for doing so). However, criticism of Islam will still render one subject to prosecution because of "racism".

Congratulations to our dutch neighbours. You are a beacon of light. Hartelijk bedankt!

I'm tempted to make bumper stickers that say 'Muhammad was a pedophile'.
If everyone knew that about him I don't think our media and white house could continue to perpetrate this political correct whitewash of Islam without some serious backlash against them.

We don't tolerate the Warren Jeffs of America so why on earth would we tolerate the Muhammads of the east? It is what it is: pedophilia and rape.


I will be eurprised if the Dutch are really empowered to speak freely about religion. In the U.K we have a law which specifically empowers citizens to speak out against and even ridicule and insult religious belief. However other laws say a citizen may be prosecuted if he says anything or displays signs which cause other citizens to feel harassed, alarmed and distressed. I am up for trial on January the 3rd because I displayed anti-Islam signs on my car which caused two non-Muslim ladies to feel harassed alarmed and distressed. And this is inspite of Lord Chief Justice Stephen Sedley saying "free speech which does not offend is no free speech at all."
