Someone should go to the same judge and request an injunction preventing every Islamic mosque within the scope of that court's jurisdiction from causing or inciting violence, or threatening bodily harm to non-Muslims and anyone who questions Islam or insults Mohammed (the poobah).

Yes, this does set a precedent. Any imam who uses hateful and racist language during his preaching ought to have an injunction slapped on his ass.

It would be amusing to find a mosque in the same jurisdiction as this judge and request a injunction against it for disseminating hateful, violent, misogynist inspiring literature sure to be found therein.

Kauffman's aggressive personal style does not serve him well in this case. While his message is benign enough, he is easy to paint as a menace because of his intense demeanor. If a lawyer he needs, it should be one who can speak calmly and rationally to represent this case, not shout down the opposition or use aggressive tactics -- that is exactly, I think, what his Islamist opponents would like to see. They can't prove anything by Kauffman's words, but they can use his style to dramatic effect and bias the judgement of the court.

As for the court issuing a restraint, from one perspective, this says nothing at all. " to bar Joe Kaufman, co-founder of Americans Against Hate, from causing or inciting violence against their members" says nothing that is not already enshrined in law and applies to all citizens. In other words, the court has apparently refused to apply any special sanction against Kauffman.

From another perspective, however, by making this pronouncement, the court has, in effect, implied acceptance of the proposition that Kauffman shows some tendency to engage in such illegal activity. What evidence to this effect, I wonder, has been brought forward?

More to the point, how can such a ruling be brought down while Kauffman remains unaware of it? Has he been tried in absentia, or have hearings been held in which his character has been defamed, to which he has not been invited to make submissions?

Something really smelly is happening here, and it doesn't sound legal. I'm not an american citizen, but I have always understood that, in both civil and criminal American courts, a person cannot be shut out of proceedings in which charges or actions could be brought against him, without the opportunity to defend himself, except under extraordinary circumstances -- which I can't see applying here.

It appears that Kauffman's rights have been violated here, and the first order of business for his lawyer may well be to get to the bottom of what happened, maybe even bringing countercharges.

Curry also ruled that Texas courts have jurisdiction in this matter, paving the way for Islamic organizations in North Texas to seek libel damages from Kaufman.

That is until the discovery phase starts and Kaufmans attorney starts asking questions about writings and speeches of D/FW area mosques and imams, along with sources of funding of said mosques and imams.

Then they suddenly decide that they've made their point and elect to withdraw the suit.

I'm not Joe Kaufman ,niether are all the other people who have commented here so lets hope these polishers are in it for the long haul.

The only crime i see is the one others have mentioned and that is Joes rights being violated.Also the crime of the politicians having thier nose ,obviously,permanantly inserted into a certain crevace of a certain entity.

On another note.If it were to happen in my town with these jihadists running around with thier kill infedels signs i would have not a second thought of filing charges of incitement and hate speech.I also will not hesitate to file a lawsuit....believe it.If the proper officials did nothing about it then you can't believe the amount of stink i would raise...far more than any polisher can while rubbing that tightly coiled pile on the neighbors lawn.

Did I understand the Judge correctly ?

He admits to the common knowledge that Islam only expect Muslims to be Peaceful 1/12th of the year because of "Holy days" ( or is it "Holy-Daze" ) during Ramadan yet he takes sides with the 11/12th's of the year where the Islamofascists within the Muslim population want the "Right" for the "6 Flying-Imams" to board a Airplane while acting out all tyhe signs of a well-founded Potential threat the Hijack the Plane and slaughter 1000's of non-Muslim civilians .

I just want to understand if I've got this right because more and more Judges seem to live in fear of actually convicting the "Guilty" Jihadists that admit to the killing of Americans for Alllah while the same Judge will have no quams over assuming a "Guilty" based on an "Alleged" harm against Muslims if the Alleged person is a non-Muslim .

We in Canada have the same crap but have put up with it for decades now and my example of the PC madness is the slaughtering of 240 Canadian civilians by Sikh Terrorists in British Columbia and the "Squamish-5" eco-terrorists that used a truck-bomb to attack a business in Toronto and ,killed 1 person while injuring several immigrant workers on the Night Shift that were cleaning staff.

And what's the difference ( or deference ) for the Justice meted out you ask?

When the Squamish-5 ( Squamish B.C.) were arrested they had a quick trial on valid evidence and phone-taps to back it up with an admission to the Terrorism via a truck-bomb , OH Yeah...and they were young white punks with a grudge against the Governments and wanted their version of Justice .
BUT , when the same type of evidence was there for the Sikh terrorists in B.C. that tried to plant bombs on 3-planes leaving canada which luckyly only work on the 747 at 35'000 feet , the Politicians and Police feared the "Racism" labels and waited until after the fact to admit they had foreknowledge of these plots but didn't feel a Conviction for the attempted terrorism would hold up once in front of a Judge .
Plus....it took 18 years and about 80'000'000.00 dollars for an investigation and Trial which ended up as an aquital for delayed Justice and old testamony from the witnesses that the Sikh's hadn't killed-off yet or threaten with death into a silence or sudden lose of memory , and the only person to do jail-time was the person the confessed to making the bombs for the accused while not knowing exactly how they were to be used ( keep in mind that in B.C. explosives are common for remote expansion of Industries and some land owners willing to pay for a huge tree stump to be removed very quickly) by the Sikh males that were tied to the bombings for Political reasons against a Government back home that need Justice meted out by them right here in canada.

Just follow me here on the logic for the Air-India bombing the slaughtered a total of 329 Humans which included close to 60 grand-children
on a visit to their Parents homeland to see their roots and meet them .
A Judge will convict a man for "Allegedly" building the bombs for the "Alleged" Terrorists
solely on his confession that proved the two Sikh males planned the slaughter and received the bombs that matched the evidence from remains of the Japanese explosion at the airport from a delay that cause a bombing on the ground that killed baggage handlers as well , BUT .... when a Judge must convict the actually person that used the bombs and murdered 240 Canadian Citizens that same Judge rules on a lack of evidence for "Guilt" and the two men walk away to kill again or promote their Perverted version of Sikhism as we now hear from other Sikhs that did nothing to stop them during the early stages of the plan.

The Muslims in America that want to stir-up more bogus "Islamophobia" reports to further their
perverted version of islam as career-victims of "The Jooooo's" have caught on to the spineless PC Judges and Politicians that are willing to let more Americans be slaughtered on the Altar of Multiculturalism just to stay in power for one more Term .

I am not a lawyer, and the US legal system is not the same as ours, but this sounds like a "preliminary injunction" where one side applies to the judge for protections prior to the case being heard. The other side doesn't have to be present. The injunction provides protections to prevent irreversible harm while awaiting trial. Generally it implies that the plaintiff's case, as presented by their lawyers (who are sworn officers of the court, so should not lie or deceive the court), is reasonably strong, and the benefits of the injunction outweigh the harm caused by it.
Since this injunction is basically to obey normal law, it doesn't imply much judgement against Joe Kaufman.

Of course Mr Kaufman will have to defend the actual case properly with good lawyers.
