Tunisia: Muslim cleric calls for “sterilizing the wombs of Jewish women”

The Tunisian Association to Support Minorities is suing a prominent Tunisian imam for hateful incitement against Jews.

During a Friday sermon broadcast live on November 30 on Hannibal TV, Sheikh Ahmad Al-Suhayli of Rades, a suburb of Tunis, told his followers at the Khatib mosque that “God wants to destroy this sprinkling of Jews”¦ and is for sterilizing the wombs of Jewish women,” the liberal Egyptian daily Al-Masry Al-Youm reported.

Qais El-Beltagi, a lawyer representing the association, alleges in the lawsuit that Al-Suhayli’s comments violated Tunisia’s 2011 Decree 115, which criminalizes “calls to hatred between races and religions, and the population.” He said that article 52 of the decree calls for “a prison term of between one and three years and a fine ranging from 500 to 1,000 euros” for hate-filled speeches….

    How does he know Allah wan’ts that? Does it say so somewhere in Quran? Did Gabriel visit him too? The Imam better be careful, he is dangerously at risk of shirk…

    This appears to be an odd case where, instead of this law being used to defend Islam, is now being used to defend a non-Muslim minority. Good luck getting a Muslim judge to rule against a Muslim cleric.

    That said, I don’t agree with such “hate” speech laws. The Muslim cleric’s comments rise to the level of incitement to violence involving forcefully sterilizing some women, removing some women’s capacity to have children. Morally, it’s about as evil as raping them, if not worse. It is, among other things, incitement to genocide of a particular group of people. For these reasons–calls to violence and genocide–this cleric should be prosecuted and jailed for a very long time.

    Those advocates of “hate” speech laws fail to realize the logical consequences of what they advocate, were it to be applied equally to all people. For one, it would be necessary to prosecute the people advocating the hate speech laws too because of the hateful things they say. Of course, advocates of hate speech laws generally aren’t advocating protecting all people from hateful speech. They are only advocating that some groups be protected. The general term hate is used in an attempt to hide or obscure the blatant partisan power grab that the advocates of hate speech laws are engaging in when they advocate such laws.

    I agree with you, Kinana. Hate speech laws of any kind are geared to punish motive, thus getting the state into thought control. No motive should be punishable, only the act and the intention to do wrong irrespective of motive. It should make no difference WHY someone was killed for prosecution purposes (though for investigative purposes why someone acted as they did is important). The classic formulation is actus rea+mens rea=crime.

    This formulation is eminently sound. Hate speech laws are not.
