The sorrier piece is not that the muslims complained about the koran flushing because we expect that from them - but that this complaint was taken seriously - by institutions that say there is a separation of church and state when it comes to Jews and Christians.

Freedom of Speech? Where have you gone?

This case fulfills the exact type of 'Rights' that the ACLU 'represents' that they represent.

If the ACLU does not joint 'in suit' on the defense, it shows that they are the 'Political Action Team' representing the 'Discrimination of chosen religions'.

P.S. How can 'one' burn an American flag and it be freedom of speech, but the same cannot burn a Koran? Wouldn't 'hate' occur in both instances, or the expression that is protected by freedom of speech?

Never has our freedom of speech faced a more crystal clear threat than in the response to 'Koran Desecration'. This is THE moment. The 'summer soldier and the sunshine patriot' will hem and haw and tut-tut.

It is disturbing to think there could be a slew of muslim officers in a department of 20k-25K policeman.

Since the MSA (muslim students association) filed the complaint, is there some way that this could be turned around for this guy to sue MSA for violating his rights to free speech?

And since CAIR likes to be involved in these kinds of lawsuits, could we name them as co-defendents? Possibly a class action for all of us infidels that would like to express our opinion of islam buy flushing a koran?

Could be worth a few million (54 maybe?) dollars if worded right.

This is just another attempt to force others to acknowledge the Koran as something "holy", thus ligitimizing Mohammad as a Phrophet. What Muslims can't get through preaching, they'll get through intimidation. Too bad the State of New York is willing to assist in helping them.

I only hope the defense comes out fighting, pulling no punches.

Defense lawyers should maintain that their client was protesting the distribution of hate literature on campus, in the form of the Koran. they should maintain the the sexist, pornographic features of the Koran were deeply offensive to him, and he felt it his duty to protect the honor of women, and people of other faiths from the being intimidated by Muslims on campus.

Defense lawyers must put Islam on trial by presenting as evidence the Koran itself.

Just defending "free speech" won't do the trick. In case anybody hasn't noticed, "diversity" trumps free speech and free thought in this country nowdays.

OK, now it starts to become a little clearer. According to the copy of the complaint, the Korans appear to have been library books from the university library. (The university security manager states that he is “a custodian of said property…”).

OK, so it’s looking like a minor case of what we in the UK would term criminal damage. So Shmulevich is charge with Criminal Mischief in the Fourth Degree, defined, under New York State Law as:

A person is guilty of criminal mischief in the fourth degree when, having no right to do so nor any reasonable ground to believe that he has such right, he:
1. Intentionally damages property of another person; or
2. Intentionally participates in the destruction of an abandoned building as defined in section one thousand nine hundred seventy-one-a of the real property actions and proceedings law;
or 3. Recklessly damages property of another person in an amount exceeding two hundred fifty dollars.

Unfortunately for Shmulevich, however, New York has a Hate Crimes Act that allows for extra charges and penalties to be added on to any unlawful act that is judged to have had a hate element to it.

The NYPD Hate Crimes Unit defines the offence thus:

A hate crime is any offense or unlawful act that is motivated in whole or part by a person's, a group's or a place's identification with a particular race, religion, ethnicity, sexual orientation, disability, gender or age.

So he’s charged with Criminal Mischief in the Fourth Degree as a Hate Crime.

Shmulevich apparently confessed to the crime, but was a bloody fool if he admitted, as the complaint claims, that it was motivated out of anger towards a group of Muslims he’d had an argument with. That was just making a rod for his own back.

The New York Penal Code classes Criminal Mischief in the Fourth Degree as a Grade A Misdemeanour offence.

From the most recent copy that I could find, under New York Criminal Sentencing Guidelines, the lowest penalty for conviction of a person with “no priors” (no previous felony convictions) is No Jail. The highest penalty is ONE YEAR IN PRISON.

I found out about it reading The Jewish Light. Front Page. The reform Jews in St. Louis ARE HELPING muslims "fight the discrimination." Incredible.

This is another petty case wasting taxpayer dollars. This is a matter to be dealt with in-house. I'm sure not everyone who intentionally destroys a library book gets arrested. Pay the replacement cost, and whatever else punishment, and move on.

Sorry to report but, Bill O'Reilly AGREED WITH CAIR! He disagreed with Michelle Malkin, saying Stanislav was indeed guilty of a hate crime.

Next up, Hannity and Colmes also had a segment on the arrest (with guest Bridget Gabrielle) and even Colmes criticized the charges as excessive.

Well, I guess you saw O'Reilly's reaction, which was disappointing to say the least. Michelle Malkin tried to point out the irony and extenuating circumstances surrounding this situation, but her arguments seemed to go over his head. He was sympathetic to the "outraged" muslims.

How can one commit a hate crime against an inanimate object? The alleged felon did not threaten, harm, or harass any person, so how could he be guilty of a hate crime?! The accused may be guilty of petty theft and deliberate damage to the plumbing system, but those negligible offenses pale in comparison to the daily heinous atrocities committed by muslims around the world, most of which are perpetrated with impunity and the tacit approval of the ummah.

I am so sick of islam, muslims, muhammad, and the qur'an! Our country will never be the same because of muslims and they simply are not worth the aggravation and contention they create everywhere they go. If muslims have made one worthwhile contribution to this country, I would love to hear about it.

We need to stop taking notice of these people. They use intimidation and threats of violence to stifle critiscism. We see programs on TV insulting Christianity, Hinduism, etc. etc. but nothing on Islam. Why? Because when you say Islam is violent they use violence to intimidate (go figure). We have muslims burning effigies of our Queen, burning our flags (U.S and U.K) and we do nothing. It really is time to realise that they are using our liberal attitudes to install a form of control not seen since..........well, let's face it, since islam the last country overrun by muslims. I would love to believe that islam is peacefull but there is not prrof whatsoever. No matter how many pictures they show of smiling muslim girls the proof this violent religion is there for all to see.
