Lawsuit over Roxbury mosque dismissed

An update on this story. "Lawsuit over mosque site is dismissed," by Stephen Kurkjian for the Boston Globe:

A Suffolk Superior Court judge dismissed a lawsuit that contended the Boston Redevelopment Authority's sale of a parcel of land in Roxbury for a price significantly below its appraised value to the Islamic Society of Boston violated the constitutional separation between religious groups and the state.
Judge Sandra L. Hamlin ruled that James C. Policastro of Mission Hill did not have legal standing to challenge the sale because he did not file his lawsuit within 30 days of the sale, which the Legislature set as the BRA's deadline for appealing the agency's decisions. Policastro filed his suit on Sept. 28, 2004, more than 16 months after the BRA sold the parcel. The sale price for the parcel was $175,000, and the society spent another $43,820 to improve the land. It had been appraised at more than $400,000.
The Islamic Society planned to build the largest mosque in New England on the site, along with a school and a cultural center, but completion of the project has been delayed by funding problems and controversy over extremist remarks by two former officials of the society.
In her decision, Hamlin rejected Policastro's contention that he was not bound by the BRA's deadline but instead should be afforded the court's customary three-year period to bring the suit because he was contesting the agency's decision on constitutional grounds.
Hamlin, however, said she was basing her ruling on a 1988 Supreme Judicial Court decision that held that taxpayers were limited to the 30-day period to appeal decisions of redevelopment agencies.
In an interview yesterday, Policastro said that because he was not paying for the lawsuit himself, the decision whether to appeal would be up to his lawyer, Samuel Perkins of Boston. Perkins said yesterday that he would appeal. Policastro and Perkins both declined to say who was paying for the lawsuit.
Perkins said Policastro remains determined to find out why the BRA was so intent on selling the 45,000-square-foot parcel, located in Roxbury Crossing, to the Islamic Society. A related suit filed by the David Project, a nonprofit Jewish advocacy group, to force the BRA to release all documents related to the sale, remains open.
"The city isn't getting full payment for the land, and there are a lot of things that we need to be aware of that we are not," Policastro said yesterday.
A spokeswoman for the Islamic Society of Boston praised Hamlin's decision in a statement.
"We are very pleased that the court put an end to the legal campaign against the Islamic Society of Boston, which is part of a greater effort by those seeking to oppose area Muslims from building a place of worship," said Jessica Masse, the society's inter faith coordinator. "Part of Mr. Policastro's suit demanded that the ISB return the land and the mosque be torn down. Now this threat is gone. It is full steam ahead now -- we will see our mosque built to completion."
Albert L. Farrah Jr., a lawyer for the Islamic Society, said Hamlin's decision was a proper one that would discourage legal objections to redevelopment projects long after contractors had broken ground on the jobs.
About $12 million has been spent on the project so far, and Massie said yesterday that the Islamic Society hoped to raise another $2 million to complete construction of the mosque and part of the school in time to open by the beginning of the Ramadan season in September.

With a great deal of funding coming from the usual suspects, the Saudis.

I can just imagine how some well-greased palms enabled this project.

In civil suits, fraud will toll [i.e., suspend] the statute of limitations. Where there has been deception, parties who have been the victims of such deception -- as all the taxpayers in Boston, and certainly Mr. James Policastro of Mission Hill --should be allowed to have that "30 days" rule thrown out.

A typical statement is the following:

"There are circumstances that suspend or toll the statute of limitations. Dishonest or fraudulent concealment of the right to sue by the wrongdoer will suspend the deadline an amount of time equal to the period of concealment."

The BRA has been engaged in all sorts of "dishonest or fraudulent concealment of the right to sue" and therefore there should be suspension of "the deadline" by "an amount of time eequal to the period of concealment."

There will be an appeal. And there should be. This is an idiotic decision.

Let the masters of jus standi come forward and help out. This is an important case, important bdcause all over America, Saudi money is transfrorming the landscape (and who paid for that $15 million mosque in Bilerica, a very modest town, with scarcely a hundred families at the mosque? Who, and why?), by building mosques and madrasas and underwriting carefully-targetted campaigns of Da'wa,, directed at the economically and psychically marginal members of society, who then become a threat to the rest of us.

If you want to find out what a Saudi-funded mosque looks like, consult the report of Freedom House, which gathered written material found in Saudi-funded mosques all over this country. Google "Freedom House" and "Saudi" and "mosque" and keep going till you find that report. And if you can finally brush down your hair, which will have stood on end, think about what is going on, and think about that Muslim agent of Islam who, having burrowed deep inside city government, did everything he could, from the swindling of taxpayers by the ludicrously low price put on the land in question (which had been assigned a true market value just months before) to flying off to Saudi Arabia, on a trip the details and funding of which the BRA and the party in question refuse to reveal even now.

This case stinks to high heaven. And the judgment, throwing out the suit on a mere technicality when the issues invovled -- misbehavior by city officials that cheat the citizens of Boston, misbehavior that has been followed by classic stonewalling and a coverup --should be made an issue by Mayor Menino (who knows that many find his own early role in this unforgivable, and he has a lot to make up for), and by all those serving in the legislature, that is in what was originally called, and still is, the Great and General Court of Massachusetts.

John Quincy Adams, who knew all about Islam (google "Islam" and "John Quincy Adams"), possibly the greatest American statesman of the 19th century, and certainly the greatest statesman ever produced by the State of Massachusetts, would not have been amused. He would have been -- I am channelling him right now -- enraged.

There has to be more to this than even bribes as it is so widespread this literal attack on Judeo Christian worship. If Jerry Falwell had got a deal like this the Justice Department would be throwing people in prison.

I firmly believe that besides oil money that there are highly placed influential Muslims in every sphere of governments and think tanks which are influencing the higher ups to do things which make no sense. The Conservative Union of all things is exposed as having such a sweetheart deal going on and yet the Conservative media will not touch the story of "oil payoffs" and Muslims who are setting up CAIR type bodies to change America.

Jimmy Carter is bought and paid for by oil money. Look at what goes on at Emory University. Hoover Institute's main Persian expert is a Persian who is basically advocating a "peaceful" settlement in America not attacking Iran...that amounts to giving Iran the bomb and waiting for it to blow up New York City.

There is a 5th column in this as driven as the homosexual 5th column using the same mantras of phobias and scream campaigns to change public policy. They are using American laws to take over America.

There is a great deal going on under the surface in the Muslim communities in the Boston area. I have an imperfect understanding of what's going on (to say the least), but nonetheless I try to point out and comment on things that strike me as significant, but that aren't getting coverage in the media. Today and tomorrow, I'll try to tackle some recent developments one by one. Today we start with Jessica Masse, the new interfaith coordinator and spokesman for the Islamic Society of Boston (ISB).

The Islamic Society of Boston has had many trials and tribulations as it has attempted to build the largest mosque in the Northeast in Roxbury, Massachusetts, a $22 million dollar project. Daniel Pipes has a play-by-play of the ISB story. Several writers have covered the story as well, including Dean Barnett and Tamar Morad. There's so much material here: ties to terrorists and terrorist group supporters; anti-Semitic statements by one of ISB's trustees who attended interfaith dialogues in Boston; multiple lawsuits against their critics; sweetheart deals with the Boston Redevelopment Authority (BRA); mosque fund-raising trips by a BRA official to the United Arab Emirates; and most recently, news that $1 million dollars in funding came from the Saudi-based Islamic Development Bank, which disburses - among other things - "special funds created to support Palestinian families, including the families of suicide bombers." Like moths to the flame.

Anyone who's the spokesman for the ISB has to be working overtime. The previous face of the ISB was Salma Kazmi, its Assistant Director. The new spokesman is Jessica Masse, who though only on the job for one month, has been writing up a storm and getting lots of media coverage. On December 28, 2006, the Globe published Masse's letter to the editor about The David Project's questioning of the UAE trip, which concludes:

"The real story here remains the relentless efforts of the David Project to stop the building of a mosque and center for interfaith dialogue in Roxbury . The ISB's letter invited the David Project to participate in dialogue to "begin a discussion toward healing the divisions between our communities" and to help lessen tensions between area Muslims and Jews. In response, the David Project has once again elected to practice only hatred toward area Muslims by rejecting dialogue."

Strong words for the new ISB spokeman's first public statement. A few days later, Masse was quoted in a December 30, 2006 article about the renewed attempt of an interfaith group to conduct mediation between the ISB and The David Project:

"We embrace the proposal, and our hope is that we can get the David Project to sit down with the Interreligious Center for Public Life and us and work on these resolutions and make them happen," said Jessica Masse , interfaith coordinator for the Islamic Society of Boston, which operates an existing mosque in Cambridge and is overseeing the construction of the new mosque. "We want to immediately begin the process of healing these rifts."

OK then! (My earlier thoughts on this dialogue here and here.) On January 10, 2007, Masse is quoted in the Globe article about that $1 million dollar financing for the ISB mosque from a Saudi-Arabia-based bank:

"(ISB) spokeswoman Jessica Masse .... said that the loan is the first money for the project obtained from the financial institutions of Middle Eastern governments. She stressed that the bank works with many Western governments and that it cofinanced, with the United States, some projects approved by the United Nations and the World Bank."

I wondered who this new, energetic ISB spokesman was. My question was answered last week by a Muslim American Society e-mail dated January 11, 2007 (the MAS operates the ISB e-mailing list):

"I joined the Islamic Society of Boston as an employee a little over a month ago. When I left my job at Harvard Medical School, I was looking to do something fulfilling, some way to contribute to my community. Al-hamdulillah, I found many opportunities, but the most urgent need I found was with the Islamic Society of Boston (ISB)."

"We all have seen ISB beaten in the press for the past several years and I made the decision to join them to try and help and contribute to the dream of a building a beautiful mosque for our community so that we Muslims can pray together in dignity and peace."

Aha, it is the same Jessica Masse who worked for the Yang Research Laboratory at Harvard University. Her picture can be found on Google, she is an attractive young woman and apparently is a convert to Islam. Looks like the ISB has chosen someone with a non-Muslim name and non-Middle Eastern appearance to be its public face. She has the victim mentality down pat, as her e-mail criticizes the Boston Globe for publishing the article about the Saudi bank funding and Jeff Jacoby's column on same. She asks people to "to write letters to the editor to protest this attack on Muslims in the Boston community." More from the e-mail:

Why Islamic Society of Boston got loan from
Islamic Development Bank?

It seems that the normal rules of civility and legal tradition no longer apply to Muslims living in America. The mere mention of the words "Muslim" and "Saudi Arabia" in the same breath elicits accusations of "ties to terror" and charges of extremism in a complete reversal of innocent until proven guilty.

For example, in 2005, the Islamic Society of Boston was approved for a $1 million loan from the Islamic Development Bank, with headquarters in Saudi Arabia, to partially fund its ISB Cultural Center in Roxbury. According to the new logic of guilty-by-association, because the ISB is a Muslim organization and the Islamic Development Bank is in the Middle East, the public should be scared.

Yes, the ISB borrowed money from the Islamic Development Bank, which has ties to Islamic countries of all types. But the institution's members are Islamic countries that practice all sects and strains of Islam -- Sunni, Shia, Sufi, Wahhabii, Salafi. The bank finances projects jointly with the United Nations and the US government. The assertion that this enormous, multilateral bank with 20-year ties to the UN promotes a Wahhabi strain of Islam by means of its lending practices is absurd. This paranoid logic argues that if you are Muslim and have any contact with Saudi Arabia you must be a terrorist.

This game of guilt by association is a threat not only to Muslims, but to anyone who is unfortunate enough to be politically unpopular in this atmosphere of fear and insecurity. Such use of fear-mongering tactics against Muslims is the same mean-spiritedness that led to the internment of Japanese citizens during World War II.

Fifty years from now, people will look back on the stereotyping of Muslims with equal shame. As David Cole, law professor at Georgetown University, recently noted in the Washington Post, the administration launched a post- 9/11 campaign of profiling Muslims and those from Arab countries, "calling in 8,000 young men for FBI interviews and 80,000 more for registration, fingerprinting, and photographing by immigration authorities. Not one of those 88,000 has been convicted of terrorism."

The public has every right to ask why the Islamic Society of Boston turned to the Middle East for assistance in funding its $14 million mosque. This requires some knowledge about Islam. For Muslims, obtaining interest-free (sharia-compliant) funding is a religious mandate. Therefore, traditional funding has not been an option. With donations trickling to a halt because of unscrupulous charges of ties to radicalism by groups in opposition to the mosque, the society was compelled to seek assistance funding the partially built structure.

Yes, Muslims sought a loan to pay for part of the expense of building a beautiful mosque and cultural center in the heart of Boston. This is not unlawful. It is not un American. To challenge the Islamic Society of Boston's right to obtain legitimate, ethically appropriate financing on the basis of the location of the bank is denying the society and its religious community the right to do as all other religious communities in America have done -- to raise money to build a place of worship.

The public has questions for Muslims in America and we have responded. We have opened our mosque to the public, taken part in outreach efforts, and worked extensively to foster understanding of Islam and Muslims. We have been answering questions for years and we will continue to do so. However, asking questions and providing answers is a two-way street……

After some consideration, it appears that the all-out Saudi assault to buy naive and greedy infidels out in America and build Jihad training centres (and that's what they are -- watch the Channel 4 Dispatches "Inside a Mosque" still hopefully on YouTube), is all part of the BIG JIHAD.

The BIG JIHAD -- perhaps there is a better term -- is born out of a strangely coherent set of circumstances, some planned, some co-ordinated, some not.

The Saudi end of this is the Soft Jihad, as Spencer and others have coined it. It's a Jihad that, frankly, is born out of a desperation.

Desperation coming from the realization that someday, in a forseeable future, the unearned and undeserved oil will run dry in the Magic Kingdom. They've got to set up ROOTS elsewhere. Islam must take over the world, after all. The "prophet" commands it.

They've got to act, and act now. This is the big drive. The modern world is foolishly clouded in its thinking by PC and left-wing moonbats and deluded right-wing apologists alike who only see things in their context where "religious people don't do things like jihad!" The press is available to buy, academia is ready for handouts, the internet, well, its troublesome, but they can recruit thousands of jihad dis-information dudes and flood the place.

Sooner than they want to let on, the oil will dry up. Iran will soon be consuming more oil than it produces and will not be able to export. Soon the spectre of the "prophet" and his minions will be poor again and without influence.

They've got to pour it on! Now is their chance! That's why they're so bold.

Every new convert to islam (especially women)from the West should be deported to saudi arabia or pakistan or any islamic hellhole of their choice. Let them experiance the brunt of islam first hand.

Growing up in reletively peaceful, liberal and affluent soicety has made some of these people loose touch with reality. Do not molly coddle them any more. Treat them like traitors (that they are) to their own kind just like muslims treat their apostates.

Has anybody kept a count on how many mosques, islamic schools and other islamo funded institutions have sprung up since 9/11? Instead of having made their lives a misery (as they never tire of saying it) islamic terrorism has actually helped their cause in the US no end.

There seems to have been a spate of western women conversions of late, and muslims are eager to show them as trophies.

In the UK, there is Yvonne Ridley - who is turning more militant by the minute, then there was another convert who actually joined the police service in London and refused to shake the hand of her boss - Sir Ian Blair, then there was another stupid one, unearthed by Channel 4 that gave an alternative Christmans message to the kafurs of Great Britain in a full blown tent.

Send them all a one way ticket to their masters in camel country post haste!

I cannot convey the sorrow I am feeling over this article. I live just outside of Boston and I believe the heritage of my forefahers have been trampled in the dust. The Saudi inspired Jiahd is well entrenched here in Boston and they have a sophisticated bunch of manipulaters that are pulling the wool over the liberal, lame so called Americans.

Remember there is another suit pertaining to this. The ISB has sued sixteen courageous citizens and groups, amongst them, Ahmed Mansour, a Muslim scholar who pointed out links of directors of the ISB to terror groups and also produced Saudi hate literature found in Boston area mosques. There is still hope that these groups will not settle out of court as the scumbags from the ISB want them to do.

And we have a Benedct Arnold, a Harvard grad as head of the propagands machine of the ISB... I apologize to all of you for my sorry state of Massachusetts.

As you also mention, there is much made of that by CAIR, et al. But the numbers are miniscule.

However, one can see the draw for disfunctional women who have grown up in an environment of abuse and/or without structure or order. Much like the draw for insecure and immature young men and even angry bitter old women-hating curmugeons. And then for the few women there is the "rush" of ultimate rebelion against their parents for those young enough and screwed up enough. The love affair will continue until they are slapped around enough, and smacked down enough, and maybe -- maybe they might escape with their lives years later.

Wait for the future handful of western "defector" women making a media splash in the next few years and doing the talk show routes and writing insipid books about how stupid they were. It is only a matter of time.

I wonder why they chose Boston for this naked onslaught. I suspect that they may have read their American history textbooks and learned that Boston is famous for the long and bitter struggle between a Yankee Unitarian and Congregational aristocracy and mostly immigrant Irish Catholic leadership, and that they are hoping to restage the story. However, there are a number of things wrong. First, the Catholics were part of the American state from the beginning - one or two confessed Catholics signed the Declaration of Independence; this at a time when there were no Muslims west of the Atlantic (except perhaps for some descendants of slaves in Brazil) and when America fought her first war abroad against the powers of jihad in North Africa. Second, the Catholics never wanted to overthrow or alter the American constitution. Loyalty to the laws of the country has always been a ruling principle of the Church, just as loyalty to nothing but Shariah and the Ummah has been a Muslim one. Most Catholic immigrants had an experience or at least an idea of a democratic, representative system, and wanted nothing more than to be part of it. Third, there is no hope for anyone properly religious in the history of the struggle for Boston. Both sides lost their traditional religion, the Protestants first, the Catholics later, leaving us with a uniformly irreligious and stupid political leadership and a tradition of party machines and civic corruption. And if the tradition of party machines and civic corruption does not bother Muslim activists, the inevitable tendency of power politics to destroy any religious convinction should.

Then, there is that Custody Battle played out by Wahabbi Rules.
The kids are somewhere in Saudi, she knows not where.
