Sifton
Brooklyn ice cream shop owner Abad Elfgeeh pled guilty to funding jihad terrorism. But that wasn't good enough for the judge. From AP, with thanks to Miriam:
Judge Charles P. Sifton said the Yemeni proprietor, Abad Elfgeeh, had not understood the consequences of his guilty plea to illegally transferring money to bank accounts in Yemen, Switzerland, Thailand and China.FBI agents arrested Elfgeeh last year after learning that $20 million had passed through the bank accounts of his Brooklyn-based business from 1997 and 2003. He pleaded guilty in October.
Elfgeeh, a naturalized U.S. citizen, remained under house arrest.
“Nobody, but most importantly not Mr. Elfgeeh, was clearly advised (about) ... his rights to a jury trial with the prospect of facing the sentences that he now faces,” Sifton said.
Court filings portray Elfgeeh, 49, as a vital link in a system that moved millions of dollars to Osama bin Laden, al-Qaida and Hamas. Prosecutors also believe Elfgeeh was an associate of Sheik Mohammed Hasa Al-Moayad, a prominent Yemeni cleric charged with funneling millions to al-Qaida before the Sept. 11 attacks.
A pre-sentencing report by the U.S. Probation Department plays down any link to terrorism, saying federal agents assigned to the case had said “there appears to be little, if any, evidence to suggest that Elfgeeh had any role in financing terrorism or any knowledge that money he was transmitting was used to finance terrorism.”
Frank Hancock, Elfgeeh’s lawyer, added: “The only thing they have credible evidence for is the fact that he was operating a legal business that they say he needed a license for.”
Prosecutors said they would try to strike another plea bargain. But, Elfgeeh, who faced the possibility of more than 10 years in prison, said he refused to accept a deal that included jail time.
“I didn’t do anything wrong,” Elfgeeh said as he left a federal court in Brooklyn. “America is still good.... It’s still the best country in the world.”
In a letter requesting a 10-year sentence, prosecutors say Elfgeeh told a confidential informant that he had sent money to al-Moayad, who has pleaded innocent to charges and is being held without bail.
Records show al-Moayad had called Elfgeeh’s ice cream shop and kept its number in his phone book, prosecutors said. Before his extradition, Al-Moayad also told an FBI agent that Elfgeeh had helped him raise money in the United States.

You people need to get a life. Your consumed by hatred. Your all going to grow up old and lonely miserable people.
Hopefully one day you will realise that you are on a fruitless journey. There's more to life than hate...
Umar : Aren't you muslims the most peaceful, civilized, kind, gentle, open-minded and tolerant people in the world? No, sorry - you really aren't.
Posted by: Johannes at May 13, 2004 9:14 AMUmar:
Actually, Umar, the problem is that Muslims are consumed by hatred. If you Muslims were not seeking world domination and just wanted peaceful co-existence, then there would be no problem. You quit bothering us and we will quit bothering you.
Unfortunately, though, we both know that will not happen because what Muslims do is religiously mandated and to stop doing it would lead to charges of apostasy. Consequently, all Western nations are going to become like Israel. We will be spending vast amounts on security to keep you Muslims under control for the forseeable future. Why we are even letting you in our countries is a vast puzzle for me given the security risks that Muslims pose.
Why don't you go and spend a few hours each day or week developing a theological basis for a peaceful Islam and then telling your co-religionists about it. And at the same time, why don't you go over to Muslim countries and tell them that freedom of conscience is a human right. We in the West allow you the freedom to practice your religion but this right is not reciprocated in Muslim countries.
In other words, Umar, the problem is YOU not us.
Posted by: Mentat at May 13, 2004 9:41 AMUmar, I like the way you said "you" people. Are we not all brothers and sisters? My belief is that we are and that we all should get along. That is unless you are of the same opinion that Americans are infidels. In that case, who is the one consumed with hatred. The people that worked in the Trade Center were guilty of nothing more than earning a living. Yet they were savagely attacked by hateful men, all in the name of Allah. No Umar, we are not the ones who misinterpret our religions to make hateful attacks on people in the name of God. We are however the people who will bring hell to those who've disrupted our peaceful existence. You are right about one thing Umar, we will be the ones that grow old. I'm afraid, however that all of the miserable hatefull people will be long gone by then.

Anger is usually a short responce to the behavior of others towards you.
Hate is a slowly aquired form of anger that needs to be fueled overtime.
Documents like the Hamas Charter that evolved from the Wahaabist fundalmentalist teachings of clerics in Saudia Arabia and created its authors such as Shieke Yassin, and Rantisi foment and fabricate hate. They learned long ago that creating hate among certain groups of people gives them power over them by the hate mongering (demogogue) precipetators that they are. This demogoguery is practiced quite openly in Islamic fundalmentalist mosques and taught in the Madrasses to young impressionable children throughout the middle east and it is also rearing its ugly head in our western civilization.
In my over 50 years of attending sermons at christian churches, I have never heard a pasture ,priest,or minister preach a sermon that defiled or spoke of hate towards another religion, and if I did, I would walk out of that church without hesitation.
Sadly this is not the case among many Islamic teachings. There is indeed a clear difference here. Actions will always speak louder than words do. I do see a lot of hostile comments on Jihad Watch, but I believe they are more seated in anger, though unfortunatly and sadly that is changing over time to that which is hate. Hopfully cooler heads will prevail from those of us who represent the real teachings of peace.

Posted by: Catherine at May 13, 2004 11:56 AMEverybody on this site seems to be forgeting that since the end of WWII the US has embarked on numerous 'expeditions' bent on crushing first 'communism' and now 'terrorism'. Obviously these are just pretexts for the consolidation and maintanence of US political-economical clout. The result of 60 years of CIA covert operations, installing or deposing governments/dictatorships and a general policy of interference, coercion and in many cases war is progressively being exposed for what it is by new technologies (like the internet). The fact is that people are better informed (if not better educated) than ever before from a variety of sources and US foreign policy seems flimsy and unfounded. Nobady has the right to be the sole bearer of truth and wisdom, we can propose our truth claims and in this sense the world is a much more democratic place. Otherwise we can try and impose our will through invasion-terrorism-war, call it what you might. I'm just stressing that the US is/has been the agressor for a couple of generations now and it has understandably caused resentment abroad. Unfortunately this has been the case throughout history with all great powers/empires and people like ourselves have blindly kept on sheding our blood. Don't get me wrong I would fight&die for what I hold sacred, after all we are all tribal creatures but I certainly don't appreciate being lied to for the wrong reasons!

Oh, THIS is a nice strategy: act like you're mentally RETARDED and the judge will let you off, even if you've told him you're GUILTY!
Sifton is the REAL idiot, the defendant just plays one in the courtroom.
Posted by: BleedingHeart at May 13, 2004 3:57 PMMr. Arxos: You are laying out some very broad comments without noting any specifics in your condemnation of American policies.
Let me remind you who tried to starve the German people to death after the defeat of the Nazis after WWII. Without the Berlin airlift (the greatest humanitarian effort in world history) conducted by America, thousands upon thousands of Germans would have died at the hands of the soviet union.
Let us not forget when Nikita Kruschev took off his shoe in the United Nations and pounded it on the table and said " we will bury you "! meaning the United States.
Let us not forget the Soviet Union shipping nuclear missiles to Cuba in ships . with the intention of checkmating America.
Let us not forget the invasion of South Korea by Cummunist North Korea with support from the Soviet union.
Let us not forget the invasion of Hungary, and Afghanistan by the Soviet Union without provocation.
And let us not forget the wall erected to keep people in ,instead of out.
Mr. Arxo: you say; don`t get me wrong, well my friend I do indeed get you wrong if you are one to believe that America has acted with a collectivly corrupt mind set.
From Mr. Arxos:
Everybody on this site seems to be forgeting that since the end of WWII the US has embarked on numerous 'expeditions' bent on crushing first 'communism' and now 'terrorism'. Obviously these are just pretexts for the consolidation and maintanence of US political-economical clout.
"Pretexts for maintenance of our political clout". As if to say everything that America does is based on a lie? How you can compare communism to to terrorism escapes me altogether.
And so all the presidents and their cabinets, the U.S. congressman and senators have all conspired over the past 60 years to perpetuate a big lie on the rest of America. I would strongly suggest you go back and read your history book my friend.
Posted by: Mackie at May 13, 2004 3:58 PMDoes anyone know an email address, home address, or phone number of Judge Charles P. Sifton?

Posted by: Ali Dashti at May 13, 2004 4:06 PMBob, the 'provocation' and 'reason' has been the fight against communism, drugs and now terrorism. What do you think, were all of these valid threats to US security? Was McCarthyism justified, the Contra movement of Nicaragua, Vietnam&indochina, embargos and sanctions left and right etc? The bombing of Serbia and the current war of Iraq namely were/are illegitimate operations in the eyes of international institutions and opinion and therefore the US can be considered the agressor. I am not saying that it was unprovoked, merely that it was/is all a great game for power, as for merit it's debatable (many say that principle is reserved for us simple-folk down the ladder). To emphasise my point I might add that in the absence of the soviet bloc NATO is not an alliance anymore (I think it never was) but a hegemony, which goes for the international community as a whole, something repeated in history ad infinitum. Remember to be the greatest superpower means firm control on the homefront, those two are inseperable. To control the world politically and economically first you have to dominate the American people, to wield them in unison, under the umbrella of ideology.
Posted by: arxos at May 13, 2004 4:09 PMThe bombing of Serbia ... Arxos: You ARE kidding, right? Clinton bombed in Serbia to Protect the muslims and you have a problem with this? So we aren't even right when we (some of we) are On your side?
Or if you refer to WW I - I seem to recall America was pretty much Isolationist during the first few decades of this century. If we were so hot to get into war, why did it take us Two Years to do so in that one?
Posted by: Gary at May 13, 2004 4:32 PMArxos,
Battling communism in the past and terrorism in the present are acts of self-preservation by America and her allies. Just as all civilized nations agree that there exists a right for an individual to protect himself against lethal force to himself or others, so to do nations have a right to self-defense. In most iterations of self-defense law, the key to the law applies to imminent and apparent threat. Lethal force can be applied if the person has a reasonable fear of grave injury or death.
While you may wish to consider it a “great game,” we like to call it survival in a hostile world. And I hope I misunderstand you when I read your statement “to be the greatest superpower means firm control on the home front.”
Obviously sir, you know nothing of the real America. Our greatest strength is our tolerance of ideas, and dissent. Our greatest strength is our ability to exchange conflicting ideas without exchanging blows. Something that I believe we are doing right now.
It is a concept called "the marketplace of ideas" and the real reason the United States is a superpower.

your comments are a welcome addition
to the dialogue on Mr Spencer's site.
As long as there are more judges such as Sifton in the US,the terrorists are free to move about and plot our anihylation without much trouble.
As long as demagogues and hypocrites are still in positions to make such decisions as this, our country will never be able to be safe from terrorist attacks.
As long as we still allow muslims to immigrate to the US,our country will remain vulnerable to more terrorist attacks.
How many more 9/11`s do we have do endure,in order to wake up and rid this country of the muslim cancer?!
I can't beleive that everyone actually talks like this. Do you really beleive that all muslims are out for the violent overthrow of the US? Are we all immigrants?
Honestly in all my years i have never been to a khutbah in any country that advocated violence. The ones that do are not the majority by far. In fact they have always advocated involvement, outreach, education, voting, becoming a vital part of the country.
If this desire to better oneself in order to better the country that you live in is extremist or jihadist then maybe you are right. But as a devout muslim i have had the blessing of helping more than 2 dozen women come to islam in the west and they have been nothing but a blessing to the communities they live in. I am proud to say some of them have surpassed me in knowledge and peity. They work tirelessly to see the elevation of the people they live amongst. God willing, this trend will grow!!

Posted by: Ahlam at May 14, 2004 6:29 AMAhlam : When you say "your world" (meaning my world, that is), you clearly show your muslim arrogance once again. Is "your" world another than mine? Have you ever spoken up loudly and clearly in front of your fellow believers against antisemitism, slavery, terrorism, homophobia, mysogyny, honor killings and public executions? THAT would make "my" (if not "your") world better.
