It would be useful to see the precise text of the criminal statute that was violated. In the US the creation of that text would be the responsibility of a legislative branch. A judge would apply the facts to that legislative provision. A judge may not add to or ignore the statute. In the US, again, if a judge is dissatisfied with legislation he can refer to a superior constitutional provision to invalidate legislation, and of course fully explain the decision.

What I see here is the enforcement of an unwritten Sharia-based constitutional exemption applied exclusively to an Islamist. Isn't this the same step in the process that renders Muslims unaccountable for attacks on non-Muslims in openly (loud and proud) Sharia-based governments? It can't defy Sharia, thus it is Sharia.

Let’s face it, western legal systems have been increasingly corrupt for decades or more. Victims rights?? Disgusting! Long jail terms for murder? Barbaric!

In Canada, youth crime law is so pathetic, that it actually encourages youth crime… The poor poor young criminal, exchanging notes with others of his cohort, knows what load of rubbish to hand to what idiot judge, and laughs on the other side of the courtroom door. The quality of judges is a serious problem, even without dhimitude… or financial corruption. A local judge, a falling down habitual drunk, routinely drove home after getting plastered, taking for granted that since he was a judge, the police would let him go. And quite a few would have, knowing that the system would NOT take his criminal act very seriously. The same dolt could be a poster boy for useless jackasses being elevated to positions that they never would or could qualify for, but the selection process is political, so standards don’t count.

Seeing these idiots enforce their own ignorant bigotry as law, or laws being created out of the same ignorant bigotry, is rather hard on ones enthusiasm for life…. The Canadian supreme court (they don’t deserve capitalization) has a shabby history of laws being changed to suit the needs of one of their own, and have recently decreed a racist standard, where ‘native’ Canadians are to be held to a much lower standard of conduct. The police are very selective about what laws will be enforce when dealing with pressure groups or minorities, and victims, if they object, are lucky if they are ignored.

Cries of ‘kill the jews kill the jews’ have been heard in my city, and NOTHING was done about it…. Major roadways are blocked by preferred minorities, and NOTHING is done about it.

A few years ago I was unemployed and in order to pay the bills I slept in my basement and rented out my room. I was fined $200 because it's illegal to sleep in a basement even when it's your own basement. The fact that I didn't know that didn't matter, it's the citizen's responsibility to know the law. Before I was fined I saw other people fined who openly said they didn't know. I find it hard to believe the Muslim who said he didn't know but even assuming he is telling the truth it's his responsibility to know.

The only exception would be if the young man could be proved to be intellectually disabled or of unsound mind. While these options are hinted at, they are not spelled out.

PRCS, the reason that the school "cannot be named for legal reasons" is most likely that the school is currently subject to a legal investigation. Most likely there have been questions raised about the legality of its curriculum. So the school's anonymity is probably a good sign.

However, there are only a few Muslim day-schools (as opposed to after-school madrassas) in Birmingham - I suspect no more than half a dozen. The school will be identified long before its identity is officially released.
